We request that the following items from Exhibit B be addressed: 1.1.2 — The 10 -foot wide multi -use pathway on the east side of the Five Mile Creek currently extends to the north property but does not completely extend to the southern boundary. This is due to the topography of the south side which slopes away dramatically from the edge of the path (see photo). If the pathway is extended in the future, a gentle slope will need to be installed starting in the parcel to the south in order to connect this section of path. We request the Commission strike this requirement as it is not currently feasible to extend completely to the southern property line without first elevating the ground from the adjoining parcel. The developer would provide an easement to south boundary so the path can be connected in the future. Furthermore, the Parks Department has stated that they are okay with the current path and indicated that there was no need to addess it at this time. 1.1.5 — It is proposed that gates be installed near the ends of the private streets. We request that the Commission strike this requirement. The existing street design was initially installed in 2007 as part of a multi -family development, which has limited the options we have had for the proposed plat. Installing gates on both S. Truss Ln. and S. Torino Ln. where they connect to the proposed public street would serve no purpose other than to create an unnecessary barrier between the homeowners in this development. 1.1.7 — The existing fence around the perimeter of the common area was not installed as part of the initial development in 2007. The fence to the north belongs to the LDS Church and surrounds its entire property. The fence to the south belongs to the homeowner of that property and encloses their parcel. This fence does not extend the full length of the southern border so the developer is willing to extend the fence line on the south with either a 4 -foot tall closed vision fence or 6 -foot tall open vision fence from the existing fence to the eastern border of the property.
