It has come to our attention through a Mr. Tom Chalberg, representing the owners of the
parcel to the north of the above-referenced site, that Rite Aid is unwilling to cooperate in
bringing the site up to City of Meridian standazds. The adjacent property owner is
willing to pay their shaze to bring the parking lot and landscaping into compliance. East
First Street is designated as an entryway corridor in the City of Meridian, and visual
aesthetics aze very important. Other areas of violation for this parcel include pedestrian
walkways, signage and provision of trash enclosures.
Please be informed that, due to the above issues, a certificate of zoning compliance
cannot be issued for the property. Therefore, no building permits of any kind may be
issued unless the site is brought up to current standards. We would like to work with you
to assist you in meeting our mutual goals. If you have any questions, please do not

I am writing to inform you that the City of Meridian has received several complaints regarding the large
Salvation Army donation trailer that is often located in the center of the parking lot in front of your store
located at 1626 E. First Street.
The nature of the complaints are tied directly to the location of the trailer. The placement of the trailer in
the middle of the shopping center parking lot has created a safety hazard, placed a limitation on the parking
spaces available within the lot, and can be somewhat unsightly when donations pile up on the outside of the
trailer.
In addition to the complaints that we have received, there are a number of ordinances within the City Code
that prohibit the donation trailer from being placed within the interior of the parking lot. Section 11-13-5 of
the Meridian City Code (MCC) requires that retail stores provide at least 1 parking space for each 200
square feet of gross floor space. If we add the square footage of just the Rite Aid Drug Store (40,700sq. ft.),
Salvation Army Store (12,480 sq. ft.), and the 10,000 square foot stnip/retail building located on the south
side of the shopping center we can determine that the shopping center requires at least 315+ parking stalls.
Unfortunately, there are only 170+/- parking stasis provided for the entire shopping center. The placement
of the donation trailer in the center of the parking lot eliminates a number of parking spaces that need to be
available for patron parking.
The shopping center is located in the C-C zone (Community Business District). Section 11-8-1 of the MCC
prohibits outside storage uses from being located within the C-C zone. The collection and storage of
donations in a trailer is "outside storage", and is thereby a prohibited use of the property.
Furthermore, at a public hearing held on behalf of the Salvation Army, prior to the opening of the subject
thrift store, the Planning and Zoning Director stated to the Planning and Zoning Commission that "They
(the Salvation Army) have agreed that there will be no drop off site. They've agreed that that is not a good
location to have a drop off site, so if people are going to donate goods, they will have to be there during
operating hours and bring it into the store." (July 13, 1999).
The City recognizes the need for donations in order to operate your facility, and we would not object to the
placement of the trailer behind the building, as long as all donations are placed promptly within the trailer
when received and all donations that are received during non-operational hours be placed within the
building prior to opening the store each day.

Steve Slater, Special Envoy for Salvation Army, has been the primary contact for the new occupancy of
this location. He was told by the Building Department that, since this building had a previous tenant, he
was not required to obtain a Certificate of Occupancy or obtain inspections from their department.
However, he was required by the Fire Department to install sprinkler and alarms, which he did last
month. Also, P&Z required the parking in front of the building to comply with current code and that he
install and maintain landscaped beds (barrells). I inspected this today and the site is in compliance.

As we have discussed by telephone, Rite Aid Corporation does not approve any changes to the common
area for the purpose of adding landscaping, for the following reasons'
• Parking is already very tight, with the l 70 full-size spaces we have currently. Parking will be
impacted negatively under the new landscaping plan, as 36 (or 21%) of the proposed 17] spaces will
be compact spaces.
• The Reciprocal Easement and Restriction Agreement dated February 2, 1990, between the shopping
center parties states that no changes can be made to the shopping center without the prior written
consent of all owners in the shopping center. Rite Aid does not consent to these modifications.
Tom, we are willing to review a proposal for 1tA to consider participating in the parking lot repairs to the
overall shopping Center_ Such proposal should be presented to Bernie Reth and should include the overall
cost, Rite Aid's pro rata share at 64%, and a detailed contractor's bid for the work.

Re: Request for Conditional Use Permit to Operate Thrift Store and Provide Clothing and
Household Goods to Needy Families by the Salvation Army
After discussions with The Salvation Army and information provided regarding their operations, it
is the decision of the Planning & Zoning Administrator that the use is a conforming use as a retail
store and that their use will fall in compliance with City Ordinances. The Salvation Army has
agreed to work with the owner of the property and the City to ensure the building and property is
brought into compliance with landscaping and building code requirements. A letter of credit or
cash will be delivered to the City for needed improvements prior to temporary occupancy being
given. The Salvation Army will be reimbursed for the cost of the application.
Assessments for sewer and water service will be reviewed to see if additional load would
justify an adjustment. Applicant will be required to enter into an Assessment Agreement
with the City of Meridian.
2. Handicap parking, associated signage and building construction shall meet the
requirements of the Americans with Disabilities Act.
3. All signage will be subject to design review and requires sepazate permits.
4. A minimum of one (1) three-inch (3") caliper tree per 1,500 squaze feet of asphalt on the
pazcel will be provided.
5. All trash areas aze to be enclosed by a screening fence.
