Carlton Meridian, ID 83642 Re: Vienna Woods No. 3 and No. 4 Final Plats Dear City Council: We are submitting the final plats for Vienna Woods No. 3 and No. 4 for your review and comment. Phase 3 consists of 41 buildable lots and the central park area. These homes will likely be priced from $175,000 and up. Phase 4 consists of 23 lots and 2 pathways. These homes will likely be priced from $240,000 and up. Both of these final plats conform to the Ada County approved preliminary plat-that was reviewed by a previous City Councilas well as the applicable Ada County Subdivision Ordinance. The design of both the infrastructure and the plat conform to acceptable engineering, architectural and surveying practices as well as the applicable governmental standards. Please review and recommend approval to Ada County as soon as possible. We have concurrently submitted construction drawings for both phases to the City Engineer's office for review and comment. We will be working closely with both Gary Smith and Will Berg regarding the approval of, or bonding for the City improvements (sewer and water) prior recording the final plat. Insert the word "applicable" before "City Ordinances" as this project is within the County, has a R-4 County zoning designation, and is subject to the County's Ordinances as the lead agency. 1.1.2 (2.) The corrected net density calculation is 3.15. ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT FOR VIENNA WOODS NO. 3 (FP-00-027) -2 r '''~ 1.1.3 (5.) The specified improvements in the first sentence are to be installed and approved prior to "the release of the non- build agreement" since the City does not issue the building permits. 1.1.4 (6.) Perimeter fencing is to be installed prior to "release of non-build agreement," instead of issuance of City building permit. 1.1.5 (7.) Lots 4 and 5 are very large lots (both greater than 11,500 SF). While these lots do not meet the City's front lot line standards, these lots do meet the zoning standards of the County R-4 zoning. Despite agood-faith attempt during the design of the preliminary plat to comply with not only the County Codes, but also Meridian Codes, a few lots (approximately 10 out of 227) were approved with front dimensions just under 80' as part of the County's rezone and preliminary plat. 1.1.6 (9.) The rear lot line arrow for Lot 1 of Block 10 should point to the north property line, not the east property line. While this lot's southern property line doesn't strictly comply with the City's standards (it is 79 per staff's measuring technique vs. 80), it does exceed the Coutny's standard of 70' for the R- 4 zoning. The house on this lot will be better situated with the northern property line as the "rear" line with a 10' utility easement. 1.1.7 (9b.) Delete (6.) As this subdivision is within the County's lead jurisdiction. 1.1.8 (11.) In Vienna Woods, pertains to the City inspecting the sewer service line the builder installs from the street to the house. The City inspects the work within the right-of-way when the developer is installing the sewer lines and service stubs, but it is the State that inspects the service line from the stub to the house, and then the State also inspects the interior plumbing. The County does not issue the "final" approval until the State has signed-off. ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT FOR VIENNA WOODS NO. 3 (FP-00-027) -3 1.1.9 (13.) Notation: The County Engineer recently indicated that until the State Code is changed to be in compliance with last summer's Supreme Court ruling, City signature elements will be required on the plat -which is contrary to what the surveyor was told a few months ago. 1.1.10 (15.) Notation: The non-occupancy note will likely not be needed. 1.2 Fire Chief, Kenny Bowers, requires that no-parking of vehicles, equipment and/or trailers will be allowed in the cul-de-sac. All common lots will need to be kept clear of trash and weeds. 1.3 The Central District Health Department requires after written approval from the appropriate entities are submitted, they can approve this proposal for central sewage and central water; that plans must be submitted to and approved by the Idaho Department of Health and Welfare, Division of Environmental Quality for central sewage and central water; that run-off is not to create a mosquito breeding problem; and it is suggested that stormwater be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality; that engineers and architects should obtain current best management practices for stormwater disposal and design a stormwater management system that is preventing groundwater and surface water degradation. Re: Request for Final Plat for Vienna Woods Subdivision No. 3 - 4 1 Single-family Lots on 15.15 Acres by Skyline Development Company This final plat is a portion of an 80-acre development within Ada County. As part of the City's negotiations with Ada County over the Meridian Impact Area, City Council agreed to provide services to this property. The applicant has buih a lift station and approximately one mile of temporary sewer line in Locust Grove to connect to the City's sewer system near Summerfield Subdivision. The City's agreement with Ada County requires City approval of all subdivision plats with the Meridian Area of Impact. LOCATION The property is generally located on the east side of Locust Grove Road approximately one-half mile north of McMillan Road. It is designated as Single-family Residential in the Comprehensive Plan. We have reviewed this submittal and offer the following comments, as conditions of the application. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: SITE SPECIFIC REQUIREMENTS 1. Applicant is to meet all terms of the approved preliminary plat and City Ordinances. 2. Net density calculation on plat application is incorrect. Provide updated information for inclusion in file. 3. If the pressurized irrigation system within this development is to remain a private homeowners association system, complete plans and specifcations shall be reviewed by the Public Works Department as part of the development plan review process. A draft copy of the pressurized irrigation system O&M manual (updated) must be submitted prior to plan approval. The City of Meridian requires that pressurized irrigation systems be supplied by a year-round source of water. If a creek or well source is not available, asingle-point connection to the culinary water system shall be required, and the common azeas within the development will be a subject to water assessments. The design of drainage azeas shall ensure that water is retained only during major storm events for a maximum 24-hour period The park/stormwater detention azea should be designed to comply with the requirements of the City's landscape ordinance. 5. Street signs are to be in place, water system shall be approved and activated, pressurized irrigation system approved and activated, drainage lots constructed, fencing installed, and road base approved by the Ada County Highway District prior to any building permits being issued. Landscaping and pathways shall be constructed prior to obtaining certificates of occupancy. Although building permits will be issued by Ada County, these elements shall still be met as a condition of approval of the final plat. 6. Applicant shall be responsible to construct asix-foot-high, permanent perimeter fence along property boundary, except where the City has expressly agreed, in writing, that such fencing is not necessary. Said fencing shall be instaIled across the ends of the firture stub streets. Fencing is to be in place prior to applying for building permits. 7. Lots 4-5, Block 9, do not meet the minimum 80-foot frontage requirement for the City of Meridian. Staffrecommends that the plat be revised to comply. 8. By arrow, designate rear of lot for Lots 10, Block 4; Lots 6-7, 11 & 16 of Block 9, and Lot 1 & 5, Block 11; Lot 1, Block 12; and Lots 18, Block 4, this is necessary due to the dedication of easements with a note. 9. By arrow, designate rear of lot for Lot 6, Block 4 towazds the east Iine, and Lot 1, Block IO towazds the east line, this is necessary due to less than 80' minimum street frontage on the Debussy and Strauss frontages. 9. Revise or add the following notes for Vienna Woods Subdivision: (1) ...highest established ses~e~ normal groundwater elevation. (6.) Minimum square footage of houses is 1, 400 square feet, exclusive of garage. (7.) Annexation to the City of Meridian has been requested, and the City of Meridian may annex this subdivision at any time. I0. Please add "50"' dimension to the right-of--ways within this development. 11. Application for sewer and water will need to be processed through the Public Works Department for each building lot. The Plat of "VIENNA WOODS SUBDIVISION NO. 3" as evidenced in Plat bearing the "PLAT SHOWING VIENNA WOODS SUBDMSION NO. 3, A SKYLINE DEVELOPMENT COMPANY DEVELOPMENT, LOCATED IN THEN 1/2 OF THE SW 1/4 OF SECTION 29, TOWNSHIP 4 NORTH, RANGE 1 EAST, BOISE MERIDIAN, ADA COUNTY, IDAHO, 2000, HAND WRITTEN DATE OF: 12/14/00, SHEET 1 OF 3, CML SURVEY CONSULTANTS, INCORPORATED, and Skyline Development Company, Developer", is Conditionally Approved subject to those conditions of Staff comments as set forth in the Memorandum to the Mayor and City Council from Bruce Freckleton, Engineering Technician III, and Shari Stiles, Planning and Zoning Administrator, dated January 29, 2001, listing 7 General Comments and 16 Site Specific Comments, and a copy of the response letter dated February 2, 2001, from Tucker Johnson of Skyline Development Company, of which true and correct copies are attached hereto marked Exhibit "A", and consisting of six pages, and by this reference incorporated herein, with the additional requirements as follows, to-wit: 1.1 That at the City Council meeting of February 6, 2001, action by the Council approved the Applicant's response letter to include from their letter as conditions the following: Site Specific: l.l.l (1.) Insert the word "applicable" before "City Ordinances" as this project is within the County, has a R-4 County zoning designation, and is subject to the County's Ordinances as the lead agency. 1.1.2 (2.) The corrected net density calculation is 3.15. ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT FOR VIENNA WOODS NO. 3 (FP-00-027) - 2 1.1.3 (5.) The specified improvements in the first sentence are to be installed and approved prior to "the release of the non- build agreement" since the City does not issue the building permits. While this lot's southern property line doesn't strictly comply with the City's standards (it is 79 per staffs measuring technique vs. 80), it does exceed the Counny's standard of 70' for the R- 4 zoning. 3 (FP-00-027) - 3 1.1.9 (13.) Notation: The County Engineer recently indicated that until the State Code is changed to be in compliance with last summer's Supreme Court ruling, City signature elements will be required on the plat -which is contrary to what the surveyor was told a few months ago. 1.1.10 (15.) Notation: The non-occupancy note will likely not be needed. 1.2 Fire Chief, Denny Bowers, requires that no-parking of vehicles, equipment and/or trailers will be allowed in the cul-de-sac. As part of the City's negotiations with Ada County over the Meridian Impact Area, City Council agreed to provide services to this property. The applicant has built a lift station and approximately one mile of temporary sewer line in Locust Grove to connect to the City's sewer system near Summerfield Subdivision. The City's agreement with Ada County requires City approval of all subdivision plats with the Meridian Area of Impact. LOCATION The property is generally located on the east side of Locust Grove Road approximately one-half mile north of McMillan Road. It is designated asSingle-family Residential in the Comprehensive Plan. 3. If the pressurized irrigation system within this development is to remain a private homeowners association system, complete plans and specifications shall be reviewed by the Public Works Department as part of the development plan review process. A draft copy of the pressurized irrigation system O&M manual (updated) must be submitted prior to plan approval. The City of Meridian requires that pressurized irrigation systems be supplied by a yeaz-round source of water. If a creek or well source is not available, asingle-point connection to the culinary water system shall be required, and the common areas within the development will be a subject to water assessments. Vienna Woods Sub. No. 3.fp FP-00-027 Mayor and Council Januazy 29, 2001 Page 2 4. The design of drainage areas shall ensure that water is retained only during major storm events for a maximum 24-hour period. The park/stormwater detention azea should be designed to comply with the requirements of the City's landscape ordinance. 5. Street signs aze to be in place, water system shall be approved and activated, pressurized irrigation system approved and activated, drainage lots constructed, fencing installed, and road base approved by the Ada County Highway District prior to any building permits being issued. Said fencing shall be installed across the ends of the future stub streets. Fencing is to be in place prior to applying for building permits. 7. Lots 4-5, Block 9, do not meet the minimum 80-foot frontage requirement for the City of Meridian. Staffrecommends that the plat be revised to comply. By arrow, designate reaz of lot for Lots 10, Block 4; Lots 6-7, 11 & 16 of Block 9, and Lot 1 & 5, Block 11; Lot 1, Block 12; and Lots 18, Block 4, this is necessary due to the dedication of easements with a note. 9. By arrow, designate rear of lot for Lot 6, Block 4 towazds the east line, and Lot 1, Block 10 towards the east line, this is necessary due to less than 80' minimum street frontage on the Debussy and Strauss frontages. 9. Revise or add the following notes for Vienna Woods Subdivision: (1) ...highest established ~eas~l normal groundwater elevation. (6.) Minimum square footage of houses is 1, 400 square feet, exclusive of garage. (7.) Annexation to the City of Meridian has been requested, and the City of Meridian may annex this subdivision at any time. 10. Please add "50"' dimension to the right-of--ways within this development. 11. Application for sewer and water will need to be processed through the Public Works Department for each building lot. Assessment fees will be collected at that time. The~i y of -----'~' Meridian will require inspections of service line connections. 12. Please add "BASIS OF BEARING", CP&F Filing numbers, RPOB, and a bearing on the tie from the S1/16 to the RPOB. 13. Insert the word "applicable" before "city Ordinances" as this project is within the County, bas a R4 County zoning designation, and is subject to the County's Ordinances as the lead agency. 2. The corrected net density calculation is 3.15 3 . OIL 4. OK 5, The specified improvements in the first sentence are to be installed and approved prior to "the release of the non-build agreement" since the City does not issue the building permits, 6. Perimeter fencing is to be installed prior to "release of non-build agreement," instead of issuance of City building permit. 7. Lots 4 and 5 are very large lots (both greater than 11,500 SF). While these lots do not meet the City's front lot line standards, these lots do meet the zoning standards of the County R4 zoning. Despite agood-faith attempt during the design of the preliminary plat to comply with not only the County Codes, but also Meridian Codes, a few lots (approximately 10 out of 227) were approved with front dimensions just under 80' as part of the County's rezone and preliminary plat. 8.
