NOTE.• A conditional use permit modification was submitted concurrently and approved by the Director to allow the proposed building expansion. Except for the building addition, no other site or landscape improvements are proposed or approved with the subject application. The site is located at 505 N. Main Street. DECISION The applicant's request for CZC and DES are approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify submittal requirements. You must complete this process before you commence the use or construction. As part of the application submittal, you will need to provide one set of the final, stamped "approved" Planning Division plans, stamped and signed by the architect and/or civil engineer as applicable. You must provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set: Please contact Building Services for additional details about building permits and inspections. Site Specific Conditions of Approval 1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. 3. The site plan and landscape plan prepared by James Gipson, dated 03/08/13, labeled Sheet 1 is approved (stamped "approved" on 04/02/13 by the City of Meridian Planning Division) with the following comment: Conditions Document Meridian Automotive CZC & DES • The existing landscaping along the east side of the building must remain protected during construction or replaced if damaged during construction. 4. The elevations prepared by James Gipson, dated 03/08/13, labeled Sheet 2, are approved (stamped "approved" on 04/02/13 by the City of Meridian Planning Division) with no changes. 5. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 6. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 7. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 8. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (CUP-02-004, CZC-04-072 and MCU-13-001). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 7. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. 8. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the existing use (vehicle repair) as set forth in UDC 11-4-3-37. 9. The conditional use approval shall be null and void if the applicant fails to 1) acquire building permits and commence construction of the strucutre within two years as set forth in UDC 11-SB- 6F1 or 2) gain approval of a time extension as set forth in UDC 11-SB-6F4. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before April 17, 2013, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11- SA-6B. Conditions Document 2 Meridian Automotive CZC & DES If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. This will explain our request for modification of this existing Conditional Use Permit (CU 02-004). The modification consists of construction a minor addition to the rear (West) side of the existing Meridian Automotive building. The proposed addition is to be single story, approximately 715 sf. in area, and of construction similar to the existing structures on the site. The exterior will be "Hardi- board" horizontal siding with hardiboard trim. The roof will be metal, light gray. The existing fence along Bower Street will be replaced with a six foot (6'-0") high screening fence with a gate. The proposed addition is to be used for storage and minor work area. The use of the site is to remain an automotive and machine service and repair facility, and this addition will provide enclosure for some elements which are currently outside. We believe the proposed minor addition is in harmony with the existing conditional use permit, and no substantial change in use or character is proposed. Please note that a modification to the front (East) wall is also proposed. Since this does not involve any addition to the existing building (only a new facade, entry door, and sign/canopy), this requires no modification of the existing CU. The front (East, facing Main Street) facade will be modified as shown by the accompanying drawings. A screen wall with doors and windows will be constructed, and anew entry sign and canopy will be added. The colors will be as illustrated in the colored drawing of the proposed project. No increase in building area is proposed in this portion of the work. The architectural character of the facade will be enhanced, from the original metal "Quanset hut" form to a more conventional building appearance. A more substantial entry statement will be created, with a new door, windows, and the entry sign canopy. The major roofline will remain unchanged, but the proposed facade and sign/canopy will relieve the existing single roofline of the curved building, and provide a sense of pattern variation. No change to mechanical equipment is proposed, with no equipment being visible from the street. Materials will be stucco and metal, in the colors illustrated. The standard red and blue ACDelco colors will be used, with a light tan stucco color. Parking will remain unchanged, as will the existing pedestrian walkways. The new entry area will greatly enhance the pedestrian approach to the building, with an area covered by the canopy. The exterior will be "Hardi- boazd" horizontal siding with hazdiboazd trim. The roof will be metal, light gray. The existing fence along Bower Street will be replaced with a six foot (6'-0") high screening fence with a gate. The proposed addition is to be used for storage and minor work area. The reaz addition will not change the architectural character of the facility, but will enhance the appeazance by screening elements which aze currently outside. The proposed new fence will also help in this respect. The facade (facing Bower Street) will be of "hazdi-boazd siding and trim, painted to match the light tan color of the front (East) facade. No new entrance is proposed towazd Bower Street. The roofline will be a continuation ("plane in") of the existing rear shed construction. The basic building form remains unchanged, except that the proposed rear addition brings the form closer to Bower Street. The pazking and pedestrian elements are indicated in the comments regazding the front (East facing) portion of the project. The use of the site is to remain (automotive and machine service), and this addition will provide enclosure for some elements which are currently outside, thus creating a neater appearance. We believe the proposed work is in harmony with the Design Review intent, and will enhance the appearance of the existing facility, to better comply with current requirements. RECITALS. 1,1 ACHD owns and has exclusive jurisdiction over the public right-of-way located: in Ada County, Idaho, more particularly described and/or depicted on Exhibit "A" attached hereto {the "Right-of-Way"~;. 1.2 Licensee desires. a license to use the Right-of Way for the limited purposes hereinafter set Earth, and, far the consideration and an the terms and conditions hereinafter set forth; ACHD is willing to extend such. license to Licensee. SECTICJN ~. LICENSE: Ll'CENSE NC)T EXCLUSIVE. 2.1' Cn the terms and. conditions hereinafter set forth, ACHD hereby extends to Licensee a license on, over, across and under the Right-of-Way for the. following. uses and purposes ("Authorized Use"} and'. no others: Licensee to allow an existing building to remain 3 feet within the ACHD public right of way of Main Street.. 22' This Agreement does not extend to Licensee the rightto use the Right-cif- Way to the exclusion of ACHD-for any use within its. jurisdiction, authority and discretion or of ethers to the. extent authorized by law to use public right-of way: if the Right.-of= Way has been opened as a public Highway (as used in the Agreemen# the term "Highway" is as defined in Idaho Code § 40-109(5}j Licensee's Authorized: Use is .subject. to the rights of the public to use the Right-of-1Nay for Highway purposes. Licensee's Authorized Use is also subject to the rights. of holders of easements of record or obvious an inspection of the Right-of-Way -and statutory rights of utilities to use the public. right-of-way. Any construction andlor installation by Licensee of improvements; incPuding, without limitation,. buildings, fixtures and landscaping {the "improvements"}; on, over, across and under the Rigfi#-of--Way shall be accomplished. in accordance with designs,. plans and. specifications approued in advance and in writing by AGHD as required t~ satisfy. applicable laws, its policies and good engineering practices. to approving such plans and specifications, AGHD assumes no responsibility far any deficiencies or inadequacies in the.. design or construction of the Improvemen#s, and the responsibility therefor shall be and remain in Licensee.. SEGTiON 4. TERM, 4.1 The term. of this.. Agreement wll commence on the 15 day of OCiC)BII3 ,.2003,. and will continue until terminated by either party, with or without cause, which termination shall be effective following THIRTY {30} DAYS advance written notice of termination given the other party. 4,2 If Licensee defaults in the performance of any obligations incumbent upon it to perform hereunder ACRD may terminate this Agreement and the rights extended to Licensee hereunder at any time, effective at the end of thirty {3U} days following.. the date AGHD shall provide written notice of termination to Licensee, which' notice shall specify such default{s}. Licensee shall have such thirty {30} day period. to correct and! cure the specified defaults, and if so corrected and cured., to the satisfaction of AGHD, this Agreement shall not be terminated but shall continue in full force and effect,. SECTION a. FEE. There is no fee far the Licensee's Authorized. Use of the Right-of- Way under this Agreement. SECTION 6'. MAINTENANCE' FA,iLURE TO MAIiVTAW; RELOGATiC?N OF UTl'LITIES. 6.1 At its sole cos# and expense, Licensee shall maintain the Improvements in good condition and repair and as required to satisfy applicable laws,. the policies of .AGHD and sound engineering practices. Licensee shall.. have access over, across and under the Righ#-of-Way for the purposes of accomplishing::.. such repair and maintenance:. 62 If the Highway on andCor adjacent to the Right~of-UUay is damaged as a result of: {i} the performance by Licensee of the maintenance required by section 6.1, or the failure or neglect to perform such maintenance; andtor LICEIUSE AGREEMENT -Page 2 {116102 A:1505 Main 5t license agr.dac {ii} Licensee's design, installation or use of the.. Improvements, regardless of cause; at its sole .cost and expense Licensee shall forthwith correc# such deficiency and restore the Highway and the surface of the Right-of-Way to the same condition it was in prior thereto,.. and if Licensee shall fail or .neglect to commence. such correction and restoration within t~iventy-four (24} hours of notification thereof,: ACHD may proceed to do so, in which event Licensee agrees to reimburse ACHD for the costs and expenses thereof,... including:, without limitation, reasonable compensation for the use of staff and equipment of ACHD.. 6.3 Notwithstanding the provisions ofi section 6.2, should an emergency exist related'. to the Licensee's use of this license which threatens the stability or function of the Highway on or adjacent to the Fright-af-Way ar the safety of the public use therea€, ACHD shall have: the right to immediately perform,. on behalf of, and at the cost of Licensee necessary emergency repairs.. ~.4 Licensee wilt be responsible for the relocation of any existing utilities located on the Right-af-Way as may be required in connection with any construction ar fnstaliatan of Improvements by Licensee in the Right-af-Way. SECTION 7. RELOCATION OF (MPROVEIVIENTS, if during the term of this .Agreement ACHD requires,. in its sole discretion, at any time,. and from time to time,- that the Highway on andlor adjacent to the Right-of-Way be widened andlor realigned, redesigned, improved and/ar reconstructed,. Licensee hereby accepts responsibility far alt costs far relacafing, modifying: or otherwise adapting the Improvements to such realignment andlor relocation andlor reconstruction if required by ACHD, which shall be accomplished by Licensee according to designs, plans and specifications approved in advance by ACHD in writing; provided Licensee may elect to terminate this Agreement. in lieu. of complying with this responsibility, and further provided ACHD gives Licensee adequate written. notice as necessary to allow Licensee... to redesign, relocate, modify ar adapt the Improvements to the realignment andlor relocation andlor recanstruc#ion af' the Highway and also licenses Licensee such additional area of its right-af~way, if any,. as may be necessary far the proper operation of the Improvements. .SECTION. 8. PERMIT. If the proposed construction.. and installation of the, Improvements, ar .any reconstruction, relocation or ,maintenance thereof requires Licensee to obtain a permit under ACHD pallcies, Licensee shall first obtain such permit from ACHD (Construction Services Divisions before carnmencirtg such work,. and pay.. the required fees and otherwise.. comply with the conditions set forth therein. SECTItJN 9. N:O TITLE. IN LICENSEE, Licensee shall have na right, title or interest in or to the Right-af-Way other than the right. to temporarily use. the same pursuant to the terms of this Agreemenf. Right-of-Way, or any constructc~r~ car installation cif Improvements thereon; or the repair and maintenance thereof, ar the relc~catian of improvements ar utilities thereon.,: ar the restoration thereof at the termination of this Agreement, shall be at the sole cost and expense of Licensee. SECTION t 1. TAXES AND ASSESSMENTS. Licensee agrees to pay all'. special assessments and personal property taxes that may be Ievied and. assessed on the. lmpravements during the term of this Agreement. SECTION '12, RESTORATION ON TERMINATION. Upon termination of this Agreement,.. Licensee will promptly remove ail }mprovements and restore the Right-of- VJay to at least its present condition. Shau}d Licensee fail or neglect to prompt}y remove. the Improvements and restore the: Right-of-Way, ACHD may do so, and.. assess Licensee for the casts thereof. Provided, ACHD and. Licensee may agree in writing that some or ail of such Improvements are to remain on the Right-af-Way following; termination, and by entering into such an agreement Licensee thereby disclaims al[ right, title and interest in and to the same,. and hereby grants such Improvements to ACHD, at no cast,. Furkher provided, if the Authorized Use of the.. Right-of-Way under this Agreement is for landscaping in ACRD right-of-way and the irrigation and maintenance thereof, and the general. purpose government with jurisdiction has adapted. ordinances, rules and regulations. governing the landscaping and maintenance of such right-of-way by owners of the adjacent property, to the extent such .owners are obligated to maintain and irrigate the landscaping Licensee. need nat. remove the same from the.. Right-of--Way. SECTION 13. SECTION 14. COIVIPL}ANCE WITH LAW-. WASTE AND NUISANCES PROHIBITED.
