This decision is based upon our review of the information provided, additional information available to our office and our March 7, 2013 site inspection. The relocation of the fence line on the berm located along East Z.aldia Drive, Kingsbridge Subdivision is located entirely in an upland area; therefore, a DA permit is not required. However, Nine Mile Creek, a water of the United States (U.S.), including wetlands, is immediately adjacent to the project area. Precautions should be taken to ensure that no unauthorized discharge into Nine Mile Creek is made during any construction activities. An authorization may be required if the method, ape, and/or location of the proposed work is altered. Please contact this office if changes are made to tate project. The project site is located along East Zaldia Drive, within Section 28 of Township 3 North, Range 1 East, near latitude 43.567531° N and longitude -116.351412° W, in Ada County, Meridian, Idaho. Your request has been assigned File Number NWW-2006-2100033, which should be referred to in future correspondence with our office regarding this site. AUTHORITY The DA exerts regulatory jurisdiction over waters of the U.S., including wetlands, pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344).
