Meridian Reservoir & Booster Pump StationCERTIFICATE OF ZONING COMPLIANCE REPORT DATE: May 20, 2013 TO: Clint Worthington FROM: Sonya Watters, Associate City Planner SUBJECT: Meridian Reservoir & Booster Pump Station -CZC-13-063; DES-13-059 OWNER: City of Meridian DESCRIPTION OF APPLICANT'S REQUEST The applicant, Clint Worthington, City of Meridian, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval of a two million gallon municipal water storage facility and booster pump station. The site consists of 4 acres in size and is zoned R-4. The proposed use is classified as public infrastrucfitre and requires conditional use in the R-4 zoning district. A conditional use permit (CLIP-12-017) was approved for the proposed use on January 2, 2013. The site is located at 3468 S. Locust Grove Road. ANALYSIS OF UDC REQUIREMENTS RELATED '1'O SITE SPECIFIC CONDIT1ON5: The UDC (11-3A-7} limits fence height in the R-~1 zoning district to a maximum of six feet (6'). However, the LIDC (11-SB-SB.2) does allow requests for alternative compliance when certain conditions exist. The applicant submitted a request for alternative compliance to UDC 11-3A-7 statuig that safety considerations exist that make alternative compliance desirable. Because access to this site is prohibited to anyone other than City personnel and will house a City owned municipal water storage facility and booster pump station, an increased fence height to eight feet (8'} will allow increased security and safety for the site. In order to grant approval for an alternative compliance application, the Director shall determine the following: 1. Strict adherence or application of the requirements are not feasible; or Due the nattue of the proposed arse ctnd the secerr•ity measures Needed for such a facility, the Director finds that strict adhere~~ce to the requirements of UC 11-3A-7 are not feasible, 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The Director finds that the proposed increase in the height of the fence surrvtrnding tl7e facility and the wrought iron material provides an equal means of meeting the regtriren2ents as the height and see-through nature of the fence will provide additional security for the site. 3. The alternative means wil! not be materially detrimental to the public welfare or impair the intended uses and character of surrounding properties. The Dis'ector finds t1~at the alternative means of complying with UDC 11-3A-7 is actually sttpe-•ior and should ernc~ance the public safety and welfare by providing a more secure site far the City's public ifzft•astructure. Site Specific Conditions of Approval Per UDC 11-SB-SB2, the Director (at the applicant's request) approved alternative compliance to UDC 11-3A-7 regarding the requirement for a maximum fence height of six feet (6') in the R-4 zoning district. The Director approved an 8-foot tall wrought iron fence to be constructed as a security fence around the site. Z.` 4. Per Council's approval, the applicant shall not be required to the the irrigation ditch that runs along the east boundary of the site and shall be required to improve the ditch as a water amenity. The applicant shall the alI other irrigation facilities as set forth in UDC 11-3A-6A. 5. Upon access being provided from the property to the north, the applicant shall close the existing access tv Locust Grvve Road as set forth in UDC I 1-3A-3A. 6. Prior to issuance of issuance of Certificate of Occupancy, the applicant shall submit a public pedestrian easement for the fataxre multi-use pathway for approval by City Council and subsequent recordation. 7. A 10-foot wide multi-use pathway is required to be constructed along the north side of the Ten Mile Creek as shown an the site plan approved with CUP-12-417. Construction of the pathway shall take place once the City has acquired an easement on the property at the southeast corner of the site for connection to the existing pathway in Tuscany Lakes Subdivision. The applicant shall design and construct the future multi-use pathway along the north side of the Ten Mile Creek consistent with the location and specifications (Chapter 3} set forth in the Meridian Pathways Master Plan unless otherwise approved by the Parks and Recreation Director. The future pathway along the Ten Mile Creek shall be illuminated with a four-foot tall bollard style or similar lighting source in accord with UDC 11-3A-8H, unless otherwise waived by the Director. Such lighting shall be shielded from adjoining residences. Process Conditions of Approval Conditions Document 2 Me~i~iian Reservoir & Booster Pump Station CZC-13-063; DES-I3-OS9 3. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11-3A-6B. 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UllC 11-SC-3C. 3. Upon installation of the landscaping and prior to inspection by Plarming Department staff; the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 4. The site plan prepared by CH2MHiil on 5/2/13, labeled Sheet C101, is approved (stamped "approved" on 5/20/13 by the City of Meridian Planning Department) with no changes. 5. The landscape plan prepared by CH2MHil1 on 5/2/13, labeled Sheets L101 & L301, is approved (stamped "approved" on 5/20/13 by the City of Meridian Planning Department) with no changes. 6. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Department. 7. The elevations prepared by CH2MHil1 on 5/2/I3, labeled Sheet AS201, are approved {stamped "approved" on 5/20113 by the City of Meridian Planning Department) with no changes. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC I 1-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (AZ-12-013; CUP-12-017). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant shall have an ongoing obligation fio maintain all pathways. 6. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 7. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC i 1- 3A-3. All requests for review shall be filed in writing with the Planning Department on or before June 4, 2013, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11- SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance.
