The parties hereto are the parties to the original Development Agreement. This application is a request for a development agreement modification to the original Development Agreement. More specifically Section S.B.S, which requires the applicant to apply for aconditional-use permit for all future uses on each parcel. The applicant requests that the language of Section S.B.S be modified to read as follows: "5. All future uses on proposed lots or parcels within the annexation area shall be deemed approved so long as they conform to uses allowed within the designated C-G zone. Any future use incorporating adrive-thru window into the design of a building shall require aconditional-use permit if said drive-thru window is located within three hundred feet of the exterior wall of a residential building." The reasons for the request are as follows: 1. The parcels are bordered on three sides by commercial uses. 2. The property is zoned C-G. To go through the conditional-use process for each new use that is in conformance with the designated C-G zone is time consuming and costly for the developer, and burdens staff with additional work, and wastes their valuable time. Additionally the applicant requests that the address for notices to the developer in Section 17 of the Development Agreement be amended to read "White-Leasure Development Company, P.O.
