Bill: as a follow up to our phone conversation, I own the property at 3300 Falcon Drive, which is immediately
to the west of the above project, as my residence for nearly 30 years. I have been in contact with Scott Wonders
at JUB and with Mr. Evans of the LLC as well. I will not be back in the country for the December 6 hearing, so
I am submitting this email as written testimony for the hearing. The two items that need to be in the project
when final, and which have been discussed with the project, and with which I understand they agree:
(1) The irrigation pump that serves my property (and 3 other properties not in the project) is located on the
northwest corner of the project, near Victory Road, on the McDonald lateral. We all will continue to need water
from that pump each irrigation season in the future. Scott is working with the irrigation company to determine
the best method to continue that usage for the 4 properties outside the project. We are all flow irrigation (6"
gated pipe) and that is what the pump is designed to serve. We would not be able to use pressurized irrigation
from the project to my understanding. I have been paying for all expenses of the pump, including all repairs, for
years.
(2) The fencing of the property between the project and my property, which I understand to be a six foot fence,
needs to be vinyl rather than wood, preferably beige or tan. I run horses in the field adjoining that fence, and
they are great chewers on wood. Wood also tends to deteriorate in appearance pretty quickly.
The lots in this project, compared to the prior submission some years ago by a different owner, are larger lots
bordering my property, all back. yards, so the set back should be suff dent. The neighbors to the south may have
concerns about the two lots facing on Falcon, but they were having discussions with the owner and Scott and
appeared to be settling those questions. I am still concerned about traffic from the project onto or from Falcon,
since access to Eagle Road from Falcon, and from Eagle Road to Falcon, is difficult during rush hours, and
often other times, and Falcon itself is narrow. Waiting on Eagle to turn onto Falcon with a green light behind
you at Victory and Eagle is an interesting experience. However, it appears that the project design will tend to
push most of the project traffic north to Victory rather than onto Falcon.
