APPLICATION SUMMARY The applicant, The Land Group Inc., is requesting to vacate a portion of the public water easement platted on Lot 4, Block lof Southeast Corner Marketplace Subdivision No. 2. 2. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The subject property is located near the southeast corner of E. Ustick Road and N. Eagle Road, in the northwest '/4 of Section 04, Township 3 North, Range 1 East. B. Applicant/Representative: Russ Hepworth, The Land Group 462 E. Shore Drive Eagle, Idaho 83616 C. Southeast Corner Marketplace Subdivision No. 2 -VAC-13-001 - 1 - 5. PROCESS FACTS The subject application is a request to vacate a platted easement. By reason of the provisions of the Meridian City Code Title 11, Chapter 5, the City Council is the decision making body on this matter. The UDC does not require the site be posted with a public hearing notice sign. A. Newspaper notifications published on: January 28, and February 11, 2013 B. Radius notices mailed to properties within 300 feet on: January 24, 2013 6. LAND USE A. Existing Land Use(s): This property is currently being developed with a 27,380 square foot commercial building. B. Character of Surrounding Area and Adjacent Land Use and Zoning: The subject property is surrounded on the north, east, west and south by vacant and developed commercial properties zoned C-G. C. History of Previous Actions: • The final plat (FP-07-020) for Gateway Marketplace Subdivision No. 2 was approved by the Meridian City Council on July 10, 2007. The final plat consists of 16 commercial lots. The existing water main was installed as part of the subdivision improvements. • A certificate of zoning compliance (CZC-12-077) has been approved to construct a commercial building. A condition of the CZC requires the vacation process to be completed prior to the issuance of the certificate of occupancy for the first tenant. 7. AGENCY COMMENTS MEETING No comments were received by the Planning Department from other City departments for the subject application. 8. STAFF ANALYSIS The applicant is requesting to vacate a portion of an existing water easement (2,174 square feet) platted on Lot 4, Block lof Southeast Corner Marketplace Subdivision No. 2 (see Exhibit A.2). The water main was installed in conjunction with the subdivision improvements. A 27,380 square foot building is currently under construction over the top of the water easement which necessitates the need to vacate a portion of the existing easement (see Exhibit A.3). The portion of the easement and water main that is to remain (adjacent to the rear of the building) will adequately service development of the site.
