DESCRIPTION OF APPLICANT'S REQUEST
The applicant, City of Meridian Parks Department, requests certificate of zoning compliance (CZC) and
administrative design review (DES) approval to expand the Settler's Park tennis facility located at 3245
N. Meridian Road. The subject property is zoned L-O.
Site improvements consist of five (5) additional tennis courts, three (3) youth tennis courts, a new parking
area, several shade structures, a covered picnic shelter, associated landscaping and aright-in/right-out
only access to Ustick Road.
Currently, the site is served by two (2) approved access points to Ustick Road that was constructed when
the park was developed. The applicant is requesting approval of a third access point (right-in/right-out
only).
Per UDC 11-3A-3A, the number of access points to arterial roadways shall be limited to provide safe
entrance onto the adjacent street. The adjacent roadway, W. Ustick Road, is designated an arterial street
which requires a waiver by City Council to allow the requested access point, thus the access as proposed
cannot be approved by the Director.
DECISION
The applicant's request for CZC and DES is approved with the conditions listed in this report.
Note: This is not a building permit Please contact Building Services at (208) 887-2211 to verify
submittal requirements. You must complete this process before you commence the use or construction.
As part of the application submittal, you will need to provide one set of the final, stamped "approved"
Planning Division plans, stamped and signed by the architect and/or civil engineer as applicable. You
must provide these plans in PDF format and hardcopy as specified in the Building Services "Plan
Intake Checklist" and include them with your building submittal set. Please contact Building Services
for additional details about building permits and inspections
Site Specific Conditions of Approval
1. The site plan and landscape plan prepared by The Land Group, dated 02/15/13, labeled C2.01 and
L1.01, are approved (stamped "approved" on 02/27/13 by the City of Meridian Planning
Division) with the following comments:
a. Upon installation of the landscaping and prior to inspection by the Planning Division
staff, the applicant shall provide a written certificate of completion as set forth in UDC
11-3B-14A.
b. Except for landscape improvements approved with this application, all other landscaping
shall remain protected during the construction on the site.

c. Coordinate with ACHD on the proposed site/landscape improvements within the right-of-
way.
d. Protect any existing trees on or adjacent to the subject property that are greater than four-
inch caliper and/or mitigate for the loss of such trees as set forth in UDC 11-3B-10.
2. The shade structures attached in Exhibit D are approved as submitted.
3. The site plan, landscape plan and shade structures shall not be altered without prior written
approval from the City of Meridian Planning Division.
4. The applicant shall comply with the access to street standards as set forth in UDC 11-3A-3. The
proposed access to Ustick Road is not approved. The applicant must seek Council waiver of
the proposed access point. If Council does not grant the waiver of the proposed access point,
the applicant shall submit revised plans that eliminate the proposed access point.
5. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant
shall submit a new site plan to the City of Meridian Planning Division for approval prior to
issuance of the building permit.
6. The applicant shall complete all required improvements prior to issuance of a Certificate of
Occupancy. It is unlawful to use or occupy any building or structure until the Building Official
has issued a Certificate of Occupancy.
Ongoing Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets
the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth
in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14.
2. The project is subject to all current City of Meridian ordinances and any applicable conditions of
approval associated with this site.
3. The issuance of this CZC does not release the applicant from any previous requirements of the
other permits issued for the site.
4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a
minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the
area.
5. The applicant shall comply with the outdoor lighting provisions as set forth in UDC 11-3A-11.
The outdoor lighting shall have downward shielding and shall not impact the surrounding
single-family residences.
6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping
and constructed features within the clear vision triangle consistent with the standards in UDC 11-
3A-3B.
CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the Director. All
requests for review shall be filed in writing with the Planning Division on or before March 13, 2013,
within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-
SA-6B.

If City Council review of the decision is not requested, the action of the Director represents a final
decision on a land use application. You have the right to request a regulatory taking analysis under Idaho
Code 67-8003.
EXPIRATION
Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has
not commenced within one year of the date of issuance of the Certificate of Zoning Compliance.
Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure or
site shall expire if said construction or alteration has not commenced within one year of the date of
issuance of the Certificate of Zoning Compliance.
In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until February
27, 2014.

Dear Mr. Parsons:
We are pleased to enclose the following application and supporting materials for Certificate of Zoning
compliance associated with the Settlers Village Square Phase 2: Tennis Courts project. This project adds an
additional 5 tennis courts (4 performance courts and 1 stadium court) and (3) 10 and under courts to the
park. An additional 35 parking stalls will be constructed with this project and aright-in/right-out access into
the parking lot will be constructed off of Ustick Road. The tennis and parking lot project occurs on the
existing 56 acres of Settlers Park. The project limits are approximately 2.85 acres. The project includes
fencing the tennis courts with 10' high, 6' high, and 3' high chain link fencing. Other improvements will
include sidewalks, lighted pedestrian areas, lighted stadium court; fabric shade sails at performance courts,
picnic shelter, trash enclosure, landscape areas, parking and right-in/right-out access off of Ustick Road.
