Item 2: Adoption of the Agenda Yearsley: Thank you. The next item on the agenda is the adoption of the agenda. There is a couple of changes to the agenda. Public hearing PP 13-002, Bellabrook Villa is to be opened for the sole purpose of being continued to the March 21st, 2013, meeting and CPAM 12-007, AZ 13-003 and PP 13-004, Woodburn West Subdivision, will also be continued for the sole -- opened for the sole purpose of being continued to the March 21st, 2013, meeting. Freeman: Just -- there might be some people in the audience that were here to hear Meridian Planning & Zoning Commission March 7, 2013 Page 4 of 11 those. I don't know if it's clear to them that we are not going to be hearing those tonight and I just thought we might want to mention that. Yearsley: Just want to make sure -- the Bellabrook Villas, which is located at 300 South Locust Grove, we are not going to be hearing that, that's going to be heard on March 21st. And, then, the Woodburn West Subdivision -- and that's located a quarter mile east of North Linder Road, that, again, has been continued to March 21st. So, we are not going to be hearing those tonight. So, don't know if that's what you were here for. So, we just basically continue those to the meeting of March 21st. So, in two weeks. Freeman: Thank you, Mr. Chair. Yearsley: Thank you. So, before we open the public hearing -- next public hearings we will kind of explain that process. We will open each item. We will start with the staff report. The staff will state their findings regarding how the items adhere to the Comprehensive Plan Uniform Development Code and with staff recommendation. The applicant will, then, have the opportunity to come forward to present their case for the approval of their application and respond to staffs comments or questions. The applicant will have up to 15 minutes to do so. At that point we will open it to public testimony. There is a sign-up sheet in the back as you entered for anyone wanting to -- wish to testify. Any persons testifying will come forward and be allowed three minutes. If they are speaking for a larger group, like an HOA, there is a -- and there is a show of hands to represent the group, they will be given up to ten minutes. After the testimony has been heard the applicant will have the opportunity to respond if they desire for up to ten minutes and, then, we will close the public hearing and the Commission will have an opportunity to deliberate and discuss and, hopefully, be able to make recommendations for City Council. E. Public Hearing: CUP 13-001 Treasure Valley Pediatrics by Treasure Valley Pediatrics Located 1620 S. Celebration Avenue (Lot 1, Block 1 of Gala Subdivision) Request: Conditional Use Permit Approval to Construct a New 2,265 Square Foot Addition to an Existing Medical Office Building Approved Yearsley: So, with that being said, we will open the public hearing for CUP 13-001, Treasure Valley Pediatrics by Treasure Valley Pediatrics and we will start with the staff report. Parsons: Thank you, Mr. Chairman, Members of the Commission. The item on the agenda this evening is Treasure Valley Pediatrics conditional use permit. The site is located at 1620 East Celebration Avenue. It's approximately 1.24 acres and is currently zoned L-O in the city. The property was annexed and platted in 2000 as part of the Resolution Park Subdivision. During that approval process there was a development agreement that is attached to this property that requires any new construction obtain conditional use permit approval. Back in 2002 the city did approve a conditional use permit to -- for the site to develop with the 8,200 square foot building as you see in this Meridian Planning & Zoning Commission March 7, 2013 Page 5 of 11 aerial here. The applicant tonight is proposing to construct an addition that is approximately 2,265 square feet and it will be located on the north side of the building. Here are the approved plans that were acted on back in the day. You can see on the left-hand side the addition will be north towards Overland Road. Landscape changes to the site are pretty minimal at this point. Staff anticipates only sod being removed. Any other landscaping that's around or adjacent to that construction zone would have to be protected during the construction on the site. Anything damaged as a result of the construction would have to be replaced or mitigated for. I'd also make mention that there are no site improvements to the landscaping at all either -- or, excuse me, the parking lot with the addition. The site needs to comply with 21 parking stalls under the UDC. Currently the site is developed with 47 stalls, which is above the minimum required by ordinance. I would also make mention to you that back in 2003 this property also resubdivided, therefore, creating two lots and adjacent to this is another medical office that shares access with this property as well. It's not reflected in the landscape plan, but it is -- that is how it's constructed out there today. Primary uses surrounding this property are medical office buildings and other retail shops. There is also quite a bit of vacant commercial property that could develop in the future as well. Again, as I mentioned to you, the applicant is proposing a small addition to the site. The intent is to basically construct the addition with similar building materials. Primary building materials will be stucco and, then, there is some decorative corbels and, then, asphalt shingle roofing, which is consistent to what's already constructed on the site. Staff did receive agreement from the applicant with -- written testimony from the applicant. They are in agreement with the conditions of approval. To staffs knowledge there aren't any other outstanding issues before you this evening and at this time I'd stand for any questions you have. Yearsley: Thank you. Any questions? All right. Mr. Chairman and Commission Members, thank you for the opportunity to come before you tonight. Through my employment at ZGA Architects I'm here tonight to represent Millennial Pediatrics Associates and as staff has pointed out they are proposing an approximately 2,200 square foot addition to their building. We agree with all the staff comments on the report and we take no exceptions at this time and stand for any questions. Yearsley: Thank you. Are there any questions? Freeman: Just one. Did you get -- I'm sorry. Of the applicant. Did you get clarification on your streetlight question? I saw that you submitted one -- Adams: Yes, we did. Freeman: -- in the process. Okay. That was it. Thank you. Yearsley: Thank you. At this time I have Seth Thomas. Would you like to come up and Meridian Planning & Zoning Commission March 7, 2013 Page 6 of 11 testify? Please state your name and address for the record, please. Thomas: Seth Thomas. 6939 West Holiday Drive, Boise, Idaho. I'm here on behalf of the Resolution Business Park, as well as Idaho Central Credit Union, who is my employer, so -- we submitted a letter to the city ahead of time just kind of wondering about the parking plan. I mean I heard through the notes that their parking is acceptable. However, we have -- our covenants state that we shouldn't be parking on the road, that we can do everything that we can to avoid having our staff and -- and our customers park on the road, but if you have driven through that business park it's become a bit of a nightmare on the parking side and I'm just wondering if, you know, adding extra square footage and, obviously, increasing staff or traffic through there, if there is any sort of parking plan other than just, you know, sticking with what's there. So, that's all I have. Yearsley: Thank you. Marshall: Mr. Chair, I do have a question. Adams: Pardon me? Marshall: I have a question of you, sir. Adams: Yes. Absolutely. Marshall: So, are you suggesting that their current clientele are actually parking on the street, that they are feeding this parking on the street? Adams: Yeah. So, we are right next to them across the street, right across Celebration, so Celebration comes off from Overland Road and we are on one side of Celebration and they are on the other side of Celebration and that street is lined each day with cars and it's not us, it's not our -- all of our employees park within our own parking lot, so don't know if it's customers or if it's -- you know, in a lot of cases the staff or the -- you know, the staff will park on the street to leave the parking spaces in the lot available for -- for customers, so I know that, you know, I was there today and I was taking a look and their parking lot was, you know, 80 or 90 percent full most of the day and, you know, the streets are lined with cars in all directions and, you know, having more capacity just seems like it would alleviate that issue. Marshall: Thank you. Yearsley: Thank you. I don't have anybody else signed up to testify, but was there anybody else that would like to come up and testify? With that can we get a -- Marshall: Applicant to -- Yearsley: Oh, that's right. Can we get the applicant to come up and respond. We understand that there is complications -- or not complications, but there is currently congested parking there, but we do fall within the requirements of what is asked by the city, so -- and we ultimately double that requirement and do not propose that it cause anymore, you know, additional parking problems, other than what's there, so -- in that existing, you know, facility. So, it does -- I mean they do provide additional exam spaces, but it's -- we have provided the parking that is required for that space. Freeman: Mr. Chair? Yearsley: Yes. Freeman: I have a question. And I'm just curious. I do understand from the staff report that you are not only adequately parked, but you have excess parking available in your lot. Adams: Correct. Freeman: And I find it hard to believe that a clinic of that size is actually filling that parking lot on a regular basis. Am I just missing something or is that parking overflow from something else? Do you have any idea what -- Adams: I myself do not have any documentation about, you know, how that's being utilized, if it's just by Treasure Valley or if it's by other, you know, occupants throughout the business park there, so -- Freeman: Okay. I was just curious if you knew why, because I'm scratching my head. Thank you, Mr. Chair. Marshall: I also have a question then. My question, then, is the additional space -- how many additional employees is that going to require. Or allow for and how many additional patients per hour and I would be curious as to -- or do you know anybody that could answer that? Adams: Probably the employee -- you know, the actual owners of the space, the doctors that work there. I don't know how that will compound there. How many additional patients they will see. I mean I -- that's not for me to determine right now at this time, so -- Marshall: Is there anyone else with you that could help answer that a little more clearly? And I would ask for your name and address, sir, if -- Tierney: Steve Tierney. 4096 East Driftwood Drive, Meridian, Idaho. Mr. Chair and Meridian Planning & Zoning Commission March 7, 2013 Page 8 of 11 Commissioner Joe Marshall, there will be two extra doctors and probably three nurse practitioners. So, probably five staff, nine additional exam rooms. So, I don't know -- do know in that whole area the development and there is sort of a shared parking agreement and there are -- we do -- we have noticed some folks from even to the south buildings parking in our area. Those are things that happen. It is kind of a shared open parking agreement and we -- we have talked with the River Birch Courtyard, which is adjacent to us, and they haven't had any issues. The through put is fairly quick. Some of these exams are a very quick -- sometimes a 15 minute time frame, so it's in and out. So, there are -- there are probably some times in the interim when you're entering and exiting that it could appear full. Some of that is overflow parking from other areas, but, again, those are things that we -- when we had the neighborhood meeting we had the River Birch folks there. Unfortunately, we didn't have anybody else there to talk about those concerns. There is on-street parking. I believe -- and Imay -- I may stand corrected, but I believe it's allowed and it's sort of indicative of that development. As far as our client is concerned we have -- we have provided as much parking to the maximum capacity to allow this future expansion, which they had planned and it was designed for expansion. I stand for any other questions. Marshall: That's all I had. Freeman: No further questions. Yearsley: All right. Adams: Thank you. Yearsley: So -- now at this time can I get a motion to close the public hearing for CUP 13-001 ? Yearsley: So, do I have anyone who has -- wants to comment? Freeman: I will start. The development seems to be in harmony with the surrounding development with existing building. The architecture fits. While I hear the concern about parking, you know, the fact that they have already twice the required capacity of the UDC -- 1 certainly can't justify requiring this particular owner to bear the burden of any additional parking that's needed in that area. I'm suspicious that maybe there is Meridian Planning & Zoning Commission March 7, 2013 Page 9 of 11 some overflow from the high school. I just -- I don't understand what causing the issues. The street parking isn't illegal. So, you know, I'm development and I can't see putting the onus of parking issues on developer in that area. Yearsley: Anybody else? Marshall: Mr. Chair, if I could real quick. Yearsley: Commissioner Marshall. around that is in favor of this one particular Marshall: I agree with Commissioner Freeman. First thing. The architecture is absolutely awesome. I think it fits perfectly and, yes, they are over twice the UDC and can't find any fault with that. On-street parking is perfectly legal throughout the city on all public streets where it's not posted no parking and I -- I do have some concern that don't know how a pediatrics facility could fill both the street and their parking lot, 47 -- Freeman: Forty-seven. Marshall: -- 47 spaces, but, then, again, I mean 2,000 square foot, we are talking nine exam rooms, of which, you know, if you were maxed out maybe seven or eight are full and, then, five more staff is -- that's 14 -- 13 -- 12, 13 more cars and looking at the site compared to the overall. site, I can see where maybe the city might want to go back and visit the UDC if this is actually what's going on, but I think there is going to be more -- needs to be more investigation there before we do anything there. To be honest, again, they meet all the code -- all the requirement. The architectural seems to fit. It's the proper location for this type of development. I do feel for those that are concerned with the parking, but, again, it's perfectly legal to park on the street and I don't have any other concerns with it. Miller: Mr. Chair? Yearsley: Commissioner Miller? Miller: I have the sneaky suspicion that that might be high school parking causing that overflow as well. I can't justify putting it on this project to -- they are already exceeding the parking requirements. I can see the plan here and it's easy enough being a high school student I could see how you could park there and get out quicker for lunch, you know, which would force those properties to the south to move their parking forward. So, it sounds like it might be a conversation that needs to be had with the high school there that might be causing these issues and I can't see justifying adding more parking requirement to this project. They more than double the city's requirements as it is, so -- Yearsley: Thank you. I have one quick comment. I actually drive that street every day, because I take my daughter to school most mornings there at Mountain View and it -- it does fill up there. I mean when I drive by there about 20 to 8:00 there is people already Meridian Planning & Zoning Commission March 7, 2013 Page 10 of 11 starting to park there on Gala Street, so -- and I do wonder if you get -- you get a significant amount of high school students. From my understanding is only the juniors and seniors can actually leave the campus, so you may get some younger students not wanting to park in the parking lot, so they can actually sneak out and go get some lunch. So, that might be a reason why as well, so -- but I agree that they meet the requirements and, you know, it's hard to enforce more stringent parking, you know, based on meeting the requirements. So, that's all I have. Freeman: Mr. Chair? Yearsley: Commissioner Freeman.
