TEC-12-011 ORDER OF CONDITIONAL APPROVAL OF TIME EXTENSION BY: SAWTOOTH LAND SURVEYING APPLICANT This matter coming on regularly before the City Council on December 18, 2012, upon the Applicant's submittal of a preliminary plat time extension application for a two (2) year extension within which to obtain the City Engineer's signature on the fourth phase of the final plat for Larkspur South Subdivision, which the preliminary plat was originally approved on January 9, 2007, as provided in Unified Development Code § 11-6B-7C, and good cause shown. An administrative time extension (TE-08-025) for eighteen (18) months was approved for this subdivision by the Planning Director and would have otherwise expired on December 6, 2010. The first phase of a final plat for the Larkspur South Subdivision was approved by City Council on September 7, 2010 and received City Engineer's signature on November 19, 2010. The ORDER OF CONDITIONAL APPROVAL OF TIME EXTENSION FOR LARKSPUR SOUTH SUBDIVISION TEC-12-Oll Page 1 of 2 subject plat would have otherwise expired on November 19, 2012 without the subject time extension. STAFF RECOMMENDATION Staff recommends approval of a two (2) year time extension to obtain the City Engineer's signature on the fourth phase of the Larkspur South Subdivision as requested by the applicant, to expire November 19, 2014, with the conditions included in Exhibit B. III. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The subject property is located west of S. Meridian Road and north of E. Victory Road in the SW '/4 of Section 19, T.3N., R.lE. B. UNIFIED DEVELOPMENT CODE Per UDC 11-6B-7A, approval of a preliminary plat shall become null and void if the applicant fails to obtain the City Engineer's signature on the final plat within two years of the approval of the preliminary plat. Per UDC 11-6B-7C, upon written request and filing by the applicant prior to the termination of the allowed time period, the Director may authorize a single extension of time to obtain the City Engineer's signature on the final plat not to exceed two (2) years. Additional time extensions up to two (2) years as determined and approved by City Council may be granted. With all extensions, the Director or City Council may require the plat to comply with current provisions of the UDC. VI. PROCESS FACTS A. The subject application is for a time extension. A public hearing is required before the City Council on this matter, consistent with Meridian City Code Title 11, Chapter 5. B. Newspaper notifications published on: November 26, and December 10, 2012 C. Radius notices mailed to properties within 300 feet on: November 26, 2012 D. Applicant posted notice on site by: December 8, 2012 VII. HISTORY OF PREVIOUS ACTIONS • The Annexation (AZ-06-049) and preliminary plat (PP-06-051) for the Larkspur South Subdivision was approved by the Meridian City Council on January 9, 2007. The preliminary plat consists of 67 residential lots and 4 common lots on 12.81 acres. • An 18-month time extension (TE-08-025) to obtain the City Engineer's signature on the final plat was approved by the Director on November 6, 2008. • The City Council approved the final plat (FP-10-006) for the first phase on September 7, 2010 and the City Engineer signed the plat on November 19, 2010. The subject plat consists of 22 residential lots and 1 common lot on 3.79 acres. • Subsequent final plats (FP-12-014 and FP-12-015) were approved by City Council on August 21, 2012. The fourth phase consists of 28 residential lots and 2 common lots on 6.71 acres and the fifth phase 8 residential lots and 2 common lots on 2.36 acres. These plats have not received City Engineer's signature. VIII. STAFF ANALYSIS This is the second time extension requested by the applicant. The applicant has met the necessary deadline by filing a written request for a time extension before the preliminary plat expired. The proposed request extends the preliminary plat and the remaining two phases. Currently, the fourth phase is under construction. Per UDC 11-6B-7C, the City Council may require the preliminary plat to comply with the current provisions of the UDC. Since project is adequately conditioned and the remaining phases have been approved by Council, staff is not recommending any new conditions of approval.
