Micron CUP 00-003NOTICE OF HEARING NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian and the Laws of the State of Idaho, that the Planning and Zoning Commission of the City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho at the hour of 7:00 p.m. on January 11, 2000 for the purpose of reviewing and considering the application of Micron Technology for a conditional use permit, 4 each, 2880 square foot trailers and temporary parking zoned I-L located at 3475 E. Commercial Court, is a multi-use building comprised of warehouse space for the receiving, re-packaging and shipping of computer memory modules and office space for telephone and on-line ordering of the memory modules. The existing building has 50,000 square feet of floor area on the ground floor and 15,000 square feet on two mezzanine floors. Approximately 55% of the building area is warehouse use and the remaining 45% is offices. 6. The site is located in an area of light industrial and warehouse buildings. Other businesses in the immediate area include Coors Distributing, Albertson's, Idaho Truck Specialties, Sherwin-Williams Paints, Capitol Distributors, U.S. Filter and American Energy. The north property line parallels Commercial Court, the south property line abuts a railroad right-of--way, the east and west property lines adjoin other warehouse properties. Approximately 70% of the 6.56 acre property is currently improved with building, parking and landscaping. 7. The proposed use involves providing up to four temporary office units, each approximately 2,880 square feet, addmg 11, 520 square feet. They are frame structures with wood siding and asphalt shingle roofs. An interconnecting platform will provide access to the units, complete with stairs and handicap accessible ramps. Additional parking, about 248 spaces, will be provided in temporary graveled lots to the east and west of the units. Crucial Technology, a subsidiary of Micron Technology, Inc., is a wholesaler and distributor of computer memory modules. This business has been experiencing considerable growth recently and is expecting this growth to continue into the coming years. To accommodate this growth, additional office and warehouse space is required immediately. When Crucial originally occupied their building, a portion of it was left vacant to allow for future growth. In recent months, the available space has been exhausted. Micron is actively developing a permanent space alternative to the temporary space solution presented here. Micron currently expects to have new permanent space available in approximately 12 to 18 months. Given the industriaUagricultural nature of the vicinity, the temporary nature of the use, and since the temporary buildings will be both screened and dwarfed by the adjacent warehouse buildings, we feel that the proposed Conditional Use will have no detrimental effect on the subject property or the neighborhood. 13. City Ordinance Section 11-8-1.B lists temporary construction buildings as conditional uses in all zones but the R-4 zone, in which they are prohibited. Staff has not enforced conditional use permit applications for temporary construction buildings due to lack of staff and the proliferation of construction trailers throughout the City. In some cases, construction could be completed prior to obtaining a conditional use permit. Staff will be requesting a change of this ordinance provision to allow staff level approval of construction trailers. Due to the fact that this is not a temporary construction trailer and temporary buildings are not permitted outright anywhere in the City, and the fact that temporary gravel parking is being proposed, a conditional use permit is required. CONDITIONAL USE COMMENTS: 1. The property is designated in the Meridian Comprehensive Plan as Light Industrial. As part of a conditional use permit, the City of Meridian may impose additional restrictions/conditions. No new municipal sewer or water service is being requested by Micron to serve the trailers. Given the temporary nature of this development, Staff doesn't have any serious concerns about this arrangement. The primary consideration is that the trailers be adequately served with fire protection and that any additional usage placed on the existing sewer and water system in the main building be adequately assessed. (See condition #1 under "Site Specific" below.) 4. No signage details were submitted and none are approved separate from the existing signs. GENERAL REQUIREMENTS: 1. Any existing irrigation/drainage ditches crossing the property to be included in this project shall be tiled per City Ordinance 12-4-13. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance. Wells may be used for non-domestic purposes such as landscape irrigation. 3. Off-street parking shall be in accordance with the standards set forth in Section 1 i-13-4 of the City of Meridian Zoning and Development Ordinance and in accordance with the Americans with Disabilities Act (ADA) requirements. All site drainage shall be contained and disposed of on-site. 5. All construction shall conform to the requirements of the Americans with Disabilities Act. SITE SPECIFIC REQUIREMENTS 1. Applicant shall be required to enter into a Re-assessment Agreement with the City of Meridian. The City will review the existing water usage amounts for the 50,000-square-foot building and calculate the projected demand placed on the system based on the anticipated number of new employees. 2. Provide the Public Works and Fire Departments with information on the method of fire protection to be used for the modular trailers. Applicant must obtain a Certificate of Zoning Compliance and Occupancy Certificate for all modular trailers. 4. Coordinate locations of any new trash enclosure with Sanitary Services, Inc., and provide a letter of approval from their office prior to applying for building permits. 5. Sheet GO of the application shows a total of 137 standard parking spaces required on site, which includes the parking required for the 11,520 s.f. of office space for the trailers. However, the Applicant is requesting to add 244 new temporary parking spaces (gravel). This would result in 340 parking stalls beyond the required minimum. Staff does not understand the purpose in providing so many extra stalls. Applicant should address this issue before ahe Commission. With few exceptions, gravel parking is prohibited within Meridian city limits and discouraged due to contribution to air pollution levels. 6. The four modular trailers (11,520 s.f.) under an office use requires an additiona129 parking stalls, two (2) of which must be ADA handicap accessible. The Site Plan (Sheet G1) does not show any handicap stalls serving the trailers. Applicant shall provide a minimum of two (2) handicap stalls in the row of parking immediately north of the handicap ramp. These must be paved. 7. Provide handicapped accessible parking spaces and associated signage in accordance with the Americans with Disabilities Act. All building and parking lot construction needs to meet the requirements of the Americans with Disabilities Act. 8. A maximum timeframe needs to be established for allowing use of the temporary trailers. The C.U.P. application states 12-18 months as the estimated timeframe. If approved, Staff recommends Micron submit a status of their relocation plans after 12 months of operation (starting from date of occupancy). City Council must approve of any time extension beyond 18 months via a modification of the conditional use permit. 9. This parcel is adjacent to the Union Pacific Railroad. This corridor is designated as a multiple use pathway in the Meridian Comprehensive Plan. Staff recommends that landscaping be required adjacent to the UPRR right-of--way to improve the aesthetics of the temporary buildings and to bring the site up to Ordinance requirements. Three-inch caliper trees should be required using the area of existing asphalt and area that is proposed for temporary parking, with a minimum of one three-inch caliper tree per 1,500 square feet of such area.
