RE: Sadie Creek Promenade
Modified Development Agreement Application

Dear Planning Staff,
On behalf of Sadie Creek Commons LLC, we are pleased to submit an application for a
Development Agreement Modification for Sadie Creels Promenade located on the southwest
corner of Eagle Road and Ustick Road. The 14.7 acre site is located in the City of Meridian
with C -G zoning approved in 2006. The accompanying Preliminary Plat (PP -05-053) and
Conditional Use Permit (CUP -05-049) have since expired. The Development Agreement
(#108008770) for the property was approved by City Council on January 22, 2008 and
recorded on January 25, 2008.
Since the original approval of this property, the Bienville Square property has been
constructed to the south and Ustick Road has been widened with access points fixed for this
property. As such, the connectivity, access point, and utilities are existing at our property
boundary. The property currently consists of 3 parcels that are intended to be further
subdivided through the City of Meridian preliminary and final plat process in the future. In
the meantime, we are requesting up to two (2) Certificate of Zoning Compliance, under the
current C -G zoning, prior to subdividing and recording a final plat. At the same time, there
are some minor clarifications to the Development Agreement warranted given the progress
of adjacent properties since the original approval date of this property.
The Development Agreement conditions listed under Section 6 "Conditions Governing
Development of Subject Property" and proposed revisions are as follows:
Original Condition #1: That all future uses shall not involve uses, activities, processes,
materials, equipment and conditions of operation that will be detrimental to any persons,
property or the general welfare by reason of excessive production of traffic, noise, smoke,
fumes, glare or odors.
Proposed Condition #1: As stated.
Original Condition #2: That all future development of the subjectproperty shall be
constructed in accordance with City of Meridian ordinances in effect at the time of
development.
Proposed Condition #2: As stated.
Original Condition #3: That the applicant be responsible for all costs associated with the
sewer and water service extension.
Proposed Condition #3: As stated.
Original Condition #4: That any existing domestic wells and/or septic systems within this
project will have to be removed from their domestic service, per City Ordinance Section 5-7-
517, when services are available from the City of Meridian. Wells may be used for non-
domestic purposes such as landscape irrigation.
Proposed Condition 44: As stated.
Original Condition #5: Thatprior to the issuance of any certificate of zoning compliance
all landscaping shall be constructed along the western property boundary and along Ustick
Road to the point of connections with Sadie Creek Avenue. These office lots should include
either a permanent easement or be redesigned to include landscaping in common lots
including masonry block wall on the western boundary.
Proposed Condition #5: That prior to the issuance of certificate of zoning compliance for
the office lots west of Centrepoint Way, all landscaping shall be constructed along the
western property boundary and along Ustick Road to the point of connection with
Centrepoint Way. These office lots should include either a permanent easement or be
redesigned to include landscaping in common lots including masonry block wall on the
western boundary.
Original Condition #6: That the maximum square footage of one single building shall not
exceed 75,141 square feet, which is % of the maximum requested of 150,282 SF.
Proposed Condition 46: As stated.
Original Condition 47: That all buildings along the western property boundary shall be
single story buildings designed to discourage views and access facing the west, unless
required for emergency access. Furthermore, these office lots shall have hours of operation
consistent with office operations which have been determined to be 6 am —10 pm.
Proposed Condition #7: As stated.
Original Condition #8: That the applicant shall redesign the site to meet the 300'
standard separation for drive thru uses with this application or variance is obtained.
Proposed Condition #8: DELETE, since C -G zoning now allows drivethrus if separated by
300 feet, and are allowed with a conditional use permit if they are within 300' of residential
zoning.
Original Condition #9: That all access for Sadie Creek Promenade Subdivision shall be
taken from Ustick Road atpoints determined by ACED.
Proposed Condition #9: That all access for Sadie Creek Promenade Subdivision shall be
taken at the existing Ustick Road driveway locations constructed by ACRD with the Ustick
Road widening project.
Original Condition #10: That Lots 1 and 2 of Block 2 of the site plan dated September 15,
2005 are for office uses only. Non retail uses shall be located on these lots. All other lots
shall be limited to Office/Retail/Restaurant/Drive thru uses and General Commercial uses
listed as permitted in UDC Table 11-2B-2. Any uses (excepting Drive Thru) not listed as
permitted shall be subject to conditional approval.
Proposed Condition #10: That the buildings located west of Centerpoint Way are for
office uses only. Non retail uses shall be located on these lots. All other lots shall be
limited to Office/Retail/Restaurant/Drive thru uses and General Commercial uses listed as
permitted in UDC Table 11-213-2. Any uses (excepting Drive Thru) not listed as permitted
shall be subject to conditional approval.
Original Condition #11: That the western most public road referenced to as Sadie Creek
Avenue may be renamed as approved by the Ada County Street Naming Committee. The
road name has been approved as Centrepoint Way.
Proposed Condition #11: As stated.
Add Proposed Condition #12:
Owner shall be allowed to obtain up to two (2) Certificate of Zoning Compliance in
accordance with the C -G zoning ordinance, prior to recording a final plat. Preliminary Plat
approval and Final Plat approval/recordation are required prior to the issuance of the 3`d and
any subsequent Certificate of Zoning Compliance on the property.
