I am writing on behalf of William and Mary Howell and Meridian Gateway Associates that are the owners of the
parcels noted herein and are part of that certain Development Agreement dated August 25`h, 2005 and recorded
September 15, 2005, as Instrument # 105134293.
The parties hereto are the parties to the original Development Agreement.
This application is a request for a development agreement modification to the original Development Agreement.
More specifically Section S.B.S, which requires the applicant to apply for aconditional-use permit for all future uses
on each parcel. The applicant requests that the language of Section S.B.S be modified to read as follows:
"5. All future uses on proposed lots or parcels within the annexation area shall be deemed approved so long as
they conform to uses allowed within the designated C-G zone. Any future use incorporating adrive-thru
window into the design of a building shall require aconditional-use permit if said drive-thru window is
located within three hundred feet of the exterior wall of a residential building."
The reasons for the request are as follows:
1. The parcels are bordered on three sides by commercial uses.
2. The property is zoned C-G. To go through the conditional-use process for each new use that is in
conformance with the designated C-G zone is time consuming and costly for the developer, and burdens
staff with additional work, and wastes their valuable time.
Additionally the applicant requests that the address for notices to the developer in Section 17 of the Development
Agreement be amended to read "White-Leasure Development Company, P.O. Box 1277, Boise, Idaho 83701."

Per Unified Development Code (UDC) 11-SA-SD, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment

You are invited to a neighborhood meeting to discuss an application for a Development
Agreement Modification for property located at the southwest corner of Meridian and Overland
Road. (See Attached).
The purpose of the modification application is to remove the requirement for aconditional-use
permit for each proposed use for the vacant properties located in the vicinity of the Walgreens
Drug Store at the intersection of Meridian and Overland Road.
If approved the requirement for a conditional use permit will only apply to buildings with a
drive-thru window (fast food and banks). Other uses allowed within the existing commercial
zone would be approved without going through the conditional process. This not only saves the
owner time, it also relieves city staff from hours of unnecessary work.
The meeting will be held February 13, 2013 at 6 PM at the Sandman Motel located at 1575 S.
Meridian Road, Meridian, Idaho.
