This letter is to confirm that the Director approved your conditional use permit time extension application
for the subject property.
In accord with UDC 11-SB-6F, in order for the conditional use permit to remain valid, the applicant shall
commence the use as permitted in accord with the conditions of approval, satisfy the requirements set
forth in the conditions of approval, and acquire building permits and commence construction of
permanent footings or structures on or in the ground, or submit an application for a time extension on or
before December 2, 2014.
The applicant, director, or a party of record may request City Council review of a decision of the Director.
All requests for review shall be filed in writing with the Planning Department on or before December 14,
2012, within fifteen (15) days after the written decision is issued, and contain the information listed in
UDC 11-SA-6B.
If City Council review of the decision is not requested, the action of the Director represents a final
decision on a land use application. You have the right to request a regulatory: taking analysis under Idaho
Code 67-8003.

SUBJECT: Jack in the Box -Conditional Use Permit Time Extension (File #TED-12-001)
I. APPLICATION SUMMARY
The applicant, Jeffrey Hall, has requested approval of a two (2) yeaz time extension to commence the
use approved with the conditional use permit (CUP-10-012). The conditional use permit is for a
restaurant with a drive through located at 1815 S. Meridian Road.
The conditional use permit for the restaurant with a drive through was approved by the Meridian
Planning and Zoning Commission on December 2, 2010. Per the conditions of approval, the
conditional use permit would otherwise expire on December 2, 2012.
The applicant has been unable to meet the time requirements specified in Unified Development Code
(CTDC) 11-SB-6F for conditional use permits. The applicant states Jack in the Box has been in a
transitional period with a new franchisee during this period and unable to commence the use.
The subject property is located at 1815 S. Meridian Road, in the NE 1/< of 3N., 1 W., Section 24.
II. STAFF RECOMI~~NDATION
Staff recommends approval of a two (2) year time extension for the conditional use permit, as
requested by the applicant, to expire on December 2, 2014, with the conditions listed in Exhibit B.
III. STAFF ANALYSIS
The City of Meridian's Unified Development Code (iJDC 11-SB-6F3) authorizes the Director to
grant a single extension of time not to exceed one two (2) year period to commence the use approved
with the conditional use permit as specified in UDC 11-SB-6F.1, provided that none of the conditions
listed in UDC 11-SB-6F.4 exist. Further, the Director may require compliance with the current
provisions of the UDC as a condition for granting a time extension (UDC 11-SB-6F3).
Since the approval of the conditional use permit, the Unified Development Code (LTDC) has been
amended to require the property owner to .post a performance surety with the City in the amount of
125% of the total construction cost for all incomplete sewer, water and reuse infrastructure prior to
fmal plat signature. Additionally, the property owner is required to post a warranty surety with the
City in the amount of 20% of the total construction cost for all completed sewer, water and reuse
infrastructure for a duration of two years. Staff recommends these new UDC requirements be
included as conditions of approval of the current time extension request.

commence the use.
