They wish to build a three story class "A" Office Building and request that the City of Meridian approve this request for height variance. The present use of their new Meridian property is a vacant lot zoned C -G. The C -G zone allows a building with a roof height of up to 40'. The proposed building roof height is 42' with a mansard extending to 46' and other architectural elements extending up to 55'-6". This two foot differential is the basis of our request for variance. We were asked to create a three story office building that would act as their corporate headquarters well into the next century, that would give United Heritage the image that they wished to portray and that would provide a visible presence along the interstate. With this in mind, we have designed a building that we feel meets the clients needs and also will be a fine addition the community. However, due to the structural and mechanical systems required, our design for their building requires a 42 foot roof height to contain the architectural and functional elements that were called for. • Page 1 In conclusion, we feel the hardship of not allowing our requested variance would be to both the owner and to the community as a three story office building of lesser height will not have near the visual impact and architectural elements that are present in the design before you. The Applicant seeks a variance of the following provision of the Revised and Compiled Ordinances of the Meridian City Code Section 11-9-1, Zoning Schedule of Bulk and Coverage Controls for C -G zone, which provides for a "Maximum Building Height of M 9. The characteristics of the subject property which prevent compliance with the requirements of the Ordinance are that the current zoning only allows a 40 foot maximum building height. The difficulty or hardship which would result if requirements of the Ordinance were applied to the subject property are that the current zoning for this property allows for 40 feet maximum building heights. The Applicant requests 59' 8-3/4" to the top of towers; 50' 2-3/4" to the top of mansard, and 462-1/2" to the high point of roof. 11. The difficulty or hardship which would result if requirements of the Ordinance were applied to the subject property are that due to the structural and mechanical systems required, the design of the building requires a 59' 8-3/4" to the top of towers; 50' 2-3/4" to the top of mansard, and 46' 2-1/2" to the high point of the roof to contain the architectural and functional elements and a smaller three story office building would not have near the visual impact and architectural elements. 12. A literal interpretation of the provisions of the Ordinance shall deprive the Applicant of rights commonly enjoyed by other properties in the same district under terms of the Ordinance is that the loss in the height of the top of the towers, the top of the mansard and the highest point of the roof, would not portray a good visual image of the three story class "A" office building. 13. The variance requested is for the visual impact the three story class "A" office building would have along the interstate. The variance is not profit oriented, it is due to practicality. The granting of the requested variance will not be detrimental to the public's welfare or injurious to other property in the area of the proposed plat, and, in fact, the development of the plat in accordance with the conditions of approval and the requirements of the Subdivision Ordinance will prevent the conditions which are the source of the complaints raised in the public hearing of this matter. 15. The granting of this variance will not have an effect of altering the interest and purpose of the Subdivision or Development Ordinance and or the City's Comprehensive Plan. 16. The applicant paid the fee established by the City Council for application variance. CONCLUSIONS OF LAW 1. The City of Meridian has authority pursuant to the enactment of the Local Land Use Planning Act of 1975 codified at Chapter 65, Title 67, and in particular, by the provisions of Idaho Code § 67-6516 to provide as part of its zoning ordinance for the process of applications for variance permits. 2. The City of Meridian has exercised its authority of Idaho Code § 67-6516 by the enactment as a part of its Zoning and Development Ordinance variances, as set forth in Meridian City Code §§ 11-1 S and 12-1 L 3. Application and standards for variances are set forth in Meridian City Code § 11-18-2, and the findings which are required are set forth in § 11-17-3, include required findings that there are special circumstances or conditions affecting the property that strict application of the provisions of Zoning and Development Ordinance would clearly be impracticable and unreasonable, and a finding that strict compliance with the requirements of the Zoning and Development Ordinance would result in extraordinary hardship to the owner, subdivider or developer because unusual topography, the nature or condition of adjacent development, or other physical conditions or other conditions that make strict compliance with the ordinance unreasonable under the circumstances, or that the conditions and requirements of said ordinance will result in inhibiting the achievements or the objectives of the ordinance, and that the granting of a specified variance will not be detrimental to the public's welfare or injurious to other property in the area in which the property is situated, and that such variance will not have the effect of altering the interest and purposes of the Zoning and Development Ordinance and the Meridian Comprehensive Plan. 5.
