4)- REASON FOR DEVELOPMENT AGREEMENT MODIFICATION -The poorly built fence bordering the South Property Line
of the Kingsbridge Subdivision Phase 1 is not located as per the development agreement. The fence is currently situated
8 %: ft. inside the property lined and 3 %2 ft. in from the Development Agreement (?). The berm was constructed on the
South Property Line when there were residents on the adjoining property to be a buffer between that residence and the
new subdivision of Kingsbridge. At this time that residence is no longer there and the Napoli Subdivisiontias acquired
that property and is now developing it. The berm is serving little or no use for the Napoli Subdivision but it has a huge
negative impact on Lots 8, 7, 6, 5, 4, and 3 of Block 3 for the homes being built on those lots. -Therefore we propose to
remove the existing fence; regrade and lower the berm 3 feet and relocate and install the fence 8 % feet further south
on the correct property lines as specified on the original development agreement. Stetson Homes will work with the
Kingsbridge Home Owners Association to relocate or plant narrower trees in the Common Lot in Kingsbridge. Stetson
Homes does not assume the responsibility of re-landscaping the Common Lot.
COMIVIITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-SA-SD, the applicant for all applications requiringa
public hearing (except for a UDC text .amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.

UDC 11-SA-5.

A public meeting was held on August 16, 2012 at 6:00 pm at 3346 E. Salcombe Dr, Meridian,lD 83642 to discuss the
issue of the berm and fence placement on the southernmost property line of the Kingsbridge Subdivision.
The following are the minutes of that meeting...
After Stan Ray presented the proposal of lowering the berm height by three feet and moving the fence 8 %2 feet to the
correct property line placement the meeting was opened to comments from the floor.
Brian Larsen, Valorie Ross, Meagan Thorndyke, and Darrel Birchfield all spoke in favor of lowering the berm and moving
the fence as proposed.
Brian Larsen: "The berm is ugly and the fence is poorly constructed."
Valorie Ross: "It takes up most all of our back yard where our 5 children need to play. The fence height is so imposing,
it's right in our face(?)"
Meagan Thorndyke: "We want to put in a patio but the berm and the fence are right there, and have you seen the fauna
its hiding???It's not straight at all!!!"
The three property owners in attendance from the Napoli Subdivision spoke and told of how they had asked for the
berm and fence so that they didn't have to look people's houses, only the roofs. They commented that they hadn't
noticed that the fence was up and down and crooked. The acted somewhat concerned for the new homeowners and
their back yard dilemma by making suggestions for lowering the berm but installing a taller fence.
