Due to the concern expressed by the emergency service providers in the City of Meridian, we have revised our initial street name proposal (of a single street name in each loop) and complied with the strict interpretation of the Street Name Ordinance. This means that there will be five separate street names for each "Loop" road wiihin Woodbridge. We subsequently had this proposal, along with specific street names, approved by the Street Name Committee at their meeting on May 11, 2000. This approval, however, did not include the use of "Woodbridge Drive". The committee had recommended against the use of this name, as it would be duplicated in the city of Boise. We were informed by the committee that they were required to make a recommendation of denial in all situations of duplicated, similar or sound alike names. However, they also informed us that the recommendation could be appealed to the City Council if we did not agree with it. After a review of the situation in which that name is used, we have decided to appeal this matter to the Meridian City Council for the following reasons: • "Wood Bridge Lane", ui Boise, is private rather than public, • It is located in a developed portion of town and will never be extended, • It is approximately 200-feet in length and has very few properties addressed off of it, • And, discussions with the Meridian Fire Chief, Police Chief and a Public Works official revealed that there wasn't any concem with the duplication as it would be in a different jurisdiction. We feel that the reasons mentioned above are justification for the use of this name in addition to the fact that community will be known as "Woodbridge" and it is logical to have the consistency of the main street in the development carrying the sanle name. Approval of this appeal will be good for the identity of the Woodbridge Community as well as the City of Meridian. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: SITE SPECIFIC COMMENTS The proposed domestic water system for this development, as analyzed by our computer model, should provide water pressures in the low 40 to mid 50 PSI range. The computer modeled water volume and pressure should provide a fire flow of 1000 GPM and meet the 20 PSI residual requirements. The analysis also indicates that looping the 12 inch diameter water main in Locust Grove to Franklin Road will not significantly improve normal system pressures. We strongly feel that customers will view the system pressures as borderline, even though they exceed the minimum standards established by the State of Idaho Department of Environmental Quality. Connecting this subdivision to the higher city system pressure zone currently serving the St. Luke's area would raise system pressures by approximately 30 PSI. Currently there is not an easy way to connect this subdivision with the higher pressure zone in Magic View Subdivision. With the construction of Phase 2 of this development, a connection will be required to the main in the Magic View Subdivision. At that time, Phase 1 of this development will be valved-offfrom the low-pressure zone in S. Locust Grove Road. Applicant will be required to construct the necessary piping/valving with this development to accommodate this future conversion. Applicant shall be required to disclose this low water pressure situation to builders/residents. 2. Add minimum house sizes to the plat and indicate that minimum sizes are exclusive of garages. 3. Woodbridge Drive is a duplication of the name of a private street in Boise, and applicant is requesting City Council approval to use the name. Fire Chief Kenny Bowers has verbally indicated he has no objection to the duplication. Police Chief Bill Gordon should provide input on this issue. 7. Sanitary sewer service to this site will be via the existing trunk main that traverses through the development, Applicant will be responsible to construct lateral sewer mains to and through this proposed development. Installation of a sewer line in Locust Grove will be n~uired so as to provide service to adjacent property through this development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Only typical sections for the landscaping were received. Please submit the required detailed plans for review and approval prior to signature on the final plat. A letter of credit or cash surety in the amount of 110°1o will be required for landscaping improvements along Locust Grove Road and within the right-of--way of Woodbridge Drive prior to signature on the final plat. Perimeter fencing shall be installed prior to obtaining building permits. 11. Assessment fees for water and sewer service are determined during the building plan review process. Applicant shall be required to enter into an Assessment Agreement with the City of Meridian for the clubhouse portion of the development. In addition to these assessments, "late comers" fees for sewer, and possibly water, will be charged against this parcel to help reimburse the parties responsible for installing the water and sewer mains to their current points. This applicant may submit a written request to the City Clerk's office for the City to enter into a late comers agreement for those portions of sanitary sewer and water mains that they will be installing as part of their project that will benefit other lands. 12. Applicant has not indicated whether the pressurized irrigation system within this development is to be owned and maintained by the homeowners association or the Nampa & Meridian Irrigation District. If the system is being proposed as a private system (H.O.A.), plans and specifications for the irrigation system shall be reviewed by the Public Works Department as part of the development plan review process. A draft copy of the pressurized irrigation system O&M manual must be submitted prior to plan approval. The conditional use permit approved for this project includes a multiple use pathway along Five Mile Creek. The City of Meridian shall work with applicant to secure a license agreement with the Nampa and Meridian Irrigation District for a pathway along the Five Mile Creek. Said agreement shall be between O'Neil Enterprises, Inc., and the Nampa and Meridian Irrigation District. Applicant shall provide the easement for a future public pathway along Five Mile Creek on the plat. 14. The open detention ponds shown on the drainage plan show that a significant portion of the area proposed as common open area during the conditional use process is now proposed for drainage detention. The drainage plan also shows these detention ponds as being eight feet deep. Detailed plans of these ponds will need to be reviewed to determine if these areas are indeed usable as common area by all residents of the development. Detention ponds shall be designed such that accumulated water is disposed of within a 24- hour period. The City has been experiencing problems with groundwater in drainage areas, particularly those without an outflow to an existing drainage system. 15. Applicantms engineer will be required to submit a signed, stamped statement certifying that all street finish centerline elevations are set a minimum of three feet above the highest established normal groundwater elevation. 16. Several lots on the preliminary plat map indicate that they are within the 100-year floodplain. The preliminary subsurface evaluation report prepared by Strata, Inc., dated June 28, 1999, states on page 5 under Opinions and Recommendations, oWe recommend that residential development be restricted to areas outside the 100-year floodplain.p Several of these lots are also impacted by wetlands. Conditions that may be required by the Commission in approving the use of structures in a Floodplay Overlay Zone shall include: a. Limitations on periods of use and operation; b. Imposition of deed restrictions; c. Location and arrangement of structures within the floodway and floodway fringe areas to avoid an increase in flood heights during the recurrence of the 100-year flood discharge; d. Requirement for construction of channel modifications, dikes, levees and other protective measures; e. Placement of survey benchmarks; and f. Floodproofing measures. The evaluation of the effect on a proposed use in the floodway and floodway fringe areas causing increase in flood heights is based not just on the effect of the single use acting alone, but upon the reasonable assumption that other landowners within the floodplain may need to be allowed to develop to an equivalent extent within the floodway and, therefore, the accumulative effects of all such encroachments must be considered by the Commission in making any decision 18. Several needed details are missing from the plat. Due to the numerous notations made on the plat, the Public Works Department will supply the applicantms engineer with a redlined copy of the plat submittal so the required corrections and details can be provided. 19. This project is subject to all terms of the development agreement and conditional use permit as approved by the Meridian City Council. Staffms failure to cite specific ordinance provisions or terms of the approved conditional use permit does not relieve Applicant of responsibility for compliance. GENERAL COMMENTS 1. Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 12-4-13. (OEI) would like to submit the following comments and points of clarification on behalf of Woodbridge Community LLC. We have had the opportunity to discuss our concerns with staff and have come to an agreement on a number of modifications. Below you will find a summary of our concerns and a list of modified conditions is attached as Exhibit A. Please note that we are in general agreement with the comments/conditions not addressed in this letter in that they are generally consistent with the Conditional Use Permit and Development Agreement previously approved for the Woodbridge Community. Site Specific Comments: OEI recognizes Staff's concern that the water pressure available to serve Woodbridge is marginal even though it surpasses the minimum standards of the Idaho Department of Environmental Quality. Furthermore, OEI is supportive of a future connection to the "high zone", currently serving the St. Luke's area, in order to improve water pressure for the residents of Woodbridge. We do feel however, that placing a requirement for a connection to the "high zone" should be made if and when future phases dictate the need for the connection. Having said that, we feel that the necessary provisions for this future connection should be addressed in Phase 1, as they would need to be constructed as a part of the infrastructure for Phase 1. Discussions with staff revealed that they are in agreement and that they would be supportive of modifying the condition as described above. 4. 4`~ note: Staff and the applicant agree that this note should include "lateral users association" in identifying parties that can assume the responsibility and maintenance for irrigation/drainage facilities. 5. OEI would like to avoid providing utility easements on all side yard areas wherever possible. Discussions with Staff revealed that the requirement was suggested in order to accommodate the service providers in Woodbridge, but they did not see a need for the easements if the service providers did not require side yard easements. Staff supported OEI's suggestion of wording the condition to require side yard easements "where necessary". 12. Section 2.14 on page 7 of the findings of fact for the preliminary plat approval included an additional sentence on this condition that read: "Staff shall work with applicant to determine the common area irrigation assessments." Staff and OEI agree that the provision of a pathway is sufficiently addressed by the conditions of approval for the Conditional Use Permit and that an easement can be recorded at a later date. In addition to the comments made above, OEI would like to reiterate our desire to use Woodbridge Drive as the name for the main east-west roadway within the Woodbridge community and would appeal to Council to consider this request. The computer modeled water volume and pressure should provide a fire flow of 1000 GPM and meet the 20-PSI residual requirements. The analysis also indicates that looping the 12-inch diameter water main in Locust Grove to Franklin Road will not significantly improve normal water system pressures. We strongly feel that customers will view the system pressures as borderline, even though they exceed the minimum standards established by the State of Idaho Department of Environmental Quality. Connecting this subdivision to the higher city system pressure zone currently serving the St. Luke's area would raise system pressures by approximately 30 PSI. Currently there is not an easy way to connect this subdivision with the higher pressure zone in Magic View Subdivision; however, the applicant shall be required to construct the necessary piping/valuing with the development of Phase 1 to allow for a future connection to this system if/when it is determined to be necessary for future phases. Applicant shall be required to disclose information on the water system planned for this development to homebuilders and future residents in the Covenants, Conditions and Restrictions (C,C, & R's). 4. Due to the concern expressed by the emergency service providers in the City of Meridian, we have revised our initial street name proposal (of a single street name in each loop) and complied with the strict interpretation of the Street Name Ordinance. This means that there will be five separate street names for each "Loop" road within Woodbridge. We subsequently had this proposal, along with specific street names, approved by the Street Name Committee at their meeting on May 11, 2000. This approval, however, did not include the use of "Woodbridge Drive". The committee had recommended against the use of this name, as it would be duplicated in the city of Boise. We were informed by the committee that they were required to make a recommendation of denial in all situations of duplicated, similar or sound alike names. However, they also informed us that the recommendation could be appealed to the City Council if we did not agree with it. After a review of the situation in which that name is used, we have decided to appeal this matter to the Meridian City Council for the following reasons: • "Wood Bridge Lane", in Boise, is private rather than public, • It is located in a developed portion of town and will never be extended, • It is approximately 200-feet in length and has very few properties addressed off of it, • And, discussions with the Meridian Fire Chief, Police Chief and a Public Works official revealed that there wasn't any concern with the duplication as it would be in a different jurisdiction. We feel that the reasons mentioned above are justification for the use of this name in addition to the fact that community will be known as "Woodbridge" and it is logical to have the consistency of the main street in the development carrying the same name. Approval of this appeal will be good for the identity of the Woodbridge Community as well as the City of Meridian. The overall concept of this project for this phase appears to be adequate. I have a few minor concerns, one being the storm drainage as It appears tp be designed for the 100-year event although if the District is to receive any storm water back into its' system, it will need bD be designed for the Z5-year event. The plans also indicate a 54" culvert to be placed in the Fivemile Drain and later a bridge to be constructed. The culvert was discussed previously in an on-site meeting, however the District will need to review the bridge plans for approval when it is available. The District will need a license agreement for both storm water discharge and encroachment if the plan is to discharge return flow back into the Fvemile Drain. The last issue is the pressure irrigation system; everything appears to be acceptable with the exception of the loop located at the southeast corner, which appears not to be looped. This will have to be changed so the entire system is looped. The District also needs a completed contract for the operation and maintenance of this system signed by the developer. It will be presented to the District's Board of Directors with the other license agreement for their consideration at the next available board meeting. Prepared by City of Boise Public Worlcs Department, January 1997. 1.4 The Nampa SL Meridian Irrigation District has reviewed the plans for this project. The overall concept of this project for this phase appears to be adequate. One concern pertains to the storm drainage as it appears to be designed for the 100-year event although if the District is to receive any storm water back into its system, it will need to be designed for the 25-year event. The plans also indicate a 54" culvert to be placed in the Fivemile Drain and later a bridge to be constructed. Pertaining to the culvert, the District will need to review the bridge plans for approval, when it is available. The District will need a license agreement for both storm water discharge and encroachment if the plan is to discharge return flow back into the Fivemile Drain. Pertaining to the pressurized irrigation system; everything appears to be acceptable with the exception of the loop located at the southeast ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT FOR WOODBRIDGE SUBDIVISION (FP-00-008) - 4 r-~ corner, which appears not to be looped. This will have to be changed so the entire system is looped. The District also needs a completed contract for the operation and maintenance of this system signed by the developer. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: SITE SPECIFIC COMME~'TS 1. The proposed domestic water system for this development, as analyzed by our computer model, should provide water pressures in the low 40 to mid 50 PSI range. The computer modeled water volume and pressure should provide a fire flow of 1000 GPM and meet the 20 PSI residua_ 1 requirements. The analysis also indicates that looping the 12 inch diameter water main in Locust Grove to Franklin Road will not s jQnificantly improve normal system pressures. We strongly feel that customers will view the system pressures as borderline, even though they exceed the minimum standards established by the State of Idaho Department of Environmental Quality. Connecting this subdivision to the higher city system pressure zone currently serving the St. Luke's area would raise system pressures by approximately 30 PSI. Currently there is not an easy way to connect this subdivision with the higher pressure zone in Magic View Subdivision. With the construction of Phase 2 of this development, a connection will be required to the main in the Magic View Subdivision. At that time, Phase 1 of this development will bevalved-offfrom the low-pressure zone in S. Locust Grove Road. Applicant will be required to construct the necessary piping/valving with this development to accommodate this future conversion. Applicant shall be required to disclose this low water pressure situation to builders/residents. 2. Add minimum house sizes to the plat and indicate that minimum sizes are exclusive of garages. 3. Fire Chief Kenny Bowers has verbally indicated he has no objection to the duplication. Police Chief Bill Gordon should provide input on this issue. 7. Sanitary sewer service to this site will be via the existing trunk main that traverses through the development. Applicant will be responsible to construct lateral sewer mains to and through this proposed development. Installation of a sewer line in Locust Grove will be required so as to provide service to adjacent property through this development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Sewer manholes are to be provided to keep the sewer lines on the south and west sides of the ~. Applicant to include a note on his development plans to retain and protect the all-weather gravel access to the City of Meridian's Five Mile Creek Sanitary Sewer Trunk Line in accordance with the provisions of the recorded sanitary sewer easement. 8. Water service to this site will be via extensions of the existing main in Locust Grove Road from its intersection with Central Drive, or from its intersection with Franklin Road. Applicant will be responsible to construct the water mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. 9. Five Mile Creek and the defined wetland tnoutary of Five Mile Creek are excluded from the piping requirement. All other ditches are to be tiled. 10. A perimeter fencing plan, and detailed landscape plan for Locust Grove Road as well as a typical landscape plan for pedestrian pathways, wetland areas, stormwater retention ponds, and street landscape islands, was to be submitted for review and approval by staff with the final plat application. Only typical sections for the landscaping were received. Please submit the required detailed plans for review and approval prior to signature on the final plat. A letter of credit or cash surety in the amount of 110% will be required for landscaping improvements along Locust Grove Road and within the right-of--way of Woodbridge Drive prior to signature on the final plat: Perimeter fencing shall be installed prior to obtaining building permits. 1 1. Assessment fees for water and sewer service are determined during the building plan review process. Applicant shall be required to enter into an Assessment Agreement with the City of Meridian for the clubhouse portion of the development. In addition to these assessments, "late comers" fees for sewer, and possibly water, will be charged against this parcel to help reimburse the parties responsible for installing the water and sewer mains to their current points. This applicant may submit a written request to the City Clerk's office for the City to enter into a late comers agreement for those portions of sanitary sewer and water mains that they will be installing as part of their project that will benefit other lands. 12. Applicant has not indicated whether the pressurized irrigation system within this development is to be owned and maintained by the homeowners association or the Nampa & Meridian Irrigation District. If the system is being proposed as a private system (H.O.A.), plans and specifications for the irrigation system shall be reviewed by the Public Works Department as part of the development plan review process. If a creek or well source is not available, asingle-point connection to the culinary water system shall be required. If a single-point connection is utilized, the developer shall be responsible for the payment of assessments for the common areas prior to signature on the final plat by the Meridian City Engineer. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments as determined by the City Engineer for the entire common open area 13. The conditional use permit approved for this project includes a multiple use pathway along Five Mile Creek. This pathway is proposed to be public at such time as adjacent properties are developed, extending the pathway. The City of Meridian shall work with applicant to secure a license agreement with the Nampa and Meridian Irrigation District for a pathway along the Five vide Creek_ Said agreement shall be between O'Neil Enterprises, Inc., and the Nampa and Meridian Irrigation District. If required by the Nampa and Meridian Irrigation District, the applicant shall be required to provide liability in~»-ance for the pathway until such time as it becomes part of a larger public pathway system. If and when the pathway is deeded to the City as part of a larger public pathway system, the City would then assume liability and maintenance responsibilities. Applicant shall provide the easement for a future public pathway along Five Mile Creek on the plat. i4. The open detention ponds shown on the drainage plan show that a significant portion of the area proposed as common open area during the conditional use process is now proposed for drainage detention. The drainage plan also shows these detention ponds as being eight feet deep. Detailed plans of these ponds will need to be reviewed to determine if these areas are indeed usable as common area by all residents of the development. Detention ponds shall be designed such that accumulated water is disposed of within a 24- hour period. The City has been experiencing problems with groundwater in drainage areas, particularly those without an outflow to an existing drainage system. 15. Applicantms engineer will be required to submit a signed, stamped statement certifying that all street finish centerline elevations are set a minimum of three feet above the highest established normal groundwater elevation. 16. Several lots on the preliminary plat map indicate that they are within the 100-year floodplain. The preliminary subsurface evaluation report prepared by Strata, Inc., dated June 28, 1999, states on page 5 under Opinions and Recommendations, oWe recommend that residential development be restricted to areas outside the 100-year floodplain. p Several of these lots are also impacted by wetlands. Please provide plans and applicable agency approvals for any modifications to the floodplain and wetlands areas. Compaction test results must be submitted to the Meridian Building Department for all lots impacted by filling. Applicant shall comply with all provisions of City Ordinance Section 11-11 pertaining to the Floodplain Overlay District. Conditions that may be required by the Commission in approving the use of structures in a Floodplay Overlay Zone shall include: a. Limitations on periods of use and operation; b. Imposition of deed restrictions; c. Location and arrangement of structures within the floodway and floodway fringe areas to avoid an increase in flood heights during the recurrence of the 100-year flood discharge; d. Requirement for constriction of channel modifications, dikes, levees and other protective measures; e. Placement of survey benchmarks; and f. Floodproofing measures. The evaluation of the effect on a proposed use in the floodway and floodway fringe areas causing increase in flood heights is based not just on the effect of the single use acting alone, but upon the reasonable assumption that other landowners within the floodplain may need to be allowed to develop to an equivalent extent within the floodway and, therefore, the scc•~zmuladve effe~,s of all sccu eacrLac:~ens :~~Lst ~e crns:4er~d by the Commission in making any decision 18. Several needed details are missing from the plat. Due to the numerous notations made on the plat, the Public Works Department will supply the applicantms engineer with a redlined copy of the plat submittal so the required corrections and details can be provided. 19. This project is subject to all terms of the development agreement and conditional use permit as approved by the Meridian City Council. Staffms failure to cite specific ordinance provisions or terms of the approved conditional use pemut does not relieve Applicant of responsibility for compliance. GENERAL COMMENTS 1. Any existing irrigation drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 12-4-13. Plans will need to be approved by the appropriate irrigation drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Corrie Mayor of Meridian Meridian City Council 33 East Idaho Street Meridian, Idaho 33642 Re: Woodbridge, Finai Plat Dear Mayor Come and Ciry Council Members: In response to the Staff report prepared for the Woodbridge Hearing on June 6, 2000, O'Neill Enterprises, Inc. (OEI) would like to submit the following comments and points of clarification on behalf of Woodbridge Community LLC. We have had the opportunity to discuss our concerns with staff and have come to an agreement on a number of modifications. Below you will find a summary of our concerns and a list of modified conditions is attached as Exhibit A. Please note that we are in general agreement with the comments/conditions not addressed in this letter in that they are generally consistent with the Conditional Use Permit and Development Agreement previously approved for the Woodbridge Community. Site Soecific Comments: OEI recognizes Staff's concern that the water pressure available to serve Woodbridge is marginal even though it surpasses the minimum standards of the Idaho Department of Environmental Quality. Furthermore, OEI is supportive of a future connection to the "high zone", currently serving the St. Luke's area, in order to improve water pressure for the residents of Woodbridge. We do feel however, that placing a requirement for a connection to the "high zone" should be made if and when future phases dictate the need for the connection. Having said that, we feel that the necessary provisions for this future connection should be addressed in Phase 1, as they would need to be constructed as a part of the infrastructure for Phase 1. Discussions with staff revealed that they are in agreement and that they would be supportive of modifying the condition as described above. 4. 4`s note: Staff and the applicant agree that this note should include "lateral users association" in identifying parties that can assume the responsibility and maintenance for irrigation drainage facilities. OEI would like to avoid providing utility easements on all side yard areas wherever possible. Discussions with Staff revealed that the requirement was suggested in order to accommodate the service providers in Woodbridge, but they did not see a need for the easements if the service providers did not require side yard easements. Staff supported OEI's suggestion of wording the condition to require side yard easements "where necessary". 12. Section 2.14 on page 7 of the findings of fact for the preliminary plat approval included an additional sentence on this condition that read: "Staff shall work with applicant to determine the common area irrigation assessments." Staff and OEI agree that the provision of a pathway is sufficiently addressed by the conditions of approval for the Conditional Use Permit and that an easement can be recorded at a later date. In addition to the comments made above, OEI would like to reiterate our desire to use Woodbridge Drive as the name for the main east-west roadway within the Woodbridge community and would appeal to Council to consider this request. Due fo the concern expressed by the emergency service providers in the City of Meridian, we have revised our initial street name proposal (of a single street name in each loop) and complied with the strict interpretation of the Street Name Ordinance. This means that there will be five separate street names for each "Loop" road within Woodbridge. We subsequently had this proposal, along with specific street names, approved by the Street Name Committee at their meeting on May 11, 2000. This approval, however, did not include the use of "Woodbridge Drive". The committee had recommended against the use of this name, as it would be duplicated in the city of Boise. We were informed by the committee that they were required to make a recommendation of denial in all situations of duplicated, similar or sound alike names. However, they also informed us that the recommendation could be appealed to the City Council if we did not agree with it. Afrer a review of the situation in .vhich that name is used, we have decided to appeal this matter to the Meridian City Council for the following reasons: • "Wood Bridge Lane", in Boise, is private rather than public, • It is located in a developed portion of town and will never be extended, • It is approximately 200-feet in length and has very few properties addressed off of it, • And, discussions with the Meridian Fire Chief, Police Chief and a Public Works official revealed that there wasn't any concern with the duplication as it would be in a different jurisdiction. The reasons for rejection were mainly duplication of names. The applicant is questioning only one name. The name "Woodbridge" is duplication of an e~osting °lane' in southeast Boise. Thirty (30) days .prior to any County public hearing on such application, the Ada County Development Services Department Director shall send to the Meridian City Clerk all County land use applications to be considered by the Ada County Planning and Zoning Commission or the Board of Ada County Commissioners concerning property located within the Meridian City area of City impact. The Meridian Planning and Zoning Commission or the Meridian -City Council shall make recommendations to the Ada County Development Services Department director on such application, in writing, and shall cite the Meridian Zoning and/or Subdivision Ordinances or the Meridian Comprehensive Plan policies, goals, objectives or provisions supporting such recommendation. Such recommendation shall be submitted in writing to the Ada County Development Services Department Director prior to or at such public hearing. Such input form Meridian shall not be binding or controlling on the County, but shall be treated as documentary evidence. 2. Neither the Board of Ada County Commissioner nor the Ada County Planning and Zoning Commission shall hold a public hearing on such application until the recommendation of the Meridian City Council or Meridian City Planning and Zoning Commission, as the case may be, has been received, or the date the County should have been received said Council's of Commission's recommendations, specified above, has passed. A transmittal for the preliminary plat and private road was sent to the City of Meridian on April 12, 2000. This fulfills the 30-day requirement. The City must submit comments prior to the final hearing on the preliminary plat. The property contain 18 acres and is located in the southwest corner of the intersection of Amity and Locust Grove Roads, Meridian ID; Section 31, T. N., R. 1E. This application is comprised of: 1) Application forms prepared and submitted by the applicant. 2) Site plan. 3) All other information contained in File # 00-01-S/00-06-PR. PROCEDURAL ITEMS 1. On March 15, 2000, the applicant held a neighborhood meeting. 2. On Apri112, 2000, Development Services accepted File #00-O1-S/00-06-PR and scheduled it for public hearing before the Ada County Planning and Zoning Commission on May 25, 2000. 3. On Apri112, 2000, staff notified other agencies of this application and solicited their comments. Any comments received are attached to the staff report. 4. On May 3, 2000, persons owning property within 300 feet of the subject property were notified of the public hearing by mail. Legal notice of the Commission s public hearing was published in the Idaho Statesman on May 8, 2000. On May 17, 2000, notices were posted on and near the site. SUMMARY OF KEY FINDINGS Although each lot will have the required amount of frontage to a public road, the applicant intends to use the existing driveway to his residence on the proposed lot 2. Because this driveway will cross Lot 1, he has submitted a private road application to maintain this access. This application complies with Goa18 and Land Use Policy 6.8b of the Meridian Comprehensive Plan. RECOMMENDATION Staff recommends that the Commission recommend approve the private road and recommend approval of the subdivision as submitted, subject to the attached conditions of approval. APPLICABLE LAW This section details the comprehensive plan policies, zoning ordinance regulations, and other applicable standards regarding development of the subject property. Policy 5.10-9 of the Ada County Comprehensive Plan. "The specific goals, policies and implementuzg ordinances that Ada County and the City of Boise have agreed will be applicable in the Boise Area of City impact, are codified in Ada County Code, Title 9, Chapter 3, as it may be amended from time to time." a) Goa18 of the Meridian Comprehensive Plan: "To establish compatible and efficient use of land through the use of innovative and functional site design." b) Land Use Policy 6.8b of the Meridian Comprehensive Plan: "Within the Urban Service Planning Area one single family residential house may be placed on a 5 or 10 acre tract provided dry line sewer and eater lines are installed and constructed, and plans are layouts for roads are made and provisions are made for future resubdivision of the 5 or 10 acre tract to an urban density as shown in the Comprehensive Plan Land Use map." 2. Title 9, Chapter 4 of the Ada County Code. All sections of Chapter 4 apply, especially the following: Section 9-4-1 A. "The Meridian Comprehensive Plan, adopted by the city of Meridian on December 21,1993 shall apply to the meridian area of City impact." C. "All subdivision plat applications in the urban service planning area for land zoned RT (Rural Transitional) shall require a street and utility easement plan. Said plan shall provide for future resubdivision to urban densities and shall be included on the final plat. This requirement may be waived if a letter is submitted to the Director from the Meridian City Council prior to preliminary plat approval by the Board. 00-O1-S/ 00-06-PR Worden Subdivision page 3 ~^-~ .-. D. A condition of approval for all subdivision plats in the urban service planning area for land zoned RT (Rural Transitional) shall require that, prior to occupancy of the subdivision's first dwelling unit, dry line sewer and water lines shall be installed to accommodate the future resubdivision to urban densities. This requirement may be waived if a letter is submitted to the Director from the Meridian City Council prior to preliminary plat approval by the Board." 3. Article 8-4C of the Ada County Code. The purpose statement of the RT (Rural Transitional) states, in part: "A. To provide standards and regulations for the development of lands within areas of city impact, except for the Foothills Planning Area designated in the Boise City Comprehensive Plan within the Boise area of city impact, that may not presently be served by urban services, consistent with the goals and policies of the applicable comprehensive plan. B. To allow agricultural and rural residential uses to continue within areas of city impact until urban services are extended." 4. Section 8-10-13 of the Ada County Code. "The Commission before recommending action on a preliminary plat and t11e Board, before taking action on said plat, shall first make the following findings of fact and conclusions of law that shall be supported by evidence in the hearing record: a) The design conforms to the standards established in Section 8-10A-1 of this Title. b) The water supply and sewage system are in accordance with the minimum standards established in Section 8-10C-3-2 of this Title for the type of development proposed. c) If applicable, the proposed subdivision complies with the Article 8-D of this Title (Wildland-Urban Interface Overlay District). d) The design conforms to the topography and natural landscape features and shows consideration for the location and function of land uses and structures to achieve this purpose. e) The development would not cause undue damage, hazard or nuisance to persons or property in the vicinity. f) The internal street system is designed for the efficient and safe flow of vehicles and pedestrians without having a disruptive influence upon the activities and functions contained within the proposed subdivision nor place an undue burden upon existing transportation and other public services in the surrounding area. g) Community facilities, such as parks, recreational, and open space areas are functionally related to all dwelling units and are easily accessible via pedestrian and/or bicycle pathways. h) The proposal complies with the dimension standards set forth in this Title for the applicable zoning district. 00-O1-S/00-06-PR Worden Subdivision page 4 n i) The overall plan is in conformance with the applicable Comprehensive Plan(s), Future Acquisition Maps, Area of City Impact ordinances including applicable subdivision regulations, and other pertinent ordinances." Section 8-13-3 of the Ada County Code. "Access to a public street: Except as permitted by other provisions of this Title, no building shall be constructed for use in whole or in part for residential, commercial or industrial purposes unless such a lot or parcel has continuous frontage as required on a public street, except where such lot or parcel has a permanent access easement to a public street which was of record prior to the effective date of this Title, or upon a private street which has been approved by the Commission. No lot or parcel shall be deemed to abut upon a street unless it meets the minimum street frontage and minimum lot depth of the particular zone in which it lies except as permitted in Chapter 9, Planned Developments. a) The Commission may, after public hearing, approve frontage and access on a private street, subject to compliance with the following conditions: i) Private streets are to be named and provided with an approved street sign which complies with the provisions of the Ada County Uniform Street Name Ordinance. ii) Private streets shall originate at a public right of way and terminate at a forty five foot (45') radius cul-de-sac or other approved turnaround area. If the terminus is other than the cul-de-sac, written approval from the Star Fire Department for the turnaround area shall be submitted to Development Services. iii) Access shall be guaranteed by a perpetual use easement across the servient estate. A copy of the recorded easement shall be deposited with Development Services. iv) Any private street greater than four hundred feet (400') shall not be allowed more than four (4) lots with residence fronting on it. However, if the street meets the public street construction standards, as specified in the Ada County Highway District Development Policy Manual (as it may be amended from time to time) and as verified by the Highway District, this provision shall not apply. v) Construction Standards: RT ZONE Minimum right of way width: 30' Minimum improved width: 20' 6" of 2" crushed gravel, compacted: required 2 % slope from centerline: required Improved surface: gravel These standards may be modified by the Commission as permitted in Chapter 9, Planned Developments." 00-O1-S/ 00-06-PR 1Norden Subdivision page 5 FINDINGS OF FACT If any of these Findings of Fact are deemed to be Conclusions of Law they are incorporated into the Conclusions of Law section. Compliance with Title 9, Chapter 2 of the Ada County Code. The Commission finds that this site is inside the Meridian Area of City Impact and has been reviewed in accord with the provisions of Title 9, Chapter 4. The City of Meridian has not submitted any comments. The applicant has submitted a resubdivision plan in accordance with this Chapter. 2. Compliance with Chapter 8-4C of the Ada County Code. The Commission finds that this site is zoned RT and is within the Meridian Area of City Impact. The Meridian Comprehensive Plan is the applicable plan. This application complies with Goa18 and Land Use Policy 6.8b of the Meridian Comprehensive Plan because it allows redevelopment of this site to an urban density. 3. Compliance with Section 8-10-13 of the Ada County Code. The Commission finds the following: a) The lot design conforms to the standards established in Section 8-10A-1. b) This development will create 31ots that will contain individual septic systems and wells. In accordance with Section 8-10C-3-2, each lot will contain at least 5 acres. c) This site is not in the Wildland-Urban Interface Overlay District. d) The site generally slopes from the southwest to the northeast and does not any unique landscape features. e) The creation of three residential lots will not cause undue damage, hazard or nuisance to persons or property in the vicinity because a residential subdivision is located on the west boundary of the site. f) The lots have frontage to Locust Grove Road and a private lane that provide at least 250 feet of frontage to each lot. ACHD is requiring the entrance onto Park Lane be paved at least 30 feet from the public road. In addition, ACHD does not expect this development to place an undue burden on the existing transportation system. g) There are no community facilities or open space areas. h) Each lot will contain at least five acres and 250 feet of frontage to a public road, as required in the RT (Rural Transitional) zone. i) The overall plan proposes a residential subdivision with a density of 6 acres per dwelling. The Commission further finds that the Meridian Comprehensive Plan intends this site for residential uses. 00-O1-S/00-06-PR Worden Subdivision page 6 4. Section 8-13-3 of the Ada County Code. The Commission finds the following: a) The proposed private street name shall be approved by the street name committee. b) The proposed private street originates at Locust Grove Road, a public right of way, and terminates at a forty five foot (45') radius cul-de-sac. c) The final plat will show graphically depict the private road and the extent of the easement. A copy of the recorded easement shall be deposited with Development Services. d) The private street will have only two lots fronting on it. e) The private lane will be contain a twenty foot wide improved surface within a thirty foot wide easement. The improved surface will be gravel, in conformance with the construction standards in Section 8-13-3 of the Ada County Code. f) This application is not a Planned Development and no deviation from the private street standards is allowed. CONCLUSIONS OF LAW If any of these Conclusions of La~v are deemed to be Findings of Fact they are incorporated into the Findings of Fact section. The Commission concludes that application #00-O1-S/00-06-PR complies with Title 9, Chapter 2 of the Ada County Code. 2. The Commission concludes that application #00-O1-S/00-06-PR complies with Policy 5.10- 11 of the Ada County Comprehensive Plan. 3. The Commission concludes that application #00-O1-S/00-06-PR complies with Article 8-4C of the Ada County Code. 4. The Commission concludes that application #00-01-S/ 00-06-PR complies with Section 8-10- 13 of the Ada County Code. 5. The following list details the tasks (in order) that the applicant must complete prior to submittal of the final plat. Please note that you have two years to complete these. This deadline will be from the date the Board grants preliminary approval. 1. The final plat shall be approved by the Board of County Commissioners within twenty- four (24) months of the Board of County Commissioner's approval of the preliminary plat, unless a time extension is granted in accordance with Section 8-9-3C-7(a) of the Ada County Code. An application for a time extension must be submitted 30 days prior to the expiration date. 2. The approved final plat must be recorded with the County Recorder's Office «-ithill one (1) year of the Board of County Commissioner's as required by Section 8-12-10A of the Ada County Code. 3. All street names shall be approved by the Ada County Street Name Committee prior to submission of the final plat. 4. The private street shall be constructed and then pass inspection by the Ada County Engineer prior to submission of the final plat. 5. Approval of plans, installation of fire protection facilities and final inspection as specifically required by the Meridian City-Rural Volunteer Fire Department is required. 6. All site improvements are prohibited prior to approval of the preliminary plat, approval of the surface runoff drainage plan by the Ada County Engineer, and the approval of the appropriate public agencies having jurisdiction over the facility being consh•ucted. 7. The final plat shall comply with Section 8-10-14-3 of the Ada County Code. All public rights of way shall be dedicated and constructed to standards of the Ada County Highway District. Any work within the Ada County Highway District rights of way requires a permit. Private streets are to be named and provided with approved street signs which comply with the provisions of the Ada county Uniform Street Name Ordinance. b. Private streets shall originate at a public right of way and terminate at a forty five foot (45') radius cul-de-sac or other approved turnaround area. If the terminus is other than a cul-de-sac, written approval from the Meridian Rural Volunteer Fire District for the turnaround area shall be submitted to Development Services. c. Any private street greater than four hundred feet (400') shall not be allowed more than four (4) lots with residence fronting on it. However, if the street meets the public street construction standards, as specified in the Ada County Highway District Development Policy Manual (as it may be amended from time to time) and as verified by the Highway District, this provision shall not apply. d. The private road shall be constructed prior to submittal of the final plat. No building permits shall be issued until the private road has been constructed and verified by the County Engineer. 12. No building permits will be issued until the final plat is recorded, parcel numbers are issued by the County Assessors office, and all required improvements have been constructed and approved by the appropriate authority or a surety agreement and performance bond have been posted and accepted by the Director. 14. Compliance with Section 31-3805 of the Idaho Code pertaining to irrigation waters is required. Irrigation/drainage waters shall not be impeded by any construction on site. 15. The applicant shall comply with all requirements of the Central District Health Department. 16. The development standards (including lot coverage, building heights, setback requirements, and street frontage) of the RT (Rural Transitional) zone shall be used for the development of this parcel. 00-O1-S/ 00-06-PR ~Norden Subdivision page 10 .~ ~., 17. All outdoor lighting shall comply with the approved lighting plan and Section 8-13-13 of the Ada County Code. All lights shall be oriented and/ or provided with a cutoff shield so that no lighting element or transparent shield is visible from any adjacent property. Outdoor lighting shall not exceed 0.50 foot-candles as measured a the property line. REQUIRED SUBMITTALS 18. Prior to submittal for approval by the Board of County Commissioners, the final plat shall contain the following certificates and endorsements: a. signature of the owner(s); b. certificate of the plat surveyor; c. certificate of the County Surveyor; d. certificate of the Meridian City Clerk; e. certificate of the Meridian City Engineer; f. endorsement of the Central District Health Department; g. endorsement of the Ada County Highway District. 19. A drainage design plan and any subsequent revisions shall be submitted to and approved by the Ada County Engineer prior to submittal of the Final Plat. a. The drainage design plan shall include, but is not limited, to the following: identification of high ground water areas, poorly drained areas, and areas being developed over soils with poor drainage characteristics, poor soil-bearing capacity, hydric soils, liquefaction and soil strength loss. These areas shall be identified on the drainage plans and specific measures included in the design to overcome the adverse effects of these characteristics (i.e., concentration of ground water in building crawl spaces, subsidence of foundations, etc.). The plan shall comply with Section 2905, Foundation Investigation, of the Uniform Building Code (1997 Edition) as adopted by Ada County. A site specific geotechnical report may be required by the Ada County Engineer. The drainage design plan shall be prepared and submitted by a Professional Engineer licensed in the State of Idaho. b. The construction of drainage improvements, including site grading, shall not begin prior to approval of the drainage design plans by the Ada County Engineer. As-built drawings, acceptable to the County Engineer inform and substance, shall be submitted prior to final approval of the drainage improvements. c. Prior to acceptance of a final plat by the County Engineer, the above conditions must be satisfied and all drainage improvements completed, and inspected, and approved by the County Engineer, except where bonding is provided. The following statements shall appear on the face of the final plat: a. "This development recognizes Section 22-4503 of the Idaho Code, Right to Farm Act, which states: No agricultural operation or an appurtenance to it shall be or become a nuisance, private or public, by any changed conditions in or about the surrounding nonagricultural activities after the same has been in operation for more than one (1) year, when the operation was not a nuisance at the time the operation began; provided, that the provisions of this section shall not apply whenever a nuisance results from the improper or negligent operation of any ~~„ agricultural operation or appurtenance to it. b. "Building setbacks and dimensional standards in this subdivision shall be in compliance with the applicable zoning regulations at time of issuance of a building permit." 21. In accordance with Section 8-10A-6, there shall be easements provided for utilities, drainage, and irrigation abutting to all public street right of way and subdivision boundaries, and, where considered necessary, centered on the interior lot lines. Said easements shall have a minimum width of ten feet (10'). 22. Installation of service facilities must comply with the requirements of the public utility providing the services. The piece of land for our project is approximately 18.00 acres located in the E'h NE'/4 NE'/4 of Section 31, Township 3 North, Range 1 East of the Boise Meridian, Ada County, Idaho. It is right on the corner of Amity Road and South Locust Grove Road and falls in the Meridian City Impact Area. It is currently zoned RT (rural transitional). We are proposing a subdivision of three lots - 5.02 acres, 6.39 acres, and 5.01 acres. All the lots meet the required acreage for the zoning in which they are located. A home currently exists on what will be Block 1, Lot 2. This home as well as the home on Block 1, Lot 1 will be accessed from a private road (which we have chosen to be named Rose Lane, if approved). This private road will be maintained by a homeowners' association. This road takes its access off of South Locust Grove Road. Block 1, Lot 3 will access directly off of South Locust Grove Road. The rights-of--way for Amity Road and South Locust Grove Road as they currently exist are shown on the preliminary plat. These rights-of--way will increase once our property is subdivided. These increases are also shown on the preliminary plat. Water for domestic purposes shall be supplied by single party wells. Sewage disposal will be individual septic systems. Post development storm water runoff shall be contained onsite by means of swales, barrow ditches, and retention ponding areas as needed. Imgation shall be supplied by existing imgation ditches. An engineered soils report has been submitted to Central District Health. Regarding the Natural Features Map: 1. There aren't any potentially hazardous areas on this project. 2. Commercial buildings require the design to be done by an Idaho licensed design professional. At the very least, floor plans for a dwelling to be used as a sales office shall be drawn and stamped by an Idaho architect. Those plans are required to show how accessibility issues will be addressed in the specific commercial buildings. If the sales office /model home has not been constructed with an accessible toilet room, an accessible portable toilet room will be required on site. If there is a group of dwellings that will be used as model homes for a subdivision, an accessible route into all model homes would also be required. Failure to identify these types of commercial buildings typically causes both construction and design costs to escalate as additional work must be done to a dwelling to create a compliant sales office /model home. Ada County Grading and Excavation Permits are required prior to any earth work commencing. This includes the creation of streets, lots, storage or parking areas and ponds. Plans shall be submitted for approval to enable the issuance of the grading permit. Plans shall be prepared by an Idaho licensed civil or geotechnical engineer. We commonly encounter subdivisions that have not been designed to combine lot coverage with anticipated storm water runoff or summer irrigation. This creates wet basements and crawlspaces. A geotechnical expert may be able mitigate this problem during the design stage by mandating natural swales or foundation drainage plans. Further, if the subdivision contains fill material, or if homes are to be constructed on non virgin, wet or expansive soil, a geotechnical report and foundation design compliant with the 1997 Uniform Building Code Section 1804.1 will be required for each specific home site. The placement of buildings or structures on or adjacent to slopes greater than 33.3% shall be dcne in conformance to the 1997 Uniform Building Code Section 1806.5. The proposed project consists of a 3 lot subdivision in the Rural Transition (RT) zone and a 697.6 ft. private road,to provide access to the lots. The subject property is 18 acres and is located at the southwest corner of the intersection of Amity and Locust Grove Roads, Meridian, ID; Section 31, T. 3N., R. 1 E. Staff analysis is noted in italics. Area of City Impact Agreement Section 9-4-4C6: B. All subdivision plats, situated within the area of impact, shall be submitted to the City of Meridian for approval, in addition to Ada County approval, as provided in Idaho Code section 50-1306. County staff transmitted the preliminary plat and private road application to the City of Meridian on April 12, 2000. The City must submit comments prior to the final hearing on the preliminary plaf application. Items which may be considered by the City include, but are not limited to, continuity of street pattern, street widths, integrity and continuity of ufility systems, and drainage provisions. The City's comprehensive plan shall be used as a guideline for making the comments. The County shall consider all comments submitted by the City. The final plat must be signed by the City of Meridian. Section 9-4-3C: C. All subdivision plat applications in the urban service planning area for land zoned RT (Rural Transition) shall require a street and utility easement plan. Said plan shall provide for future re- subdivision to urban densities and shall be included on the final plat. This requirement may be waived if a letter is submitted to the Director from the Meridian City Council prior to preliminary plat approval by the Board. The application does indicates that they have prepared a re-subdivision plan showing urban development at four units per acre. This re-subdivision plan shall be noted on the final plat, or the applicant must obtain a letter from the Meridian City Council waiving this requirement. The letter must be received prior to preliminary plat approval. Section 9-4-3D: ~ ;- D~ A condition of approval for all subdivision plats in the urban service planning area for land zoned RT (Rural Transition) shall require that, prior to occupancy of the subdivision's first dwelling unit, I dry line sewer and water lines shall be installed to accommodate the future resubdivision to urban densities. This requirement may be waived if a letter is submitted to the Director from the Meridian City Council prior to preliminary plat approval by the Board. The Application Letter notes that they are proposing to install on site septic and individual wells. The applicant roust either erovide dry sewer and water lines~r a letter from fhe Meridian City Council waiving this requirement. The letter must be received pnor to preliminary plat approval. Section 9-4-4C: C. Processing of Land Use Applications in the Meridian Area of City Impact: 1. Thirty (30) days prior to any County public hearing on such application, the Ada County Development Services Department Director shall send to the Meridian City Clerk all County land use applications to be considered by the Ada County Planning and Zoning Commission or the Board of Ada County Commissioners concerning property located within the Meridian City area of City impact. The Meridian Planning and Zoning Commission or the Meridian City Council shall make recommendations to the Ada County Development Services Department director on such application, in writing, and shall cite the Meridian Zoning and/or Subdivision Ordinances or the Meridian Comprehensive Plan policies, goals, objectives or provisions supporting such recommendation. Such recommendation shall be submitted in writing to the Ada County Development Services Department Director prior to or at such public hearing. Such input form Meridian shall not be binding or controlling on the County, but shall be treated as documentary evidence. 2. Neither the Board of Ada County Commissioner nor the Ada County Planning and Zoning Commission shall hold a public hearing on such application until the recommendation of the Meridian City Council or Meridian City Planning and Zoning Commission, as the case may be, has been received, or the date the County should have been received said Council's of Commission's recommendations, specified above, has passed. A transmittal for the preliminary plat and private road was sent to the City of Meridian on April 12, 2000. This fulfills the 30-day requirement. The City must submit comments prior to the final hearing on the preliminary plat. Meridian Comprehensive Plan The Meridian Comprehensive Plan Generalized Land Use Map designates the subject property as "Single Family Residential." The subject property is within the Urban Service Planning Area Boundary. A proposed 10-Mile sewer trunk line extension runs southeast through the section intersecting Locust Grove Road '/< mile north of the site and intersection Amity Road Y< mile east of the site. An existing elementary school/ park site is located east of the site along Amity Road. • Page 2 ,^ Goals of the Comprehensive Plan Goal 1: To preserve Meridian's environmental quality and to make provisions for and improve the total natural environment by adopting City-wide and Urban Service Planning Area policies, which deal with area-specific policies and programs. As noted previously, the subject property is within the Urban Service Planning Area (USPA). Many of the policies in the comprehensive plan specifically mention the USPA. Goal 2: To ensure that growth and development occur in an orderly fashion in accordance with adopted policies and procedures governing the use of land, residential development the provision of services and the distribution new housing units within the Urban Service Planning Area. In order to evaluate this proposal in an orderly fashion, this analysis lists applicable policies, procedures, and standards from the Meridian Area of City Impact Agreement and the Meridian Comprehensive Plan. Goal 3: To encourage the kind of economic growth and development which supplies employment and economic self-sufficiency for existing and future residents, reduces the present reliance on Boise and strengthens the City's ability to finance and implement public improvements, services and its open space character. The applicable Meridian Comprehensive Plan policies and Meridian Area of City Impact Agreement standards focus on the provision of dry sewer and water lines to offset the costs of providing services. However, Section 9-4-3D of the Meridian Area of City Impact Agreement gives the City of Meridian the authority to waive this requirement. Goal 4: To provide housing opportunities for all economic groups within the community. The proposed subdivision would create two additional large lots within the USPA. The proposed restrictive covenants have architectural standards and require a 2,500 square foot minimum, site-built home. Goal 5: To preserve and improve the character and quality of Meridian's man-made environment while maintaining its identity as aself-sufficient community. The proposed protective covenants regulate 1) garbage arid refuse disposal, 2) allowed number of livestock, 3) storage of junk cars and other equipment, and 4) maintenance during construction. In addition, the covenants have architectural. These provisions will likely improve the quality of the built environment. Goal 7: To provide community services to fit existing and projected needs. As noted previously, many of the comprehensive plan policies and Area of City Impact Agreement standards focus on the provision of services; specifically, dry sewer and water lines. Goal 8: To establish compatible and efficient use of land through the use of innovative and functional site design. The Meridian Area of City Impact Agreement requires that the applicant provide a re-subdivision plan of the comprehensive plan density of 1 unit per 4 acres This re-subdivision plan must be noted on the final plat, or the Meridian City Council must write a letter prior to final approval of the preliminary plat stating that they waive this requirement. Goal 9: To encourage a balance of land use patterns to insure that revenues pay for services. • Page 3 /'~ The proposed development will not require Meridian services or increase revenues to the City. Goal 10: To create an Urban Service Planning Area which is visually attractive, efficiently managed and clearly identifiable. As noted previously, the proposed subdivision will likely improve the built environment through the proposed covenants. The proposed subdivision will be efficiently managed by providing a re- subdivision plan. However, because the proposed subdivision is not at urban densities, it will not be "clearly identifiable" as being within the USPA. Population Goal Statement and Policies Goal: Anticipate growth and development demand to continue. Plan for and promote high quality development that provides for necessary pubic facilities and services to maintain a quality lifestyle. The proposed subdivision will not rely on public wastewater or water facilities and services. School Siting Goal Statement and Siting Policies Goal: School and subdivision developments will be jointly planned and sited to ensure mutual benefits and neighborhood identity. The proposed subdivision will potentially add two new houses within the Meridian School District. Given an average of 2.5 persons per household in the year 2000 (See Table 1 of the Meridian Comprehensive Plan), this yields a potential of 5 new persons. In the School Facilities chapter, the comprehensive plan notes that the school contribution to gross population factor is .5. Wdh 5 new residents, this means a potential increase of 2.5 new students. This will have little effect on the need to site a school near the proposed subdivision. School Facilities Policy 3.3: School sites should be reserved for future acquisition in advance of development of planned land use. Approval of subdivision plats may be withheld if adequate school iaciiities cr sites are not available to sere the proposed subdivision. As part of the application process a transmittal was sent to the Meridian School District. The school district currently exceeds student capacity. According to the Meridian Joint School District web page Mary McPherson Elementary located just a ' < west of the site along Amity Road has a capacity of 528 students and has a 1999 enrollment of 588 students. School Facilities Policy 3.11: The City of Meridian supports the School District's investigation of the feasibility offees-in-lieu-of-land dedication by sponsors of new residential housing. Such fees would be dedicated to the acquisition and/or development of public school sites and facilities. See previous note. Land Use Goal Statement and Policies Goal: All land use development in the Meridian area will be considered an asset to the community and not detract from our quality of life. The proposed subdivision will enable two new houses to be built that will be similar fo the existing rural residential development. • Page 4 .~"'~. Policy 1.3: The following land use activities are not in compliance with the basic goals and policies of the Comprehensive Plan: a) strip commercial and strip industrial; b) scattered residential (sprawl or spread). The proposed subdivision will add two new residential lots within the USPA that will not be provided municipal water and sewer services. This maybe viewed as "scattered residential,"and this may make it more difficult to develop the property at urban densities when services are available. However, the re- subdivision plan is required in order to mitigate this impact. Policy 6.3: Although it is recognized that urbanized development does exist within the rural areas of the Area of City Impact, the rural lands should be kept in agricultural production as long as possible until urban services (municipal sewer and water facilities and other essential services) can be provided. In regard to single family dwelling on 5- or 10-acre tracts the following shall apply: a. (not applicable) b. Within the Urban Service Planning Area one single family residential house maybe placed on a 5 or 10 acre tract provided dry line sewer and water lines are installed and constructed, and plans and layouts for roads are made and provisions are made for future re-subdivision of the 5 or 10-ace tract to an urban density as shown in the Comprehensive Plan Land Use map. The proposed subdivision creates two 5-acre lots and one nearly 6.5-acre lot. These lots will have irrigation water and may still be used for agriculture. Although smaller lots (5 acres versus 20 acres) are more difficult fo farm economically, they can support livestock. The proposed covenants include a provision to restrict the number of livestock to prevent over-grazing. A re-subdivision plan is required prior to approval of the preliminary plat. c. (not applicable) Policy 6.4: Residential development is allowed in the rural areas provided that said development does not exceed the Rural Residential Agricultural density, unless it is inside the Urban Service Planning Area and City sewer and water is provided, when Low, Medium and High density residential may be considered. All residential development must also comply with the other appropriate sections of this plan. The term "Rural Residential Agricultural density" is not defined by the comprehensive plan. There is reference in the rural land use policies section is to "5 or 10 acre tract."Presumable this means a density of between 1 unit per 5 acres and 1 unit per 10 acres. The proposed subdivision has a density of 1 unit per 6.6 acres. Natural Resources and Hazardous Areas Goal Statement and Policies Goal: Retain the existing high-quality environment for ourselves and future generations, by ensuring that land, air, water, vegetation and wildlife are not diminished in quality or quantity by future activity. The proposed subdivision could result in two new wells and septic systems on the subject property. Policy 5.5: No septic tank systems within the Urban Service Planning Area shall be approved by Central District Health Department unless the following is demonstrated prior to approval. a. Dry sewer lines have been constructed and installed in preparation of connection to wet sewer lines throughout the parcel of land owned by the person proposing to install the septic system and plan have been prepared for connection to the municipal sewer system. • Page 5 The applicant must provide dry sewer lines or a lefter from the Meridian City Council prior to the final hearing waiving that standard. b. Placement of the temporary septic system will not degrade groundwater of surface water aquifers during the interim period. Central District Health Department has been notified of the subdivision request and will have an opportunity to place conditions on the installation of septic systems within the subdivision. c. The septic system is solely a temporary and interim wastewater disposal system. The applicant must provide dry sewer lines or a letter from the Meridian Cify Council prior to the final hearing waiving that standard. Natural Resources and Hazardous Areas Policy 5.8U: Septic or other approved individual on-site sewage disposal systems maybe permitted within the Urban Service Planning Area by approval of the Meridian City Council. The applicant must provide a lefter from the City of Meridian allowing on-site sewage disposal systems. Public Services, Utilities and Energy Resources- Engineeringand Public Works Goal Statement Goal: To provide high quality technical analysis, construction, inspection, and maintenance of the City's utility infrastructure. Develop short and long-range plans for improvement and expansions to the utility infrastructure to assure that basic service to the citizens are delivered without interruption. The proposed subdivision will not use public wafer or wastewater services. Policy 5.2: All new developments will be phased for connection to the municipal water system within the Urban Service Planning Area. Policy 5.3: The construction of individual wells in rural land within the Urban Service Planning Area shall be discouraged. The proposed subdivision will likely result in two new individual wells within the USPA. Policy 5.4: Adequate water supply will be available for fire protection. The Meridian Fire District has been notified of the proposed subdivision. The applicant shall meet any conditions of approval from the fire district prior to final plat approval. Policy 5.5: All development in the Urban Service Planning Area shall be required to connect to the municipal sewer system. This conflicts with Land Use Policy 6.3b, which allows development on 5 or 70 acre lots without connecting to a municipal sewer system. Public Services, Utilities and Energy Resources- Public Safety Goal Statement (Police/Fire) and Policies • Page 6 ,-.. ~ Goal: To provide the highest possible level of public safety, property protection and crime protection services to citizens and visitors of Meridian in a courteous, responsive and cost effective manner. The proposed subdivision will create additional demand on fire and police services. Policy 6.8: Police protection within the city limits and police protection furnished by the Ada County Sheriffs Department in the areas outside the city limits, but within the Urban Service Planning Area, should be maintained according to the recommended service ratio of 1.6 to 1.8 police officers per 1,000 persons. According to Lt. Raney of the Sheriff's Department, a police offrcer standard of 1.6 to 1.8 per 1,000 persons is a standard goal for urban areas. As density decreases, sc does the per capita crime rate, so .the 1.6 to 1.8 standard would be inappropriate for the sparsely populated areas of the County. The current level of service by the Sheriff's Department is .7 police officers per 1,000 population. Ideally, Lt. Raney would like to raise the standard to 1.0 police officers per 1,000 population. Transportation Goal Statement and Policies Goal: To develop a balanced and mixed transportation system in accord with all air quality and environmental concerns which provides for the efficient and safe movement of people and goods in both short and long terms. The Meridian Comprehensive Plan notes Amity Road as an urban collector and Locust Grove Road as a local road. (This is consistent with the Ada County Long Range Highway and Street Map.) Both Locust Grove and Amity Roads are section line roads. Policy 1.5U: Encourage clustering of uses and controlled access points along arterial, collector, and section line roads. Two of the proposed lots will have a shared access from a private road entering off Locust Grove Road. The third lot will receive access from Locust Grove Road. Maintenance of the private road should be addressed in the proposed covenants for the subdivision. Policy 1.8U: Preserve and protect future transportation corridor rights-of-ways through land use planning. Require all new development to provide adequate easements for future pathways. The proposed private road easement is sixty (60) feet. The preliminary plat notes a thirty (30) foof setback from the private road easement. This will allow sufficient area fo locate a local street in the future, while maintaining a 30 foot setback from such street. Open Space and Recreation Policy 2.5U: New subdivision development, highway improvements, and all changes of land use will be considered as opportunities to: a. Provide greenways, bicycle paths or pedestrian access to public parks, and links between parks, schools, and neighborhoods. There is an existing park and school site approximately '.mile west of the proposed subdivision along Amity Road. b. Negotiate for the acquisition of park sites. If the City of Meridian wishes to negotiate for acquisition of a park site, they should notify the County prior to the May 25, 2000 hearing by the Commission. ~ Page 7 \. . ~ .-~ c. Ada County Long Range Highway 8~ Street Map The applicable portion of Amity Road is designated as an urban collector with a minimum right-of-way width of sixty (60) feet. All section line roads are noted as future transportation corridors. The preliminary plat notes that the existing right-of--way for Amity is fifty (50) feet ACHD may require the applicant to dedicate 5feet ofright-of--way, for a total of 30 feet ofright-of--way from the centerline of Amity Road.
