Irrigation District. for its review on the above-referenced development. If this
development.. is under a "rush" to be finalized, I would recommend that you submit a
cashier's check, money order or cash as payment of the fees in order to speed the
process up. If you submit a company or personal check, it must clear the bank before
processing the application.
Should this development be planning a pressure urban irrigation system that will be
owned, operated and maintained by the Irrigation District, I strongly urge you to
coordinate with John P. Anderson, Water Superintendent for the Irrigation District,
concerning the installation of the pressure system. Enclosed is a questionnaire that you
must fill out. and return in order to initiate the process of contractual agreements between
the owner or developer and the Irrigation District for the ownership, operation and
maintenance of the pressure urban irrigation system.

Please find attached the original of the Findings of Fact and Conclusions
of Law and Decision and Order Granting a Variance, pursuant to action of the
Council at their October 17, 2000, meeting. The Findings will be on the Council's
agenda for November 8, 2000.
Please serve conformed copies of the Findings upon the Applicant and
the Planning and Zoning Department, Public Works and the City Attorney office, if
Council approves the Findings.

12. The proposed parking lot design utilizes landscaping which exceeds the proposed Landscape
Ordinance.
13. The current Landscape Ordinance requires 3 inch caliper trees. Planning staff allows for
110% of the required caliper inches when large trees are not available, as is the current
situation. The proposed landscape plan shows 121 trees, which is 75% of the current
requirement.
14. The larger trees required by the current Landscape Ordinance are difficult to obtain. The
available landscape area will be heavily planted with trees, as proposed. Additional trees
would present maintenance problems caused by overcrowding.
15. With the new Landscape Ordinance expected to be adopted in the near future, this variance
would result in this property being well in compliance as soon as the new ordinance is
approved.
16. Other properties are not in compliance with the current Landscape Ordinance. The
Albertson's property to the east is in the process of being upgraded.
17. Should the current Landscape Ordinance be applied, the owner would not enjoy the
improvements of the new ordinance.
18. The owner was not involved in the decision by Meridian Planning and Zoning to revise the
Landscape Ordinance, nor did the owner contribute to non-availability of larger trees.
19. Granting of this variance would not confer any special rights to Micron Technology which
are, or will be, available to adjacent property owners.
20. The proposed variance would not affect the Meridian Comprehensive Plan.
21. The application fee is attached,
22. Micron Technology would be convenienced through the availability of the smaller caliper
trees. Micron would not profit from the proposed variance. The convenience is not the sole
reason for the variance.
23. The applicant agrees to post the property not less than one week prior to the hearing date.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the City Council of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the
hour of 7:30 p.m. on October 17, 2000, for the purpose of reviewing and considering
the application of Micron Technology d/b/a Crucial Technology for a request in a
variance of the current landsaping ordinance to permit landscaping to be in compliance
with the proposed landscaping ordinance for property generally located off of Eagle
Road between Franklin Road and Fairview Avenue.
A more particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Street, and is available for inspection during
regular business hours.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing and the public is welcome and invited to
submit testimony.
