Meridian Town Center Village Pavilion ACERTIFICATE OF ZONING COMPLIANCE REPORT DATE: December 6, 2012 E IDIAN~-- TO: Meridian CenterCal, LLC I D A H O FROM: Sonya Watters, Associate City Planner SUBJECT: Meridian Town Center Village Pavilion A -CZC-12-080; DES-12-050 OWNER: Meridian CenterCal, LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant, Meridian CenterCal, LLC, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval of a 3,445 square foot (s.£) pavilion and associated park area at The Village at Meridian Town Center. The pavilion is proposed to consist of an open air food court (during nice weather) with three vendors. The intended use is a food court and assembly, which is classified as a restaurant use in UDC 11-1A-1. As such, it is a principal permitted use in the C-G zoning district. This application is for approval of Pavilion "A" elevations and the associated park area only; the overall site planning and landscaping was previously approved under the master plan (CZC-11-021). The site is located at 1857 N. Records Way. DECISION The applicant's request for CZC is approved with the conditions listed in this report. Note: This is not a building permit Please contact Building Services at (208) 887-2211 to verify if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you will need to provide one set of the final, stamped "approved" Planning Department plans, stamped and signed by the architect and/or civil engineer as applicable. You must provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set Please contact Building Services for additional details about building permits and inspections. Site Specific Conditions of Approval 1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC consistent with the standards as set forth in UDC 11-3A-7 and 11-3A-6B. 2. All ground level mechanical equipment shall be screened to the height of the unit as viewed from the property line in accord with UDC 11-3A-19A.1 e. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. Conditions Document 1 Meridian Town Center Village Pavilion ACZC-12-080; DES-12-049 3. The site plan prepared by Perkowitz + Ruth Architects„ labeled Sheet A02.01, dated 11/7/12, is approved (stamped "approved" on 12/6/12 by the City of Meridian Planning Department) with no changes. 4. The elevations prepared by Perkowitz + Ruth Architects, labeled Sheets A21.01 & A21.02, dated 11/7/12 are approved (stamped "approved" on 12/6/12 by the City of Meridian Planning Department) with no changes. 5. The approved site plan & elevations may not be altered without prior written approval of the City of Meridian Planning Department. 6. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 7. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (AZ-07-012; VAR-07-017; MDA-11-002; CZC-11-021). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. CITY COUNCIL, REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before December 21, 2012, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until December 6, 2013. Broadway Ave, Suite 210 Meridian, Idaho 83642 RE: PAVILION A at THE VILLAGE, MERIDIAN TOWN CENTER Dear Ms. Wafters: On Behalf of CenterCal Properties, LLC we are pleased to present the attached application and supporting materials for Pavilion A at the Village, Meridian Town Center for Certificate of Zoning and Design Review. This submittal entails the 8th building of this new project previously approved through a "Master application", CZC-11-021. This CZC submittal is for Pavilion A elevations only -all site planning and landscaping has been previously approved under the master plan. The attached reference site plan has the allocated portion of parking removed as per Planning and Zonings request. Pavilion A is located directly to the west of a proposed theater. This building is in the main park which is centrally located in the Village. The intended use for Pavilion A is a food court and assembly on the first floor. This building is steel moment frame exposed steel structure with infill silicone butt glazing units for a minimalistic contemporary look. The exposed steel will be finish in high quality automotive paint. A stone fireplace and a fully stacking Nana wall system will allow the building to become an open air food court during nice weather. A full surround sunscreen system will allow for shading a add an attractive element to the elevations. A clearstory element will wrap the mechanical area to provide screening and a backlit area during the evening. The mechanical units will be fully screened behind the clerestory light wells. The Nana walls and doors will flow onto patios and Ipe wood decks and then transition to the parks beyond. The inside will feature a stone floor with in-slab heating coils for heating. A Rulon wood ceiling system with recessed LED lighting will provide an open and contemporary feel. The space will be tempered with air conditioning and ceiling fans for climate control during the peak conditions. The bathrooms are located within the adjacent B building. CenterCal Properties has it's own trash collection which picks up trash at individual building enclosures and takes it to central compactor to be located behind the theater building. This compactor will be the location that Sanitary Services will eventually access for pickup. This too will be included in a future CZC application. Access and turn- around for emergency vehicles had been approved by the master CZC.
