a public hearing at the Meridian City Hall, 33 East Idaho Avenue, Meridian, Idaho, at the
hour of 6:30 p.m. on February 20, 2001, for the purpose of reviewing and considering
the application of Mountain West Bank for a Conditional Use Permit to construct a
branch bank with drive-thru teller in an L-O zone generally located west of S. Eagle
Road, north of E. Magic View Drive.
A more particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Avenue, and is available for inspection during
regular business hours, Monday through Friday, from 8:00 a.m. to 5:00 p.m.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing, and the public is welcome and invited to
submit testimony. Oral testimony may be limited to three (3) minutes per person.
Written materials may be submitted seven (7) days prior to the above hearing date so
that all interested parties may examine them prior to the hearing. All materials

The above entitled conditional use permit application having come before
the City Council on February 20, 2001, at the hour of 6:30 p.m., at Meridian City Hall,
33 East Idaho Street, Meridian, Idaho, and Shari Stiles, Planning and Zoning
Administrator, appeared and testified, and appearing and testifying on behalf of the
Applicant were Mike McI<innis of Mountain West, Holly Lloyd, Marty Seger, Jonathan
Seel, and Jim Boyd, and no one appeared in opposition, and the City Council having duly
considered the evidence and the record in this matter and the Recommendations to City
Council issued by the Planning and Zoning Commission who conducted a public hearing

and the Council having heard and taken oral and written testimony, and having duly
considered the matter, the City Council hereby makes the following Findings of Fact,
Conclusions of Law and Decision and Order to-wit:
FINDINGS OF FACT
1. A notice of a public hearing on the conditional use permit was published for
two (2) consecutive weeks prior to the said public hearing scheduled for February 20,
2001, before the City Council, the first publication appearing and written notice having
been mailed to property owners or purchasers of record within three hundred feet (300')
of the external boundaries of the property under consideration more than fifteen (15) days
prior to said hearing and with the notice of public hearing having been posted upon the
property under consideration more than one week before said hearing and the copies of
all notices were made available to newspaper, radio and television stations as public service
announcements; and the matter having been duly considered by the City Council at the
February 20, 2001, public hearing; and the applicant, affected property owners, and
government subdivisions providing services within the planning jurisdiction of the City of
Meridian, having been given full opportunity to express comments and submit evidence.
2. There has been compliance with all notice and hearing requirements set forth
in Idaho Code §67-6509, 6512, and Meridian City Code §§ 11-15-5 and 11-17-5 as
evidenced by the Affidavit of Mailing, and the Affidavit of Publication and Proof of
Posting filed with the staff report.

3. This proposed development request is in an L-O zone, by reason of the
provisions of the Meridian City Code § 11-17-4, a public hearing was required before the
City Council on this application.
4. The property is located at the northwest corner of Magic View Drive
and Allen Street, Meridian, Idaho.
5. The owner of record of the subject property is James Boyd of Boise, Idaho.
6. Applicant is Mountain West Bank of Coeur d'Alene.
7. The subject property is currently zoned L-O Limited Office. The zoning
District of L-O is defined within the City of Meridian Zoning and Development
Ordinance, Section 11-7-2.
8. The proposed application requests a conditional use permit for a bank with
a drive-thru window. The L-O zoning designation within the City of Meridian Zoning and
Development Ordinance requires a conditional use permit be obtained for most uses
including those requested by the Applicant. (Meridian City Zoning and Development
Ordinance, Section 11-8-1).
9. The Meridian City Council recognizes that the proposed application is in
compliance with the Meridian Comprehensive Plan.
10. The use proposed within the subject application will in fact, constitute a
conditional use as determined by City Ordinance.

Subdivision and Development Ordinances codified at Titles 11 and 12, Meridian City
Code and all current zoning maps thereof and the Comprehensive Plan of the City of
Meridian, and Maps and the Ordinance establishing the Impact Area Boundary.
12. Giving due consideration to the comment received from the governmental
subdivisions providing services in the City of Meridian planning jurisdiction public
facilities and services required by the proposed development will not impose expense
upon the public if the following conditions of development are imposed and the
following is also found to be required to mitigate the effects of the proposed use and
development upon services delivered by political subdivisions providing services to the
subject real property within the planning jurisdiction of the City of Meridian:
Adopt the Recommendations of the Planning and Zoning and Engineering
departments as follows:
12.1 .Sanitary sewer and water service to this site shall be provided via mains
and services that were installed as part of the recently completed St.
Luke's road extension project and subject to latecomers fees.
12.2 In accordance with City Ordinance 11-13-4.B.2., underground year-round
pressurized irrigation shall be provided to all landscape areas on site.
Submit hook-up and design details based on the proposed landscaping.
Applicant shall be required to utilize any existing surface or well water for
the primary source. If City water is proposed as a secondary source,
developer shall be responsible to pay water assessments for the
landscaped areas.
12.3 Ordinance 11-4-9.B., "Modification or Amendment of Applications Or
Uses," allows approved applications, including CUP's, to be amended,
altered or modified through the same procedures as an initial application.
The conditions of the existing CUP do not restrict future modifications.
As an application modification, the Applicant shall provide to the P&Z

Commission and Council a list of all existing conditions (as outlined in
Item #2, pages 10-13, of the CUP Decision and Order signed by the City
on 3-7-00) and state which conditions he wishes to modify or delete vis-a-
vis the subject application. An 8 1/2 x 11 "copy of the existingf approved
Site Plan for Lot 3 should be attached to this list of proposed
modifications. The Applicant shall also provide a conceptual Site Plan of
how the proposed bank plan/layout will interface with the existing plan
for the entire lot.
12.4 The Site Plan shows six (6) new trees within a 5-foot planter strip along
the eastern property boundary. It appears these trees may be in a Nampa
Meridian Irrigation District easement. Trees are not permitted within
NMID's easements. Applicant shall verify NMID's easements and, if the
trees need to be relocated, provide a revised landscape plan.
12.6 An internal parking lot planter shall be added to the parking row of 18
stalls along the eastern property line to break-up this continuous row of
parking spaces.
12.7 The Site Plan shows the preliminary location of sewer and water service
lines adjacent to the eastern side of the building, passing under the
landscape planter at the SE corner of the building. These lines shall be
moved east of the planter to accommodate the tree in this planter.
12.8 The Site Plan shows entry drive aisle widths of 24 feet off the main
driveway and on the north, east and south sides of the building. City
Ordinance 11-13-4.F. requires a minimum of 25 feet. Revise these widths
accordingly on the Site Plan at the time of building permits submission.
12.9 The Applicant is proposing one (1), 8-foot tall, 90 s.f. free-standing sign
at the SE corner of the site, just north of the entry drive. The location and
height of the sign is approved but the actual sign background area shall be
limited to 50 s.f., excluding any part of the sign structure or support.
Applicant shall clarify if the sign is intended to be a multi-panel sign for
future users of Lot 3 or if it's intended to sign only the bank. As a single-
tenant sign, the above conditions would apply. However, if the sign is
intended to provide signage for future users on the west and south ends
of the lot, a larger sign background area - up to 80 s.f could be supported
by staff. The property owner shall consider that any future uses in the

NW area of the lot shall have no direct street frontage and may benefit
from signage at this location.
12.10 Of concern is the lack of pedestrian access to the bank off Allen Street
and the main driveway coursing the southern boundary of this site. No
sidewalks are shown to access the site from either Allen Street or the new
proposed driveway. Given the existing office buildings in Midvalley
Business Park south of Magic View Drive, the approved office building on
Lot 3 south of the bank and the proposed AmeriTel Inn east of the site,
there is an increasing opportunity for pedestrian traffic in this
subdivision. In coordination with Magic View Partners LLC, The
Applicant shall add sidewalks to the plan to access the bank entry in
accordance with Magic View Partner's design of the southern half of Lot
3. Sidewalk connection shall be made to the Allen Street extension
currently under construction.
12.11 Off-street parking shall be provided in accordance with Section 11-13 of
the City of Meridian Zoning and Development Ordinance and/or as
detailed in site-specific requirements.
12.12 Paving and striping shall be in accordance with the standards set forth in
Sections 11-13-4.D. and 11-13-4.E. of the City of Meridian Zoning and
Development Ordinance and in accordance with Americans with
Disabilities Act (ADA) requirements.
12.13 A drainage plan designed by a State of Idaho licensed architect or
engineer is required and shall be submitted to the City Engineer
(Ord. 557, 10-1-91) for all off-street parking areas. All site drainage shall
be contained and disposed of on-site.
12.14 Outside lighting shall be designed and placed so as to not direct
illumination on any nearby residential areas and in accordance with City
Ordinance Section 11-13-4.C.
12.15 Any existing domestic wells and/or septic systems within this project shall
be removed from their domestic service per City Ordinance Section 9-1-4
and 9-4-8. Wells may be used for non-domestic purposes such as
landscape irrigation.

12.16 All irrigation ditches, laterals or canals, exclusive of natural waterways,
intersecting, crossing or lying adjacent and contiguous to the parcel shall
be tiled per City Ordinance 12-4-13. Plans shall be approved by the
appropriate irrigation drainage district, or lateral users association, with
written confirmation of said approval submitted to the Public Works
Department.
12.17 Provide a minimum of one (1) two-inch (2 ") caliper tree per 1,500 sq. ft.
of asphalt area on the site in accordance with City Ordinance Section 11-
13-4.B.3.c.
12.18 All trash and/or garbage collection areas shall be enclosed on at least three
(3) sides in accordance with City Ordinance Section 11-12-1.C.
Coordinate trash enclosure locations and construction requirements with
Sanitary Service Company (SSC) and provide a letter of approval from
SSC to the Planning & Zoning Department prior to applying for building
permits.
12.19 Provide five-foot-wide sidewalks in accordance with City Ordinance
Section 12-5-2.K.
12.20 All construction shall conform to the requirements of the Americans with
Disabilities Act.
Adopt the Recommendations of the Ada County Highway District as follows:
12.21 Applicant shall construct a 25-foot wide shared driveway south of the
site, at the south property line as proposed. The driveway shall be paved
to its full width and at least 30-feet into the site beyond the edge of
pavement of Allen Street with 15-foot curb radii.
12.22 Prior to issuance of a building permit, the developer shall be required to
pay the standard impact fee, and the overlay fee of approximately
$60,250 based on 1,395 vehicle trips per day.
12.23 Utility street cuts in pavement less than five years old are not allowed
unless approved in writing by the District.
12.24 Other than the approved driveway, direct lot or parcel access to St. Lukes
Street/Allen Street is prohibited.

Adopt the Recommendations of the Central District Health Department as
follows:
12.24 The Applicant's building shall be served with central sewage and central
water.
12.25 Stormwater shall be pretreated through a grassy swale prior to discharge
to the subsurface to prevent impact to groundwater and surface water
quality.
12.26 The Engineers and architects involved with the design of the subject
project shall obtain current best management practices for stormwater
disposal and design a stormwater management system that prevents
groundwater and surface water degradation.
13. The proposed uses within the subject application will be harmonious
with and in accordance with the Meridian Comprehensive Plan and the City of
Meridian Zoning and Development Ordinance because:
13.1 The subject property is designated on the "Generalized Land Use Map" as
"Mixed/Planned Use Development".
14. The uses proposed within the subject application subject to the
conditions herein ordered will be designed, constructed, operated and maintained to be
harmonious and appropriate in appearance or intended character of the general vicinity
and that such uses will not change the intended essential character of the same area.
1 S. The uses proposed within the subject application will not be hazardous
or disturbing to existing or future neighboring uses.

16. The uses proposed within the subject application will be served
adequately by central public facilities and services such as highways, streets, police and
fire protection, drainage structures, refuse disposal, water, and sewer.
17. The uses proposed within the subject application will not involve uses,
activities, processes, materials, equipment and conditions of operation that will be
detrimental to any persons, property or the general welfare by reason of excessive
production of traffic, noise, smoke, fumes, glare or odors.
18. The development will not result in the destruction, loss or damage of
natural or scenic feature of major importance relating to the property.
CONCLUSIONS OF LAW
1. The City of Meridian shall exercise the powers conferred upon it by the
"Local Land Use Planning Act of 1975" hereinafter referred to for convenience as the
"Act" codified at Chapter 65, Title 67, Idaho Code (I.C. §67-6503).
2. The Meridian City Council may exercise all the powers required and
authorized under the "Act" except the power to adopt ordinances by the establishment
of a Planning and Zoning Commission by ordinance pursuant to Idaho Code Section
67-6504 which the City Council of the City of Meridian has established by the passage
of the "City of Meridian Zoning and Development Ordinance" at Titles XI and XII,
Chapter I, Meridian City Code.

3. As part of a zoning ordinance the City Council can, subject to hearing
and notice provision required, provide for the process of special and/or conditional use
permits which a proposed use is otherwise prohibited by the terms of the ordinance but
allowed with conditions under the specific provisions of the ordinance which the City
of Meridian has done in the adoption of its zoning ordinances.
4. The City Council has the duty and responsibility to review the facts and
circumstances of each application for special use permit to determine prior to granting
the same that the evidential showing supports the finding that the following standards
are met and that the proposed development: (Meridian City Code § 11-17-3 )
a. Will, in fact, constitute a conditional use as determined by City policy;
b. Will be harmonious with and in accordance with the Comprehensive
Plan and this Ordinance;
c. Will be designed, constructed, operated and maintained to be
harmonious and appropriate in appearance with the existing or intended character of
the general vicinity and that such use will not change the essential character of the
same area;
d. Will not be hazardous or disturbing to existing or future neighboring
uses;
e. Will be served adequately by essential public facilities and services such
as highways, streets, police and fire protection, drainage structures, refuse disposal,
water, sewer or that the person responsible for the establishment of proposed
conditional use shall be able to provide adequately any such services;
f. Will not create excessive additional requirements at public cost for
public facilities and services and will not be detrimental to the economic welfare of the
community;

g. Will not involve uses, activities, processes, materials, equipment and
conditions of operation that will be detrimental to any persons, property or the general
welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors;
h. Will not result in the destruction, loss or damage of a natural or scenic
feature of major importance.
5. Prior to granting a conditional use permit in an Limited Office District
(L-O), a public hearing shall be conducted with notice to be published and provided to
property owners or purchasers of record within three hundred feet (300') of the
external boundaries of the land under consideration for the conditional use permit all
in accordance with the provisions of Meridian City Code § 11-17-5 City of Meridian
Zoning and Development Ordinance, which provides as follows:
"Prior to approving a Conditional Use Permit, the applicant and the
Commission and Council shall follow notice and hearing procedures provided in
Chapter 15 of this Title. Provided, however, that conditional use applications
for land in Old Town and in industrial and commercial districts shall only be
required to have one public hearing which shall be held before the Planning and
Zoning Commission; and after the recommendation of the Commission is
made, the application shall go before the City Council without a public hearing
and the Council may approve, deny, or modify the recommendation of the
Commission."
6. Following the public hearing and within 45 days after the conclusion of
the public hearing the Commission shall, transmit its recommendations to the
Meridian City Council with supportive reasons. The Commission shall recommend
that the application be approved, approved with conditions or denied. The
Commission shall ensure that any approval or approval with conditions of an
application shall be in accordance with Meridian Comprehensive Plan, City of

7. When the City Council approves a conditional use permit it may impose
conditions of that approval that reasonably:
A. Minimize adverse impact on other development;
B. Control the sequence and timing of development;
C. Control the duration of development;
D. Assure that the development is maintained property;
E. Designate the exact location and nature of the development;
F. Require the provision for on-site public facilities or services; and
G. Require more restrictive standards than those generally required, in this
Ordinance.
8. The City of Meridian has, by ordinance, established the Impact Area and
the Comprehensive Plan of the City of Meridian, which was adopted December 21,
1993, Ord. 629, January 4, 1994 and Maps.

1.11 Off-street parking shall be provided in accordance with Section 11-13 of
the City of Meridian Zoning and Development Ordinance and/or as
detailed in site-specific requirements.
1.12 Paving and striping shall be in accordance with the standards set forth in
Sections 11-13-4.D. and 11-13-4.E. of the City of Meridian Zoning and
Development Ordinance and in accordance with Americans with
Disabilities Act (ADA) requirements.
1.13 A drainage plan designed by a State of Idaho licensed architect or
engineer is required and shall be submitted to the City Engineer
(Ord. 557, 10-1-91) for all off-street parking areas. All site drainage shall
be contained and disposed of on-site.
1.14 Outside lighting shall be designed and placed so as to not direct
illumination on any nearby residential areas and in accordance with City
Ordinance Section 11-13-4.C.
1.15 Any existing domestic wells and/or septic systems within this project shall
be removed from their domestic service per City Ordinance Section 9-1-4
and 9-4-8. Wells may be used for non-domestic purposes such as
landscape irrigation.
1.16 All irrigation ditches, laterals or canals, exclusive of natural waterways,
intersecting, crossing or lying adjacent and contiguous to the parcel shall
be tiled per City Ordinance 12-4-13. Plans shall be approved by the
appropriate irrigation/drainage district, or lateral users association, with
written confirmation of said approval submitted to the Public Works
Department.
1.17 Provide a minimum of one (1) two-inch (2 ") caliper tree per 1,500 sq. ft.
of asphalt area on the site in accordance with City Ordinance Section 11-

1.18 All trash and/or garbage collection areas shall be enclosed on at least three
(3) sides in accordance with City Ordinance Section 11-12-1.C.
Coordinate trash enclosure locations and construction requirements with
Sanitary Service Company (SSC) and provide a letter of approval from

1.21 Applicant shall construct a 25-foot wide shared driveway south of the
site, at the south property line as proposed. The driveway shall be paved
to its full width and at least 30-feet into the site beyond the edge of
pavement of Allen Street with 15-foot curb radii.
1.22 Prior to issuance of a building permit, the developer shall be required to
pay the standard impact fee, and the overlay fee of approximately
$60,250 based on 1,395 vehicle trips per day.
1.23 Utility street cuts in pavement less than five years old are not allowed
unless approved in writing by the District.
1.24 Other than the approved driveway, direct lot or parcel access to St. Lukes
Street/Allen Street is prohibited.

project shall obtain current best management practices for stormwater
disposal and design a stormwater management system that prevents
groundwater and surface water degradation.
2. The conditions shall be reviewable by the Council pursuant to Meridian

This matter coming before the City Council on the 20~' day of February,
2001, under the provisions of Meridian City Code § 11-17-4 for final action on
conditional use permit application and the Council having received and approving the
Recommendation of the Planning and Zoning Commission the Council takes the
following action:
1. That the Applicant of the property is granted a conditional use permit for a
bank with adrive-thru window, the proposed application request of a conditional use
permit for the construction, development, maintenance and use for a bank with a
drive-thru window, as described in the "Preliminary Plan" on file with the City
Clerk's office, for the development of the aforementioned bank with adrive-thru
window and which property description is on file in the City Clerk's office.
2. That the above named applicant is granted a conditional use permit for a bank
with adrive-thru window, located at the northwest corner of Magic View Drive and

Allen Street, Meridian, Idaho, subject to the following conditions of use and
development:
Adopt the Recommendations of the Planning and Zoning and Engineering departments as
follows:
2.1 Sanitary sewer and water service to this site shall be provided via mains and
services that were installed as part of the recently completed St. Luke's road
extension project and subject to latecomers fees.
2.2 In accordance with City Ordinance 11-13-4.B.2., underground year-round
pressurized irrigation shall be provided to all landscape areas on site. Submit
hook-up and design details based on the proposed landscaping. Applicant shall
be required to utilize any existing surface or well water for the primary source.
If City water is proposed as a secondary source, developer shall be responsible
to pay water assessments for the landscaped areas.
2.3 Ordinance 11-4-9.B., "Modification or Amendment of Applications Or Uses,"
allows approved applications, including CUP's, to be amended, altered or
modified through the same procedures as an initial application. The conditions
of the existing CUP do not restrict future modifications. As an application
modification, the Applicant shall provide to the P&Z Commission and Council
a list of all existing conditions (as outlined in Item #2, pages 10-13, of the
CUP Decision and Order signed by the City on 3-7-00) and state which
conditions he wishes to modify or delete vis-a-vis the subject application. An 8
1/2 x 11 "copy of the existingf approved Site Plan for Lot 3 should be attached
to this list of proposed modifications. The Applicant shall also provide a
conceptual Site Plan of how the proposed bank plan/layout will interface with
the existing plan for the entire lot.
2.4 The Site Plan shows six (6) new trees within a 5-foot planter strip along the
eastern property boundary. It appears these trees may be in a Nampa Meridian
Irrigation District easement. Trees are not permitted within NMID's
easements. Applicant shall verify NMID's easements and, if the trees need to
be relocated, provide a revised landscape plan.

2.6 An internal parking lot planter shall be added to the parking row of 18 stalls
along the eastern property line to break-up this continuous row of parking
spaces.
2.7 The Site Plan shows the preliminary location of sewer and water service lines
adjacent to the eastern side of the building, passing under the landscape
planter at the SE corner of the building. These lines shall be moved east of the
planter to accommodate the tree in this planter.
2.8 The Site Plan shows entry drive aisle widths of 24 feet off the main driveway
and on the north, east and south sides of the building. City Ordinance 11-13-
4.F. requires a minimum of 25 feet. Revise these widths accordingly on the
Site Plan at the time of building permits submission.
2.9 The Applicant is proposing one (1), 8-foot tall, 90 s.f. free-standing sign at the
SE corner of the site, just north of the entry drive. The location and height of
the sign is approved but the actual sign background area shall be limited to 50
s.f., excluding any part of the sign structure or support. Applicant shall clarify
if the sign is intended to be a multi-panel sign for future users of Lot 3 or if it's
intended to sign only the bank. As asingle-tenant sign, the above conditions
would apply. However, if the sign is intended to provide signage for future
users on the west and south ends of the lot, a larger sign background area - up
to 80 s.f could be supported by staff. The property owner shall consider that
any future uses in the NW area of the lot shall have no direct street frontage

Dear Commissioners,
The subject application is on your February 1, 2001 agenda as a continued item from the January 4, 2001
meeting. You have already received the staff report dated 11-30-00. After discussions with Jonathan Seele
of W.H. Moore Company, representing the Applicant, Staff has agreed to modify two of the proposed
conditions in the report. I request that you incorporate these changes into your discussion and final motion.
Item #7 of the report pertains to terms of the Development Agreement. Two of the sub-paragraphs under
this item should be modified as follows:
#7.b. -This condition should be deleted. The License Agreement with ACHD pertains only to the
landscaping in the right-of-way on the north end of Lot 2, which is the east lot where AmeriTel Inn
is proposed. Lot 3, which is the lot on which the bank is proposed, does not have any
landscaping within ACHD's right-of-way and, therefore, should not be required to submit a copy
of the License Agreement prior to submitting building permits. The same condition is also in the
AmeriTel Inn staff report and will still apply to that lot.
#7.c. -The timeframe condition Staff recommended at the end of this paragraph required the
existing utility easements in Lot 2 and 3 be vacated prior to submittal for a Certificate of Zoning
Compliance for the bank. However, condition #5.1.14 on page 6 of the Development Agreement
only requires that "conflicting" easements be vacated prior to building permits. This word should
be added to the bank condition so that it reads..."DA requires that any conflicting utility
easements in Lot 2 and 3 be vacated prior to applying for building permits. Vacation
applications for any easements which conflict with proposed building locations should be
approved by City Council prior to submittal for a Certificate of Zoning Compliance for the
bank."
I will address these items at the February 1St meeting, but wanted you to have a written reference.

We have reviewed this submittal and offer the following comments, as conditions of the
applicant. These conditions shall be considered in full, unless expressly modified or deleted by
motion of the Meridian City Council:
APPLICATION SUMMARY
This application proposes to construct asingle-story, 5,260 s.f. bank with adrive-through on a 0.95-
acre area in the NE corner of Lot 3 in the Amended Magic View Subdivision. The entire Lot 3 (5.2
acres) was a part of the "Magic View Office Complex" project Annexation and Conditional Use
Permit by Magic View Partners, LLC, approved by City Council on 3-7-00. As proposed, Magic View
Partners would maintain ownership of the lot and Mountain West Bank would lease this 0..95-acre
portion. Staff is not aware of any plans to plat this lot. By submitting a new CUP for this lot, the
Applicant is concurrently proposing to modify the existing Conditional Use Permit already approved
for this lot. While there is also a Development Agreement (DA) with binding conditions that was
approved with the annexation of this lot, no modification of the DA is required if the Applicant
complies with all the outstanding DA conditions listed herein. ACRD has approved the Site Plan and
the curb cut and driveway locations as submitted.
Note that the existing Magic View Partners CUP (#CUP-99-040) also pertains to Lot 2 of Magic
View Subdivision, east of subject lot. So, if approved, the subject CUP would modify only portions of

LOCATION & SURROUNDING USES
The subject property is located immediately west of the proposed AmeriTel Inn project on Lot 2 of
Magic View Subdivision, at the northwest corner of Magic View Drive and Allen Street. The lot is
currently zoned Limited Office, which permits banks outright and drive-through services with a CUP.
The property is located in an area designated as Mixed/Planned Use Development in the
Comprehensive Plan.

neighborhood), zoned R2, Ada County. Five homes aze adjacent to the north of subject lot.
South - Atwo-story, 35,000 s.f. office building is approved on the same Lot 3, immediately
south of the bank site. Across Magic View Drive to the southeast is the Texaco/food mart
facility. A new multi-tenant office building is directly across Magic View Drive.
East -Proposed AmeriTel Inn, zoned L-O, and Eagle Partners complex (Idaho Power C.U.
and Chevron/McDonalds), zoned C-G.
West - A 5-acre lot with asingle-family home, zoned RUT in Ada County.
CURRENT OWNER OF RECORD
The property owner of record is Magic View Partners, of which Winston H. Moore and James L. Boyd
are general partners. Both partners have submitted their consent for the subject application.
SITE SPECIFIC REQUIREMENTS
1. As part of a conditional use permit, the City of Meridian may impose additional
restrictions/conditions.
2. Sanitary sewer and water service to this site will be provided via mains and services that were
installed as part of the recently completed St. Luke's road extension project.
3. Assessments for sewer and water service are determined during the building permit application
process.
4. In accordance with City Ordinance I1-13-4.B.2., underground year-round pressurized irrigation
must be provided to all landscape areas on site. Please submit hook-up and design details based on
the proposed Landscaping. Applicant shall be required to utilize any existing surface or well water
for the primary source. If City water is proposed as a secondary source, developer shall be
responsible to pay water assessments for the landscaped azeas.
5. The Site Plan proposes three (3) drainage swales within the boundaries of this site. The design of
drainage areas shall ensure that water is retained only during major storm events for a maximum
24-hour period.
6. Ordinance 11-4-9.B., "Modification or Amendment of Applications Or Uses," allows approved
applications, including CUP's, to be amended, altered or modified through the same procedures as
an initial application. The conditions of the existing CUP do nat restrict future modifications. As an
application modification, the Applicant should provide to the P&Z Commission and Council a list
of all existing conditions (as outlined in Item #2, pages 10-13, of the CUP Decision and Order
signed by the City on 3-7-00) and state which conditions he wishes to modify or delete vis-a-vis
the subject application. An 8 % x 11" copy of the existing/approved Site Plan for Lot 3 should be
attached to this list of proposed modifications. The Applicant should also provide a conceptual
Site Plan of how the proposed bank plan/layout will interface with the existing plan for the entire
lot.
7. Existing Development Agreement Terms: A Development Agreement (DA), recorded by Ada

County on 3-23-00 as Instrument #100021$69, is binding on the subject property. Since Magic
View Partners was the developer/property owner who signed the DA, they are ultimately
responsible to the City for completion of these requirements -not Mountain West Bank. But since
Mountain West Bank's application is the first proposed building on Lot 3 of the Magic View
Partner's project, Staff feh it was most appropriate to include the outstanding annexation and DA
conditions herewith. The DA allows oflice uses outright and requires a CUP for all other uses.
Section 5 (page 4) of the DA also contains 14 special conditions that must be met on this property.
Staff has reviewed the 14 DA conditions and listed below several conditions that must still be
completed as part of the annexation. We have suggested some new timeframes (shown in italics)
for completion of these items in tandem with the AmeriTel Inn project:
a. DA requires construction of a 4-foot berm and a 6-foot fence within a 20-foot wide
buffer along the north boundary of Lot 3. (This should be constructed prior to issuance
of Mountain West Bank building permits.)
b. DA requires Magic View Partners to enter into a License Agreement with ACRD for
construction of the 30-foot berm. (A copy of said agreement should be provided to the
P&Z Department at the time of CZC submittal.)
c. DA requires the existing utility easements in Lot 2 and 3 be vacated prior to applying
for building permits. (The Vacation applications should be approved by City Council
prior to submittal for a Certificate of Zoning Compliance for the bank.)
d. DA requires dedication of all rights-of--way for the St. Luke's Road and Magic View
Drive by recorded Warranty Deed prior to the issuance of any building permits. (A copy
of said deed should be provided to the P&Z Department at the time of CZC submittal.)
e. Item #14, page 9, of the DA states that no Certificates of Occupancy will be issued on
this ground "until all infrastructure and other improvements which are imposed by the
terms of this agreement, the annexation ordinance, and the CUP are completed," unless
there is an amendment. Staff understands this condition to apply to the above a-d
conditions.
8. The Site Plan shows six (6) new trees within a 5-foot planter strip along the eastern property
boundary. It appears these trees may be in a Nampa Meridian Irrigation District easement. Trees
are not permitted within NMID's easements. Applicant should verify NMID's easements and,
should the trees need to be relocated, provide a revised landscape plan.
9. An internal parking lot planter must be added to the parking row of 18 stalls along the eastern
property line to break-up this continuous row of parking spaces.
10. The Site Pian shows the preliminary location of sewer and water service lines adjacent to the
eastern side of the building, passing under the landscape planter at the SE corner of the building.
These lines will need to be moved east of the planter to accommodate the tree in this planter.
11. The Site Plan shows entry drive aisle widths of 24 feet off the main driveway and on the north, east
and south sides of the building. City Ordinance 11-13-4.F. requires a minimum of 25 feet. Please
revise these widths accordingly on the Site Plan at the time of building permits submission.
12. The Applicant is proposing one (1), 8-foot tall, 90 s.f. free-standing sign at the SE corner of the
site, just north of the entry drive. Staff supports the location and height of the sign but the actual

sign background area will be limited to SO s.f., excluding any part of the sign structure or support.
Applicant should clarify if the sign is intended to be a multi-panel sign for future users of Lot 3 or
if it's intended to sign only the bank. As asingle-tenant sign, the above conditions would apply.
However, if the sign is intended to provide signage for future users on the west and south ends of
the lot, Staff could support a larger sign background area - up to 80 s.f. The property owner should
consider that any future uses in the NW area of the lot will have no direct street frontage and may
benefit from signage at this Iocation.
13. Staff is concerned about the lack of pedestrian access to the bank off Allen Street and the main
driveway coursing the southern boundary of this site. No sidewalks are shown to access the site
from either Allen Street or the new proposed driveway. Given the existing office buildings in
Midvalley Business Park south of Magic View Drive, the approved office building on Lot 3 south
of the bank and the proposed AmeriTel Inn east of the site, there is an increasing opportunity for
pedestrian traffic in this subdivision. In coordination with Magic View Partners LLC, Staff
recommends the Applicant add sidewalks to the plan to access the bank entry in accordance with
Magic View Partner's design of the southern half of Lot 3. Sidewalk connection should be made to
the Allen Street extension currently under construction. The Applicant should be prepared to
address this issue at the Planning & Zoning Commission hearing.
GENERAL REQUIREMENTS
1. Off-street parking shall. be provided in accordance with Section 11-13 of the City of Meridian
Zoning and Development Ordinance and/or as detailed in site-specific requirements.
2. Paving and striping shall be in accordance with the standards set forth in Sections 11-13-4.D.
and 11-13-4.E. of the City of Meridian Zoning and Development Ordinance and in accordance
with Americans with Disabilities Act (ADA) requirements.
3. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall
be submitted to the City Engineer (Ord. SS7, 10-1-91) for all off-street parking areas. All site
drainage shall be contained and disposed of on-site.
4. Outside lighting shall be designed and placed so as to not direct illumination on any nearby
residential areas and in accordance with City Ordinance Section 11-13-4.C.
S. Any existing domestic wells and/or septic systems within this project will have to be removed
from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells may be used
for non-domestic purposes such as landscape irrigation.
6. All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing
or lying adjacent and contiguous to the parcel shall be tiled per City Ordinance 12-4-13. Plans
will need to be approved by the appropriate irrigation/drainage district, or lateral users
association, with written confirmation of said approval submitted to the Public Works
Department.

7. Provide a minimum of one (1) three-inch (3") caliper tree per 1,500 sq. ft. of asphalt area on the
site in accordance with City Ordinance Section 11-13-4.B.3.c.
8. All trash and/or garbage collection areas shall be enclosed on at least three (3) sides in
accordance with City Ordinance Section 11-12-1.C. Coordinate trash enclosure locations and
construction requirements with Sanitary Service Company (SSC} and provide a letter of

STORM WATER MANAGEMENT RECOMMENDATIONS
It is recommended that storm water be pre-treated through a grassy swale
prior to discharge to the subsurface to prevent impact to ground water and

This application has been referred to ACHD by the City of Meridian for review and comment. The
applicant is requesting conditional use approval to construct a 5,260-square foot bank with drive-thru
window. The 0.95-acre site is located on the west side of St. Lukes Street/Allen Street extended, and
north of Magic View Drive. This development is estimated to generate 1,400 additional vehicle trips
per day based on the Institute of Transportation Engineers Trip Generation manual.
The Commission previously reviewed and approved this site as MAZ99-0022/MCUP99-0040, a
rezone and conditional use application for an office and restaurant. This report addresses the current

~::` HISTORY:
B. On December 30, 1998, the ACHD Commission acted on MCU-43-97 and as art of that actin
found that an extraordinary impact existed because of the potential of large volpumes of trips th t
would be generated by the redevelopment of Magic View Subdivision and required the
construction and dedication of a new road into the Magic View Subdivision from Eagle Road
opposite the driveway/private street into St. Luke's medical center. During consideration of
MCU-43-97, the Commission reviewed several options for assuring adequate and safe access
from Eagle Road into this rapidly redeveloping area. The selected option included the
construction of the new road across the property that was the subject of MCU-43-97 and through

the subject site extending the road to the intersection of Magic View Drive and Allen Drive. The
cost of construction and right-of--way was to be shared among all the redeveloping properties in
Magic View Subdivision.
C. In the Consideration of MCU-43-97, the Ada County Highway District found that the anticipated
fiscal impacts of the anticipated developments in Magic View Subdivision are of such a
magnitude that ACHD will be unable to accommodate the developments without excessive and
unscheduled public expenditures which exceed the anticipated impact fees from such
developments. The above mentioned street will ultimately be constructed as a 52-foot (4-lane)
street section, at its connection with Eagle Road, tapering to a standard 46-foot commercial street
section 500-feet west of Eagle Road. The cost of the roadway was estimated to be approximately
$650,000.00. Since that estimate, the developer ofMCU-43-97 has constructed about one-third
ofthe-length of the road. The construction of the road was at the expense of the developer and
ACHD purchased the right-of--way.
In its review of MCU-43-97, the Commission adopted an extraordinary fee based on trip
generation rates. The Commission determined that the Extraordinary Impact Fee would
be $43.19 per trip. This parcel includes 0.95-acres, resulting in a trip generation rate of
approximately 1,395-trips per day, for a bank with a drive thru. Therefore, this property
should pay an overlay fee to the District in the amount of approximately $60,250. Staff
recommends that the Commission require the payment of that amount into a fund for the
reimbursement of cost to construct and dedicate right-of--way for a new road from the
intersection of Eagle Road and St. Luke's driveway to the intersection of Magic View Drive
and Allen Drive as the proportionate share of this property on a per trip basis.
D. St. Luke's Street is currently being extended through the site to Magic View Drive in alignment
with Allen Street as a 46-foot street section with curbs, gutters, sidewalks and bike lanes.
CURRENT APPLICATION
E. On November 13, 2000, the District Planning and Development staff inspected this site and
evaluated the transportation system in the vicinity. On November 20, 2000, the staff met as the
District's Technical Review Committee and reviewed the impacts of this proposed development
on the District's transportation system. The results of that analysis constitute the following Facts
and Findings and recommended Site Specific Requirements.

F. The applicant is proposing to construct a 25-foot wide driveway south of the site, at the south
property line. The driveway will be shared with the site to the south when it develops. Policy
requires driveways to align or offset a minimum of 125-feet from any existing or proposed
driveways.
Staff is currently reviewing a conditional use application for a hotel on the east side of Allen
Street. When the roadway was designed a driveway on the east side of Allen Street was
approved in alignment with the proposed driveway. The hotel site does not show a driveway in
that location. The proposed driveway is approved with this application.
G. Graveled driveways abutting public streets create maintenance problems due to gravel being
tracked onto the roadway. In accordance with past action by the District the applicant should be
required to pave the driveway its full width and at least 30-feet into the site beyond the edge of
pavement of Allen Street with 15-foot curb radii.
H. The applicant should be required to provide a recorded cross access easement from the parcel to
the south to use that parcel for access to the public streets prior to issuance of a building permit
because this site does not have direct lot access.
I. Utility street cuts in pavement less than five years old are not allowed unless approved in writing

,,Y J. In order to reduce trips to and from this development it is recommended that Tenants occupying
the proposed building be required to provide an Alternative Transportation Program for
employees and provide an annual report to ACRD on employee participation. Commuteride
-~-.~i staff will coordinate the Alternative Transportation Program with the applicant. For more

K. In order to reduce trips to and from this development, it is recommended that the tenants
occupying the proposed building(s) be required to participate in any Transportation Management
Association (TMA) or Transportation Management Organization (TMO) that is formed with a
boundary that includes this site or is adjacent to this development.
A Transportation Management Association (TMA) or Transportation Management Organization
(TMO) is formed with a coordinator that works as a liaison between businesses and private and
public transportation providers to increase the use of alternative transportation and other trip
reduction measures (shuttle buses, bus pass programs, vanpools, carpools, bicycle and walking
enhancements). An annual survey will be required of the TMA/TMO to monitor participation in
alternative transportation programs and forwarded to the ACHD Commuteride Office.
L. Based on development patterns in this area and the resulting traffic generation, staff anticipates
that the transportation system will not be adequate to accommodate additional traffic generated
by this proposed development with the requirements outlined within this report.

Special Recommendation to City of Meridian and ITD:
1. This development and the potential for redevelopment in the area will exacerbate the existing
traffic problems on Eagle Road. The District reconnnends that a median be constructed in
Eagle Road from the Eagle Road/I-84 interchange to Franklin Road as suggested in the second
level of access control recommended in the Eagle Road Access Control Study. The median
should be constructed to eliminate left turns at driveway and street approaches at every location
except the St. Luke's signalized driveway and the westward extension of St. Luke's Street. In
later stages of protection, frontage road on both the east and west side of Eagle Road should be
constructed from Franklin Road south to the signalized intersection at St. Luke's driveway to
provide access to full access intersections for the parcels affected by the median.
The following requirements are provided as conditions for approval:
Site Specific Requirements:
Construct a 25-foot wide shared driveway south of the site, at the south property line as
proposed. Pave the driveway its fiill width and at least 30-feet into the site beyond the edge of
pavement of Allen Street with 15-foot curb radii.
2. Provide a recorded cross access easement from the parcel to t11e south to use that parcel for

3. Prior to issuance of a building permit, the developer shall be required to pay the standard
impact fee, and the overlay fee of approximately $60,250, based on 1,395 vehicle trips per day.
The overlay fee will offset the cost of the extension of St. Lukes Street.
4. Utility street cuts in pavement less than five years old are not allowed unless approved in

Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein. An
engineer registered in the State of Idaho shall prepare and certify all improvement plans.
The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. It is the responsibility of the applicant to verify all existing utilities within the right-of--way.
Existing utilities damaged by the applicant shall be repaired by the applicant at no cost to
ACHD. The applicant shall be required to call DIGLINE (1-800-342-1585) at least two full
business days prior to breaking ground within ACRD right-of--way. The applicant shall contact
ACHD Traffic Operations 387-6190 in the event any ACHD conduits (spare or filled) are

8. No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to

9. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject

This application has been refen-ed to ACHD by the City of Meridian for review and comment. The
applicant is requesting conditional use approval to constrict a 5,260-square foot bank with drive-thru
window. The 095-acre site is located on the west side of St. Lukes Street/Allen Street extended, and north
of Magic View Drive. This development is estimated to generate 1,400 additional vehicle trips per day
based on the Institute of Transportation Engineers Trip Generation manual.
The Commission previously reviewed and approved this site as MAZ99-0022/MCUP99-0040, a rezone
and conditional use application for an office and restaurant. This report addresses the current site plan.

Franklin Road is improved with two lanes east and west of Eagle Road. The Franklin Road/Eagle
Road intersection operates at a Level of Service F and is listed as one of the hundred most critical
intersections in Ada County.
HISTORY:
B. On December 30, 1998, the ACHD Commission acted on MCU-43-97 and as part of that action,
found that an extraordinary impact existed because of the potential of large volumes of trips that
would be generated by the redevelopment of Magic View Subdivision and required the construction
and dedication of a new road into the Magic View Subdivision from Eagle Road opposite the
driveway/private street into St. Luke's medical center. During consideration of MCU-43-97, the
Commission reviewed several options for assuring adequate and safe access from Eagle Road into
this rapidly redeveloping area. The selected option included the construction of the new road across
the property that was the subject of MCU-43-97 and through the subject site extending the road to
the intersection of Magic View Drive and Allen Drive. The cost of construction and right-of--way
was to be shared among all the redeveloping properties in Magic View Subdivision.
C. In the Consideration of MCU-43-97, the Ada County Highway District found that the anticipated
fiscal impacts of the anticipated developments in Magic View Subdivision are of such a magnitude
that ACHD will be unable to accommodate the developments without excessive and unscheduled
public expenditures which exceed the anticipated impact fees from such developments. The above
mentioned street will ultimately be constructed as a 52-foot (4-lane) street section, at its connection
with Eagle Road, tapering to a standard 46-foot commercial street section 500-feet west of Eagle
Road. The cost of the roadway was estimated to be approximately $650,000.00. Since that estimate,
the developer of MCU-43-97 has constructed about one-third of the length of the road. The
construction of the road was at the expense of the developer and ACHD purchased the right-of--way.
In its review of MCU-43-97, the Commission adopted an extraordinary fee based on trip
generation rates. The Commission determined that the Extraordinary Impact Fee would be
$43.19 per trip. This parcel includes 0.95-acres, resulting in a trip generation rate of
approximately 1,395-trips per day, for a bank with a drive thru. Therefore, this property
should pay an overlay fee to the District in the amount of approximately $60,250. Staff
recommends that the Commission require the payment of that amount into a fund for the
reimbursement of cost to construct and dedicate right-of--way for a new road from the
intersection of Eagle Road and St. Luke's driveway to the intersection of Magic View Drive
and Allen Drive as the proportionate share of this property on a per trip basis.
D. St. Luke's Sheet is currently being extended through the site to Magic View Drive in alignment with
Allen Street as a 46-foot street section with curbs, gutters, sidewalks and bike lanes.

CURRENT APPLICATION
E. On November 13, 2000, the District Planning and Development staff inspected this site and
evaluated the transportation system in the vicinity. On November 20, 2000, the staff met as the
District's Technical Review Committee and reviewed the impacts of this proposed development on
the District's transportation system. The results of that analysis constitute the following Facts and
Findings and recommended Site Specific Requirements.
F. The applicant is proposing to construct a 25-foot wide driveway south of the site on Allen Street, at
the south property line. The driveway will be shared with the site to the south when it develops.
Policy requires driveways to align or offset a minimum of 125-feet from any existing or proposed
driveways.
Staff is currently reviewing a conditional use application for a hotel on the east side of Allen Street.
When the roadway was designed a driveway on the east side of Allen Street was approved in
alignment with the proposed driveway. The hotel site does not show a driveway in that location.
The proposed driveway is approved with this application.
Based on the volumes of traffic expected to use this new roadway, this driveway may be restricted to
right-in/right-out at some point in the future when there is another full access driveway for this site.
G. Graveled driveways abutting public streets create maintenance problems due to gravel being tracked
onto the roadway. In accordance with past action by the District the applicant should be required to
pave the driveway its full width and at least 30-feet into the site beyond the edge of pavement of
Allen Street with 15-foot curb radii.
H. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by

In order to reduce trips to and from this development it is recommended that Tenants occupying the
proposed building be required to provide an Alternative Transportation Program for employees and
provide an annual report to ACHD on employee participation. Commuteride staff will coordinate
the Alternative Transportation Program with the applicant. For more information contact Pat Nelson

In order to reduce trips to and from this development, it is recommended that the tenants occupying
the proposed building(s) be required to participate in any Transportation Management Association
(TMA) or Transportation Management Organization (TMO) that is formed with a boundary that
includes this site or is adjacent to this development.
A Transportation Management Association (TMA) or Transportation Management Organization
(TMO) is formed with a coordinator that works as a liaison between businesses and private and
public transportation providers to increase the use of alternative transportation and other trip
reduction measures (shuttle buses, bus pass programs, vanpools, carpools, bicycle and walking
enhancements). An annual survey will be required of the TMA/TMO to monitor participation in
alternative transportation programs and forwarded to the ACHD Commuteride Office.

K. Based on development patterns in this area and the resulting traffic generation, staff anticipates that
the Franklin Road/Eagle Road intersection will not be adequate to accommodate additional h•affic
generated by this proposed development with the requirements outlined within this report.
Special Recommendation to City of Meridian and ITD:
This development and the potential for redevelopment in the area will exacerbate the existing
traffic problems on Eagle Road. The District recommends that a median be constructed in Eagle
Road from the Eagle Road/I-84 interchange to Franklin Road as suggested in the second level of
access control recommended in the Eagle Road Access Control Study. The median should be
initially constructed to eliminate outbound left turns at driveway and street approaches at every
location except the St. Luke's signalized driveway and the westward extension of St. Luke's Street.
In the future, left turns into these driveways and street approaches may be eliminated as well. In
later stages of protection, frontage roads on both the east and west side of Eagle Road should be
constructed from Franklin Road south to the signalized intersection at St. Luke's driveway to
provide access to full access intersections for the parcels affected by the median. It is important to
recognize that a median in Eagle Road will cause inconvenience to the residents of the existing
subdivisions at the southeast and southwest corners of the intersection at Franklin and Eagle Roads,
but will improve the overall safety of the roadways.

Applicant
1. The property is located at the northwest corner of Magic View Drive
and Allen Street, Meridian, Idaho.
2. The owner of record of the subject property is James Boyd of Boise.
3. Applicant is Mountain West Banlc of Coeur d'Alene.
4. ,The subject property is currently zoned LO Limited Office. The zoning
district of LO is defined within the City of Meridian Zoning and Development
Ordinance, Section 11-7-2.
5. The proposed application requests a conditional use permit for a bank
with adrive-thru window. The LO zoning designation within the City of Meridian
Zoning and Development Ordinance requires a conditional use permit be obtained
for most uses including those requested by the Applicant. (Meridian City Zoning and
Development Ordinance, Section 11-8-1).

any future uses in the NW area of the lot will have no direct street
frontage and may benefit from signage at this location.
1.10 Staff is concerned about the lack of pedestrian access to the bank off
Allen Street and the main driveway coursing the southern boundary of
this site. No sidewalks are shown to access the site from either Allen
Street or the new proposed driveway. Given the existing office buildings
in Midvalley Business Park south of Magic View Drive, the approved
office building on Lot 3 south of the bank and the proposed AmeriTel
Inn east of the site, there is an increasing opportunity for pedestrian
traffic in this subdivision. In coordination with Magic View Partners
LLC, Staff recommends the Applicant add sidewalks to the plan to
access the bank entry in accordance with Magic View Partner's design of
the southern half of Lot 3. Sidewalk connection should be made to the
Allen Street extension currently under construction. The Applicant
should be prepared to address this issue at the Planning & Zoning
Commission hearing.
1.11 Off-street parking shall be provided in accordance with Section 11-13 of
the City of Meridian Zoning and Development Ordinance and/or as
detailed in site-specific requirements.
1.12 Paving and striping shall be in accordance with the standards set forth in
Sections 11-13-4.D. and 11-13-4. E. of the City of Meridian Zoning and
Development Ordinance and in accordance with Americans with
Disabilities Act (ADA) requirements.
1.13 A drainage plan designed by a State of Idaho licensed architect or
engineer is required and shall be submitted to the City Engineer
(Ord. 557, 10-1-91) for all off-street parking areas. All site drainage shall
be contained and disposed of on-site.
1.14 Outside lighting shall be designed and placed so as to not direct
illumination on any nearby residential areas and in accordance with City
Ordinance Section 11-13-4.C.
1.15 Any existing domestic wells and/or septic systems within this project will
have to be removed from their domestic service per City Ordinance

6. The Meridian Planning and Zoning Commission recognizes that the
proposed application is in compliance with the Meridian Comprehensive Plan.
7. The use proposed within the subject application will in fact, constitute a
conditional use as determined by City Policy.
RECOMMENDATION
The Meridian Planning and Zoning Commission hereby recommends to
the City Council of the City of Meridian that they approve the conditional use
permit as requested by the applicant, subject to the following:
Adopt the Recommendations of the Planning and Zoning and Engineering
departments as follows:
1.1 Sanitary sewer and water service to this site will be provided via mains
and services that were installed as part of the recently completed St.
Luke's road extension project and subject to latecomers fees.
1.2 In accordance with City Ordinance 11-13-4.B.2., underground year-
round pressurized irrigation must be provided to all landscape areas on
site. Please submit hook-up and design details based on the proposed
landscaping. Applicant shall be required to utilize any existing surface or
well water for the primary source. If City water is proposed as a
secondary source, developer shall be responsible to pay water
assessments for the landscaped areas.
1.3 Ordinance 11-4-9.B., "Modification or Amendment of Applications Or
Uses," allows approved applications, including CUP's, to be amended,
altered or modified through the same procedures as an initial
application. The conditions of the existing CUP do not restrict future
modifications. As an application modification, the Applicant should
provide to the P&Z Commission and Council a list of all existing
conditions (as outlined in Item #2, pages 10-13, of the CUP Decision

and Order signed by the City on 3-7-00) and state which conditions he
wishes to modify or delete vis-a-vis the subject application. An 8 i/z x
11 " copy of the existing/approved Site Plan for Lot 3 should be attached
to this list of proposed modifications. The Applicant should also
provide a conceptual Site Plan of how the proposed bank plan/layout
will interface with the existing plan for the entire lot. .
1.4 Existing Development Agreement Terms: A Development Agreement
(DA), recorded by Ada County on 3-23-00 as Instrument # 100021869,
is binding on the subject property. Since Magic View Partners was the
developer/property owner who signed the DA, they are ultimately
responsible to the City for completion of these requirements -not
Mountain West Banlc. But since Mountain West Banlc's application is
the first proposed building on Lot 3 of the Magic View Partner's project,
Staff felt it was most appropriate to include the outstanding annexation
and DA conditions herewith. The DA allows office uses outright and
requires a CUP for all other uses. Section 5 (page 4) of the DA also
contains 14 special conditions that must be met on this property. Staff
has reviewed the 14 DA conditions and listed below several conditions
that must still be completed as part of the annexation. We have
suggested some new timeframes (shown in italics) for completion of
these items in tandem with the AmeriTel Inn project:
a. DA requires construction of a 4-foot berm and a 6-foot fence
within a 20-foot wide buffer along the north boundary of Lot 3. (This
should be constructed prior to issuance of Mountain West Banlc
building permits.)
b. DA requires Magic View Partners to enter into a License
Agreement with ACHD for construction of the 30-foot berm. (A copy of
said agreement should be provided to the P&Z Department at the time
of CZC submittal.) Staff in their memo of 1 / 18/01 recommended this
condition 7b. be deleted. 7.c was also deleted and this item
renumbered.
c. DA requires dedication of all rights-of-way for the St. Luke's
Road and Magic View Drive by recorded Warranty Deed prior to the
issuance of any building permits. (A copy of said deed should be
provided to the P&Z Department at the time of CZC submittal. )
d. Item # 14, page 9, of the DA states that no Certificates of

Occupancy will be issued on this ground "until all infrastructure and
other improvements which are imposed by the terms of this agreement,
the annexation ordinance, and the CUP are completed," unless there is
an amendment. Staff understands this condition to apply to the above
a-c conditions.
1.5 The Site Plan shows six (6) new trees within a 5-foot planter strip along
the eastern property boundary. It appears these trees may be in a
Nampa Meridian Irrigation District easement. Trees are not permitted
within NMID's easements. Applicant should verify NMID's easements
and, should the trees need to be relocated, provide a revised landscape
plan.
1.6 An internal parking lot planter must be added to the parking row of 18
stalls along the eastern property line to break-up this continuous row of
parking spaces.
1.7 The Site Plan shows the preliminary location of sewer and water service
lines adjacent to the eastern side of the building, passing under the
landscape planter at the SE corner of the building. These lines will need
to be moved east of the planter to accommodate the tree in this planter.
1.8 The Site Plan shows entry drive aisle widths of 24 feet off the main
driveway and on the north, east and south sides of the building. City
Ordinance 11-13-4.F. requires a minimum of 25 feet. Please revise these
widths accordingly on the Site Plan at the time of building permits
submission.
1.9 The Applicant is proposing one (1), 8-foot tall, 90 s.f. free-standing sign
at the SE corner of the site, just north of the entry drive. Staff supports
the location and height of the sign but the actual sign background area
will be limited to 50 s.f., excluding any part of the sign structure or
support. Applicant should clarify if the sign is intended to be a multi-
panel sign for future users of Lot 3 or if it's intended to sign only the
bank. As asingle-tenant sign, the above conditions would apply.
However, if the sign is intended to provide signage for future users on
the west and south ends of the lot, Staff could support a larger sign
background area - up to 80 s.f. The property owner should consider that

As you are likely aware from the P&Z meeting notes, the neighborhood in general has been very supportive of the
proposed Mountain West Bank application (CUP-00-049). This is due to the fact that the applicant has stated that hours
of operation will be weekdays (9-6) and the application itself is much in alignment with the concept of one story office
buildings backing up to the neighborhood that was represented by the developer in the original meetings and concept plan
submitted in the development agreement. In fact, if it were not for the 24-hour ATM and night drop the bank proposes,
we would likely not even be here before you tonight.
Unfortunately, there is one small remaining item that must be resolved before the neighbors can fully support this
development. We have attempted to work with the bank and the developer on this issue, but have not been able to make
any progress; therefore, we must plead our case before the members of the city council.
As you are well aware, ATM crime is a major concern in the banking industry (*1,*2) as well as within local
communities. For this very reason, security analysts for the banking community along with insurance companies of the
banking industry recommend that ATMs and night drops be placed in site of high traffic areas where they are very visible
to the public at all hours (*3,*4).
In our original meetings with the bank we voiced our concern about security and the bank representative indicated that
security was an issue and that it was a high priority. At the ls` P&Z meeting (in which the hearing was postponed) the
neighbors again spoke to both the developer and another representative from the bank about security and specifically
requested that they look at several alternatives for the ATM and night drop:
1. Closing the ATM at dusk.
2. Relocating the ATM to the front of the building away from the neighborhood and visible from the street.
3. Constructing an 8' mason wall that could serve as barrier to potential crime.
The representative assured us they would look into these issues, but did not return our call when we requested to see what
progress had been made prior to the Feb ls` P&Z meeting. We can understand why closing the ATM may not be in the
best business interest of the bank, and we can even understand why it may have been too expensive to relocate the ATM
to the front, since they are attempting to squeeze this bank onto a very small piece of the property and plan to put another
building just to the west. But we cannot understand why the developer and bank will not agree to even consider the third
most cost effective alternative. Since the ATM is located away from the main street behind the building to the west and
in direct view of trees on the berm backing neighbor yards where a criminal element could hide, we feel that a wall is
required.
Attached you will find diagrams and contractor quotes of how this wall can be built with minimal cost and impact to the
bank and developer. This is the same system used along the recent Curtis road extension. The contractor assures us that
installation on the berm is not a problem as long as the berm is constructed properly. In fact, the same system was used to
construct this wall on a berm in Salt Lake City and it is still plumb today, ten years after the initial installation. In
addition, when you examine the costs of the proposed pre-cast masonry wall vs. a wooden fence, its likely that the wood
fence would end up being even more expensive to maintain and replace, before the warranty on the masonry wall is ever
reached (*5).
All it would take is one criminal incident that could alter the life of a neighbor family member forever. Please grant us
the courtesy of that consideration when you rule on this CUP.
We therefore formally request that CUP-00-049 and CUP-99-040 corresponding to the original development agreement
#10021869 be modified from:
"a 4 foot high berm and 6-foot high solid, wooden fence on top of the berm...."
to read: "a 4 foot high berm and a 7'/z-foot high minimum solid wall (masonry, concrete, stone, or pre-cast mason) on
top of the berm...."
With this one modification the neighbors could support the development of Mountain West Bank 100%.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the Planning and Zoning Commission of the
City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho
Avenue, Meridian, Idaho at the hour of 7:00 p.m. on February 1, 2001, for the purpose
of reviewing and considering the application of Mountain West Bank for a Conditional
Use Permit to construct a branch bank with drive-thru teller in an L-O zone generally
located west of Eagle Road, north of Magic View Drive .
A more particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Avenue, and is available for inspection during
regular business hours, Monday through Friday, 8:00 a.m. to 5:00 p.m.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing and the public is welcome and invited to
submit testimony. Oral testimony may be limited to three (3) minutes per person.
Written testimony may be submitted seven (7) days prior to the above hearing date so
that all interested parties may examine them prior to the hearing.

This application has been referred to ACHD by the City of Meridian for review and comment. The
applicant is requesting conditional use approval to construct a 5,260-square foot bank with drive-thru
window. The 0.95-acre site is located on the west side of St. Lukes Street/Allen Street extended, and

Per our conversation earlier today, attached is a copy of Meridian's sign application form
Also, I checked the conditions of the approved CUP on the entire W.H.Moore parcel. I'm
attaching page 4 from the final Order of Conditional Approval on this CUP. Condition #2.11
outlines the signage requirements for both lots in the original CUP (note that the allowable
number of 4 signs would be cut in half for just the west parcel that the bank is on -making
the maximum number of allowable signs on that parcel of 2 signs). Until W.H. Moore submits
a CUP to formally amend this condition as stated, this is what runs with the land. A sign
program was not approved with the original CUP (even though that's what the condition
states). So, if you want to amend the existing CUP sign condition with the pending bank CUP,
we will need to see a site plan of the entire parcel with details on the number, locations and
size of all proposed signs at build-out. Otherwise, condition #2.11 of the existing CUP will
govern the allowable signage for the bank -which would likely mean the free-standing sign
for the bank only would not be approved.
Hope this helps. We will need any additions/modifications to the bank CUP application by
Tuesday at 12:00 noon in order to make it into the Commissioner's packets for the Thursday
meeting.

about reposting for this project. I spoke with Shelby at the City tnis morning; she was
extremely helpful and faxed me a copy of the undated letter and affidavit tha' wos to
have been sent out to all project applicants prior to the rescheduled hearing. Patano
Architects did not receive this letter and affidavit for reposting; and to the best of my
knowledge, neither did the developers for the project, WH Moore Company and J: Boyd
Company. (A copy of the letter was foxed to WH Moore on Jan. 3~, the day before the

was acceptable. On Tuesday Jan 2~d. Jonathan sold that, as per o conversation with Ms.
Stiles, the drawings were to be submitted without the drive through shown. we have
changed all of our drawings and instructed our consultants to do the some. On January
9~ ~ we plan to su'~mit the items req~~ired for the Certificate of Zoning Compliance; on
January 16'" we will be submitting the items required for the building permil. As di~ected
by the Ci+y, we will not be showing the drive through at this +ime, I confrmed the in o
conversation with Brad this morning.
