NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the City Council of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the
hour of 7:30 p.m. on August 1, 2000, for the purpose of reviewing and considering the
application of City of Meridian for a variance of the 30-foot front yard setback required in
the L-O zone, proposing a 20-foot yard setback generally located on the west side of
Ten Mile Road approximately one-half mile north of Cherry Lane.
A more particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Street, and is available for inspection during
regular business.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing and the public is welcome and invited to
submit testimony.

A variance from the terms of this Ordinance shall not be granted by the Council unless and until a
written application for a variance is submitted to the Administrator and the Council. Provide a written
narrative containing, where applicable, the following outlined information:

Range 1 West, Boise Meridian, Ada County, Idaho; Lot 8, Block 10, of The Lakes at
Cherry Lane No. 5.

7. What is intended to be done on or with the property: City of Meridian fire substation
8. The zoning district that pertains to the subject property: L-O (Limited office)
9. Vicinity map at a scale approved by the Council showing property lines, existing streets,

external boundaries of the land being considered. This list must be obtained from the City of
Meridian Planning c& Zoning Department. Please request list seven days prior to submitting
application: See attached list of mailing addresses
12. Characteristics of subject property that prevent compliance with the requirements of this
Ordinance.• The applicant requests the 10-foot reduction to allow for an eight-foot
overhang at the front of the building. The parcel does not have adequate depth to
construct a building with the needed square footage for a substation and allow proper
clearances for vehicles at the rear of the building.

13. Minimum requirements of this Ordinance that need to be reduced to permit proposed use:
Section 11-19-1 of the Meridian City Ordinance requires a setback of 30 feet on arterial
and collector streets in the L-O zone. To accommodate the Ten Mile fire substation
design, the applicant requests a reduction in the front yard setback from 30 feet to 20
feet.
14. Difficulty or hardship which would result if requirements of this Ordinance were applied to
subject property: If the variance is not granted, the proposed fire substation design will
be compromised. Also, the aesthetics of the building design are important so that the
substation can fit in with the existing neighborhood. The only encroachment into the
30-foot setback will be the canopy for the entrance to the building.
15. Unusual or peculiar circumstances that indicate that regulations of this Ordinance should not
be strictly complied with: The fire department did not have a detailed design for the
substation when the property was acquired. The site design criteria for maneuvering of
trucks requires a greater setback at the rear of the building. No property is available at
this location to provide a larger building site. The previous landowner would like to see
a building that fits into the neighborhood, and has the appearance of a residence with a
large garage. Also, the fire substation will provide a much needed public service to the
area.
16. Statement that special conditions and circumstances exist which are peculiar to the land,
structure or buildings involved which are not applicable to other lands, structures or
buildings in the same district: This piece of land was donated to the City of Meridian for a
fire substation site. The land surrounding this properly is developed as residential The
desired structure for the substation has greater aesthetic appeal with the inclusion of the
canopy over the entrance to the facility.
17. Statement that a literal interpretation of the provisions of this Ordinance shall deprive the
applicant of rights commonly enjoyed by other properties in the same district under terms of
this Ordinance: The proposed fire substation building cannot easily be accommodated
on this site. The use proposed is not typical of structures in the L-O zone, and a site plan
had not been determined at the time the property was acquired.
18. Statement that special conditions or circumstances exist that were not a result of the
applicant's action: This piece of property is surrounded by developed properties on all
sides, and is therefore an "infill" type development. The applicant does not have any
flexibility to increase the size of the lot to meet the needs of the project.
19. Statement that granting the variance requested shall not confer on the applicant arty special
privilege that is denied by this Ordinance to other lands, structures or buildings in the same
district: The applicant does not believe this variance will confer any special privilege
that is denied to other lands, structures or buildings in the same district given the
constraints of the site.
20. Relationship of the proposed variance to the Meridian Comprehensive Plan.• The proposed
variance would allow for the construction of a fire substation in northwest Meridian.
