Near Zero Office Building~~~ CERTIFICATE OF ZONING COMPLIANCE REPORT DATE: January 28, 2013 TO: The Christensen Corporation FROM: Bill Parsons, Associate City Planner SUBJECT: Near Zero Office Building CZC-12-086; DES-12-057; ALT-13-004 OWNER: Gramercy, LLC DESCRIPTION OF APPLICANT'S REQUEST E IDIAN~-- IDAHO The applicant, The Christensen Corporation, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval to construct a new 63,900 square foot office building. Alternative compliance is also proposed in regard to the parking lot landscape standards set forth in UDC 11-3B-8C. The property consists of 3.19 acres of land and is zoned C-G. The site is located at 2644 E. Blue Horizon Drive. DECISION The applicant's request for CZC, DES and ALT is approved with the conditions listed in this report Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify submittal requirements. You must complete this process before you commence the use or construction. As part of the application submittal, you will need to provide one set of the final, stamped "approved" Planning Division plans, stamped and signed by the architect and/or civil engineer as applicable. You must provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Site Specific Conditions of Approval 1. Prior to issuing the first certificate of occupancy for the building, any of the unused City utility easements adjacent to E. Blue Horizon Drive must be vacated. The easement vacation requires a public hearing and the submittal of a vacation application. Please contact the Planning Division to initiate this process. 2. The proposed building is approved for an office use. Any other uses other than office shall obtain approval of a Certificate of Zoning Compliance Verification application from the Planning Division of the new use prior to submitting a tenant improvement application to the Building Division. 3. Except for the photovoltaic panels, all ground level mechanical equipment shall be screened to the height of the unit as viewed from the property line and/or all rooftop mechanical equipment shall be screened as viewed from the farthest edge of the adjoining right of way in accord with UDC 11-3A-19A.1e. Process Conditions of Approval Per UDC 11-SB-SB2, the Director (at the applicant's request) approved alternative compliance to UDC 11-3B-8C in regard to the parking lot landscape requirements (see Analysis section below for more information). Conditions Document 1 Near Zero Office Building CZC-12-086; DES-12-057, ALT-13-004 2. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 3. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. 4. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 5. The site plan prepared by Carver/Thornton/Young, dated O1/10/13, labeled AS-101, is approved (stamped "approved" on 01/28/13 by the City of Meridian Planning Division) with the following comment: • The applicant shall secure the necessary approvals from ACHD for the right-of--way work and new curb cuts proposed for E. Blue Horizon Drive. 6. The landscape plan prepared by Breckon Land Design, dated 12/14/12, labeled L-101, is approved (stamped "approved" on 01/28/13 by the City of Meridian Planning Division) with the following comments: • Add one (1) 2-inch caliper deciduous tree within the second planter island east of the shared driveway stubbed to the north. • All existing (street buffers) landscaping adjacent to the construction zone must remain protected during construction on the site. • Protect any existing trees on or adjacent to the subject property that are greater than four- inch caliper and/or mitigate for the loss of such trees as set forth in UDC 11-3B-10. 7. The elevations prepared by Carver/Thornton/Young, dated 11/30/12, labeled A-201, are approved (stamped "approved" on 01/28/13 by the City of Meridian Planning Division) with no changes. 8. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 9. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 10. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 11. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (AZ-06-021, PP-06-019, FP-06-048 and DA #106141056). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. Conditions Document 2 NearZero Office Building CZC-12-086; DES-12-057, ALT-13-004 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. ANALYSIS OF UDC REQUIREMENTS RELATED SITE SPECIFIC REQUIREMENTS At the time this property was platted several City utility (water and sewer) easements were created to serve multiple buildings (see sheet AS-101). Now that one building is planned for the lots, these utilities are no longer necessary to serve the development. Staff has agreed to allow the applicant to move forward with construction however, the applicant must complete the vacation process prior to issuance of the first certificate of occupancy. ANALYSIS OF UDC REQUIREMENTS RELATED TO THE ALTERNATIVE COMPLANCE The applicant has submitted a request for alternative compliance pertaining to the parking lot landscaping, as follows: The applicant requests approval of alternative compliance to UDC 11-3B-8C.1 which requires along the northern boundary: 1) a tree within four (4) of the require planter islands and 2) a minimum 5-foot wide landscape buffer planted one tree per 351inear feet and shrubs, lawn, or other vegetative groundcover. The required landscaping cannot be accommodated because of an existing ingress/egress easement and several utility easements along a portion of the shared boundary. To offset the requirement of the 5-foot wide landscape buffer, the applicant has obtained written approval (see file) from the adjacent property owner to allow shared parking and provide cross access consistent with the Gramercy Subdivision approvals. Therefore, the Director has waived the 5-foot wide landscape buffer in accord with the UDC. In addition, the applicant is proposing a mix of shrubs within the required planter islands and the required trees will be placed along the west and south perimeter of the site. Staff has reviewed the applicant's request and finds the required landscaping interferes with existing utility and ingress and egress easements, thus staff approves the request in accord with UDC 11-SB-SB.2d. ALTERNATIVE COMPLIANCE FINDINGS: In order to grant approval for alternative compliance, the director shall determine the following findings: 1. Strict adherence or application of the requirements is not feasible; OR Because of the location of existing easements and cross access is required via the recorded plat, the Director finds it is not feasible to plant trees within the planter island or provide the 5-foot wide perimeter landscape buffer along the north boundary. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The Director finds the applicant's proposal to plant the required trees elsewhere on the site provides an equal means of meeting the applicable UDC requirements. Further, waiving the 5- Conditions Document 3 Near Zero Office Building CZC-12-086; DES-12-057, ALT-13-004 foot buffer requirement allows the applicant to comply with the cross access requirement of the recorded plat and helps facilitate shared parking when the vacant commercial lots develop in the future consistent with the approved Gramercy Subdivision. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of the surrounding properties. Staff finds that the proposed alternative will not be detrimental to the public welfare or impair the use/character of the surrounding properties since the amount of trees required are not being diminished on the site and the proposed development will provide cross access and an opportunity for shared parking consistent with the approved Gramercy development. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before February 12, 2013, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11- SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. The buildings' architectural character consists of sand blasted tilt up concrete with horizontally banded windows with horizontal concrete reveals at walls between the windows at head and sill locations. The long, rectangular, footprint of the building is shifted at midpoint to reduce its visible mass as you move around it along both S. Wells Ave. and E. Blue Horizon Drive. The shift also creates an appropriate backdrop for the architecturally interesting, 'lantern,' entry points at north and south sides of the building. Green wall vertical landscape elements are employed at east and west ends of the building to reduce the visual bulk of the building, create architectural interest, and provide passive shading/cooling for the buildings interior. Green wall vertical landscape elements also sheath the storefront-wrapped lobby 'lantern' elements above ground level and are visible from lobby interiors. In addition, the facade is `ornamented' by photovoltaic array shading devices that are supported by gloss black painted steel frame brackets. Fenestration is human-scaled and occurs in several recurring `banded' patterns. All windows are made of clear-anodized (silver) aluminum frames with tow E glazing. All exterior mechanical equipment is rooftop-mounted and screened from view by parapets as well as an extensive rooftop-mounted photovoltaic array (please see the attached color board /character perspective for an example of building forms, patterns and colors). We are requesting Conditional Use Minor Modification approval for the main entry plaza at building midpoint on the south side. The plaza extends outward from the `lantern' entrance to the northern curb of E. Blue Horizon Drive. The reason for this request is to give the building a more civic or public pedestrian-oriented presence than is typical for suburban campus office developments. We are also requesting to reduce the length of the easterly median on E.
