Spurwing Challenge Golf CourseCERTIFICATE OF ZONING COMPLIANCE REPORT 1 DATE: March 12, 2013 TO: The Club at Spurwing, LLC FROM: Kristy Vigil, Assistant City Planner SUBJECT: Spurwing Challenge Golf Course CZC-13-029; DES -13-029 OWNER: The Club at Spurwing, LLC OF APPLICANT'S REQUEST The applicant, The Club at Spurwing, LLC, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval of a new nine -hole golf course (outdoor recreation facility). The site is located in the R-8 zoning district. Per UDC Table 11-2A-2, an outdoor recreation facility is a conditional use in the R-8 zoning district. The site received conditional use approval for the golf course February 7, 2012. The site is generally located north of Chinden Boulevard and west of Linder Road (parcel numbers 81065270129 and R8081770850). DECISION The applicant's request for CZC & DES is approved with the conditions listed in this report. Note: This is not a building permit Please contact Building Services at (208) 887-2211 to verify if you need a building permit anlor inspection. Ifyou do need a building permit, you must complete that process before yon commence the use or construction. As part of the application submittal, you will need to provide one set of the final, stamped "approved" Planning Department plans, stamped and signed by the architect and/or civil engineer as applicable. You must provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Site Specific Conditions of Approval 1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11 -3A -6B. 2. Prior to issuance of Certificate of Occupancy, the applicant shall remove or relocate any existing structures that do not conform to setbacks and/or use in the zone. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. Upon installation of the landscaping and prior to inspection by Planning Deparfinent staff, the applicant shall provide a written certificate of completion as set forth in UDC 11 -3B -14A. The site plan prepared by Pascuzzo & Pate on January 18, 2013, labeled Gl, is approved (stamped "approved" on March 12, 2013 by the City of Meridian Planning Department) with no changes. 5. The landscape plan prepared by Pascuzzo & Pate on January 18, 2013, labeled G3 - G6, is approved (stamped "approved" on March 12, 2013 by the City of Meridian Planning Department) with no changes. 6. The approved site plan or landscape plan may not be altered without prior written approval of the City of Meridian Planning Department. 7. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 8. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 9. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 10. If the subject property is part of a final plat that has not yet recorded, the applicant shall be responsible for all plat improvements prior to release of Certificate of Occupancy for the first structure within such plat. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-313-5, UDC 11-313-13 and UDC 11-313-14. 2. The conditional use may only be transferred or modified consistent with the provisions as set forth in UDC 11 -5B -6G. The applicant shall contact Planning Department staff regarding any proposed modification and/or transfer of ownership. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (AZ -11-005, RZ-11-006, PP -11-011, MDA -11-011, VAR -11-003, CUP -11-009, VAC -12-006, PBA -12-004, and FP -13-005). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant shall have an ongoing obligation to maintain all pathways. 7. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 8. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. 9. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-2. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before March 27, 2013, Conditions Document 2 Spurwing Challenge Golf Course CZC-13-029; DES -13-029 within fifteen (I S) days after the written decision is issued, and contain the information listed in UDC 11- 5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003, EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Broadway Ave. Suite 102 Meridian, Idaho 83642 Re: The Club at Spurwing LLC /Nine Hole Challenge Course Dear Mr. Parsons The Applicant would like to construct a new nine hole challenge golf course on property generally located at the northwest corner of Linder Road and Chinden Blvd. The addition of the Challenge Course to Spurwing will give Meridian the largest golf course in the Valley. The new course will give the Spurwing user the flexibility of playing a course that will challenge his or her short game. It will feature lakes, bunkers, sand and a variety of shots to challenge and improve the player's golf game. It will feature multiple hole placements on each greens. These pin placements will make the game more fun for the casual user and will force the better player into target golf. The project would be completed in phases in order to keep the driving range and street access open for The Club at Spurwing and the residents of the Spurwing Subdivision. The phase would be completed in the following order. Phase One: Relocate the driving range to the new location shown in the drawings included in the Application. It will take one full year of grow in time for the new driving range to be ready for use. Phase Two: Construct the new public street to replace N. Spurwing Way. The Applicant would like to keep the North Spurwing Way name for the new street location. The new street would align with N. Long Lake Way at the existing stop light. The existing N. Spurwing Way would be vacate and exchanged for the new right of way into the project. The existing N. Spurwing way would become a private street. Phase Three: During this phase the new golf course would be constructed. In addition to the golf course the street and subdivision improvements would be installed. The Applicant is proposing to construct the golf course along Chinden Blvd. as part of the required 35 foot buffer to major streets as required by UDCl 1-3H-3. He is proposing to keep all golf course improvements out of the 3 5 foot setback but would like to have the City consider allowing the lakes in the buffer zone. The reason for this request is to make sure the lakes are large enough and deep enough to prevent unwanted growth in the lakes. In addition, the Applicant would like to add a more random berming along Chinden in order to provide a more natural look. His desire is not to have a large continuous berm and wall along Chinden but to open several view corridors to the golf course. As an additional thought he would like to have some heavy tree areas to screen the tee locations and provide a variety of design along Chinden. As note in the Idaho Department of Transportation planning documents for Chinden Blvd. the Applicant is planning on installing a 10 foot pathway along Chinden inside the Idaho Transportation Departments proposed 100 foot right of way setback. After meeting with Staff it was determined the following applications needed to be filed in order for the Applicant to gain City Approval. They are as follows: Annexation Request: This application would annex the existing Spurwing Driving Range into the City of Meridian. It would also annex the parcel in the northwest corner of the new Driving Range. In addition the existing Spurwing Clubhouse would be connected to the new sewer system that would be provided also the new streets. The existing septic system for the Clubhouse is under the existing Driving Range and would be abandoned with this proposal. 2. Since the Applicant is proposing to construct a golf course a Rezone of the property would be necessary. The proposed new zone for the golf course would be an R-8. As a result of the rezone the existing R-4 and TN -C. The remaining TN -C not needed for the golf course development would be rezoned to a C -C designation. This C -C designation would be primarily at the intersection of Linder Road and Chinden Blvd. 3. Modification of the existing Development Agreement: The Applicant is proposing a complete change to the existing Development Agreement and believes it in the best interest of the City and the Applicant to draft, approve and sign a new Development Agreement. 4. Preliminary Plat: The Applicant would like to file a Preliminary Plat for 22 residential lots and the necessary golf course and street scape lots to complete the project as shown on the concept plan. 5. Vacation of Right of Way: Not sure if we need to file a vacation of right of way in the City for the existing N. Spurwing Way rigth of was unless we annex the right of way with the Annexation Request. This application may need to be done in Ada County. We hope the City will look upon this application favorably and we look forward to the completion of the new Challenge Course for The Club at Spurwing.
