Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The site plan prepared by Studio 3 Architecture, dated February I3, 2013, labeled A0.1 is approved (stamped "approved" on April 23, 2013 by the City of Meridian Planning Division} with no changes. 3. The building elevations prepared by Studio 3 Architecture, dated January 1 1, 2013 labeled A4.0 and A4.1 are approved (stamped "approved" on Apri123, 2012 by the City of Meridian Planning Division) with no changes. 4. The approved site/landscape plan and/or building elevations shall not be altered without prior written approval of the City of Meridian Plaunuig Division. 6. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that. meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (Taco Bell CUP in 1994). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other pei~nits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. 7. The applicant and/or assigns shall have the continuing obligation to meet the drive-through specific use standards in accord UDC 11-4-3-I 1. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before May 8, 2013, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11- SA-6B, If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right. to request a regulatory taking analysis under Idaho Code 67-8003, EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. As this relates to this specific building the exterior facade will be remodeled to emphasize the entry locations and to include updated images of Taco Bell. Existing towers will be replaced, existing stucco exterior will be refinished and new exterior awnings will be provided. The drive through will be provided with new ordering menus and vehicle queuing standards. For this particular project, we have added the drive through components to meet Taco Bell Corporate guidelines and incorporated them into the plan. We have also updated the parking to meet current ADA standards. The impacts are minimal on the site, and will not affect the ingress and egress of the current plan. The existing trash enclosure will remain unchanged. Storm water wi(I not be increased and drainage will not be altered. Modifications to the drive through lane will result in minor changes to the internal traffic flow, a slight reduction in parking capacity, and an increase in landscaped area. The interior modifications will include updated seating, finishes, service counter and restrooms. The restrooms wil[ have their finishes updated and also modified to meet current accessibility guidelines. The kitchens will not be modified for this work, other than maintenance that may occur when the store is partially closed for the remodel work. Based on the City of Meridian Design Manual, the project exists in a transitional neighborhood context and must meet the design guidelines of part 'C': Urban/Suburban Design Guidelines. Section 1.1 requires developments to establish patterns in support of the City's goals, however, the project is in an existing development that is already integrated with the fabric of the city and the project does not propose any changes to the development pastern. Section 1.2 asks that access to the site promote interconnectivity of the community and reduce negative impacts of vehicular access. This includes placement and orientation of buildings, service and parking areas, and any public spaces. For the most part, the site organization will remain unchanged, as most elements in this section are generally met as is. The modifications to the drive through lane are the only changes to the site organization and layout. These changes are designed to better define and segregate the queuing lane with respect to the site circulation. Ten parking spaces will be removed and replaced with new landscaping to assist with the reorganization of the drive through lane. Section 1.4 governs the layout and integration of parking areas in the development, including circulation patterns for pedestrians and vehicles. Parking areas already well exceed standards set forth in UDC 1 1-3C, even after removing ten spaces. Furthermore, existing parking areas clearly delineate circulation patterns, are broken up with appropriate landscape features, and contain appropriate lighting. Section 1.5 requests that public and open space be provided in a manner that is proportional to the use and intensity of development. Since this is an existing development and it is of a relatively small scale, no new public spaces are being proposed, however, there are significant existing and new landscaped areas provided which add texture and variety to the development. Section 1.6 is concerned with the landscaping and its ability to enhance the development character. The intent of this project is to improve the landscaped areas where changes are to be made on the site. The improvements strive to be aesthetic compositions that will fit in with the existing landscape to create a consistent appearance. Overall, 3,413 square feet of new landscaped areas will be provided, with the addition of sodded areas kept to a minimum. One 6" Crabapple tree will be removed for the reconfiguration of the drive through, buff will be mitigated with the addition of three new 2" Deodar Cedar trees. The design shows an understanding of this relationship through its use of materials to emphasize the building entries without overpowering its patrons. The entrances feature arched towers that incorporate Taco Bell branding in such a way as to create a sense of place that is at an appropriate scale, consistent with surrounding uses and neighboring buildings. Section 2.3 requires the building form to promote quality architectural character. The design for Taco Bell restaurants generally follows this principle. The building walls con#ain appropriately scaled modulations, with appropriate distinctions in materials. The windows at ground level establish a visual connection with the public realm at all public facing sides. The roof contains multiple elements, from the arched towers highlighting the entrances, to the parapets and soffits, to the existing mansard roof which masks rooftop equipment. Section 2.4 asks that the specific architectural elements of the project create interest and support human scale as a cohesive whole. The elements of this building directly address this concern as the entries and corners are emphasized with elements such as modulated walls and changes in wall material or color. These elements are also used to break up any large sections of blank walls. In addition, service and mechanical equipment, including trash bins, are appropriately screened as to not be readily visible from any public area. Section 2.5 encourages the use of quality materials that work synergistically with the design to contribute to the character of the community. As the location of this Taco Bell is readily visible from the public right-of-way on all sides, all four faces of the building have consistent detailing with a material palette that includes a new stucco finish with a cultured stone accent. The colors are mostly natural earth tones, with an accent color band to emphasize the Taco Bell brand. Finally, section 2.6 addresses the use of lighting and signage, with an emphasis on coordination with the building design. The site lighting and signage will remain largely unchanged, but the building lighting and signage will be carefully integrated with the new design. The signage in particular is helpful in emphasizing the building entrances.
