Meridian Town Center Village Bldg CCERTIFICATE OF ZONING COMPLIANCE REPORT DATE: December 4, 2012 E IDIAN~-- TO: Meridian CenterCal, LLC I D A H O FROM: Sonya Watters, Associate City Planner SUBJECT: Meridian Town Center Village Building C -CZC-12-082; DES-12-049 OWNER: Meridian CenterCal, LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant, Meridian CenterCal, LLC, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval of a 31,774 square foot (s.£) single-story shell & core for Building C at The Village at Meridian Town Center. The intended use is retail and restaurant spaces, which are principal permitted uses in the C-G zoning district. The site is located at 3600 E. Fairview Avenue. DECISION The applicant's request for CZC is approved with the conditions listed in this report. Note: This is not a building permit Please contact Building Services at (208) 887-2211 to verify if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you will need to provide one set of the final, stamped "approved" Planning Department plans, stamped and signed by the architect and/or civil engineer as applicable. You must provide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Site Specific Conditions of Approval 1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC consistent with the standards as set forth in UDC 11-3A-7 and 11-3A-6B. 2. All ground level mechanical equipment shall be screened to the height of the unit as viewed from the property line in accord with UDC 11-3A-19A.1 e. 3. Future tenants within the proposed shell & core are required to submit a Certificate of Zoning (with prior approval) and Design Review application for approval of fagade improvements and the specific use for each individual tenant space. 4. The Certificate of Zoning Compliance (with prior approval) and design review application submitted for the first tenant in the structure shall include a site and landscape plan that depicts the boundary of the site improvements associated with the structure. The details of these plans shall be consistent with the overall site & landscape plans approved with CZC- 11-021. Site improvements within the boundary associated with this structure shall be completed prior to issuance of the first Certificate of Occupancy, or surety may be submitted in accord with UDC 11-SC-3. Conditions Document 1 Meridian Town Center Village Building CCZC-12-082; DES-12-049 Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. 3. The site plan prepared by The Land Group, labeled Sheet C1.01, dated August 28, 2012, is approved (stamped "approved" on 9/14/12 by the City of Meridian Planning Department) with no changes. 4. The elevations prepared by Perkowitz + Ruth Architects, labeled Sheets A21.01 & A21.02, dated 6/29/12 are approved (stamped "approved" on 12/4/12 by the City of Meridian Planning Department) with no changes. 5. The approved site plan & elevations may not be altered without prior written approval of the City of Meridian Planning Department. 6. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 7. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (AZ-07-012; VAR-07-017; MDA-11-002; CZC-11-021). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before December 19, 2012, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. Conditions Document 2 Meridian Town Center Village Building CCZC-12-082; DES-12-049 EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Dear Ms. Wafters, On behalf of CenterCal Properties, LLC we are pleased to submit the attached. application and supporting materials for Building C at The Village, Meridian Town Center for Certificate of Zoning Compliance and Design Review. This submittal entails another single story building of this exciting new project, previously approved through a "master application", CZC-11-021. Building C is located directly West of the previously submitted Building J and is South of the existing Big Al's building. This new building will help establish the entry corridor to the project as one enters the site from Eagle Road. Building C is a single story building, highly detailed and again features a wide variety of materials similar to the other buildings of this development. This CZC is a "building only" submittal. The intended uses for Building C are retail and restaurant spaces. Exterior elevations are articulated through jogs in the floor plan and varying exterior wall heights to provide visual interest. A mixture of awnings and canopies will be featured for the future tenant storefronts. Trash enclosures are located within the building. As such, they are not identifiable to the general public other than a set of doors. CenterCal Properties has its own trash collection which picks up trash at individual building enclosures and takes it to a central compactor to be located behind the theater building. This compactor will be the location that Sanitary Services will eventually access for pickup. This too will be included in a future CZC application. Access and turn-around for emergency vehicles have been previously approved by the master CZC. This application has been prepared in coordination with the master CZC. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Future submittals associated with the site's buildings (or groups of buildings) will occur and provide additional details specific to each building, including design review of the building elevations and final details of areas immediately adjacent to structures. These future applications-will also establish the phasing for installation of landscape areas and the portion of this application's overall site landscape to be installed with a particular structure or group of structures. The applicant, through their traffic engineer, has presented Traffic Impact Studies and other materials for consideration by ACHD and ITD. The studies recommend specific off-site roadway improvements to Eagle Rd, Fairview Ave, River Valley St, and Records Rd and demonstrate how this work mitigates the increases to traffic created by this project. The roadway improvements shown in the application materials reflect these recommended improvements, and are subject to review and approval by ACHD and ITD as applicable. Broadway Ave. Meridian, ID 83642 Re: Meridian Town Center -Certificate of Zoning Compliance -Revised Power Center Dear Ms. Watters: On behalf of CenterCal Properties, LLC we are pleased to enclose the following application and supporting materials requesting a modification of the Meridian Town Center's Certificate of Zoning Compliance. The enclosed CZC application requests City review and approval of modifications to the Power Center (northerly portion) of the site. Revisions include minor adjustments building pad locations, landscapes and similar elements. These changes support enhancements to parking areas, handicap parking distribution and traffic circulation. Access points from the surrounding public roadways are substantially unchanged from the locations approved by ACHD. The modifications to the site plan address specific concerns from CenterCal and their tenants, and improve on the previously approved site plan in the following ways: x • A secondary north/south internal circulation drive has been incorporated, extending from E. River Valley St. to the'/.-mile access road. This drive will allow for better traffic flow through the portion of o the site adjacent to Eagle Rd, improving access between the pad buildings in this area. This ~ circulation is expected to decrease the traffic pressure on the main drive aisle immediately in front of fhe Power Center main buildings. • Handicap-accessible parking spaces are now better distributed along the front of the main buildings, providing for ADA parking nearer to the front doors of the multiple tenants. This has been achieved c by localizing the ADA parking, and not relying solely on pedestrian corridors to provide the required a v accessible path. • The added internal circulation discussed above has also allowed consolidation and better delineation of the parking areas adjacent to the pad buildings along Eagle Rd. Whereas the earlier design's long drive aisles resulted in these buildings not having distinct parking areas -the redesign better compartmentalizes aparking area for each pad. This enhances wayfinding, focuses customer parking near the business, and helps make what is unavoidably a large parking lot to feel less so. We realize that some may view the reduction in raised pedestrian corridors to be a potential downside. CenterCal's own experience has shown downside of these corridors outweighs the potential upside as pedestrian amenities. At other CenterCal projects, raised ped corridors generally go unused, but create an obstacle to snow plows, lot circulation and especially to shopping carts. To avoid these problems, the redesign focuses ped corridors where especially important -principally between the main buildings and the pads, helping to activate both areas and tie them into swell-integrated development. By incorporating the circulation drive as mentioned, the overall parking aisle lengths are significantly reduced, largely diminishing the need for raised sidewalks to collect customers from outlying portions of the parking.
