Cole Road Boise, Idaho 83704 Dear Mr. Glenn: RE: Groundwater Monitoring Proposed Bob Glenn Subdivision Ustick Road Meridian, Idaho J~~U~ Strata has completed the authorized subsurface evaluation and groundwater monitoring program for the referenced project in accordance with our Confirming Proposal dated August 31, 1999. The proposed 8-acre residential subdivision is located near the northwest corner of Ustick and Locust Grove Roads. The proposed subdivision will be subdivided into 21 lots. The topography of the 8-acre parcel was relatively flat, and sloped gently down from northeast to southwest. Five test pits were observed by our field engineer at the site on September 13, 1999. The approximate location of each test pit is presented on the attached Site Plan, Plate 1. All five test pits were terminated in free-draining, clean, uncemented sand and gravel at a depth of 12 feet below the existing ground surface. A groundwater observation well was installed to the test pit termination depth in each of the five test pits. Groundwater was encountered in all five test pits at a depth of approximately 7 to 9 feet below the existing ground surface. The soils encountered at each test pit location were evaluated and the soil profiles logged in the field by our field engineer in accordance with the Unified Soil Classification System (USCS). The individual test pit logs are presented in the Appendix to this report. A brief explanation of the USCS is presented on Plate 2, and should be used to interpret the terms on the test pit logs and in this report. The general subsurface soil profile at the site consisted of 1 to 2 feet of clay overlying 5 to 6 feet of silty sand that was typically cemented below a depth of 2 to 3 feet, overlying clean sand and gravel. The sand and gravel layer was cemented in the upper 6 to 12 inches. At the conclusion of our subsurface evaluation, the test pits were loosely backfilled even with the existing ground surface to reduce the hazard associated with open excavations. The test pit locations were staked and the stakes were labeled. We understand that the test pit locations were surveyed in the field by the project civil engineer (Tealey's Land Surveying). Test pits located beneath future building, pavement or sidewalk areas should be re-excavated and backfilied with structural fill that is compacted to a minimum of 95% of the maximum dry density of the soil as determined ASTM D 698 (Standard Proctor). As described in our confirming proposal, test pit remediation was not part of the agreed upon scope of services. As presented in our confirming proposal for the referenced project, we returned to the site on five separate occasions and measured the depth to the groundwater table at each of the five observation well locations. Sewer manholes shall be provided to keep the sewer lines on the south and west sides of the centerline. 2.8 Water service to this site will be via extensions from extensions of an existing main in Ustick Road. Applicant shall be responsible to construct the water mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. 2.9 Two-hundred-fifty- and 100-watt, high-pressure sodium streetlights shall be required at locations designated by the Public Works Department. All streetlights shall be installed at subdivider's expense. Typical locations are at street intersections and/or fire hydrants. 2.10 Applicant has not indicated whether the pressurized irrigation system within this development is to be owned and maintained by an association or the Nampa &. Meridian Irrigation District. If the system is being proposed as a private system, plans and specifications for the irrigation system shall be reviewed by the Public Works Department as part of the development plan review process. A draft copy of the pressurized irrigation system O&M manual must be submitted prior to plan approval. The City of Meridian requires that pressurized irrigation systems be supplied by a year-round source of water. If a creek or well source is not available, asingle-point connection to the culinary water system shall be required. If a single-point connection is utilized, the developer shall be responsible for the payment of assessments for the common areas prior to signature on the final plat by the Meridian City Engineer. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the entire common open area. 2.11 A 20-foot wide minimum landscape buffer, beyond the required ACRD right-of--way along Ustick Road, shall be constructed by the developer as FINDINGS OF FACT AND CONCLUSIONS OF LAW AND ORDER OF CONDITIONAL APPROVAL OF PRELIMINARY PLAT BY: ROBERT GLENN FOR WANDA'S MEADOW SUBDIVISION / (PP-00-011) - S a condition of the plat. The landscape buffer shall be within a common lot, owned and maintained by a homeowners association, with a note indicating such on the plat. The buffer shall contain, at a minimum, one-tree -per 35 lineal feet along Ustick Road. Fencing shall not encroach upon this buffer. 2.12 Detailed landscape plans for all common lots shall be submitted for review and approval with submittal of the Final Plat application. A letter of credit or cash surety will be required for the improvements prior to City signature on the Final Plat. 2.13 Six-foot-high, permanent perimeter fencing shall be required along the north, east and west property lines. Submit detailed fencing plans for review and approval with submittal of the Final Plat. All required fencing is to be in place prior to issuance of building permits. 2.14 The application incorrectly states that there are 2 common lots. The plat actually shows 3 common lots -Lot 1 Block 1, and Lots 1 Sz 7, Block 2. Fencing on either side of Lot 7, Block 2, shall be limited to solid fencing at a maximum height of three feet or non-sight-obstructing fencing of a maximum of four feet because the lot is within 20 feet of the right-of--way. The applicant shall submit proposed fence details for the lot with the fencing plan described in comment number 7. Developer is responsible for fencing Lot 7, Block 2, prior to applying for building permits. This lot is not a pedestrian walkway, Applicant shall leave the drainage easement as an easement within one of the lots rather than the common lot if the Ada County Highway District will allow. 2.15 Applicant shall provide a stub street to the west property line located approximately 125-feet south of the north property line. The newly submitted plat for the Hollows Sub. shows a stub street connecting to Wanda's Meadow Sub. in this same location. Also submit one 81/2 x 11 legible copy of the revised plat. 2.19 As drawn, Lot 3, Block 2, would not meet the minimum street frontage requirement on the W. Summer St. frontage. The requirement shall be the front of house orientation to be set toward N. Lily Turf Ave. To avoid being locked into this orientation restriction, adjust the Summer St. frontage to be 80-feet (1/2 arc length of curve + frontage). Adopt the Recommendations of the Ada County Highway District as follows: 2.20 Dedicate 48-feet of right-of--way from the centerline of Ustick Road abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. Stiles: Mr. Mayor and Council, this is for the property that's currently occupied by Ted Hepper's home off Ustick Road, it's immediately adjacent to property that just previously came through as a subdivision called The Hollows, would be this property right here. We have made our recommendations and would ask-we have received a revised plat, however, there are still some minor modifications that need to be made, there are a couple of lots that will need a house direction orientation arrow on them. That would be lot 6 of block 1 and lot 3 of block 3 because they would not meet the minimum 80 ft frontage requirement for both directions, they could probably change that with some minor modifications, but we just wanted to note that. Also there are some dimensional requirements in ACHD memo that don't appear to be exact on this Plat and we just want to make sure that they're going to meet any requirements in order that they can align the roadway with this subdivision that's coming in that was previously approved, but they are coming back in since that Plat expired. Staff has no objection to the project and would recommend approval with staff conditions. Corrie: Questions, Council, staff? Applicant here this evening? Mr. Siddoway. Siddoway: This was before you the previous month. There were issues on this the last time it was here. The biggest one was the stub street being provided to the property provided to the west. The plat that was originally submitted did not have it. This plat was submitted just today to the clerk. I have not had a chance to review it, but it is my general feeling that it meets compliance. With that, staff comments dated May 18tH Standard requirements based on public works issues. The 20 foot landscape buffer beyond ACHD right of way is required. The original plat did comply with this. I would say that we would recommend approval based on the comments in our staff report dated May 18 and allow the applicant to address any concerns he might have. Borup: Are you saying you want more time to study the plat. Siddoway: I am telling you I have not studied it. Borup: Comparing the two it looked to me like the only thing changed is around the area of the Stub street, we've added a flag lot there on lot 3 and appeared to my everything else complied. Is the applicant here. Pavelek: My name is Richard Pavelek, 915 W. Jefferson in Boise. What we have done is submitted the revised preliminary plat that is before you to address one of the staff conditions of approval and that was to provide a stub street to the property to the west. All other aspects are as original submission. What we wanted to do is share with you the solution that we feel meets all the requirements of the stub street. We have reviewed this with the highway district and they support this configuration and location Meridian Planning and coning Commission Meeting June 13, 2000 Page 26 for the stub street. As far as the other conditions of approval we have no difficulty in terms of meeting those prior to submission of the final plat. I believe the recommendation was from staff for approval and I believe the revision constitutes no defect in this plat. Norton: There seems to be a discrepancy between the application and the staff comments. Are there two or three common lots. Lot one block one, lot one and seven block 2. Are those all three of the common lots. Pavelek: Yes. Barbeiro: Steve, as I recall on this plan in the past, was the property to the east wasn't that zoned an R-3. We were talking about the road paralleling the property to the east. Siddoway: The property to the west of this project is R-3. The property to the west is a skinny sliver that is still RT. We have received a plat application for that property that also continues that stub street to the west. Barbeiro: I am referring to the property to the east. The sliver property. The discussion prior was that the road for this Subdivision should run center line to that property to the east . That was a discussion when this first came up for annexation and zoning because that essentially make the property to the east implausible. Borup: It is not big enough. If it was down the center line they would have to tear their buildings out. I don't think that owner requested that. Siddoway: I don't remember that. On the annexation and zoning there was a plat submittal conceptually shown as what they were intending to do. All of our comments were specific to annexation and zoning and made clear that the plat-none of the comments were in reference to the plat. Pavelek: Very briefly Mr. Chairman we did speak to the owner of the property to the east after the last public hearing and their feelings were that they did not want to develop at this time. If they do choose to in the future they would like to link their redevelopment of the property to their east, which has got a great potential for redevelopment. Siddoway: I was looking though the comments and there was one lot 3 block 2 not meeting minimum street frontage requirements. I am uncomfortable doing a on the fly review at the table. Borup: On the new plat it is lot 3 block 3. The numbers changed. Pavelek: Basically that was a recommendation that we choose one of the two for the fronting side and I think we can easily accommodate that. If it fronts on the east west street it doesn't. Borup: That is where I have a disagreement with our ordinance. Steve did that answer that for you. Siddoway: Yes and it still is shy by just barely 79 feet and 80 feet is the minimum. 63.67 plus half of the 31.2 which is 79.31 for frontage along that. Borup: It is short .7 feet. You could take that out of lot 5 I guess if you wanted flexibility. I might just mention a minor thing on item 5, it's a typo mentions what the applicant said they comply with that. They want you to do some landscaping along Victory Road. Can you handle that. Change Victory to Ustick. Commissioner's. Barbeiro: I move we close the public hearing. Norton: Second. There is sidewalk on the south side of Ustick Road. B. On May 1, 2000, the District Planning and Development staff inspected this site and evaluated the transportation system in the vicinity. On May 5, 2000 the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. The results of that analysis constitute the following Facts and Findings ~ and recommended Site Specific Requirements. ,~~ C. The applicant is not proposing a stub street to the west property line. Staff recommends that the applicant be required to provide a stub street to the west property line, at a location approximately 100-feet south of the north property line. The proposed street intersection meets the required 125-feet of separation from all public streets (as measured from centerline to centerline) and 220-feet from al] existing driveways. F. The site has an existing driveway on Ustick Road (that serves a single family dwelling), located approximately 265-feet east of the west property line. The applicant should be required to close the driveway and utilize the public streets within the subdivision for access to the existing single -~` family dwelling. G. Unless otherwise approved, the applicant should be required to construct all public roads within the proposed subdivision as 36-foot street sections with curb, gutter, and 5-foot wide concrete sidewalks within 50-feet ofright-of--way. H. The applicant should be required to construct a 5-foot wide concrete sidewalk on Ustick Road abutting the entire parcel, located 2-feet within the new right-of--way. Coordinate the location, elevation and grade of the sidewalk with District staff. ~°'` Any proposed turnaround should be constructed to provide a minimum turning radius of 45-feet. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship or inequity. The wntten re uest shall be submitted to the District no later than 9:00 a.m. on the day scheduled for ACHD Commission action. Those items shall be rescheduled for discussion with the Commission on the next available meeting agenda. ~' Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action do not provide sufficient time for District staff to remove the item from the consent agenda and report to the Commission regarding the requested modification, variance or waiver. Those items will be acted on by the Commission unless removed from the agenda by the Commission. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within six days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall specifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of its original decision. It is designated as Single Family Residential in the Comprehensive Plan. SURROUNDING PROPERTIES North -Vacant Pasture, zoned RT in Ada County. If a creek or well source is not available, asingle-point connection to the culinary water system shall be required. If a single-point connection is utilized, the developer shall be responsible for the payment of assessments for the common areas prior to signature on the final plat by the Meridian City Engineer. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the entire common open area. 5. A 20-foot wide minimum landscape buffer, beyond the required ACRD right-of--way along Ustick Road, must be constructed by the developer as a condition of the plat. The landscape ~~~ w .rr.a~ Mayor, Council and P&Z May 18, 2000 Page 3 buffer shall be within a common lot, owned and maintained by a homeowners association, with a note indicating such on the plat. The buffer should contain, at a minimum, one tree per 351ineal feet along Victory Road. Fencing shall not encroach upon this buffer. 6. Detailed landscape plans for all common lots shall be submitted for review and approval with submittal of the Final Plat application. A letter of credit or cash surety will be required for the improvements prior to City signature on the Final Plat. 7. Six-foot-high, permanent perimeter fencing shall be required along the north, east and west property lines. Submit detailed fencing plans for review and approval with submittal of the Final Plat. All required fencing is to be in place prior to issuance of building permits. 8. The application incorrectly states that there are 2 common lots. The plat actually shows 3 common lots -Lot 1 Block 1, and Lots 1 & 7, Block 2. Fencing on either side of Lot 7, Block 2, will be limited to solid fencing at a maximum height of three feet or non-sight- obstructing fencing of a maximum of four feet because the lot is within 20 feet of the right- of-way. The applicant should submit proposed fence details for the lot with the fencing plan described in comment number 7. Developer is responsible for fencing Lot 7, Block 2, prior to applying for building permits. As this lot is not a pedestrian walkway, staff would support leaving this drainage easement as an easement within one of the lots rather than the common lot if the Ada County Highway District will allow. 9. Staff supports the ACHD recommendation to provide a stub street to the west property line located approximately 125-feet south of the north property line. The newly submitted plat for the Hollows Sub. shows a stub street connecting to Wanda's Meadow Sub. in this same location. This stub should be required even if ACHD changes their recommendation not to require the stub street. 10. Any entry signage for the subdivision must be placed outside of a 40' X 40' clear sight triangle, measured from the projected intersection of Ustick Road and North Lily Turf Ave.; or, if the sign is less than 3' in height, it may be placed within the sight triangle. Show the entry signage location on the required landscape plan to be submitted with the fmal plat application. 11. Add a note to the fmal plat for minimum house size. 12. Submit 10 copies of the revised plat that conforms to these requirements at least one week prior to the public hearing with City Council. Also submit one 8 1/Z x 11 legible copy of the revised plat. 13. As drawn, Lot 3, Block 2, would not meet the minimum street frontage requirement on the W. Summer St. frontage. We would require the front of house orientation be set toward N. Lily Turf Ave. To avoid being locked into this orientation restriction, adjust the Summer St. frontage to be 80-feet (1 /2 arc length of curve + frontage).
