DESCRIPTION OF APPLICANT'S REQUEST
The applicant, Slichter Architects Inc., requests certificate of zoning compliance (CZC) and design
review (DES) approval to construct a new 27,380 square foot multi -tenant shell and core located at 2932
N. Eagle Road. At this time, no specific tenants are proposed to occupy the building.
DECISION
The applicant's request for CZC & DES is approved for the shell & core with the conditions listed in this
report. Future tenants will be required to submit a Certificate of Zoning Compliance Verification
application to the Planning Department for approval of uses.
Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you
need a building permit and/or inspection. If you do need a building permit, you must complete that
process before you commence the use or construction. As part of the application submittal, you will
need to provide one set of the final, stamped "approved" Planning Department plans, stamped and
signed by the architect and/or civil engineer as applicable. You must provide these plans in PDF
format and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them
with your building submittal set. Please contact Building Services for additional details about building
permits and inspections.
Site Specific Conditions of Approval
1. All roof mounted mechanical equipment shall be screened to the height of the unit as viewed
from the property line in accord with UDC 11-3A-19A.1e.
2. Prior to issuing the first certificate of occupancy for the building, any portion of the water
easement located under the proposed building after the utility relocation must be vacated
(see key note #S on the approved plans). The new water easement shall be recorded and
approved by the Public Works Department. The easement vacation requires a public
hearing and the submittal of a vacation application. Please contact the Planning Division to
initiate this process.
3. All future tenants within the proposed shell & core are required to submit a Certificate of
Zoning Verification application for approval of the use(s).
Process Conditions of Approval
1. No signs are approved with this application. Prior to installing any signs on the property, the
applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3
Article D and receive approval for such signs.
2. The applicant shall complete all improvements related to public life, safety, and health as set forth
in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with
UDC 11 -5C -3C.

3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the
applicant shall provide a written certificate of completion as set forth in UDC 11 -3B -14A.
4. The site/landscape plan prepared by Slichter Architects Inc., dated 12/07/12, labeled A1.01 is
approved (stamped "approved" on 12/07/12 by the City of Meridian Planning Department) with
no changes.
5. The building elevations prepared by Slichter Architects, dated 11/19/12, labeled A3.01 is
approved (stamped "approved" on 12/07/12 by the City of Meridian Planning Department) with
no changes.
6. The approved site/landscape plan and/or building elevations shall not be altered without prior
written approval of the City of Meridian Planning Department.
7. The applicant shall pay any applicable impact fees prior to the issuance of a building permit.
8. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant
shall submit a new site plan to the City of Meridian Planning Department for approval prior to
issuance of the building permit.
9. The applicant shall complete all required improvements prior to issuance of a Certificate of
Occupancy. It is unlawful to use or occupy any building or structure until the Building Official
has issued a Certificate of Occupancy.
Ongoing Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets
the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth
in UDC 11-313-5, UDC 11-313-13 and UDC 11-313-14.
2. The project is subject to all current City of Meridian ordinances and previous conditions of
approval associated with this site (MFP-11-001, FP -07-020, PP -06-022, CZC-11-026 and DA
#108080951).
3. The issuance of this CZC does not release the applicant from any previous requirements of the
other permits issued for the site.
4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a
minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the
area.
5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set
forth in UDC 11-3A-11.
6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping
and constructed features within the clear vision triangle consistent with the standards in UDC 11-
3A-3.
CITY ANALYSIS OF UDC REQUIREMENTS
At the time this property was platted a water easement was depicted on the plat to service the lot. The
submitted site/landscape plan (Sheet A1.01) indicates an existing 8" water main is to be relocated to
construct the proposed multi -tenant building. Because the water main is being relocated, a portion of the
easement is no longer necessary and must be vacated. Staff has agreed to allow the applicant to move
forward with construction however, the applicant must complete the vacation process prior to issuance of
the first certificate of occupancy.

CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the Director. All
requests for review shall be filed in writing with the Planning Department on or before 12/24/12, within
fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B.
If City Council review of the decision is not requested, the action of the Director represents a final
decision on a land use application. You have the right to request a regulatory taking analysis under Idaho
Code 67-8003.
EXPIRATION
Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure
shall expire if said construction or alteration has not commenced within one year of the date of issuance
of the Certificate of Zoning Compliance.
The administrative design review shall be exercised with the approval period of the underlying permit
(CZC) or the approval shall expire.
In accord with the above provisions, the subject Certificate of Zoning Compliance and Design
Review is valid until December 7, 2013.

Certificate of Zoning Compliance Verification and Design Review for a proposed
shell and core multi -tenant retail building located at the south east corner of
Ustick and Eagle Roads in the Gateway Marketplace shopping center.
Previous approvals of the Gateway Marketplace include CZC-11-026, DES -11-015
and ALT -11-006 for the adjacent Rosauers Supermarket and AZ -03-018, AZ -03-022,
PP -06-022, FP -07-020, VAR -06-002, VAR -07-010, MI -07-008, MFP-11-001 and
DA # 10808951.
The proposed building is an approximately 27, 380 sf. shell & core structure
designed to accommodate multiple retail tenants under separate permitting.
The proposed building will be attached to the south of the existing Rosauers
Supermarket and will complete the south end of the previously approved
development utilizing similar architectural detailing, material selections,
modulation and massing to appropriately balance with the existing adjacent
structure and patrons.

Planning Staff:
Please accept the following narrative description of the above referenced
project describing how the proposal addresses the guidelines outlined in the City
of Meridian Design Manual and Uniform Development Code section 11-3A-19.
1. Architectural Character: Working with the previously established design
elements of the adjacent/attached Rosauers Supermarket, the design
includes features that address the principals and objectives of the Design
Manual and referenced section of the Uniform Development Code.
Please refer to the attached colored elevation rendering, plans and
previously approved Rosauers development as a reference of the
following items.
a. Facades: The complementing building facades, facing Eagle
Road, incorporate modulation in both plan and elevation. Portions
of wall areas are projected outward creating recesses and entry
points of varying heights and widths including portions of variable
roof line heights. The new fagades are designed to complete and
complement the south end of the existing attached structure to
the north.
b. Primary Public Entrance: Being of a multi -tenant space, primary
entries are punctuated with sloped roof metal awning structures
and stone wainscot complementary to the design of the adjacent
existing building.
c. Roof Lines: Varying parapet heights and cornice designs along
with sloped roof awning structures have been utilized to further
modulate and complement the existing adjacent structure as well
as provide a stepping down of massing from the existing adjacent
structure and parking/pedestrian area to the west.
d. Patterned Variations: In addition to the physical modulation and
texture as noted above, material selections including type and

color have been incorporated and are complementary to the
existing adjacent structure.
e. Fenestration: Window/glazed entry elements have been
incorporated in both the stucco recesses and C.M.U. materials and
are punctuated by the metal awning structures. They have been
designed to offer flexibility for future tenant improvements while
providing scale and visibility to the street and adjacent pedestrian
walkways.
f. Mechanical Equipment: The majority of HVAC equipment is
located on the rooftop at a minimum distance from various exterior
parapet screening walls and is at a maximum distance from the
street and pedestrian areas. Ground level equipment such as
electrical and gas metering, is located to the rear of the building
and is primarily screened from view by the adjacent existing
structure.
2. Color and Materials: Referring to the attached colored rendering,
material colors and selections are primarily neutral in tone and are
complementary in both color and selection to the existing attached
structure as the design is to provide a continuation and completion of the
existing north end. Materials include various C.M.U. texture types, various
tones of stucco, various simulated stone veneers and wainscot and
accent metal and flashings with primarily color match painted C.M.U. in
the rear service area facing the existing attached structure.
3. Site Plan and Building Layout:
a. Building Layout: The layout was dictated by the previous approval
of the adjacent Rosauers and is situated on an interior portion of
the Gateway Marketplace development. Located on an existing
building pad, primary fagades and customer entries are oriented
toward Eagle Road.
b. Parking Area: Parking was established and completed under the
previous approval of the adjacent Rosauers. The existing parking
contains a portioned of shared stalls to the west and we are
proposing an additional 10 parking spaces directly in front of the
proposed building.
c. Access: Access to the development and project are provided by
existing primary site entrances and roadways from both Eagle and
Ustick Roads.
d. Street Layout and/or Internal Circulation: The existing parking areas
and development contain multiple primary access roads and
internal circulation routes. To the east of the proposed building is a

primary service drive bordering east side of the development. Both
the west and south sides are accessed by internal circulation
drives.
e. Pedestrian Walkways and Facilities: Currently walkways exist along
both Eagle and Ustick Roads with additional pedestrian routes
leading to the proposed building. Existing established pedestrian
routes form a continuous network of paths from the main roadways
to the project and are coordinated with the internal vehicle
circulation. The existing walkway along the west facade will be
modified to incorporate 10 parking spaces directly in front of the
new retail area.
