Idaho St. Meridian, Idaho 83642 RE: PINTAIL POINTE SUBDIVISION Dear P & Z members, Attached is the package for a preliminary plat, annexation, and rezone submittal package for a 3.68 -acre parcel of land located on the south side of Cherry Lane, opposite Golf View Estates. The owner/developer is Jeff Manship who currently lives on the site. The parcel is somewhat narrow and lends itself to development of lots that can accommodate side -load garages (more than ''/z). We have provided a stub street to the south boundary of this development and propose taking access from Cherry Lane by way of English Gardens Subdivision, said subdivision abutting the west boundary line of Pintail Pointe. We will be tying into the proposed sanitary sewer, water, and hopefully, pressurized irrigation system being constructed in the first phase of English Gardens. A 20' wide landscaped area will be constructed abutting the right-of-way of Cherry Lane, with the underlying lot owner responsible for maintenance. The following statements can be made regarding this project: streets will be constructed to the standards as required by the ACHD and Meridian Ordinance and the traffic impact on existing, adjacent roadways and intersections will be no more than that normally generated when a new development is constructed. The proposed use is in conformance with the City of Meridian Comprehensive Plan. The development will connect to City services. The development will comply with City Ordinances. Street names will not conflict with the City grid system. With regards to easements: a 10' public utilities and street light easement along lines common to a public road. A 10' irrigation easement along the subdivision boundary. A 5' drainage easement adjacent to common lot lines. A variance will not be requested for this development. USES PERMITTED BY THIS AGREEMENT: 4.1 The uses and development allowed pursuant to this Agreement of the subject property shall be subject to and pursuant to those uses allowed under "City"'s Zoning Ordinance R-4 Low Density Residential District codified at Section 11-7-2 C. Meridian City Code which are herein specified as follows: (R-4) Low Density Residential District• Only single- family dwellings shall be permitted and no conditional uses shall be permitted except for Planned Residential Development and public schools. The purpose of the (R- 4) District is to permit the establishment of low density single-family dwellings, and to delineate those areas where predominately residential development has, or is likely to occur in accord with the Comprehensive Plan of the City, and to protect the integrity of residential areas by prohibiting the intrusion of incompatible non-residential uses. The (R-4) District allows for a maximum of four (4) dwelling units per acre and requires connection to the Municipal Water and Sewer systems of the City of Meridian. To develop a single family residential development. 4.2 No change in the uses specified in this Agreement shall be allowed without modification of this Agreement. 5. CONDITIONS GOVERNING DEVELOPMENT OF SUBJECT PROPERTY: 5.A "Owner/Developer" shall develop the "Property" in accordance with the following special conditions: DEVELOPMENT AGREEMENT - (Jeff Manship/Pintail Point Sub AZ -00-003) - Page 4 of 15 5.1 Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. No variances have been requested for tiling of any ditches crossing this project. 5.2 Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance. Wells may be used for non- domestic purposes such as landscape irrigation. 5.3 Subdivision identification signage shall be in accordance with the standards set forth in the City of Meridian Zoning and Development Ordinance. No temporary signage, flags, banners or flashing signs will be permitted. 5.4 Provide five -foot -wide sidewalks in accordance with City Ordinance. 5.5 A minimum 20 -foot landscape buffer is required along the north property boundary of site and shall be a condition attached to this property in the Development Agreement. 5.6 Applicant shall be required to dedicate all right-of-way along Cherry Lane as required by ACHD prior to the issuance of any building permits. 5.7 The Applicant's central sewage and central water plans must be 5submitted to and approved by the Idaho Department of Health & Welfare, Division of Environmental Quality. 5.8 Run-off is not to create a mosquito breeding problem. REQUIREMENT FOR RECORDATION: "City" shall record either a memorandum of this Agreement or this Agreement, including all of the Exhibits, at "Owner/Developer"'s cost, and submit proof of such recording to "Owner/Developer", prior to the third reading of the Meridian Zoning Ordinance in connection with the annexation and zoning of the "Property" by the City Council. If for any reason after such recordation, the City Council fails to adopt the ordinance in connection with the annexation and zoning of the "Property" contemplated hereby, the "City" shall execute and record an appropriate instrument of release of this Agreement. 11. ZONING: "City" shall, following recordation of the duly approved Agreement, enact a valid and binding ordinance zoning the "Property" as specified herein. 12. REMEDIES: This Agreement shall be enforceable in any court of competent jurisdiction by either "City" or "Owner/Developer", or by any successor or successors in title or by the assigns of the parties hereto. Enforcement may be sought by an appropriate action at law or in equity to secure the specific performance of the covenants, agreements, conditions, and obligations contained herein. 12.1 In the event of a material breach of this Agreement, the parties agree that "City" and "Owner/Developer" shall have thirty (30) days after delivery of notice of said breach to correct the same prior to the non -breaching party's seeking of any remedy provided for herein; provided, however, that in the case of any such default which cannot with diligence be cured within such thirty (30) day period, if the defaulting party shall commence to cure the same within such thirty (30) day period and thereafter shall prosecute the curing of same with diligence and continuity, then the time allowed to cure such failure may be extended for such period as may be necessary to complete the curing of the same with diligence and continuity. 12.2 In the event the performance of any covenant to be performed hereunder by either "Owner/Developer" or "City" is delayed for causes which are beyond the DEVELOPMENT AGREEMENT - (Jeff Manship/Pintail Point Sub AZ -00-003) - Page 8 of 15 rte. reasonable control of the party responsible for such performance, which shall include, without limitation, acts of civil disobedience, strikes or similar causes, the time for such performance shall be extended by the amount of time of such delay. 13. SURETY OF PERFORMANCE: The "City" may also require surety bonds, irrevocable letters of credit, cash deposits, certified check or negotiable bonds, as allowed under §12-5-3 of the Meridian City Code, to insure that installation of the improvements, which the "Owner/Developer" agrees to provide, if required by the "City". 14. CERTIFICATE OF OCCUPANCY: The "Owner/Developer" agrees that no Certificates of Occupancy will be issued until all improvements are completed, unless the "City" and "Owner/Developer" have entered into an addendum agreement stating when the improvements will be completed in a phased developed; and in any event, no Certificates of Occupancy shall be issued in any phase in which the improvements have not been installed, completed, and accepted by the "City". 15. ABIDE BY ALL CITY ORDINANCES: That "Owner/Developer" agrees to abide by all ordinances of the City of Meridian and the "Property" shall be subject to de -annexation if the owner or his assigns, heirs, or successors shall not meet the conditions contained in the Findings of Fact and Conclusions of Law, this Development Agreement, and the Ordinances of the City of Meridian. 16. NOTICES: Any notice desired by the parties and/or required by this Agreement shall be deemed delivered if and when personally delivered or three (3) days after deposit in the United States Mail, registered or certified mail, postage prepaid, return receipt requested, addressed as follows: CITY: C/o City Engineer City of Meridian 33 E. Idaho Ave. Meridian, ID 83642 16.1 A party shall have the right to change its address by delivering to the other party a written notification thereof in accordance with the requirements of this section. 17. ATTORNEY FEES: Should any litigation be commenced between the parties hereto concerning this Agreement, the prevailing party shall be entitled, in addition to any other relief as may be granted, to court costs and reasonable attorney's fees as determined by a Court of competent jurisdiction. This provision shall be deemed to be a separate contract between the parties and shall survive any default, termination or forfeiture of this Agreement. 18. TIME IS OF THE ESSENCE: The parties hereto acknowledge and agree that time is strictly of the essence with respect to each and every term, condition and provision hereof, and that the failure to timely perform any of the obligations hereunder shall constitute a breach of and a default under this Agreement by the other party so failing to perform. 19. BINDING UPON SUCCESSORS: This Agreement shall be binding upon and inure to the benefit of the parties' respective heirs, successors, assigns and personal representatives, including "City"'s corporate authorities and their successors in office. This Agreement shall be binding on the owner of the "Property", each subsequent owner and any other person acquiring an interest in the "Property". Nothing herein shall in any way prevent sale or alienation of the "Property", or portions thereof, except that any sale or alienation shall be subject to the provisions hereof and any successor owner or owners shall be both benefitted and bound by the conditions and restrictions herein expressed. "City" agrees, upon tivritten request of "Owner/Developer", to execute appropriate and recordable evidence of termination of this Agreement if "City", in its sole and reasonable DEVELOPMENT AGREEMENT - (Jeff Manship/Pintail Point Sub AZ -00-003) - Page 10 of 15 discretion, had determined that "Owner/Developer" has fully performed its obligations under this Agreement. 20. INVALID PROVISION: If any provision of this Agreement is held not valid by a court of competent jurisdiction, such provision shall be deemed to be excised from this Agreement and the invalidity thereof shall not affect any of the other provisions contained herein. 21. FINAL AGREEMENT: This Agreement sets forth all promises, inducements, agreements, condition and understandings between "Owner/Developer" and "City" relative to the subject matter hereof, and there are no promises, agreements, conditions or understanding, either oral or written, express or implied, between "Owner/Developer" and "City", other than as are stated herein. Except as herein otherwise provided, no subsequent alteration, amendment, change or addition to this Agreement shall be binding upon the parties hereto unless reduced to writing and signed by them or their successors in interest or their assigns, and pursuant, with respect to "City", to a duly adopted ordinance or resolution of "City". 21.1 No condition governing the uses and/or conditions governing development of the subject "Property" herein provided for can be modified or amended without the approval of the City Council after the "City" has conducted public hearing(s) in accordance with the notice provisions provided for a zoning designation and/or amendment in force at the time of the proposed amendment. 22. EFFECTIVE DATE OF AGREEMENT: This Agreement shall be effective on the date the Meridian City Council shall adopt the amendment to the Meridian Zoning Ordinance in connection with the annexation and zoning of the "Property" and execution of the Mayor and City Cleric. The City Council takes judicial notice of its zoning, subdivisions and development ordinances codified at Titles 11 and 12, Meridian City Code, and all current zoning maps thereof, and the Comprehensive Plan of the City of Meridian adopted December 21, 1993, Ordinance No. 629, January 4,1994, and maps and the ordinance Establishing the Impact Area Boundary. 4. The property which is the subject to the application for annexation and zoning is described in the application, and by this reference is incorporated herein as if set forth in full. The property is approximately 3.68 acres in size and is located on the south side of Cherry Lane east of Black Cat Road. The property is designated as Pintail Pointe Subdivision. 5. The owner of record of the subject property is the Jeff Manship, of 4375 W. Cherry Lane, Meridian, Idaho. 6. Applicant is the owner of record. 7. The property is presently zoned by Ada County as R1, and consists of rural residential. 8. The Applicant requests the property be zoned as Low Density Residential (R-4). 9. The subject property is bordered to the north by residential development and city limits of the City of Meridian are adjacent and abut to the north and west of the subject property. The Applicant requests zoning of the subject real property as Low Density Residential (R-4) which is consistent with the Meridian Comprehensive Plan Generalized Land Use Map which designates the subject property as Existing Urban. 14. There are no significant or scenic features of major importance that affect the consideration of this application. 15. Additional conditions: 15.12 Pintail Pointe shall participate in the cost of construction of the lift station and pressure sewer line to be built and located within the English Gardens Subdivision. 15.13 Pintail Pointe shall participate in and utilize the pressure irrigation system proposed for English Gardens. 15.14 Pintail Pointe shall be a part of the Homeowners Association for English Gardens, and shall be subject to the same CCR's as English Gardens. 15.15 Pintail Pointe shall create a landscaped lot adjacent to the proposed landscape lot abutting Cherry Lane, -vhich shall be a part of the common ground deeded to the Homeowners Association. 16. It is found that if the developer pays for the requested improvements and complies with the conditions set forth in these Findings of Fact No. 15, and all sub -parts, the economic welfare of the City and its residents and tax and rate payers will be protected, which requirement shall be included in a development agreement, a condition of annexation and zoning designation. 17. It is also found that the development considerations as referenced in Finding No. 15 are reasonable to require and must be taken into account, in order to assure the proposed development is designed, constructed, operated and maintained in a manner which is harmonious and appropriate in appearance with the existing, or intended character of the general vicinity, in order to assure that the proposed use FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 6 AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY JEFF MA.NSHIP (AZ -00-003) will not change the essential character of the affected vicinity and will insure that the proposed uses will not be hazardous or disturbing to the existing, or future neighboring uses, particularly considering the impact of proposed development on potential to produce excessive traffic, noise, smoke, fumes, glare and odors. 18. It is found that the zoning of the subject real property as (R-4) Low Density Residential District allows only single-family dwellings with a maximum of four (4) dwelling units per acre and requires connection to the Municipal Water and Sewer systems and will be compatible with the Applicant's development intentions, and will assure that the zoning is consistent with the Meridian Comprehensive Plan Generalized Land Use Map which designates the subject property as Low Density Single Family and Rural Residential Housing. 19. The subject annexation request and zoning designation and proposed development relates and is compatible to the goals and policies of the Comprehensive Plan of the City as follows: 19.1 The consideration of the provisions of the Comprehensive plan and the requirements of the Zoning ordinance assure that the processing of such application is the management of growth with the aim to achieve high- quality development. Enhancement of Meridian's quality of life for all residents is achieved by applying the criteria of the Comprehensive plan and the Zoning ordinances of the City to all applications such as the subject application. 19.2 This proposed new growth development will finance public service expansion by the requirement herein that the applicant comply with the requests submitted of the political subdivisions responses within the Meridian Urban Service Planning Area submitted in the record of this FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 7 AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY JEFF MANSHIP (AZ -00-003) matter. 19.3 The application is consistent with Meridian's self identity. 19.4 The preservation and improvement of the character and quality of Meridian's man-made environment while maintaining its identity as a self-sufficient community is achieved by applying the criteria of the Comprehensive plan and the Zoning ordinances of the City to the subject application. 19.5 Compliance with the requests of the political subdivisions providing services, assures that community services are being provided for existing and projected needs and that the land use patterns of the City are balanced to insure that revenues pay for services and that the Urban Service Planning Area is visually attractive, efficiently managed and clearly identifiable. 19.6 Compatible and efficient use of land through innovative and functional site design is achieved by applying the criteria of the Comprehensive plan and the Zoning ordinances of the City to the subject application. 20. The property can be physically serviced with City water and sewer, if applicant extends the lines. CONCLUSIONS OF LAW 1. The City of Meridian has authority to annex real property upon written request for annexation and the real property being contiguous or adjacent to city boundaries and that said property lies within the area of city impact as provided by Idaho Code Section 50-222. The Meridian City Code § 11-16 provides the City may annex real property that is within the Meridian Urban Service Planning Area as set forth in the City's Comprehensive Plan. 2. The Council may take judicial notice of government ordinances, and FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 8 AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY JEFF MANSHIP (AZ -00-003) policies, and of actual conditions existing within the City and State. 3. The City of Meridian has exercised its authority and responsibility as provided by "Local Land Use Planning Act of 1975', codified at Chapter 65, Title 67, Idaho Code by the adoption of `Comprehensive Plan City of Meridian adopted December 21, 1993, Ord. No. 629, January 4, 1994. 4. The following are found to be pertinent provisions of the City of Meridian Comprehensive Plan and are applicable to this Application: 4.A The Goals of the Comprehensive Plan are set forth at Page 5 and include: 4.1 To preserve Meridian's environmental quality and to make provisions for and improve the total natural environment by adopting City-wide and Urban Service Planning Area policies, which deal with area -specific policies and programs. 4.2 To ensure that growth and development occur in an orderly fashion in accordance with adopted policies and procedures governing the use of land, residential development the provision of services and the distribution of new housing units within the Urban Service Planning Area. 4.3 To encourage the kind of economic growth and development which supplies employment and economic self-sufficiency for existing and future residents, reduces the present reliance on Boise and strengthens the City's ability to finance and implement public improvements, services and its open space character. 4.4 To provide housing opportunities for all economic groups within the community. FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 9 AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY JEFF MANSHIP (AZ -00-003) 4.5 To preserve and improve the character and quality of Meridian's man-made environment while maintaining its identity as a self-sufficient community. 4.6 To encourage cultural educational and recreational facilities which will fill the needs and preferences of the citizens of Meridian and to insure that these facilities are available to all residents of the City. 4.7 To provide community services to fit existing and projected needs. 4.8 To establish compatible and efficient use of land through the use of innovative and functional site design. 4.9 To encourage a balance of land use patterns to insure that revenues pay for services. 4.10 To create an Urban Service Planning Area which is visually attractive, efficiently managed and clearly identifiable. 4.B Comprehensive Plan Policies: The subject property is located in an area designated as Existing Urban in the Meridian Comprehensive Plan. It is within the Meridian Urban Service Planning Area. The current Plan does not contain goals or policies specific to the Existing Urban land use designation. The requested zoning of Low Density Residential District, (R-4) is defined in the Zoning Ordinance at 11-7-2 C as follows: (R-4) Low Density Residential District: Only single-family dwellings shall be permitted and no conditional uses shall be permitted except for planned residential development and public schools. The purpose of the R-4 District is to permit the establishment of low density single-family dwellings, and to delineate those areas where predominantly residential development has, or is likely to occur in accord with the Comprehensive Plan of the City, and to protect the integrity of residential areas by prohibiting the intrusion of incompatible nonresidential uses. The R-4 District allows for a maximum of four (4) dwelling units per acre and requires connection to the Municipal water and sewer systems of the City. 6. By authority of the City of Meridian under the Comprehensive Plan, a conditional use permit is not required for Applicant to construct and develop single- family dwelling units on this parcel of land. 7. Since the annexation and zoning of land is a legislative function, the City has authority to place conditions upon the annexation of land. See Burt vs. The City of Idaho Falls, 105 Idaho 65, 665 P2d 1075 (1983). 8. The development of the annexed land, if annexed, shall meet and comply with the Ordinances of the City of Meridian including, but not limited to: FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 1 I AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY JEFF MANSHIP (AZ -00-003) Section 12-2-4 which pertains to development time schedules and requirements; Section 12-4-13, which pertains to the piping of ditches; and Section 12-5-2 N, which pertains to pressurized irrigation systems. 9. The development of the property shall be subject to and controlled by the Zoning and Subdivision and Development Ordinance of the City of Meridian. 10. Section 11-16-4 A of the Zoning and Development Ordinance provides in part as follows: If property is annexed and zoned, the City may require or permit, as a condition of the zoning, that an owner or developer make a written commitment concerning the use or development of the subject property. If a commitment is required or permitted, it shall be recorded in the office of the Ada County Recorder and shall take effect upon the adoption of the ordinance annexing and zoning the property, or prior if agreed to by the owner of the parcel. Unless the commitment is modified or terminated by the City Council, the commitment shall be binding on the owner of the parcel, each subsequent owner, and each other person acquiring an interest in the property. A commitment is binding on the owner of the property even if it is unrecorded; however, an unrecorded commitment is binding on subsequent owners and each other person acquiring an interest in the property only if the subsequent owner and each other person acquiring an interest in the property has actual notice of the commitment. DECISION AND ORDER NOW, THEREFORE, BASED UPON THE ABOVE AND FOREGOING FINDINGS OF FACT AND CONCLUSIONS OF LAW, the City Council does hereby Order and this does Order: The applicant's request for annexation and zoning of approximately 3.68 acres to Low Density Residential District (R-4) is granted subject to the terms FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 12 AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY JEFF MANSHIP (AZ -00-003) and conditions of this Order hereinafter stated. 2. The application is for annexation and zoning of 3.68 acres. The legal description shall be prepared by a Registered Land Surveyor, Licensed by the State of Idaho, and shall conform to all the provisions of the City of Meridian Resolution No. 158. The legal description for annexation must place this parcel contiguous to the Corporate City Limits per Ordinance No. 686. 3. That the annexation and zoning of the subject property is subject to the following conditions which shall govern Administrative Staff review and approval of development permits required for the development of this property, as follows: 3.1 Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. No variances have been requested for tiling of any ditches crossing this project. 3.2 Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance. Wells may be used for non-domestic purposes such as landscape irrigation. 3.3 Subdivision identification signage shall be in accordance with the standards set forth in the City of Meridian Zoning and Development Ordinance. No temporary signage, flags, banners or flashing signs will be permitted. 3.4 Provide five -foot -wide sidewalks in accordance with City Ordinance. 3.5 A minimum 20 -foot landscape buffer is required along the north property boundary of site and shall be a condition attached to this FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 13 AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY JEFF MANSHIP (AZ -00-003) property in the Development Agreement. 3.6 Applicant shall be required to dedicate all right-of-way along Cherry Lane as required by ACHD prior to the issuance of any building permits. 3.7 A Development Agreement will be required as a condition of annexation. 3.8 The Applicant's central sewage and central water plans must be 5submitted to and approved by the Idaho Department of Health Welfare, Division of Environmental Quality. 3.9 Run-off is not to create a mosquito breeding problem. 3.10 Stormwater shall be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality. 3.11 The Engineers and architects involved with the design of the subject project shall obtain current best management practices for stormwater disposal and design a stormwater management system that prevents groundwater and surface water degradation. 3.12 Pintail Pointe shall participate in the cost of construction of the lift station and pressure sewer line to be built and located within the English Gardens Subdivision. 3.13 Pintail Pointe shall participate in and utilize the pressure irrigation system proposed for English Gardens. 3.14 Pintail Pointe shall be a part of the Homeowners Association for English Gardens, and shall be subject to the same CCR's as English Gardens. 3.15 Pintail Pointe shall create a landscaped lot adjacent to the proposed landscape lot abutting Cherry Lane, which shall be a part of the common ground deeded to the Homeowners Association. 4. On May 5, 1999, the Commission reviewed and approved Cherry Lane Estates, a 3 -lot residential subdivision on this 3.68 -acre site. The applicant has submitted a different preliminary plat for the site with an incresed number of lots. This report reflects the revised requirements. The applicant should construct an ACRD approved turnaround at the northern terminus of Manship Place. Coordinate the design of the turnaround with District staff. The applicant is not proposing to take any access to Cherry Lane, and is proposing to take access off internal streets only. Standard Requirements: PINTAIL.DOC Page 3 A request for modification, variance or waiver of any requirement or policy outlined herein shall be made in writing to the ACHD Planning and Development Supervisor. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship or inequity. The written request shall be submitted to the District no later than 9.00 a m on the day scheduled for ACHD Commission action. Those items shall be rescheduled for discussion with the Commission on the next available meeting agenda. Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action do not provide sufficient time for District staff to remove the item from the consent agenda and report to the Commission regarding the requested modification, variance or waiver. Those items will be acted on by the Commission unless removed from the agenda by the Commission. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within six days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall s ep cifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of its original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #188, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. 5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. Existing utilities damaged by the applicant shall be repaired by the applicant at no cost to ACHD. The applicant shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking ground within ACHD right-of-way. The applicant shall contact ACRD Traffic Operations 387-6190 in the event any ACHD conduits (spare or filled) are compromised during any phase of construction. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized PINTAIL.DOC Page 4 representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. 9. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. We have come to the fallowing mutual considerations regarding the two subdivisions. 1. Pintail Pointe will participate in the cost of construction of the lift station and pressure sewer line. 2. Pintail Pointe will participate in and utilize the pressure irrigation system proposed for English Gardens. 3. Pintail Pointe will be a part of the Homeowners Association for English ('Gardens, and will be subject to the same CCRs as English Gardens. 4. Pintail Pointe will create a landscaped lot adjacent to the proposed landscape lot abutting Cherry Trane, which will be part of the common ground deeded to the Homeowners Association. Since we have R-8 to the north, to the south and to the west, it does fit the plan and motive of our Comprehensive Plan and the planning here regardless of whether the south has 1 acre lots or regardless whether the south is county or city. Siddoway: Yes I do. First of all I'd like to ask number 9 on the agenda is the preliminary plat. The difference between this and the other is this annexation and zoning does have preliminary plat with it tonight. Would you like me to restrict my comments just to the annexation and zoning at this point or do you want me to cover the plat as well? Borup: Just cover both. Meridian Planning ai , Zoning Commission January 12, 2000 Page 33 Siddoway: Okay. The lot is 3.68 acres. It is currently zoned R-3 in the county. They are requesting to annex to the city and zone it R-4. They also have a plat for 11 family lots. The site is located along Cherry Lane, east of Black Cat on the south side of Cherry Lane. The north is Golf View Estates #3 Subdivision currently zoned R-4. To the south is a vacant 5 acre parcel zoned R-3 in the county. To the east is a 5 acre parcel zoned R-1 in Ada County with a single residence and Park Side Creek Subdivision touches the extreme southeast corner of the parcel. On the west side is phase one of the pending English Gardens Subdivision which currently has a preliminary plat approved but no final plat. This is the proposed preliminary plat for the site. Like I said, it has 11 single family lots. There are two main issues that I would like to pull out. The first is that we have requested 20 foot landscape buffers along Cherry Lane which they are complying with but we have asked for them to be on common lots and maintained by home owners association. They have responded that they do not want to do that. They want them maintained by the underlying lot owners. I point out that we have had problems with this arrangement in the past with Subdivision's. We find they are better maintained when they are maintained by a homeowners association and when they are left to individual lots owners, they are not maintained as one unit and not kept up as well. The second issue has to deal with a requested stub street to the east and Brad's comments which you have talked about a stub street to a 5 acre parcel to the east which is this parcel over here. Their response said the parcel to the east is not 5 acres but is one acre and I believe they are talking about this parcel right here which is not part of the plat. The intention was to suggest that Tutor Street be continued through to stub into this property so that eventually this would go through English Gardens and out to Black Cat Road and provide access to that as well as Cherry Lane. This is a photograph of the site as it is currently taken from the north side of Cherry Lane looking across Cherry Lane to the south. It shows the existing house and shop and garage. That is all I have at this point unless you have questions. Borup: Any questions for Steve? Do we have –we do not have a ACHD report—we do have a ACHD report. Oh, it is in the next packet. Borup: You can maybe explain a little bit but the easy way to handle it is if you had any comments, concerns, problems with staff comments. Manship: One thing I want to comment on. Taking Tutor Street over to the 5 acres. That parcel since has split and a gentleman put a road down the east side of the other side of the one acre parcel there and is going to build a barn and a shop and I have all ready visited with him. That would be a obsolete to do that. That is why we designed it the way it stands now. Borup: Any questions for Mr. Manship? Manship: That does not show it there. It since been split in the middle. It is a easement. Barbeiro: Under those circumstances carrying over Tutor Street (inaudible) the lot back here will be built upon in the near future a home, a barn. The existing home sits up on the front lot. Manship: Yes, on the northeast corner of that. Borup: Mr. Manship I have one. Are you going to have a homeowners association for this Subdivision? Manship: I was not going to have one due to the fact that there is only 11 lots and the cost of that would be —not make sense. The 2 lot owners Lot 1 block 3 and Lot 2 and still live in the house there so I would be maintaining, not that is makes any difference but I was going to have the homeowners just take care of that 20 foot section in front (inaudible) part of the CC&R's. Borup: How are you handling your irrigation. That be maintained by Nampa Meridian, I assume then. Manship: Correct. I am also trying to —1 have a meeting with Pinnacle Engineers next Monday to possibly tie into English Gardens irrigation which was a recommendation from Bruce. Borup: I think that is what Nampa Meridian is going to want to do. Barbeiro: Is this a hammerhead or tying into an existing road or— Manship: I have a new design here that it's actually going to be rounded off. That is just the way it shows with the survey for the corners of the lots. Hot off the press here if You want to take a look at it. (Inaudible) stub street. Barbeiro: I'd like to see that. Brown: Have you seen the new— Siddoway: I have not seen it. Borup: Obviously English Gardens did not have a stub street coming in at that point I am assuming. So it never should have been designed that way to begin with. Steve: I did not prepare the comments on this. I did not do the research. I don't know. Where they were platted first, you would need to tie into their stubs. Any other questions. Freckleton: Mr. Chairman. I just wanted to point out, the reason you do have a revised preliminary plat to night, it is a little—usually we don't like getting these at the meeting, but I will point out that the reason you do have this one is because of the way I had worded my comment. It was not real clear. My comments were that the revised preliminary plat should be turned in with the written response. Typically, I don't ask that the plat be revised until it goes to City Council, but somehow that comment—it is a standard comment that got the wording changed on it so that is why you are getting it tonight. One other item I did want to point out is you are aware that English Garden Subdivision went through considerable debate regarding the sewer, Black Cat Trunk Line, Ten Mile, trunk expansion fee and that sort of thing that was proposed by Brad Watson. This property will be sewering to English Gardens and therefore would be subject to that same fee. Currently I believe that fee is estimated at $1500 per lot. Could be more. Borup: Have you read ACHD's comments. Manship: Yes I have and I am willing to abide to all of them. Borup: For some reason I don't have it in my packet. So ACHD did not talk about a stub street to the east. Manship: No. The house there with the one acre lot would not meet setback requirements if I did stub that. Borup: I meant the one further to the south—Tutor that staff had made mention to. ACHD did not. Did they make a mention of that? They don't make any mention of it. Okay, they do make mention of it. They say the applicant is not proposing to extend Tutor Street to the east. District staff does not recommend a stub street at this location. They made mention of it and are agreeing with—Thank you. Borup: Maybe Kent would like to address that but the ones I have been involved in the developer put in the landscaping, put in the buffer and had it in the covenants it was to be maintained by the particular lot owner. Brown: That is one option I believe. The other one is that we can require them to have a homeowners association and my recommendation would be that the CC&R's be reviewed by the City Attorney to make sure that its going to maintained. The other way that you can do it is ask the homeowners to do it, but if it is not maintained, then the homeowner is responsible. But I don't think that— Borup: The one I was involved in there was a notation right on the plat, even showing a landscaped easement with a statement that it was to be maintained by the adjoining property owner. I don't know if that was necessary but it was on the plat in addition to the covenants. LOCATION & SURROUNDING USES The subject parcel lies within a larger County enclave on the south side of Cherry Lane surrounded by existing City limits. It is approximately 1,300 feet east of Black Cat Road. The parcel is located in an area designated as Existing Urban in the Comprehensive Plan. North — Golf View Estates #3 Subdivision is on north side of Cherry Lane and zoned R-4 (Meridian). South —. A vacant, 5 -acre parcel, zoned R3 in Ada County. South of that is Fuller Park. East — A 5 -acre parcel, zoned RI in Ada County, with a single family residence. Parkside Creek Subdivision touches the extreme SEC of subject parcel. West — Phase 1 of the pending English Gardens Subdivision (P.P. approved). ANNEXATION AND ZONING GENERAL COMMENTS 1. The legal description submitted with the application appears to satisfy the requirements of the City of Meridian and State Tax Commission, however, the boundary doesn't match the Ada County Assessor's mapping. Upon approval of the Final Plat for English Gardens Subdivision, the subject parcel can be adequately served by public facilities, and the proposed uses will allow for the orderly expansion of city limits. 3. Annexation of this property, although part of an enclave itself, will create an enclave of the 7.48 -acre Ada County parcel to the south. (Note: this is incorrect on Item #17 of the Preliminary Plat application.) ANNEXATION & ZONING REQUIREMENTS 1. Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 11-9-605.M. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. No variances have been requested for tiling of any ditches crossing this project. 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-domestic purposes such as landscape irrigation. 3. Outside lighting shall be designed and placed so as not to direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-2-414.D.3. 4. Subdivision identification signage shall be in accordance with the standards set forth in Section 11-2-415 of the City of Meridian Zoning and Development Ordinance. No temporary signage, flags, banners or flashing signs will be permitted. Signage restrictions need to be included in the Development Agreement. 5. Provide five -foot -wide sidewalks in accordance with City Ordinance Section 11-9-606.B. 6. A minimum 20 -foot landscape buffer is required along the north property boundary of site and shall be a condition attached to this property in the Development Agreement. 7. Applicant shall be required to dedicate all right-of-way along Cherry Lane as required by ACRD prior to the issuance of any building permits. 8. A Development Agreement will be required as a condition of annexation. PRELIMINARY PLAT SITE SPECIFIC REQUIREMENTS Public Works Requirements: 1. Sanitary sewer service to this site is proposed to be an extension from the proposed English Gardens Subdivision. Subdivision designer to coordinate main sizing and routing with the Public Works Department. This development will be subject to Black Cat Trunk expansion fees. These fees are currently estimated to be $1,500.00 per lot. These fees shall be due and payable upon city signatures on the final plat map. 2. Water service to this site shall be via extensions from proposed mains within the proposed English Gardens Subdivision. Applicant will be responsible to construct the water mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. 3. Applicant has shown an inadequate pressurized irrigation schematic. Please revise the preliminary plat to reflect plans for a system, (pumping facilities, piping, etc.), per the requirements of Meridian City Ordinance. Please indicate whether the pressurized irrigation system within this development is to be owned and maintained by the homeowners association or the Nampa & Meridian Irrigation District. If the system is to remain a private homeowners association system, plans and specifications shall be reviewed by the Public Works Department as part of the development plan review process. A draft copy of the pressurized irrigation system O&M manual must be submitted prior to plan approval. The City of Meridian requires that pressurized irrigation systems be supplied by a year-round source of water. If a creek or well source is not available, a single -point connection to the culinary water system shall be required. If a single -point connection is utilized, the developer shall be responsible for the payment of assessments for the common areas prior to signature on the final plat by the Meridian City Engineer. 4. One -hundred -watt, high-pressure sodium streetlights will be required at locations designated by the Public Works Department. All streetlights shall be installed at subdivider's expense. Typical locations are at street intersections and/or fire hydrants. 5. Coordinate fire hydrant placement with the Meridian Public Works Department. 6. A hammer -head turnaround shall be provided at the terminus of the east and west ends of the stub street providing frontage to Lots 1 and 2, Block 3. 7. The preliminary plat indicates several open ditches within or adjacent to the subdivision boundary; however, no existing ditch easements are shown, nor is there any information as to how these ditches are to be handled. Staff recommends this buffer be designated as a separate lot (i.e. Lot 1, Block 3). The lot shall become a common lot of the subdivision and be maintained by the Homeowner's Association. A detailed landscape plan for this lot must be submitted with the Final Plat application. A letter of credit or cash surety will be required for the improvements prior to signature on the Final Plat. 3. There is a 30 -foot wide, permanent, ingress, egress and utility easement along the west property line of this parcel (not shown on the plat). Applicant shall submit an application to vacate this existing easement prior to submitting a Final Plat application. The easement vacation must be complete prior to the City Engineer's signature on the Final Plat. 4. ACHD has not yet conducted a formal review of this subdivision. The primary public road issue Staff feel is important to receive ACHD's input on is the lack of connection to the unplatted, 5 -acre parcel contiguous to the east.
