Meridian Friends Church CUP 00-002/ ,,,~ ~., NOTICE OF HEARING NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian and the Laws of the State of Idaho, that the Planning and Zoning Commission of the City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho at the hour of 7:00 p.m. on January 11, 2000 for the purpose of reviewing and considering the application of Meridian Friends Church for a conditional use permit for existing church facility with new sanctuary addition and paved parking and landscaping located at southwest Meridian Road on west Pine Street. A more particular description of the above property is on file in the City Clerk's office at Meridian City Hall, 33 East Idaho Street, and is available for inspection during regular business hours. A copy of the application is available upon request. Any and all interested persons shall be heard at said public hearing and the public is welcome and invited to submit testimony. The attached land survey document, prepared by Tealey's Land surveying , shows the existing platted realty properties.The Church site has use of the existing northerly asphalt paved parking area and a graveled parking area located on the northeastern corner of the property. The two curb cuts shown on the site plans are existing. The USE will continue to be a Church. The land parcel is presently zoned R-4 under the existing Meridian Zoning ordinance. The ordinance requires the Church Facility, as anon-conforming use, to apply for the Conditional Use Permit (approvals) to continue its use as a Church and apply for building permits for an Addition to the Sanctuary of the Church. The attached Site Development Plan shows church patron parking. The Meridian P & Z ordinance defines the required parking ratio as (1) One space per 5 seats in the sanctuary area. In the parking layout we have provided for 64 parking spaces. Ordinance requires that 51 parking spaces be provided and adequate on-site drainage design for the proposed asphalt parking areas. This C.U. Application includes site/ landscaping plans, building elevations, and floor remodel plans submitted into Meridian Planning & Zoning for the required approvals. The scope of work includes: 1) Remodel of Foyer area and Entry. 2) Remodel of existing restrooms to comply with A.D.A / ANSU Cabo requirements. 3) Remodel and 6' Addition to page 2 of 2 the existing northeast classrooms. 4) Sanctuary Addition (28' x 40'= 1120 s.f.) to the existing building. 5) Paving of new asphalt parking areas and driveways shown on site plans. Case No. CUP-00-002 MAR - 3 2000 CITY OF iVI~~II~IAL~i 02-29-00 FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT The above entitled conditional use permit application having come before the City Council on February 15, 2000, at the hour of 7:30 p.m., at Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, and Shari Stiles, Planning and Zoning Administrator, and appearing and testifying for the Meridian Friends Church was Ken Redford, and no one appeared in opposition, and the. City Council having duly considered the evidence and the record in this matter and the Recommendations to City Council issued by the Planning and Zoning Commission who conducted a public hearing and the Council having heard and taken oral and written testimony, and having duly considered the matter, the City Council hereby makes the following Findings of Fact, Conclusions of Law and Decision and Order to-wit: FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY MERIDIAI~1 FRIENDS CHURCH (CUP-00-002) - I FINDINGS OF FACT 1. A notice of a public hearing on the conditional use permit was published for two (2) consecutive weeks prior to the said public hearing scheduled for Febniary 15, 2000, before the City Council, the first publication appearing and written notice having been mailed to property owners or purchasers of record within three hundred feet (300') of the external boundaries of the property under consideration more than fifteen (15) days prior to said hearing and with the notice of public hearing having been posted upon the property under consideration more than one week before said hearing and the copies of all notices were made available to newspaper, radio and television stations as public service announcements; and the matter having been duly considered by the City Council at the February 15, 2000, public hearing; and the applicant, affected property owners, and government subdivisions providing services within the planning jurisdiction of the City of Meridian, having been given full opportunity to express comments and submit evidence. 2. There has been compliance with all notice and hearing requirements set forth in Idaho Code §67-6509, 6512, and Meridian City Code §§ 11-15-5 and 11-17-5 as evidenced by the Affidavit of Mailing, and the Affidavit of Publication and Proof of Posting filed with the staff report. 3. This proposed development request is in an (R-4), Low Density Residential District, by reason of the provisions of the Meridian City Code § 11-17-4, a public hearing was required before the City Council on this application. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY MERIDIAN FRIENDS CHURCH (CUP-00-002) - 2 4. The property is located at 1021 W. Pine Ave., Meridian, Idaho. 5. The owner of record of the subject property Meridian Friends Church, Inc. of 1021 W. Pine Ave., Meridian. 6. Applicant is the owner of record. 7. The subject property is currently zoned Low Density Residential (R-4). The zoning district of R-4 is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2 C. 8. The proposed application requests a conditional use permit for the existing church facility with a new sanctuary addition and paved parking and landscaping. The R-4 zoning designation within the City of Meridian Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-8-1). 9. The Meridian City Council recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 10. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Ordinance. 11. The Meridian City Council takes judicial notice of its Zoning, Subdivision and Development Ordinances codified at Titles 11 and 12, Meridian City Code and all current zoning maps thereof and the Comprehensive Plan of the City of Meridian, and Maps and the Ordinance establishing the Impact Area Boundary. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY MERIDIAN FRIENDS CHURCH (CUP-00-002) - 3 12. Giving due consideration to the comment received from the governmental subdivisions providing services in the City of Meridian planning jurisdiction public facilities and services required by the proposed development will not impose expense upon the public if the following conditions of development are imposed and the following is also found to be required to mitigate the effects of the proposed use and development upon services delivered by political subdivisions providing services to the subject real property within the planning jurisdiction of the City of Meridian: Adopt the Recommendations of Planning and Zoning and Engineering staff as follows: 12.1 Off-street parking shall be provided in accordance with the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. All site drainage shall be contained and disposed of on-site. 12.2 Outside lighting shall be designed and placed so as to not direct illumination on any nearby residential areas and in accordance with City Ordinance. 12.3 Applicant shall determine the seasonal high groundwater elevation, and submit a profile of the subsurface soil conditions as prepared by a soil scientist with the design of site drainage plan. 12.4 Applicant shall provide five-foot-wide pedestrian walkways in accordance with City Ordinance. 12.5 All construction shall conform to the requirements of the Americans with Disabilities Act. 12.6 Sheet C 1.0 shows aone-way vehicular drive configuration around the church building -17-foot aisle on the east side and an 18.5-foot aisle on the west side. Both existing ingress/egress curb cuts off of Pine Street into the site are two-way (30 feet wide). One-~vay directional signs shall be FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY MERIDIAN FRIENDS CHURCH (CUP-00-002) - 4 r1 clearly posted within the site and arrows be painted on the pavement as depicted on the plan. 12.7 The Fire Department must approve the drive aisle widths as thev are less than the standard 20-foot minimum. 12.8 Applicant shall submit a notarized letter of consent from Burr International, Inc. stating they agree to the proposed use of the well house for the Church irrigation. 12.9 A minimum four-foot-wide landscape strip is required between the public sidewalk along Pine Street and the parking lot. 12.10 Nine (9) of the 36 trees proposed on the landscape plan are technically located off site within the 11-foot strip of ground adjacent to the east property line. At one (1) tree per 1,500 s.f. of asphalt, the site is required to have a total of 23, three-inch caliper trees (34,552 s.f. of asphalt). 12.11 All trash areas are to be enclosed by a screen on at least three sides. Coordinate location and construction requirements with Meridian Sanitary Service, Inc., and provide a letter of approval with submittal of the site plans prior to issuance of a Certificate of Zoning Compliance. 12.12 Applicant shall be required to enter into an Assessment Agreement with the City of Meridian. 12.13 No additional signage is proposed, and none is approved with this application. A-frame, banners, and other signage of a temporary nature is strictly prohibited and will be removed upon 3 days notice to the applicant. All signage is subject to design review and requires separate permits. Adopt the Recommendations of the Central District Health Department as follows: 12.14 Run-off is not to create a mosquito breeding problem. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERN(IT BY MERIDIAN FRIENDS CHURCH (CUP-00-002) - 5 ^'~ 12.15 Stormwater shall be pretreated through a grassy Swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality. 12.16 The Engineers and architects involved with the design of the subject project shall obtain current best management practices for storin~vater disposal and design a Stormwater management system that prevents groundwater and surface water degradation. The Planning and Zoning Commission further recommended: 12.17 The building time frame should not extend beyond 26 months. 13. The proposed uses within the subject application will be harmonious with and in accordance with the Meridian Comprehensive Plan and the City of Meridian Zoning and Development Ordinance because: 13.1 The subject property is designated on the "Generalized Land Use Map" as "Existing Urban". 14. The uses proposed within the subject application subject to the conditions herein ordered will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance or intended character of the general vicinity and that such uses will not change the intended essential character of the same area. 15. The uses proposed within the subject application will not be hazardous or disturbing to existing or future neighboring uses. 16. The uses proposed within the subject application `vill be served adequately by central public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, and sewer. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY MERIDIAN FRIENDS CHURCH (CUP-00-002) - 6 17. The uses proposed within the subject application will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors. 18. The development will not result in the destniction, loss or damage of natural or scenic feature of major importance relating to the property. CONCLUSIONS OF LAW The City of Meridian shall exercise the powers conferred upon it by the "Local Land Use Planning Act of 1975" hereinafter referred to for convenience as the "Act" codified at Chapter 65, Title 67, Idaho Code (I.C. §67-6503). 2. The Meridian Planning and Zoning Commission may exercise all the powers required and authorized under the "Act" except the power to adopt ordinances by the establishment of a Planning and Zoning Commission by ordinance pursuant to Idaho Code Section 67-6504 which the City Council of the City of Meridian has established by the passage of the "City of Meridian Zoning and Development Ordinance" at Titles XI and XII, Chapter I, Meridian City Code. 3. As part of a zoning ordinance the City Council can, subject to hearing and notice provision required, provide for the process of special and/or conditional use permits which a proposed use is otherwise prohibited by the terms of the ordinance but FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY MERIDIAN FRIENDS CHURCH (CUP-00-002) - 7 ~ ~ allowed with conditions under the specific provisions of the ordinance which the Citv of Meridian has done in the adoption of its zoning ordinances. 4. The City Council has the duty and responsibility to review the facts and circumstances of each application for special use permit to determine prior to granting the same that the evidential showing supports the finding that the following standards are met and that the proposed development: (Meridian City Code § 11-17-3 ) a. Will, in fact, constitute a conditional use as determined by City policy; b. Will be harmonious with and in accordance with the Comprehensive Plan and this Ordinance; c. Will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; d. Will not be hazardous or disturbing to existing or future neighboring uses; e. Will be served adequately by essential public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; f. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; g. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; h. Will not result in the destruction, loss or damage of a natural or scenic feature of major importance. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY MERIDIAN FRIENDS CHURCH (CUP-00-002) - 8 r1 5. Prior to granting a conditional use permit in a Low Density Residential District (R-4), a public hearing shall be conducted with notice to be published and provided to property owners or purchasers of record within three hundred feet (300') of the e,~cternal boundaries of the land under consideration for the conditional use permit all in accordance with the provisions of Meridian City Code § 11-17-5 City of Meridian Zoning and Development Ordinance, which provides as follows: "Prior to approving a Conditional Use Permit, the applicant and the Commission and Council shall follow notice and hearing procedures provided in Chapter 15 of this Title. Provided, however, that conditional use applications for land in Old Town and in industrial and commercial districts shall only be required to have one public hearing which shall be held before the Planning and Zoning Commission; and after the recommendation of the Commission is made, the application shall go before the City Council without a public hearing and the Council may approve, deny, or modify the recommendation of the Commission." 6. Following the public hearing and within 45 days after the conclusion of the public hearing the Commission shall, transmit its recommendations to the Meridian City Council with supportive reasons. The Commission shall recommend that the application be approved, approved with conditions or denied. The Commission shall ensure that any approval or approval with conditions of an application shall be in accordance with Meridian Comprehensive Plan, City of Meridian Zoning and Development Ordinance, and Idaho State law. (Meridian City Code § 11-17-6) FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY MERIDIAN FRIENDS CHURCH (CUP-00-002) - 9 7. When the City Council approves a conditional use permit it may impose conditions of that approval that reasonably: A. Minimize adverse impact on other development; B. Control the sequence and timing of development; C. Control the duration of development; D. Assure that the development is maintained property; E. Designate the exact location and nature of the development; F. Require the provision for on-site public facilities or services; and G. Require more restrictive standards than those generally required, in this Ordinance. 8. The City of Meridian has, by ordinance, established the Impact Area and the Comprehensive Plan of the City of Meridian, which was adopted December 21, 1993, Ord. 629, January 4, 1994 and Maps. DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS NOW, THEREFORE, BASED UPON THE ABOVE AND FOREGOING FINDINGS OF FACT AND CONCLUSIONS OF LAW, the City Council does hereby ORDER and this does Order that: That the above named applicant is granted a conditional use permit for the existing church facility with a new sanctuary addition and paved parking and landscaping, subject to the following conditions of use and development: 1.1 Off-street parking shall be provided in accordance with the City of Meridian Zoning and Development Ordinance and in accordance with FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY MERIDIAN FRIENDS CHURCH (CUP-00-002) - 10 Americans with Disabilities Act (ADA) requirements. Siddoway: This is an expansion of an existing church along Pine Street. The reason it is before you tonight is because the property is zoned R-4. Churches are not permitted use in R-4, therefore this is anon-conforming use and Meridian Ordinance requires a conditional use permit to expand or enlarge any non-conforming use in the city. You see the site in the vicinity map in front of you. It is right here on the south side of Pine Street. The church is located on the north 1.6 acres and the back 3.5 acres is currently vacant. The site itself is just over 5 acres. To the south you've got the railroad here and some industrial uses. (Inaudible) Subdivisions are to the north. The recently approved Tremont Place Subdivision is to the east and these LO properties to the west are currently vacant. This shows their site plan north being to the right in this case. This would be Pine Street. You have 2 entrances off of Pine Street. The only concerns that we had which weren't major was the fact that these entry ways go from 2 way to a ' way loop that circles around the church in this location. Mast of the church is existing here, this portion here the addition. The applicant may want to speak to the phasing on this because I don't know if they are prepared to do the entire site improvement at this time. The project is being developed to be constructed in 2 phases at this particular point of time. We are looking at some interior remodel to bring restrooms up to ADA standards and possibly move a few interior non bearing corridor walls. The second phase that we are looking at would be to develop the parking which is located on the east side of the building and that could possibly be developed in phase A and a B depending how soon the new addition to the sanctuary is put into place. We are looking at a time period of approximately 24 months to develop out the project in an interior construction phase and an exterior construction. Like most projects that require funding which is basically contribution funds. The church would like to have the commission consider a phased construction. Any questions? It is the expansion of the existing family center development at the intersection of Eagle Road and Fairview. The Shopko currently sits in this location. This expansion would be to the east abutting Crossroad Subdivision here and then extending to an undeveloped parcel here. This is their proposed site plan for the conditional use permit. I will come back to this in just a second. This is how the site currently looks as taken from Records Drive looking into the site with Crossroads Subdivision in the background there. Most of the issues are dealt with in the staff comments in front of you. The outstanding issues that remain to be resolved that I expect to come up tonight. One is staff comment that 35 feet of landscaping along Fairview Avenue, they currently have 20 feet in this location and 30 feet in this location. In comments with the applicant, they have stated that they could comply with that request but it would mean shrinking the buffer that they have against the Crossroads Subdivision where our current City Ordinance requires a minimum of 20 feet and they are providing 41 feet in this location and 31 feet in this location. We have also asked for an additional 10 feet of buffering between the Walmart building and loading docks and the adjacent cemetery to get some additional buffering between what we would consider compatible land uses at that position and that is also needing to be resolved. The trees that are shown along Venture Street at this point, appear to be planted in the sidewalk, so they can be shifted but in here where there is off set trees there could be some issues with spacing. I think they might be fine if they were just moved over and it would just a tight spacing of trees. That is all I have at this point. One more, the parking requirement END OF SIDE 4 Siddoway: Based on the square footage of the building as a retail use at one per 200 square feet, they are meeting that almost to the exact number. I believe they have 3 extra spaces. Both existing ingresslegress curb cuts off of fine Street into the site are two-way (30 feet wide). Staff has some concern about the internal circulation of traffic, given the two-way access driveways into the site and then tapering down to the one-way drive aisles. The only apparent options to make the drive aisles two-way are to eliminate the new landscaping area proposed for the west boundary and require the church to move the existing power pole and proposed planters on the east side of the building. Staff recommends one-way directional signs be clearly posted within the site and arrows be painted on the pavement as depicted on the plan. 1.7 The Fire Department must approve the drive aisle widths as they are less than the standard 20-foot minimum. 1.8 Applicant shall submit a notarized letter of consent from Burr International, Inc. stating they agree to the proposed use of the well house for the Church irrigation. 1.9 A minimum four-foot-wide landscape strip is required between the public sidewalk along Pine Street and the parking lot. 1.10 Nine (9) of the 36 trees proposed on the landscape plan are technically located off site within the 11-foot strip of ground adjacent to the east property line. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY This application requests approval to construct a 1,120-square-foot addition on an existing church in an R-4 zone and to add 47 parking stalls with new perimeter and interior landscaping. The church is proposing several site improvements which will be done through a phased construction plan, including the addition of 22 new trees, landscape buffer strip on the west boundary and landscaping along Pine Avenue. Churches are not permitted in the R-4 zone, making the Friends Church anon-conforming use. Meridian Ordinance Section 11-15-1 requires a Conditional Use Permit to expand or enlarge any non-conforming use. LOCATION The property's address is 1021 W. Pine Avenue and is located on the south side of Pine between Linder and Meridian Road. The church is located on the north 1.6 acres of the subject lot (total 5.1 acres). The south 3.5 acres of the lot is currently open space and is traversed by Nine Mile Creek. Neighboring uses and properties include the Union Pacific Railroad and industrial to the south, Clarinda Fair and Canna Lily subdivisions to the north, the recently platted Tremont Place subdivision (R-8) and other single-family homes to the east, and a vacant, 7.5 acre parcel zoned L-O to the west. Regarding your letter to Gary Smith dated 6-7-00, you may pave the areas shown on the site plan approved by P2 all at once or in phases. This shall not be interpreted to contradict any timing requirements for other improvements imposed by the Conditional Use Permit (3-7-00), the P2 Department or the Building Department. On another subject, I spoke with Brad Hawkins-Clark of P2 about the landscape irrigation requirements. He indicated that the well located off-site was no longer a viable source and that you indicated that water from the City's domestic system would be used for landscape irrigation.
