RE: Messina Meadows #4 -Final Acceptance
Dear Mr. Turnbull:
Installation of this project's sanitary sewer and/or domestic water systems has been
satisfactorily completed in accordance with the approved plans. These systems have passed
the required testing in accordance with City of Meridian Standard Specifications and Drawings,
and therefore are hereby accepted by the City for ownership and normal maintenance.
Record drawings submitted to us for this project are also accepted and are being forwarded to
the Idaho Department of Environmental Quality. The engineer of record is responsible for
certification of the record drawings as to horizontal and vertical location of all public water and
sewer facilities installed.
In accordance with the City of Meridian's Unified Development Code §11-5C-3, and the Public
Works Department' Standard Specifications and Drawings, the installation and materials of the
sewer and domestic water systems are to be warranted against defect by the owner for a period
of two-years from the date of this letter.

WARRANTY SURETY AG-REEMENT
THIS DEVELOPMENT SURETY AGREEMENT is made and entered into. this ~'i~day

Corporation, hereinafter referred to as CITY, and BRIGHTON DEVELOPMENT IN.C.,
hereinafter referred to as DEVELQPER,
VJITNESSETH:
WI~EREAS, DEVELQPER has petitioned the CITY to accept a subdivision plat known
as Messina 1Vleadows SubdivisionNo. ~, located in the City oflVleridian;, and
WI-IEREAS, DEVELOPER has installed all of the required public improvements. as
shown on the approved development. plans dated the 21st day of June; 201,3:
WHEREAS, prior to the CITY's endorsement and recording of said final plat
DEVELOPER must comply with the provisions of the Meridian City Code, which
include but are not limited to the execution of this Development Surety Agreement.
NOW, THEREFORE, in consideration of foregoing mutual promises,, covenants and.
agreements. of the parties, it is hereby agreed as follows:
1, The DEVELQPER agrees that they will correct, repair and maintain all required.
public improvements fxarn any defects; omissions or irregulaxities in the
consttuctio.n, materials or work the"roof for a period of two (2) calendar years from
the date of acceptance of such improvements.
2. Upon execution of this agreement, the DEVELOPER .hall submit to the CITY a
Warranty -Surety in a form approved by the CITI' in the sum of $39;807.34 to
provide for correction of any defective materials ox workmanship in such public
improvements for a period of twa (~) years after final acceptance, as defined in
Meridian. City .Coale §8-6-2: The amount of-such surety represents 20% of the.
agreed upon amounts from the contractor's final invoice number 3564 frorxi the
DEVELOPER'S contractor; Knife River - Southern Idaha Division.
3. The CITY agrees to accept the completed required subdivision itnprovernerits
upon certification by the City'Engineer: Such certification is not intended to
relieve DEVELOPER or any contractor or matexial supplier of their responsibility
for-any defects in materials'or workmanship of such improvements.

4. In construing this Agreement, it is understood that either party may b.e more than
one person and if the confext so requires, the singular pronoun shall be taken to
mean and include the plural, the masculine, and neuter, and-that generally all
grammatical changes shall be made,, assumed and implied to make the provisions
hereof apply equally to a single. or several individuals.

Dear Mr. Rich:
Central District Health Department has reviewed and does approve the final plat for this
subdivision for central water and central sewer facilities. Final approval was given
July 9, 2013.
Sanitary restrictions as required by Idaho Code, Title 50, Chapter 13 have been satisfied based
on a review by a Qualified Licensed Professional Engineer (QLPE) representing the City of
Meridian and the QLPE approval of the design plans and. specifications and the conditions
imposed on the developer for continued satisfaction of the sanitary restrictions. Buyer is
cautioned that at the time of this approval, no drinking water extensions or sewer extensions
were constructed. Building construction can be allowed with appropriate building permits if
drinking water extensions or sewer extensions have since been constructed or if the developer
is simultaneously constructing those facilities. If the developer fails to construct facilities then
sanitary restrictions may be reimposed, in accordance with Section 50-1326, Idaho Code, by
the issuance of a certificate of disapproval, and no construction of any building or shelter
requiring drinking water or sewer/septic facilities shall be allowed.

All laterals and waste ways must be protected. All municipal surface drainage must be
retained on site. If any municipal surface drainage leaves the site, the Nampa & Meridian
Irrigation District (NMID) must review drainage plans. The developer must comply with Idaho

Enclosed please find a Land Use Change Application for your use to file with the Irrigation
District for its review on the above-referenced development. If this development is under a
"rush" to be finalized, I would recommend that you submit a cashier's check, money order or
cash as payment of the fees in order to speed the process up. If you submit a company or
personal check, it must clear the bank before processing the application.
Should this development be planning a pressure urban irrigation system that will be owned,
operated and maintained by the Irrigation District, I strongly urge you to coordinate with Greg G.
Curtis, Water Superintendent for the Irrigation District, concerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate
the process of contractual agreements between the owner or developer and the Irrigation
District for the ownership, operation and maintenance of the pressure urban irrigation system.
