A notice of a public hearing on the conditional use permit was published for two (2) consecutive weeks prior to the said public hearing scheduled for February 6, 2001, before the City Council, the first publication appearing and written notice having been mailed to property owners or purchasers of record within three hundred feet (300') of the external boundaries of the property under consideration more than fifteen (15) days prior to said hearing and with the notice of public hearing having been posted upon the property under consideration more than one week before said hearing and the copies of all notices were made available to newspaper, radio and television stations as public service announcements; and the matter having been duly considered by the City Council at the February 6, 2001, public hearing; and the applicant, affected property owners, and government subdivisions providing services within the planning jurisdiction of the City of Meridian, having been given full opportunity to express comments and submit evidence. 2. The property is located south of Franklin Road and west of Locust Grove Road, Meridian, Idaho. 4. The owner of record of the subject property is the City of Meridian. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY LOMBARD-CONRAD / NEW POLICE DEPARTMENT R-8 ZONE / (CUP -00-054) - 2 5. Applicant is City of Meridian. 6. The subject property is currently zoned R-8. The zoning district of R-8 is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2. 7. The proposed application requests a conditional use permit for construction of a 35,208 s.f. police station. The R-8 zoning designation within the City of Meridian Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-8-1). 8. The Meridian City Council recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 9. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Ordinance. 10. The Meridian City Council takes judicial notice of its Zoning, Subdivision and Development Ordinances codified at Titles 11 and 12, Meridian City Code and all current zoning maps thereof and the Comprehensive Plan of the City of Meridian, and Maps and the Ordinance establishing the Impact Area Boundary. 11. Giving due consideration to the comment received from the governmental subdivisions providing services in the City of Meridian planning jurisdiction, public facilities and services required by the proposed development will not impose expense upon the public if the following conditions of development are imposed and the following is also FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY LOMBARD-CONRAD / NEW POLICE DEPARTMENT R-8 ZONE / (CUP -00-054) - 3 .-. found to be required to mitigate the effects of the proposed use and development upon services delivered by political subdivisions providing services to the subject real property within the planning jurisdiction of the City of Meridian: Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: 11.1 Sanitary sewer service to this site is not available at this time. Service will have to be extended from a future main to be installed within the future Watertower Road. Until service is available, sanitary restrictions shall remain in force on the subject parcel. 11.2 Water service to this site is not available at this time. Service will have to be extended from a future main to be installed within the future Watertower Road. Until service is available, sanitary restrictions shall remain in force on the subject parcel. Flow and pressure shall be monitored with the Meridian Water Department as part of the design process. It as anticipated that water pressures will be in the range of 50psi. 11.3 Assessments for sewer and water service are determined during the building permit application process. 11.4 In accordance with City Ordinance 11-13-4.B.2., underground year-round pressurized irrigation must be provided to all landscape areas on site. Applicant shall submit hook-up and design details based on the proposed landscaping. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the landscaped areas. 11.5 Existing Development Agreement Terms: A Development Agreement (DA) is binding on the subject property. Since Howell Murdoch Development Corp. was the developer who signed the DA, they are ultimately responsible to the City for completion of these requirements. The DA requires a CUP for the police station/department and also contains several special conditions that must be met on this property. Staff has reviewed the DA conditions and listed below several conditions that must be completed as part of the annexation. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY LOMBARD-CONRAD / NEW POLICE DEPARTMENT R-8 ZONE / (CUP -00-054) - 4 Item #5.1 — Any existing irrigation/drainage ditches crossing the property shall be tiled per City Ordinance. No variances were requested at the time of annexation. The applicant requested a wavier, see 11.32 on page 9, as approved by City Council. Item #5.15 - A minimum 20 -foot landscape buffer beyond all right-of-way shall be required. (The proposed Site Plan meets this requirement along Watertower Lane.) Item #5.17 - Requires dedication of right-of-way from centerline of Locust Grove Road abutting the parcel by means of a final plat or by recorded Warranty Deed prior to the issuance of any building permits. (A copy of said deed should be provided to the P&Z Department at the time of Certificate of Zoning submittal.) Item # 14, page 9, of the DA states that no Certificates of Occupancy will be issued on this ground "until all infrastructure and other improvements which are imposed by the terms of this agreement, the annexation ordinance, and the CUP are completed," unless there is an amendment. Staff understands this condition to apply to the above-mentioned conditions. 11.6 Ordinance 11-13-5.B. requires one (1) parking stall per 600 s.f. of floor area plus one (1) for each vehicle used in the conduct of the operation. The Applicant shall provide the estimated number of vehicles to be parked at the site in order for the City to confirm the parking ratio is met by the plan. The plan shows a total of 76 public parking stalls in front of the building and 150 at the rear to serve the station, which appears to exceed the required minimum, even under the projected 42,000 s.f. build -out scenario. 11.7 For 226 parking spaces, ADA requires a minimum of six (6) standard handicap accessible stalls and one (1) van accessible stall, for a total of seven (7) handicap accessible stalls. The Site Plan proposes eight (8) stalls, all of which could be van accessible. The plan meets the minimum standard. 11.8 The Applicant did not submit any details on the anticipated improvement schedule or potential uses of the 3 -acre area designated as "Future Green Space." The Applicant should be prepared to discuss possible uses and anticipated timeframes with the P&Z Commission and Council. At a minimum, this 3 -acre area must be kept free of weeds over 8 -inches tall to prevent fire hazards. Since the R-8 zone only allows residential, schools and public service facilities, all other uses on this 3 -acre area will require a Conditional Use Permit. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY LOMBARD-CONRAD / NEW POLICE DEPARTMENT R-8 ZONE / (CUP -00-054) - 5 11.9 Applicant shall provide the building height. A Variance application must be submitted if the height exceeds the 35 -foot maximum. 11.10 The proposed Landscape Site Plan shows several trees within the Watertower Lane right-of-way which shall be moved outside the right-of-way for the final Certificate of Zoning Compliance submittal. 11.11 Applicant shall provide a double -end planter at the north end of the double parking row in the east private parking lot and be planted with two (2) trees to match the planter at the south end of the parking row. 11.12 Applicant shall provide the type of construction and height of fencing planned along the east and southern property lines. 11.13 The pre -manufactured maintenance building along the south property line shall be setback a minimum of 15 feet from the property line. 11.14 The Applicant shall provide two (2) free-standing signs on the site, one per entrance with the maximum background area limited to 32 s.f. and the height limited to six (6) feet. Both signs shall be outside the sight triangles and be setback a minimum of 5 feet from the property line. 11.15 Off-street parking shall be provided in accordance with Section 11-13 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific requirements. 11.16 Paving and striping shall be in accordance with the standards set forth in Sections 11-13-4.D. and 11-13-4.E. of the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 11.17 A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. All site drainage shall be contained and disposed of on-site. 11.18 Outside lighting shall be designed and placed so as to not direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-13-4.C. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY LOMBARD-CONRAD / NEW POLICE DEPARTMENT R-8 ZONE / (CUP -00-054) - 6 11. 19 Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes such as landscape irrigation. 11.20 All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous to the parcel shall be tiled per City Ordinance 12-4-13. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. The applicant requested a wavier, see 11.32 on page 9, as approved by City Council. 11.21 Applicant shall provide a minimum of one (1) three-inch (3 ") caliper tree per 1,500 sq. ft. of asphalt area on the site in accordance with City Ordinance Section 11-13-4.B.3.c. 11.22 All trash and/or garbage collection areas shall be enclosed on at least three (3) sides in accordance with City Ordinance Section 11-12-1.C. Applicant shall coordinate trash enclosure locations and construction requirements with Sanitary Service Company (SSC) and provide a letter of approval from SSC to the Planning &_ Zoning Department prior to applying for building permits. 11.23 Provide five -foot -wide sidewalks in accordance with City Ordinance Section 12-5-2.K. 11.24 All construction shall conform to the requirements of the Americans with Disabilities Act. Adopt the Recommendations of the Meridian Fire Department as follows: 11.25 Applicant shall comply with all codes pertaining to water supply, hydrants, and fire sprinkler system. Adopt the Recommendations of the Ada County Highway District as follows: 11.26 Applicant shall extend Watertower Lane abutting the site for the entire length of the parcel, approximately 1,100 feet east of the existing road terminus. The road shall be constructed as a 40 -foot street section with FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY LOMBARD-CONRAD / NEW POLICE DEPARTMENT R-8 ZONE / (CUP -00-054) - 7 curb, gutter, and 5 -foot sidewalks on both sides of the roadway within 58 - feet of right-of-way. 11.27 Applicant shall align the westernmost driveway with Adkins Street (extended) as proposed. Applicant shall construct the easternmost driveway approximately 350 -feet east of Adkins Street as proposed. 11.28 Applicant shall pave the driveways to their full -required width to a point 30 - feet beyond the edge of pavement of Watertower Lane. 11.29 Applicant shall comply with all the Standard Requirements of the ACHD. Adopt the Recommendations of the Nampa Sz Meridian Irrigation District as follows: 11.30 The Nampa Sz Meridian Irrigation District's Hunter Lateral courses through the middle of this proposed project. Any encroachments within the easement of the Hunter Lateral without written approval are unacceptable. Adopt the Recommendations of the Central District Health Department as follows: 11.31 No objections provided the building is served by central sewer and water. Additionally, it is recommended that storm water be pre-treated through a grassy swale prior to discharge to the subsurface to prevent impact to ground water and surface water quality. The engineers and architects involved with the design of this project should obtain current best management practices for storm water disposal and design a storm water management system that is preventing ground water and surface water degradation. The proposed uses within the subject application will be harmonious with and in accordance with the Meridian Comprehensive Plan and the City of Meridian Zoning and Development Ordinance because: 12.1 The subject property is designated on the "Generalized Land Use Map" as "Single Family Residential". 13. The uses proposed within the subject application subject to the conditions herein ordered will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance or intended character of the general vicinity and that such uses will not change the intended essential character of the same area. 14. The uses proposed within the subject application will not be hazardous or disturbing to existing or future neighboring uses. 15. The uses proposed within the subject application will be served adequately by central public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, and sewer. 16. The uses proposed within the subject application will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY LOMBARD-CONRAD / NEW POLICE DEPARTMENT R-8 ZONE / (CUP -00-054) - 9 17. The development will not result in the destruction, loss or damage of natural or scenic feature of major importance relating to the property. CONCLUSIONS OF LAW 1. The City of Meridian shall exercise the powers conferred upon it by the "Local Land Use Planning Act of 1975" hereinafter referred to for convenience as the "Act" codified at Chapter 65, Title 67, Idaho Code (I.C. §67-6503). 2. The Meridian City Council may exercise all the powers required and authorized under the "Act" except the power to adopt ordinances by the establishment of a Planning and Zoning Commission by ordinance pursuant to Idaho Code Section 67- 6504 which the City Council of the City of Meridian has established by the passage of the "City of Meridian Zoning and Development Ordinance" at Titles XI and XII, Chapter I, Meridian City Code. 3. As part of a zoning ordinance the City Council can, subject to hearing and notice provision required, provide for the process of special and/or conditional use permits which a proposed use is otherwise prohibited by the terms of the ordinance but allowed with conditions under the specific provisions of the ordinance which the City of Meridian has done in the adoption of its zoning ordinances. 4. Will, in fact, constitute a conditional use as determined by City policy; b. Will be harmonious with and in accordance with the Comprehensive Plan and this Ordinance; C. Will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; d. Will not be hazardous or disturbing to existing or future neighboring uses; e. Will be served adequately by essential public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; f. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; g. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; h. Will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 5. Provided, however, that conditional use applications for land in Old Town and in industrial and commercial districts shall only be required to have one public hearing which shall be held before the Planning and Zoning Commission; and after the recommendation of the Commission is made, the application shall go before the City Council without a public hearing and the Council may approve, deny, or modify the recommendation of the Commission." 6. Following the public hearing and within 45 days after the conclusion of the public hearing the Commission shall, transmit its recommendations to the Meridian City Council with supportive reasons. The Commission shall recommend that the application be approved, approved with conditions or denied. Since Howell Murdoch Development Corp. was the developer who signed the DA, they are ultimately responsible to the City for completion of these requirements. The DA requires a CUP for the police station/department and also contains several special conditions that must be met on this property. Staff has reviewed the DA conditions and listed below several conditions that must be completed as part of the annexation. Item #5.1 — Any existing irrigation/drainage ditches crossing the property shall be tiled per City Ordinance. No variances were requested at the time of annexation. The applicant requested a waiver, see 2.32 on page 7, as approved by City Council. Item #5.15 - A minimum 20 -foot landscape buffer beyond all right-of- way shall be required. (The proposed Site Plan meets this requirement along Watertower Lane.) Item #5.17 - Requires dedication of right-of-way from centerline of Locust Grove Road abutting the parcel by means of a final plat or by recorded Warranty Deed prior to the issuance of any building permits. (A copy of said deed should be provided to the P&Z Department at the time of Certificate of Zoning submittal.) The plan shows a total of 76 public parking stalls in front of the building and 150 at the rear to serve the station, which appears to exceed the required minimum, even under the projected 42,000 s.f. build -out scenario. 2.7 For 226 parking spaces, ADA requires a minimum of six (6) standard handicap accessible stalls and one (1) van accessible stall, for a total of seven (7) handicap accessible stalls. The Site Plan proposes eight (8) stalls, all of which could be van accessible. The plan meets the minimum standard. 2.8 The Applicant did not submit any details on the anticipated improvement schedule or potential uses of the 3 -acre area designated as "Future Green Space." The Applicant should be prepared to discuss possible uses and anticipated timeframes with the P&Z Commission and Council. At a minimum, this 3 -acre area must be kept free of weeds over 8 -inches tall to prevent fire hazards. Since the R-8 zone only allows residential, schools and public service facilities, all other uses on this 3 -acre area will require a Conditional Use Permit. 2.9 Applicant shall provide the building height. A Variance application must be submitted if the height exceeds the 35 -foot maximum. 2.10 The proposed Landscape Site Plan shows several trees within the Watertower Lane right-of-way which shall be moved outside the right-of-way for the final Certificate of Zoning Compliance submittal. 2.11 Applicant shall provide a double -end planter at the north end of the double parking row in the east private parking lot and be planted with two (2) trees to match the planter at the south end of the parking row. 2.12 Applicant shall provide the type of construction and height of fencing planned along the east and southern property lines. The property is located south of Franklin Road and west of Locust Grove Road, Meridian, Idaho. 2. The owner of record of the subject property is the City of Meridian. 3. Applicant is City of Meridian. 4. The subject property is currently zoned R-8. The zoning district of R-8 is defined within the City of Meridian Zoning and Development Ordinance, Section 5. The proposed application requests a conditional use permit for construction of a 35,208 s.f. police station. The R-8 zoning designation within the City of Meridian Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. The Meridian Planning and Zoning Commission recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 7. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Ordinance. RECOMMENDATION 1. The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the conditional use permit as requested by the applicant, subject to the following: Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: 1.1 Sanitary sewer service to this site is not available at this time. Service will have to be extended from a future main to be installed within the future Watertower Road. Until service is available, sanitary restrictions shall remain in force on the subject parcel. 1.2 Water service to this site is not available at this time. Applicant shall submit hook-up and design details based on the RECOMMENDATION TO CITY COUNCIL - 2 CONDITIONAL USE PERMIT —MERIDIAN POLICE DEPT. BLDG. IN AN R- 8 ZONE — LOMBARD-CONRAD proposed landscaping. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the landscaped areas. 1.5 Existing Development Agreement Terms: A Development Agreement (DA) is binding on the subject property. Since Howell Murdoch Development Corp. was the developer who signed the DA, they are ultimately responsible to the City for completion of these requirements. The DA requires a CUP for the police station/department and also contains several special conditions that must be met on this property. Staff has reviewed the DA conditions and listed below several conditions that must be completed as part of the annexation. Item #5.1 – Any existing irrigation/drainage ditches crossing the property shall be tiled per City Ordinance. No variances were requested at the time of annexation. Item #5.15 - A minimum 20 -foot landscape buffer beyond all right-of- way shall be required. (The proposed Site Plan meets this requirement along Watertower Lane.) Item #5.17 - Requires dedication of right-of-way from centerline of Locust Grove Road abutting the parcel by means of a final plat or by recorded Warranty Deed prior to the issuance of any building permits. (A copy of said deed should be provided to the P&Z Department at the time of Certificate of Zoning submittal.) Item # 14, page 9, of the DA states that no Certificates of Occupancy will be issued on this ground "until all infrastructure and other improvements which are imposed by the terms of this agreement, the annexation ordinance, and the CUP are completed," unless there is an amendment. Staff understands this condition to apply to the above- mentioned conditions. 1.6 Ordinance 11-13-5.13. requires one (1) parking stall per 600 s.f. of floor area plus one (1) for each vehicle used in the conduct of the operation. The Applicant shall provide the estimated number of vehicles to be parked at the site in order for the City to confirm the parking ratio is met by the plan. The plan shows a total of 76 public parking stalls in front of the building and 150 at the rear to serve the station, which RECOMMENDATION TO CITY COUNCIL - 3 CONDITIONAL USE PERMIT —MERIDIAN POLICE DEPT. IN AN R- 8 ZONE — LOMBARD-CONRAD '-1 appears to exceed the required minimum, even under the projected 42,000 s.f. build -out scenario. 1.7 For 226 parking spaces, ADA requires a minimum of six (6) standard handicap accessible stalls and one (1) van accessible stall, for a total of seven (7) handicap accessible stalls. The Site Plan proposes eight (8) stalls, all of which could be van accessible. The plan meets the minimum standard. 1.8 The Applicant did not submit any details on the anticipated improvement schedule or potential uses of the 3 -acre area designated as "Future Green Space." The Applicant should be prepared to discuss possible uses and anticipated timeframes with the P&Z Commission and Council. At a minimum, this 3 -acre area must be kept free of weeds over 8 -inches tall to prevent fire hazards. Since the R-8 zone only allows residential, schools and public service facilities, all other uses on this 3 - acre area will require a Conditional Use Permit. 1.9 Applicant shall provide the building height. A Variance application must be submitted if the height exceeds the 35 -foot maximum. 1.10 The proposed Landscape Site Plan shows several trees within the Watertower Lane right-of-way which shall be moved outside the right- of-way for the final Certificate of Zoning Compliance submittal. 1.11 Applicant shall provide a double -end planter at the north end of the double parking row in the east private parking lot and be planted with two (2) trees to match the planter at the south end of the parking row. 1.12 Applicant shall provide the type of construction and height of fencing planned along the east and southern property lines. 1.13 The pre -manufactured maintenance building along the south property line shall be setback a minimum of 15 feet from the property line. 1.14 The Applicant shall provide two (2) free-standing signs on the site, one per entrance with the maximum background area limited to 32 s.f. and the height limited to six (6) feet. Wells may be used for non-domestic purposes such as landscape irrigation. 1.20 All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous to the parcel shall be tiled per City Ordinance 12-4-13. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY This application proposes to construct a 35,208 s.f police station on a 10 -acre parcel at the east terminus of E. Watertower Lane. The subject site was part of a larger, 20 -acre parcel annexation and rezone approved by the City on 5-23-00 from RT (Ada County) to R-8 (Meridian) under the file name "Stratford Business Park." Said application was submitted by Howell Murdoch Development Corporation and zoned R-8, in part, for the purpose of allowing the police station as a CUP. The parcel is subject to a recorded Development Agreement. LOCATION & SURROUNDING USES The subject property is located immediately east of the Dee Jay commercial subdivision and approximately 300 feet west of S. Locust Grove Road. The property is located in an area designated as Single Family Residential in the 1993 Comprehensive Plan. The surrounding uses follow: North — Stonebridge Business Park (also known as Medimont Sub), zoned I -L, separated from subject parcel by a 230 -foot wide strip of Howell-Murdoch's remnant parcel, zoned R-8. South — A 20 -acre parcel, zoned RUT, with a single family residence. Mostly vacant. East — Remainder of Howell-Murdoch's remnant parcel, zoned R-8, and Woodbridge Subdivision, zoned R-4, on east side of S. Locust Grove Road. West — Dee Jay commercial subdivision, zoned C -G. CURRENT OWNER OF RECORD The property owner of record is the City of Meridian. William Berg, Jr., as City Clerk, has submitted consent for the subject application. In accordance with City Ordinance 11-13-4.B.2., underground year-round pressurized irrigation must be provided to all landscape areas on site. Please submit hook-up and design details based on the proposed landscaping. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the landscaped areas. 6. Existing Development Agzeement Terms: A Development Agreement (DA) is binding on the subject property. Since Howell Murdoch Development Corp. was the developer who signed the DA, they are ultimately responsible to the City for completion of these requirements. The DA requires a CUP for the police station/department and also contains several special conditions that must be met on this property. Staff has reviewed the DA conditions and listed below several conditions that must be completed as part of the annexation. a. Item #5.1 — Any existing irrigation/drainage ditches crossing the property shall be tiled per City Ordinance. No variances were requested at the time of annexation. b. Item #5.15 - A minimum 20 -foot landscape buffer beyond all right-of-way shall be required. (The proposed Site Plan meets this requirement along Watertower Lane.) C. Item #5.1? - Requires dedication of right-of-way from centerline of Locust Grove Road abutting the parcel by means of a final plat of by recorded Warranty Deed prior to the issuance of any building permits. (A copy of said deed should be provided to the P&Z Department at the time of Certificate of Zoning submittal.) d. Item #14, page 9, of the DA states that no Certificates of Occupancy will be issued on this ground "until all infrastructure and other improvements which are imposed by the terms of this agreement, the annexation ordinance, and the CUP are completed," unless there is an amendment. Staff understands this condition to apply to the above- mentioned conditions. 6. Ordinance 11-13-5.13. requires one (1) parking stall per 600 s.f of floor area plus one (1) for each CUP -00--054 Meridian PD Bldg.cup r� Mayor, Council and P&Z December 4, 2000 Page 3 vehicle used in the conduct of the operation. The Applicant must provide the estimated number of vehicles to be parked at the site in order for the City to confirm the parking ratio is met by the plan. The plan shows a total of 76 public parking stalls in front of the building and 150 at the rear to serve the station, which appears to exceed the required minimum, even under the projected 42,000 s.f build -out scenario. However, the total number of vehicles used must still be submitted. 7. For 226 parking spaces, ADA requires a minimum of six (6) standard handicap accessible stalls and one (1) van accessible stall, for a total of seven (7) handicap accessible stalls. The Site Plan proposes eight (8) stalls, all of which could be van accessible. The plan meets the minimum standard. 8. The Applicant did not submit any details on the anticipated improvement schedule or potential uses of the 3 -acre area designated as "Future Green Space." The Applicant should be prepared to discuss possible uses and anticipated timeframes with the P&Z Commission and Council. At a minimum, this 3 -acre area must be kept free of weeds over 8 -inches tall to prevent fire hazards. Since the R-8 zone only allows residential, schools and public service facilities, all other uses on this 3 -acre area will require a Conditional Use Permit. 9. The R-8 zone has a maximum building height of 35 feet. The exterior building elevations submitted with the application were not to a scale, so Staff could not confirm this maximum height was met. Applicant must provide the building height at the P&Z Commission hearing. A Variance application must be submitted if the height exceeds the 35 -foot maximum. 10. The proposed Landscape Site Plan shows several trees within the Watertower Lane right-of-way. These must be moved outside the right-of-way for the final Certificate of Zoning Compliance submittal. 11. The Landscape Site Plan does not show a double -end planter at the north end of the double parking row in the east private parking lot. Staff recommends this be provided and planted with two (2) trees to match the planter at the south end of the parking row. 12. No details were provided on the type of fencing that is called -out along the east and southern property lines. Applicant must provide the type of construction and height of fencing planned. 13. The pre -manufactured maintenance building shown along the south property line appears to encroach in the 15 -foot minimum rear building setback. This building must be setback a minimum of 15 feet from the property line. 14. The Applicant is proposing two (2) free-standing signs on the site, one per entrance. No details were provided on the proposed sign type, background area or height. Staff recommends the maximum background area be limited to 32 s.f and the height be limited to six (6) feet. Both signs must be outside the sight triangles and be setback a minimum of 5 feet from the property line. The Ada County Highway District (ACHD) staff has received the above referenced application requesting conditional use approval to construct a 35,000 -square foot police station. The 10 -acre site is located on the south side of Watertower Way (extended) approximately 1,300 -feet east of Locust Grove Road. This development is estimated to generate 400 additional vehicle trips per day based on the Institute of Transportation Engineers Trip Generation manual. B. The application and site plan stamped as received by City County on October 20, 2000, and submitted to the District on November 9, 2000, have been reviewed by the ACHD Planning and Development staff and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan is changed in such a manner as to not conform with District standards/policy or an appeal of the Planning and Development staff decision is submitted as described within the Standard Requirements outlined below. C. On November 13, 2000, the District Planning and Development staff inspected this site and evaluated the transportation system in the vicinity. On November 14, 2000, the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. The results of that analysis constitute the following Facts and Findings and recommended Site Specific Requirements. D. The City of Meridian sometimes requires a preliminary plat when a single parcel is subdivided by a local roadway. The applicant should verify with the City of Meridian that this application is acceptable. E. This portion of the parcel does not abut Adkins Way right-of-way as it was stubbed to this parcels north property line. When the area north of Watertower Lane (extended) is developed, the developer will be required to extend Adkins Way into the site to connect to Watertower Lane. The following requirements are provided as conditions for approval: Site Specific Requirements: Extend Watertower Lane abutting the site for the entire length of the parcel, approximately 1,100 feet east of the existing road terminus. The road shall be constructed as a 40 -foot street section with curb, gutter, and 5 -foot sidewalks on both sides of the roadway within 58 -feet of right-of- way. 2. Align the westernmost driveway with Adkins Street (extended) as proposed. Construct the easternmost driveway approximately 350 -feet east of Adkins Street as proposed. 3. Pave the driveways to their full -required width to a point 30 -feet beyond the edge of pavement of Watertower Lane. Standard Requirements: This decision of the Planning and Development Supervisor may be appealed to the Ada County Highway District Commission by the applicant or by another party within 15 calendar days from the date of this report. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship or inequity. The request will be heard by the District Commission at an evening meeting within 20 calendar days of the District's receipt of the appeal letter. The appellant will be notified of the date and time of the Commission meeting. 2. After ACRD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within two days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall specifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of it's original decision The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #193, also known as Ada County Highway District Road Impact Fee Ordinance. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 8. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. Conclusion of Law: ACHD requirements are intended to assure that the proposed use/development will not place an undue burden on the existing vehicular and pedestrian transportation system within the vicinity impacted by the proposed development. While this solution may address some of the maintenance issues raised by the Parks Dept., it does not address the code violation that the P&Z Dept. is trying to resolve. City Ordinance 12-13-14-2 states, `Below are requirements for designing a landscape area that integrates stormwater facilities..." "G. Slopes must be less [i.e. less steep] than 3:1 (horizontal : vertical) for accessibility and maintenance." (italics added) Thus, the slopes must be less steep than 3:1 before P&Z can sign the final Certificate of Occupancy. A copy of subject ordinance is attached. Please call if you have any questions. 884-5533. 12-13-14 STORMWATER INTEGRATION 12-13-14-1 Purpose: The City encourages the incorporation of vegetated, well-designed stormwater filtration swales into required landscape areas where topography and hydrologic features allow. Such integrated site designs can improve water quality and provide a natural, effective form of flood and water pollution control. 12-13-14-2 Design Guidelines: Below are requirements for designing a landscape area that integrates stormwater facilities. The Planning &_ Zoning and Public Works Departments should be involved in the initial design and determining the appropriateness of any site. A. Stormwater swales incorporated into required landscape areas shall be vegetated with grass or other appropriate plant materials. "they shall also be designed to accommodate the required number of trees as per this ordinance if located in a street buffer or other required landscape area. B. A rock sump may be incorporated into a vegetated swale to facilitate drainage. The rock sump inlet may not exceed more than five (S) feet in any horizontal dimension. Grates for sand/grease interceptors may also be incorporated, but the inlet structures may not exceed two (2) feet in any horizontal dimension. C. Gravel, rock, or cobble stormwater facilities are not permitted on the surface of required landscape areas. Cobble may be incorporated into required landscape areas if designed as a dry creek bed or other design feature. D. Plant materials shall be a species that are able to withstand the anticipated changes in soil wetness and moisture levels. E. Organic mulch shall not be used against drainage catch basins due to potential sediment clogging. F. Open water ponds and holding areas with a permanent water level are not permitted in required landscape or Landscape Ordinance - Final 11/28/00 Page 34 buffer areas, except along Interstate -84. However, ponds that are aesthetically designed with special grading and vegetative features may be approved as provided for in Section 15, Alternative Compliance. G. Slopes must be less than 3:1 (ho rizontal:vertical) for accessibility and maintenance. H. The stormwater facility must be designed free -draining with no standing water within 24 hours of the completion of a storm event. 12-13-15 MICROPATH LANDSCAPING: 12-13-15-1 Purpose: The purpose of this section is to promote trees and other landscaping along micropaths developed within the City. This grass is not to be maintained like blue/rye but grows 6"-8" and lays over. Is to be mown a couple times a year. The Creeping Red should stop at the top of slopes and the blue/rye be left from that point to the back of curb and sidewalk due to the irrigation coverage. The seeded slopes on the south retention areas may have to be killed out and than reseeded with Creeping Red Fescue. The native seed is not to be seeded until late fall. If dust becomes a problem, this area could be `hydro -mulched' with a tacifier and mulch solution to prevent soil erosion. 9. The irrigation filter is recommended per memo dated June 10, 2002. 10. It is recommended that another irrigation head be added in this area. The existing one is very close to the overhead light. The construction plans I looked at still showed a 3:1 slope. They admit they didn't build them to those plans, so the contractor is responsible for correcting his mistake. Tom Kuntz mentioned that the resolution is that some plastic material be placed in the beds so additional dirt can be placed over the drainage area and the appropriate slope can be maintained. My take on the whole thing is that the contractor should be required to pay for all of the improvements, not the City or the Parks Department, and to either do it now or put up cash in the amount of 1100, of a firm quote for the labor and materials needed. Their lack of knowledge on City Ordinance and the condition of approval of the CUP does not relieve them of responsibility for compliance. The construction plans I looked at still showed a 3:1 slope. They admit they didn't build them to those plans, so the contractor is responsible for correcting his mistake. Tom Kuntz mentioned that the resolution is that some plastic material be placed in the beds so additional dirt can be placed ove the drainage area and the appropriate slope can be maintained. My take on the whole thing is that the contractor should be required to pay for all of the improvements, not the City or the Parks Department, and to either do it now or put up cash in the amount of 110% of a firm quote for the labor and materials needed. Their lack of knowledge on City Ordinance and the conditions of approval of the CUP does not relieve them of responsibility for compliance. I did not know about the meeting yesterday, so I am trying to get up to speed. After discussing the issue with Shari and Tom, I thought that the agreed-upon solution was for the contractor to add a subsurfac( drainage structure to accommodate runoff below ground and fill in the deep swales on the north and south of the project and landscape over the top. After calling the project foreman, Buck, and the architect, Mike Thomas, it seems that this position/decision has not been communicated to them. Their understanding is that 3 options were discussed, but no final decision had been made: Option 1: The Parks Dept. will look into acquiring a special mower to maintain the steep grass slopes. Option 2: The Stor-mor drainage system described above. Option 3: Replace the sod with a Red Fescue that requires less maintenance. According to Mike Thomas, the "interim" decision was for the Parks Dept. to monitor the maintenance costs for two years and if i is sapping maintenance resources, Tom would budget for the drainage structure from his own budget. Meanwhile, Mike is havin, his Civil Engineer recalculate the volume requirements for the Stor-mor system and is also having his Landscape Architect propose the Red Fescue solution. Buck told me that a crew is just now finishing re -grading all of the internal swales near the building so that they are more easily mowable with the riding lawn mowers. (He said they brought in several yards of topsoil to do this, so I hope they still have adequate water -holding capacity. Those areas will also have to be re-hydroseeded.) However, he was under the impression the no action was currently required for the north and south swales. Our position at P&Z is that the swales along the north (Watertower Lane) and south of the project do not meet City Ordinance and must be brought into compliance prior to final occupancy (note: I have already signed off for Temporary Occupancy to facilitate the Grand Opening while this issue is resolved.) The Stor-mor system would certainly meet ordinance requirements an+ would be the most attractive and most expensive option. I suppose replacing the sod with a heavy planting of shrubs and groundcovers (so that no mowing is necessary) would suffice to meet the ordinance, but would also likely become a real trash collector. Mike Thomas said we should all be receiving plans for the "Red Fescue Solution" on Monday, at which time I want to put a response in writing. But before I do, I hope to make sure that we are all in agreement about the solution, so that I am not contradicting any already -made agreements. Plus, it would look bad if each Department were coming back to them with a different requirement/solution. LCA proposes that the canal be landscaped in an attractive manner that would beautify the lateral and become an amenity to the site. The landscape approach would simulate the Jabil Circuit canal beautification but, will be taken a step further. The landscape will also incorporate native and wild grass pockets with indigenous vegetation to create nesting habitat for waterfowl and upland game birds that currently reside in the existing agricultural fields on the proposed site, and utilize the open canal. To preserve, protect and enhance the wildlife environment and natural resources in Meridian is of prime importance, as addressed in Chapter Five of the Comprehensive Plan Draft for 2000. "Attention to these aesthetic qualities of the physical environment should be encouraged". LCA will also develop the Hunter Lateral landscaping with the Irrigation District's easement and maintenance requirements being secured. The three acre parcel located on the West side of the Hunter Lateral Canal will remain undeveloped at this time. When this area is confirmed in the future as to what type of development will be proposed, commercial or recreational, tiling of the canal can be evaluated in conjunction with the proposed use of the parcel.
