DESCRIPTION OF APPLICAN'T'S REQUEST 1'he applicant, Bilttnore Company, LLC, requests certificate of zoning compliance (CZC) and administrative design review (DES) approval to construct an eight-plex and five (5} garage structures within Somnlersby Subdivision No, 2, Specific setbacks were approved with the Sorrvnersby planned development (CUP-04-040). A modification to the plamied development (MCU-11-002) was approved by the Commission to allow the mix of siding materials (lap, board and batten, stone wainscot} in lieu of the stucco siding as previously approved. Further, the Planning Division has tentatively approved a property boundary adjustment to reconfigure the garage lots to allow the constt'uction of the garages structures as proposed, The site is zoned R-1 S (Medium-high Density Residential District) and two (2) of the garage lots are zoned L-U. The subject properties are located near the northeast confer of W. Pine Avenue and N. Ten Mile Road. Prior to the issuance of occupancy for the garage structures, the applicant must finalize the PBA (record the ROS) with the Planning Division. 2. The end units of Building 2 do not meet the dimensional standards for garage parking; therefore each end unit must be storage units for the apartment complex. 3. The site plans prepared by Lawson Design lnc., dated 03/24/13, labeled A-101 and BLDG 1 & 2 101, are approved (stamped "approved" on OS/01/13 by the City of Meridian Planning Division) with following comment: • All ground level mechanical equipment shall be screened to the height of the unit as viewed from the property line in accord with UI)C 11-3A-19A.1e. The elevations prepared by Gary Lawson, dated 03/04/13, labeled A-201, A-202 and Sommersby Garages are approved (stamped "approved" on 05/01/13 by the City of Meridian Planning Division) with no changes. 6. The site plan, landscape plan and/or building elevations shall not be altered without prior written approval of the City of 1Vlericiian Planning Division. 7. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11-3A-6B. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall subtnit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs, 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 1 l -5C-3C. 3. Upon installation of the landscaping and priot• to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth. in UDC ll -3B-I4A. 4. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 5. If any changers must be made to the site plan to accommodate AC:EID requirements, the applicant shall subtnit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building pettnit. 6. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or stt~zeture until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 1 l -3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UI7C 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and any applicable conditions of approval associated with this site (MCU-11-002, PP-04-035; FP-06-024; CUP-04-040, PBA-13- 007 and DA #'s 105184653 and I081011151). 3. 'The issuance of this CZC does not release the applicant from any previous requirertnents of the other pertniis issued for the site. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant. shall comply with the outdoor lighting provisions as set foYth in UDC 11-3A-1 I. 6. The applicant and/or property owner shall have an ongouig obligation to maintain all landscaping and construe#ed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3B. 7. The development shall limit landscaping (i.e. shrubs, bushes, etc.) along streets, pathways, and up against shltctures, to species that do not exceed two feet in height. Additionally, trees shall be pruned to a minimum height of 6 feet above the ground or sidewalk surface. CTTY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed. in writing with the Planning llepartment on or before 05/16/2013, within fifteen (15) days after the written decision is issued, and contain the infa~n~ation listed in UDC 11-SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. EXPIRATION Certificates of Zotu~lg Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance, The administrative design review shall be exercised with the approval period of the underlyuig permit {CZC} or the approval shall expire.
