RE: Bellabrook Villas Subdivision (aka Brookside Square)
Dear Council and Commission,
Please accept this Private Street application for Bellabrook Villas (aka Brookside Square), which
is located at 300 S. Locust Grove Road, approximately 900 feet south of Franklin Road in
Meridian, Idaho, Section 17, Township 3 North, Range 1 East of the Boise-Meridian. The site is
4.38 acres in size and is currently zoned R-15.
We are proposing three private streets consisting of S. Truss Lane, E. Bellalucca Lane, and S.
Torino Lane. S. Truss Lane and S. Torino Lane will connect to E. Kalispell Street, which is a
public road that will serve as a collector for access to S. Locust Grove. The private roads are
currently constructed and are 29' wide with rolled curb and gutter. An attached 5' sidewalk is
also constructed around the outer "loop" of the private streets and parking is only allowed on one
side of the street.
Maintenance of the common lots and private roads will by the responsibility of the Bellabrook
Homeowners Association. Details are to be outlined in the CC&R's of the development.

PRIVATE ROAD MAINTENANCE AGREEMENT
A maintenance agreement for the private roads contained within Bellabrook Villas (to
include S. Truss Lane, E. Bellalucca Lane, and S. Torino Lane) will be created as part
of the Bellabrook Villas CC&R's. This agreement will outline how the roads are to be
owned and maintained by the Bellabrook Villas Homeowners Association. Sample
language to be used is as follows:
The undersigned parties, being those who own property benefited by the right-of-way
easement or private streets described below, agree to the following:
a. The expenses of maintenance, repair and/or restoration of the easement or
private streets covered by this Agreement shall be equally divided and
apportioned equally to each owner of benefiting property.
b. The easement or private street shall be maintained in good, passable condition
under all traffic and weather conditions. Maintenance and/or repair shall include
snow plowing and drainage facilities as well as pavement work.
c. This agreement shall run with the land and shall be appurtenant thereto and is
not a personal right afforded each party, and shall bind all benefited properties
and the parties, their heirs, successors, distributees and assigns.
d. This Agreement is made by and between parties who own property benefited by
the easement or private streets. All such parties shall have the right of access
over said easement or private streets. All property to which access is obtained
over the easement or private streets is deemed benefited thereby.
