We have reviewed the Staff Report for the Planning and Zoning Commission hearing for the referenced. . project and are in agreement with the Conditions of Approval with the following. exceptions. 1. .Planning Department condition 1.1.6 "The .applicant shall vacate :the 15-foot wide overhead .. .Idaho Power easement that runs through Lots 3,5, Block; submit. the vacation application concurrent with a final plat application:' We understand that vacation of the existing Idaho Power easement is not a requirement:of the _ :.. City. We would propose that the condition be modified to read, "The applicantishall vacate they 15-foot side overhead Idaho Power easement that runs through.Lots 3=5, Block 1; if and waxen a proposed structure, including setback requirements; conflicts with the~easement " 2. Planning Department condition 1.1.7 "The applicant shall`connect the .existing home (Lot.4, Block 1) to urban services (sewer and water); existing wells and septic systems shall be abandoned per the recorded development agreement. Coordinate with United Water on the water service connection." and Public Works Department conditions 2.7 "Any existing domestic wells within this project shall be removed from domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells maybe used for .non- domestic purposes such as landscape irrigation if approved by Idaho Department of Water Resources Contact Robert B. Whitney at {208)334-2190." and 2.8 "Any existing- septic systems within this project shall be removed from service :per City Ordinance Section .9-1-4 and 9-4-8. Contact Central District Health-for .abandonment procedures and inspections (208)375-5211." Lot 4 is a fully developed, 5-acre lot including a home, mature-landscaping and a pond. The existing onsite well and septic systems have functionally served the existing home on lot 4 without incident for about 16 years. The applicant recognizes that service from onsite systems may fail and has proposed water and sewer service stubs at the driveway connection location. The applicant requests that the conditions be replaced as follows: "Lot 4 will continue to be 2447 S. If one or both of the existing systems fail, the failed system service will be connected to the appropriate public system."
