Sawtooth Wireless FacilityCERTIFICATE OF ZONING COMPLIANCE REPORT DATE: TO: FROM: SUBJECT: ,�Ii.I� 0".9- February 6, 2013 General Dynamics E IDIAN*,---- IDAHO Bill Parsons, Associate City Planner Sawtooth Wireless Communication Facility (CZC-13-008; DES -13-013; ALT - 13 -005) Joint School District No. 2 DESCRIPTION OF APPLICANT'S REQUEST The applicant, General Dynamics, requests Certificate of Zoning Compliance (CZC) and administrative design review (DES) approval to construct a wireless communication facility located at 3730 N. Linder Road. The use was approved by the Planning and Zoning Commission on August 2, 2012 with CUP -12- 005. Development of the site includes a new 240 square foot mechanical building, erecting a 125 -foot tall monopole with antennas and installing new 6 -foot vinyl fencing around the facility. Concurrently, an alternative compliance is requested to waive the 5 -foot wide perimeter landscape buffer required around the outside of the facility. The subject property is zoned R-4. DECISION The applicant's request for CZC, DES and ALT is approved with the conditions listed in this report Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify submittal requirements. You must complete this process before you commence the use or construction. As part of the application submittal, you will need to provide one set of the final, stamped "approved" Planning Division plans, stamped and signed by the architect and/or civil engineer as applicable. You must provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Site Specific Conditions of Approval 1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11 -3A -6B. 2. Per UDC 11 -5B -5B2, the Director (at the applicant's request) approved alternative compliance to UDC 11-4-3-43E in regard to the 5 -foot wide landscape buffer outside the perimeter of the facility (see Analysis section below for more information). Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. Conditions Document Sawtooth Wireless Communication Facility CZC, DES, ALT 3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11 -3B -14A. 4. The site plan prepared by ATECS, labeled Sheets C-1 and C-2, dated 09/12/12, are approved (stamped "approved" on 02/06/2013 by the City of Meridian Planning Department) with the following change: • Prior to issuance of a building permit, the applicant shall amend the site plan (4) 2 -inch caliper deciduous trees around the facility in accord with the �prted etflpl compliance. • All existing (perimeter and parking lot) landscaping adjacent to the coniructiori a ' , remain protected during construction on the site. • Protect any existing trees on the subject property that are greater than four: inch mitigate for the loss of such trees as set forth in UDC 11-3B-10. 5. The elevations prepared by ATECS and Cell X ion, labeled Sheets Z-2, Z-3 and Sheets 1-0-1-3, dated are approved (stamped "approved" on 02/06/2013 by the City of Meridian Planning Department) with no changes. 6. The approved site and/or elevations may not be altered without prior written approval of the City of Meridian Planning Department. 7. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 8. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (CUP -12-005). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 5. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-43. Any new service providers that may collocate on this site must comply with the wireless communication facility ordinance in effect at the time of application submittal. ANALYSIS OF UDC REQUIREMENTS RELATED TO THE ALTERNATIVE COMPLANCE The applicant has submitted a request for alternative compliance pertaining to the landscape buffer for wireless communication facilities as follows: 1. The applicant requests approval of alternative compliance to UDC 11-4-3-43E.8 which requires at a minimum a 5 -foot wide landscape buffer outside of the perimeter of the facility. The applicant believes the location of the facility on the school district property does not warrant the additional screening because the base of the facility will not be viewed from any abutting streets Conditions Document 2 Sawtooth Wireless Communication Facility CZC, DES, ALT and is located approximately 600 -feet from the nearest single family residence. Additionally, it is the preference of the School District not to have the landscape for security and safety reasons. In lieu of the landscape buffer, the applicant is proposing to install four (4) 2 -inch caliper deciduous trees in lieu of the required landscape buffer. Since the facility is screened from the abutting streets by the existing school, the nearest residence is approximately 600 -feet away and the facility is required to be screened by a 6 -foot solid fence, Staff finds the fencing and the four trees should adequate screen the facility. ALTERNATIVE COMPLIANCE FINDINGS: In order to grant approval for alternative compliance, the director shall determine the following findings: 1. Strict adherence or application of the requirements is not feasible; OR The purpose of the buffer is to screen the facility from abutting streets and nearby residences. The facility is being located internal to site and will be screen by a solid 6 -foot tall fence and the existing school. Further, the nearby residence is approximately 600 feet away. The Director finds the existing building, the proposed fence and the separation from the nearby residents provides adequate screening for the facility. Additionally, the four (4) trees should provide limited screening as well. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The Director finds the applicant's proposal to plant the four (4) 2 -inch deciduous trees provides an equal means for meeting the requirement and addresses the safety concerns of the school district. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of the surrounding properties. Staff finds that the proposed alternative will not be detrimental to the public welfare or impair the use/character of the surrounding properties. The placement of the facility behind the school, internal to the site preserves the function of the fire access and ball fields and is located away from the adjacent residential developments. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before February 21, 2013, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11- 5A-613. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Conditions Document 3 Sawtooth Wireless Communication Facility CZC, DES, ALT Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Meridian, Idaho 83642. The proposed communication facility will replace an existing 125 ft. guyed tower located at W. Whitelaw Dr. and N. Marburg Ave in Meridian City. The proposed communication facility will include a co -locatable 125 ft. monopole, twelve (12) — eight (8) foot antennas mounted on a full array and a pre -fabricated 12' X 20' shelter that contains the electronic equipment which operates that site. The landlord of the existing AT&T communication site has informed AT&T that the lease will not be renewed and that AT&T's site must be removed. Vacating the area without building a replacement site is not an option for AT&T. AT&T built the existing site over 20 years ago; prior to the population growth in Meridian City. Since then, the surrounding area has developed into a residential community. Over the past several years, as technology evolved with the development of smart phones, the public has depended more and more on their cellular phones. There is a rising trend of residents disconnecting their home phone numbers in favor of using their cellular phones. These residents expect full coverage, wherever they live or work, that allows for the use of their smart phones. The proposed location at 3730 N. Linder Rd was chosen for three reasons. 1) It provided acceptable coverage with very little disturbance in existing coverage. 2) The landlord had sufficient room. 3) This particular landlord offered an opportunity for the entire community to benefit. AT&T's RF Engineers believe that with the implementation of its proposed design of a like for like swap of the communication site, any additional communication facilities are not required in the next 12 months.
