REV Report~~~ REVISED CERTIFICATE OF ZONING COMPLIANCE DATE: December 20, 2012 TO: Quadrant Consulting FROM: Bill Parsons, Associate City Planner SUBJECT: Kendall Ford -CZC-12-069 and DES-12-043 OWNER: Chetwood Properties, LP DESCRIPTION OF APPLICANT'S REQUEST ~E IDR IAN,:- ~J The applicant requests certificate of zoning compliance (CZC) and administrative design review (DES) approval to place a 504 square foot temporary sales office and improve the existing gravel vehicle display area that fronts on Overland Road. The site improvements include a new segment of paving and perimeter landscaping. The site is 1.80 acres in size, zoned C-G (General Retail and Service Commercial District). Per Table 11-2B-2, vehicle sales is a principally permitted use in the C-G zone subject to specific use standards. The subject property is located at 250 E. Overland Road. DECISION The applicant's request for CZC and DES is approved with the conditions listed in this report. Note: This is riot a brrildirrg permit. Please contact Building Services at (208) 887-2211 to verify if you need a building permit and/or inspection. If you need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, yore must provide these plans in PDF format and /zardcopy as specifred in the Building Services "Plan Intake Checklist': Please contact Building Services for additional details about building permits and inspections. Site Specific Conditions of Approval The site plan prepared by Quadrant Consulting, dated 12/12/12, labeled Sheet 1, is approved (stamped "approved" on 12/20/12 by the City of Meridian Planning Division) with the following comments: • The unimproved area adjacent to the back edge of the new pavement is not approved for vehicle display or vehicle parking and shall not be used as such. • The applicant shall obtain approval of the stamped civil drawings detailing the drainage of the display area from the Public Works Department. The landscape plan prepared by Jensen Belts, dated 10/08/12, labeled Sheet L.O, is approved (stamped "approved" on 10/09/12 by the City of Meridian Planning Division) with the following comment: • All existing landscaping adjacent to the construction zone must remain protected during construction on the site. • Protect any existing trees on the subject property that are greater than four-inch caliper and/or mitigate for the loss of such trees as set forth in UDC 11-3B-10. Conditions Document Kendall Ford CZC REVISED Vehicle display is prohibited in the required landscape buffers in accord with UDC 11- 3B-7C.6. 3. The site plan, landscape plan and building elevations shall not be altered without prior written approval by the City of Meridian Community Development Department. 4. The building elevations prepared by LKV Architects, attached as Exhibit D are approved (stamped "approved" on 12/20/12 by the City of Meridian Planning Department) with the following comments: • The temporary sales office may be placed on the site in conjunction with the construction of a permanent sales office building for a maximum period of 18 months from the date of issuance of the certificate of occupancy. Upon the termination of the 18 month period or the completion of the permanent structure, the temporary sales office shall be removed from the property. • The applicant must obtain CZC and DES approval from the Planning Division for the permanent sales office building. The new building must comply with design standards set forth in UDC 11-3A-19 and the guidelines contained in the Meridian Design Manual. 5. Upon installation of the landscaping and prior to inspection by the Planning Division, the applicant shall provide a written certificate of completion as set forth in UDC I 1-3B-14A. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 1 1-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. 3. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and any applicable conditions of approval associated with this site. 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site (MCU-12-006). 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant shall comply with the outdoor lighting provisions as set forth in UDC ll-3A-11. Conditions Document 2 Kendall Ford CZC REVISED 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3B. 7. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the approved vehicle sales use as set forth in UDC 11-4-3-38. CITY COUNCIL REVIEW Tlie applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before January 5, 2013, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11- SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. The current improvements are all in accordance to the City of Meridian Requirements and include an asphalt parking lot, new approaches, sidewalks, and landscaping. This new parking area will be used as an extension of the existing a car sales facility and lot located directly to the north. It is the intent of Kendall Ford to place a temporary sales office, central to the new paved parking lot, while a new permanent sales office is being designed and built. We anticipate this sales office to be removed when the new permanent sales facility is constructed or within 18 months of its placement, whichever occurs first. This temporary sales office will attempt to conform to the Architectural Character, Color & Material intent of the City of Meridian Design Manual. The fa4ade and roof line of the new sales office is linear and flat in nature which blends into the fabric of adjacent buildings and the existing Kendall Ford building immediately north. The main building face is clad in hardi-Plank siding oriented horizontally and is painted light tan. The Flat roof eyebrow, visually acts as a regulating line and defines human scale. To accomplish pattern variations, it's covered in decorative shingles and is painted a lighter tan to further complement the main building siding. The trim around windows and doors is hardi material and is panted white which unifies the earth tone browns to create a balanced color palate. In order to define the primary public entrance the door has a glass lite with adjacent site lite and is immediately recognizable as the point of access. Additionally, a deck with decorative pergola will be constructed of dimensional lumber which will add visual interest to the roof line. This new structure will include stairs and a fully accessible ADA ramp. The stairs and ramp both begin in close proximity to the main entrance. The overhead pergola acts as a visual way-finding marker for the public and architecturally defines the transitional space from the exterior to the interior. The mechanical equipment is unobtrusive and is wall mounted to the south side of the building (in lieu of roof mounted) and will be painted to match the main building color. A photograph of the existing temporary structure has been attached to address the color and material requirement on the Design review application checklist.
