Dear Ms. Stiles:
This is the final plat application for Packard Subdivision #4. Attached, you will find thirty (30)
copies of the final plat; four (4) copies of the construction plans; ten (10) copies of a map at 1" _
300 ; and a copy of the current deed to the property.
The final plat meets the approved preliminary plat for Packard Subdivision. It also complies with
the conditions of approval. As required by City Ordinance, the plat was drawn according to the
standards for development in the R-4 Zone and the appropriate notes are on the face of the plat.
This plat also complies with acceptable engineering and surveying practices as well as local
standards.
Please review the attached information and schedule a public hearing before the City Council. If
you have any questions or want additional information, please let me know. Thank you for

this subdivisions sanitary sewer and domestic water systems have been satisfactorily completed in

the Development Agreement so that we could see what the conditions of -
because I think we're going to have a plat coming in that southwest corner of
your development that's going to include a traffic signal at Pine and the

Corrie: Item No. 17 is tabled from September 5, 2000. This is a request for Final
Plat No. 00-016 -approval of 38 building lots and 1 other lot on 11.05 acres for
Packard Subdivision No. 4 by Packard Estates Development, LLC. Staff.
Stiles: Mr. Mayor and Council, this is for the final phase of Packard Estates
Subdivision. It would be on the southeast corner of the approximate 40 acre
peace here. With this approval, they can get these ditch problems cleared up
hopefully and we recommend approval with staff conditions. Thanks.
Bird: Mr. Mayor.

Bird: Shari, this isn't Wind Gate Lane one, is it.
Stiles: No. Wind Gate Lane would actually be up here. The Development
Agreement that was on the Agenda tonight dealt with the Wind Gate Lane issue
and we'll be seeing Phase Two of what they call Packard Acres now in two
weeks that would border Vern Almond and the south slue there.
Corrie: Any further discussion?
Bird: I have none.
Corrie: I'll entertain a motion on the request for Final Pfat, No. 00-016.
Bird: Mr. Mayor. I move that we approve the Final Plat approval of 38 building

Item 18. Public Hearing: VAR 00-021 Request for a variance to not pipe
an open ditch that borders the subject parcel on the west boundary
in The Hollows Subdivision by Bond and Shelli Campbell -north
of Ustick Road %2 mile east of Meridian Road:
Corrie: Item No. 18 is a public hearing on a variance request to not pipe an open
ditch that borders the subject parcel on the west boundary in the Hollows
Subdivision by Bond and Shelli Campbell -the variance number 00-021. At this
time I'll open the public hearing and staff comments first.
Stiles: Mr. Mayor and Council, this is for a property that's currently zoned R-3 in
the City. They are proposing not to pipe the ditch that runs adjacent to the west
property line. Apparently, the property owner here uses that ditch for irrigation.
I'm not sure if it's irrigation or drainage. I'd like Gary to address some of the
concerns that we have with that in regard to moving it onto the adjacent property.
There is a requirement on this subdivision to have a 15-foot wide berm
completely surrounding the .property and the adjacent property owner was here
earlier. I don't know if he's still here. Jeff, is he here? Is he here? The adjacent
property owner was here. I'm not sure if he is aware of all the implications of not
piping this ditch. He was a little concerned because he says he has sprinkler
system running all the way up nearly to his property line, so maybe Mr. Manship
can address that a little more fully, but since these were conditions of the plat,
and they are ordinance requirements, we didn't prepare a staff report for you, but
I would like Gary to address the issue of the implications of not piping that ditch.
Smith: Thank you, Mayor and Council. The Preliminary Plat shows the property
line for this subdivision down the center of that ditch and as you know, the
ordinance requires that aditch -all ditches crossing a property are immediately
adjacent there too are to be piped. That's the reason for this variance request. I
am not sure how this ditch is utilized by the adjacent property owner. If the ditch
is piped, and he uses this as a live-water ditch, and it appears from the
photograph that that's the case, then there are pertness (sic) that can be
attached to pipes to allow irrigation from the pipe, such as an Orchard Valve - or
Orchard Valves. The other issue that - if this ditch is moved off the property line
onto the property to the west, or to your left as you look at the photograph, then
there would need to be an approval by the property owner to go to the left side

We have reviewed this submittal and offer the following comments, as conditions of the
application. These conditions shall be considered in full, unless expressly modified or
deleted by motion of the Meridian City Council:
SITE SPECIFIC COMMENTS:
1. Applicant is to meet all terms of the approved preliminary plat and development
agreement.
2. Applicant has indicated previously that the pressurized irrigation system within this
development is to be connected to the existing system within Packard Subdivision. The
common areas within the development will be subject to City of Meridian water
assessments for the domestic backup.
3. Compaction test results must be submitted to the Meridian Building Department for all
lots impacted by filling.
4. The design of drainage areas shall ensure that water is retained only during major storm
events for a maximum 24-hour period.
5. Street signs are to be in place, water system shall be approved and activated, pressurized
irrigation system approved and activated, drainage lots constructed, fencing installed, and
road base approved by the Ada County Highway District prior to any building permits
being issued. Landscaping shall be installed prior to obtaining certificates of occupancy.
6. Applicant shall be responsible to construct asix-foot-high, permanent perimeter fence
along property boundary, except where the City has expressly agreed, in writing, that
such fencing is not necessary. Fencing is to be in place prior to applying for building
permits.

7. Please change the reference at the northeast corner of Lot 4, Block l0 to read ... SUBD.

10. Graphically depict 10-foot-wide Public Utilities, Drainage and Irrigation easements along

11. Graphically depict five-foot-wide Public Utilities, Drainage and Irrigation easements
along the following lot lines: The north lines of Lot 33, Block 4; Lot 27, Block 9; Lot 16,
Block 9; Lot 4, Block 10; and the southwesterly side of Lot 38, Block 4. These lines are
side lot lines against existing phases of Packard Subdivision.
12. Detailed landscaping plans for all common areas, including species, size, quantities and
locations, and pedestrian walkways must be submitted for approval to the Planning &
Zoning Department prior to City Engineer signing Final Plat.
13. Lots 4 & 6, Block 10, and Lot 25, Block 9, don't meet the minimum 80 feet of street
frontage required in an R-4 zone. Please make appropriate adjustments to adjacent lots in
order to provide the required frontage on these lots.
14. Lot 14, Block 10, does not meet the minimum 40-foot chord requirement for a culdesac
lot. Please make appropriate adjustments to adjacent lots in order to comply with City
Ordinance.
15. Add "Front Orientation of House" arrows to Lot 24, Block 10, towards N. Justin Way
and to the plat legend. This is required due to less than minimum lot frontage on E.
Moog Way.
16. Sanitary sewer service to this project will be via the existing mains that traverse through
the adjacent phases of this development. Applicant will be responsible to construct the
sewer mains to and through this proposed development. Subdivision designer to
coordinate main sizing and routing with the Public Works Department. Sewer manholes
are to be provided to keep the sewer lines on the south and west sides of centerline.
17. Water service to this site will be via an extension of an existing main installed in prior
phases of this development. Applicant will be responsible to construct the water mains to
and through this proposed development. Subdivision designer to coordinate main sizing
and routing with the Public Works Department.

18. Design of sidewalks adjacent to roadways shall provide a minimum of five feet clear
area, exclusive of mailboxes. Previous phases of this development have large mailbox
structures constructed within the walkway area.
GENERAL COMMENTS:
1. Any existing active irrigation/drainage ditches crossing the property shall be tiled per
City Ordinance 12-4=13. The ditches to be piped should be shown on the site plans. Plans
will need to be approved by the appropriate irrigation/drainage district, or lateral users
association, with written confirmation of said approval submitted to the Public Works
Department. No variances have been requested for tiling of any ditches crossing this
project.
2. Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells
may be used for non-domestic purposes such as landscape irrigation.
3. One-hundred-watt, high-pressure sodium streetlights will be required at locations
designated by the Public Works Department. All streetlights shall be installed at
subdivider's expense. Typical locations are at street intersections and/or fire hydrants.
4. Submit a "Final" letter from the Ada County Street Name Committee, approving the
subdivision and street names. Make any corrections necessary to conform.
5. Coordinate fire hydrant placement with the City of Meridian's Water Works
Superintendent.
6. Provide five-foot-wide sidewalks in accordance with City Ordinance Section 12-5-2.K
7. Please respond in writing to each of the comments contained herein, both General and
Site Specific, prior to the September 5, 2000 meeting of the Meridian City Council.

variance, and I am sure the council will approve anyway, so why make them pay and

Good Morning Mayor: Yesterday Ireceived ahand-delivered copy of a letter sent to
you by Craig Groves concerning this plat and the issue of its approval expiring because
it had not been recorded within one year from the date City Council approved it.
I understand this is an ordinance requirement and Shari is responding in enforcement
of the ordinance. I do believe the intent of this requirement is to allow the City to
declare a plat null and void if a developer is not moving forward to complete the
improvements so that either (1), we don't have a bunch of dirt under construction for
a long period of time causing other problems or (2), we have approved, undeveloped
plats that ultimately have to go through a vacation process to clear the record.
In the case of this subdivision, all improvements have been completed and the plat is
recorded and lots are available for building permits. Although there are probably
several reasons that the time went by without the plat being recorded, it has now
been recorded and all improvements are complete. It is a quality subdivision.
Although this issue is probably outside my jurisdiction, it still seems appropriate to me
that some leeway be allowed to the developer in this instance.
If the developer is required to proceed with the variance process, I can't imagine the
Council not allowing the plat to go forward with the on-site circumstances that exist so
the process amounts to a delay for the developer.

RE: Building Permits for Packard~Subdivision #4
Dear Mr. Corrie:
On September 19th, 2000, the Meridian City Council heard a request for Final Plat for
Packard Subdivision #4. The Final Plat was approved that evening and sometime that
evening the City Attorney must have drafted the Order of Conditional Approval of Final
Plat because the Order was signed on the 19th.
I doubt the Order of Conditional Approval of Final Plat was actually signed on the 19th,
and I have no way of knowing exactly when the document was signed because your
office did not mail my company a copy.
My company through our engineer, Pat Tealey, submitted on August 14`h, 2001 the final
plat for the City Engineer and City Clerk to sign. For at least 3 weeks prior to August
14th, 2001 my company worked with the Public Works Department to verify every
condition of approval had been met. On September 19th, 2001 the City Engineer and City
Clerk signed the Final Plat.
The Final Plat was delivered to the County Engineer on September 20th, 2001, and
recorded at the county on October 24, 2001.
Here is the problem. City Ordinance 12-3-8A requires final plats be filed with one year
after written approval by the Council. City Ordinance 12-3-9A2 requires the City
Engineer and City Clerk verify the development meets the City requirements. Since my
company did not receive a copy of the Order of Conditional Approval until this morning
by fax, I never received timely written approval from the Council, and I doubt official
written approval occurred the night of the hearing. In addition, why would the City
Engineer or City Clerk sign the Final Plat on September 19th, 2001 knowing the
development did not meet all the City Requirements? Or did they assume the plat was in
compliance? Did they sign because we had been working with them of nearly 2 months
requesting their signature?
In any event, requesting my company obtain a variance to extend the final plat seems like
nonsense when the plat is in fact recorded. By the City's own definition the City
Engineer and City Clerk should not sign a plat that does not meet the City requirements.
For the building department or the planning and zoning department to now refuse to issue
building permits until a variance is approved is complete nonsense. From my point of
view the City may be label for interest which is accruing on my development loan in the
amount of $350 per day.
I would very much like to resolve this issue without going through the variance
application. Please let me know if you would like to meet to discuss our options.
