ACRD now understands that it is the City's position that ACHD must sign the Development Agreement
Modification. Given this, ACHD requests that the following language be added at the end of the proposed paragraph
4.3:
ACHD's obligations under this Development Agreement shall only relate to the development of the ACRD
PROPERTY, as provided in this Paragraph 4.3.
Per our discussion a few minutes ago, I understand that you will present this request to the City Council at the hearing
tonight.
