signed sheet No.2 in the appropriate space after checking the plat sheets to see that
they conform to this department's previous review.
The following is a status of subdivision improvements, as I know them:
1. Streets: Complete with pavement, curb, gutter and sidewalk
2. Sewer and Water. Complete.
3. Streetlights: Complete, installation.
4. Permanent Fencing: The non-combustible fence along the east boundary is
complete. The fencing along Victory Road is 90% complete.
5. Landscaping: The landscaping along Victory Road is 90% complete.
Also attached is a copy of a memo sent to me by Becky, with the plat that addresses
my questions about the Development Agn~ment and the completion of the fencing
and landscaping along Victory Road. The developer has agreed to pay the sewer and
water assessment fees for the e~asting house on Lot 22, Block 7 as required in the
conditions of the development agreement.
I have transmitted these plat mylars and this transmittal to Shari for her review so she
may have some additional comments for you when she sends everything to your office.

3. Two development agreements apply to this phase of Sherbrooke No. 3. The original
development agreement Instrument #98072921 and the Sherbrooke Village Agreement. The
Village Agreement has been drafted by the City legal staff and a copy is attached. The owner
of record referenced in the document is in error. I have faxed current deeds to Marlene at Bill
Gigray's office and requested a revision. The second Development Agreement will be signed
this week and submitted to Will Berg.
4. Final Plat revised accordingly.
A copy of the original recorded Development Agreement is attached for your records. The partial
release of the original Development Agreement pertained only to Section 12 and 13, which
referenced the City as lien holder of the project. After completion and acceptance of Sherbrooke
No. 1, the City released its lien referenced in the agreement.
Tim Taylor of Westpark Company will pay the sewer and water assessment fees for Lot 22, Block 7.
Mr. Taylor will provide you with a copy of his receipt.
A small portion (approximately 10%) of the Victory Road frontage landscaping has not been
installed. The residents of the house on Lot 22 Block 7, who have a contract to purchase the lot and
home after recording of the plat, have disputed the location of sidewalk along their Victory Road
frontage. We have been negotiating with the future home owner and have come to an agreement
acceptable to Ada County Highway District. Some trees along their frontage will be relocated and
we have agreed to wait until fall to do the relocation because this improves the chances of the trees
survival. The area left unimproved on the east side of Lot 22, Block 7 could not be developed until
Lot 22, Block 7 sidewalk and landscaping is installed. The sidewalk is bonded with ACHD. We will
bond for 10% of the landscaping in the amount of $2,000.00 with Will's office. (See attached bid).

account of GEM PARK II PARTNERSHIP up to the aggregate amount of $34,984.40
available by your drafts drawn at sight on us presented at WASHINGTON FEDERAL
SAVINGS, Main Office, 1001 W. Idaho Street, Boise, Idaho 83701.
Drafts must be accompanied by Beneficiary's signed statement that the
developer has failed to perform or is in default of completion of the
fencing, landscaping, street lights, and pressure irrigation in SHERBROOKE
HOLLOWS SUBDIVISION N0. 3.
Drafts drawn under this credit must bear the following clause: Drawn under
Washington Federal Savings Letter of Credit Number 1999-31 dated July 27,
1999. The amount of each draft must be endorsed hereon.
Partial drawings are permitted.
We hereby engage with the drawer, endorsers, and holders in due course of
drafts drawn under and in compliance with the terms of this credit, that such
drafts will be duly honored upon presentation to the drawee bank.
This Letter of Credit expires July 27, 2000.
