We are submitting this application for inclusion on the October 2000 Planning Commission Meeting. The Conditional Use Permit application incorporates 7.64 acres. Currently, we are proposing a rezoning from R-8 (Single family residential) to C-N (Neighborhood Commercial) on a portion of the site. The C-N zoning would allow for the proposed uses. The proposed development is neighborhood commercial retail use on the site that would enhance this corner. The proposal includes an approximately 58,000 sq.ft. retail store, a 10,500 sq.ft. multi-tenant retail building, and 4 fuel stations with a kiosk. Two architectural pylon signs and one monument sign are proposed, with one pylon near the Linder Rd. frontage and the remaining along the Cherry Lane frontage. Our proposal would be designed in a professional manner to effectively buffer the residential uses. Numerous spruce trees are proposed along the landscape buffer adjacent to the residential to the south. The trees will provide year round screening of the project and enhance the aesthetics of the residential neighborhood. Parking lot lighting will also be screened near the residential properties. The proposal is in compliance with a variety of goals and objectives contained in the Meridian Comprehensive Plan. The proposal utilizes unimproved land within the Meridian City limits, maximizes public investments, and curtails urban sprawl. Additionally, urban services are easily provided the site (Chapter 1V Section D and Chapter V Section D). The project incorporates parking lot landscaping with internal islands, and buffers the existing residential uses with landscape screening and fencing (Chapter V Section D). Commercial land use is identified on the Future Land Use Map (Figure VII-2). West of the site is an existing commercial shopping center, east of the site is a school, north is a mix of residential and public uses (library), south is residential uses. I reside at 1503 Northgate avenue. I have been a homeowner in the same location for approximately 22 yeazs. My testimony is against the rezone and specifically against the inclusion of the CHERRY LANE SUPERSTORE for the following reasons: 1. The proximity to the middle school is a major safety issue with me. Many young children walk to and from school every weekday on the sidewalk infront of the proposed store. With the addition of more curb cuts (driveways) the children will be compromised. The safety of the children must be the number one priority of everyone. 2. The superstore will sell beer, wines, cigazettes and adult magazines. Since it is adjacent to the middle school property that should not be acceptable. 3. The traffic will be increased with many more turning movements in and out of the superstore area. This again will be a safety issue for all that walk or drive the vicinity. Has a traffic study been undertaken to determine just how much more traffic this business will generate! 4. There already exists a convience store/gas station on the southwest corner of Linder and Cherry Lane. Do we need another such business in such a small area! Albertson's has plans to install gas pumps in their Cherry Lane and Ten Mile location. 5. Do we as citizens of Meridian want Cherry Lane to become more of a strip mall azea than it is already with gas stations to Black Cat and beyond! I'm sure there are many more reasons to deny the application. I can only think of one for it. It will bring tax money to the city. The unattractive 20 foot signs along with the extra garbage, traffic and noise in our residential area would reduce the appeal of this community and our quality of life. Within a couple of miles radius we have two Albertsons, Fred Meyer, Walmart, Winco, Home Depot, and Shopko. This superstore is not a development that our community needs, and certainly not in this location. Based on the staff comments, several modifications were made to the Conditional Use Permit Site Plan prior to November 14, 2000. At this time there are only two items that diverge from the November 07, 2000 Memorandum. These items are: 1) First, the site has a landscape buffer along Cherry Lane that varies between 28 ft. and 32 ft. in width. We believe that this adequate given the high percentage of landscaping on the site with respect to the required amount. In other words, over 16% of the site (including various interior planters) is landscaped while only 10% is required. Various interior planters are provided within the parking area to enhance the landscaping aesthetics. Further, the attached list of developments indicates that a substantial number of new developments along Cherry Lane do not meet the Comprehensive Plan requirement of 35 feet. Since the Comprehensive Plan is a guide, we believe that this project should be reviewed on its merits, in which the project substantially exceeds the minimum landscape requirements and still provides adequate street buffering. As for locating the trees at 35 ft. on center, we believe that a mixture of tree spacing tends to make the project more aesthetically pleasing. Currently there are trees spaced anywhere from 15 ft. apart to 50 ft. apart along Cherry Lane. (Memorandum Item #16) 2) Second, with regards to signage, we would like to have a sign at the corner of Cherry Lane and Linder identifying the project. However, we were informed by planning staff that this would not be allowed because it was off-site. Since the property directly at the southeast corner of Cherry Lane and Linder is not part of this CUP proposal and is in the process of being split into a separate lot, we cannot comment on future proposed signage on this property. With regards to the remaining parcel that Hawkins Companies intends to purchase (approx. 10 acres), we would like an additional freestanding sign for the parcel that is east of this CUP application. We believe this is very reasonable considering that the square footage of the proposed pylon sign and monument sign on Cherry lane are less than one-half the allowed square footage. Even with the addition of a similar pylon sign on the east remainder (at a future date) we would still be under the allowed square footage. Additionally, the monument sign (9 ft. tall and 46 sq.ft.) is well below both the height and area requirements indicated. Corrections have been made to comply with all other Meridian Staff Comments as outlined in the November 07, 2000 Memorandum. Two other minor changes were made to address Meridian City Staff Comments. First, a masonry block wall that is 6 ft. tall will be provided along the south boundary of the project (Memorandum Item #15). Second, the original 10,500 sq.ft. retail building has been reduced from 10,500 sq.ft. to 9,750 sq.ft. The south five (5) ft. of the original building was removed. Therefore, a 25 ft. setback from the lot line is provided on all sides of the building (Memorandum Item # 18). A site plan showing the layout of the Superstore with an orientation towards Cherry Lane is attached. Several Planning Commissioners felt that the front of the store should be oriented toward Cherry Lane. A layout with the storefront to Cherry Lane is problematic for a number of reasons: 1) The loading and trash collection services are adjacent to the residential neighborhood to the south. Our proposal would keep truck traffic for loading out near Cherry Lane (with no circulation around the south side of the store). 2) The majority of the parking area would be west of the store. Only two drive aisles and four rows of parking would be in front of the store. 3) Parking circulation becomes circuitous and inefficient. 4) The longest wall of the building would back up to the neighborhood instead of the shortest. Essentially, due to the lot depth, the storefront orientation toward Cherry Lane is an unreasonable, substandard design that is very problematic. The storefront orientation towards the west provides a view of the front of the store from motorist entering the city from the west, thereby enhancing Meridians entry corridor. Please find the re-submittal of the Superstore building elevations (all four elevations) per Meridian staff request, the site and landscape plan, and a rotated Superstore design enclosed. With regards to signage, we would like to have a sign at the corner of Cherry Lane and Linder identifying the project. However, we were informed by planning staff that this would not be allowed because it was off-site. Since the property directly at the southeast corner of Cherry Lane and Linder is not part of this CUP proposal and is in the process of being split into a separate lot, we cannot comment on future proposed signage on this property. With regards to the remaining parcel that Hawkins Companies intends to purchase (approx. 10 acres), we would like an additional free standing sign for the parcel that is east of this CUP application. We believe this is very reasonable considering that the square footage of our pylon sign and monument sign on Cherry lane are less than one-half the allowed square footage. Even with the addition of a similar pylon sign on the east remainder (at a future date) we would still be under the allowed square footage. Additionally, the monument sign (9 ft. tall and 46 sq.ft.) is well below both the height and area requirements indicated. (Memorandum Item #13) 8. A vinyl fence that is 6 ft. tall will be provided along the south boundary of the project. (Memorandum Item #15) 9. Currently the site has landscape buffer along Cherry Lane that varies between 28 ft. and 32 ft. in width. We believe that this adequate given the high percentage of landscaping on the site with respect to the required amount. In other words, over 16% of the site (including various interior planters) is landscaped while only 10% is required. Further, the attached list of developments indicates that a substantial number of new developments along Cherry Lane do not meet the Comprehensive Plan requirement of 35 feet. Since the Comprehensive Plan is a guide, we believe that this project should be reviewed on its merits, in which the project substantially exceeds the minimum landscape requirements and still provides adequate street buffering. As for locating the trees at 35 ft. on center, we believe that a mixture of tree spacing tends to make the project more aesthetically pleasing. Currently there are trees spaced anywhere from 15 ft. apart to 50 ft. apart along Cherry Lane. (Memorandum Item #16) 10. The total amount of landscape area on the site is 1.26 acres or 16% of the site. This is well above the minimuml0% required. (Memorandum Item #17) 11. The 10,500 sq.ft. retail building has a 20 ft. setback on the south side and approx. a 25 ft. setback on the west side. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATIONS SUMMARY These two applications pertain to a single parcel of land (#S 1212223100) at the SE corner of Cherry Lane and Linder Road, currently used for agriculture. The parcel is currently split-zoned, with the western-most 1.5+/- acres fronting Linder being C-N and the remainder 10+/- acres being R-8. The Rezone application requests the 10.04 acre portion currently zoned R-8 to be rezoned to match the existing C-N zoning. The Conditional Use Fermit application proposes to develop the middle 7.6+/- acres as a commercial/retail development, including one 58,000 s.f. super store, one 10,500 multi-tenant retail building, and a fuel station with four pumps and a kiosk. The Applicants are proposing to exclude the western-most 1.5+/- acres and the eastern- most 2+/- acres from this application and develop those at a later date. The ACHD Commission will review this application at their November 8th meeting. The ACRD staff report recommends the Applicant relocate the middle access drive offCherry Lane approximately 65 feet to the west from what is proposed. They are restricting the Linder driveway to a right-in/right- out only and requiring a total of 48-feet ofright-of--way be dedicated on Linder, which is slated for 2005 construction to widen to a 3-lane section with bike lanes. LOCATION & SURROUNDING USES The subject parcel is located at the SE corner of Linder Road and Cherry Lane. The parcel has a total of approximately 1,095 feet of frontage on Cherry and 240 feet of frontage on Linder, with the main developed portion totaling approximately 700 feet of frontage. The property is located in an area designated as Existing Urban in the Comprehensive Plan. John Stubblefield, representing the deeded owner, has provided notarized consent for the application. REZONE GENERAL COMMENTS 1. The legal description submitted with the rezone application is accurate and meets the requirements of the City of Meridian and State Tax Commission. 2. The subject property is within the Urban Service Planning Area and designated as Existing Urban in the Comprehensive Plan. 3. The subject property can be adequately served by public facilities 4. If rezoned to C-N, the subject parcel would conform to the minimum area, bulk and height standards. REZONE SITE SPECIFIC REQUIREMENTS Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes such as landscape irrigation. 2. Offstreet parking shall be provided in accordance with the city of Meridian ordinance 11-13 for use of undeveloped lots. 3. Outside lighting shall be designed and placed in accordance with City Ordinance Sections 11- 13-4.C. and 12-5-2.M. 4. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. In lieu of extending SW I5`~ Avenue into the site from Northgate Subdivision as a vehicular connection, the Applicant must provide a pedestrian connection (either concrete sidewalk or asphalt path) into the project site at this location. Applicant may also be required to connect to the existing 4-inch diameter water main that is currently terminated at the property boundary. 7. The SW 15`" Avenue pedestrian walkway should connect with a new, minimum 5-foot wide walkway to be constructed along the southern edge of the west entry driveway, starting at the Linder Road right-of--way line (to connect with the future Linder Road sidewalk) and extending 400 feet to the eastern edge of the 20-foot landscape buffer. The Applicant should review the optimal placement of this new walkway, but Staff could support including the walkway within the 20-foot landscape buffer, either as a detached, meandering path or as an attached sidewalk. 8. This new SW 15~' Avenue pedestrian connection may force the relocation of one (1) or two (2) trees currently shown at this point. Since the site has the minimum number of trees per ordinance, Staff recommends these trees be relocated to the 33 stall parking row immediately east of the 10,500 retail building, to be planted in two (2) new internal planters in this row. In order to avoid potential conflict with the landscape buffer trees, these two (2) planter trees should be reduced to Class I size. 9. Staff supports the Applicant's proposal to construct a 16-foot wide driveway at the terminus of SW 13"' Avenue at the SE corner of the site. We agree that, should neighborhood cut-through traffic become a problem in the future, ACRD should examine closing this connection. However, if the vehicular connection is ever closed in the future, a pedestrian connection must be made available between the project site and Northgate Subdivision at the SW 13``` Ave. location. 10. Any pedestrian crosswalks or STOP signs in the parking lot must be located a minimum of 100- feet south of the edge of pavement of Cherry Lane to allow for sufficient stacking. 11. ACRD is requiring the dedication of 48 feet ofright-of--way from the centerline of Linder Road. However, the Site Plan currently shows only 35 feet from centerline to edge of landscape buffer. Please correct/modify Site Plan to reflect the 48-foot dedication. (Note that the proposed pylon sign on Linder is shown within the future right-of--way and will need to be moved to the east.) 12. The Applicant should confirm with the Meridian Fire Department that the proposed 10,500 s.f. retail building meets with their approval with providing emergency access to only two (2) sides of the building. Please provide said approval at the P&Z Commission hearing. 13. It is unclear if these signs are intended to provide signage for the entire 11.7-acre site at build-out or if additional signs will be requested in the future for these other outparcels. The Cherry Lane frontage from Linder Road to the eastern property boundary (approx. 1,095 feet) is limited to a maximum of two (2) free-standing signs with a maximum background area of 150 s.f. and a maximum height of 20 feet per sign. The Linder Road frontage is 1united to a maximum of one (1)free-standing sign of the same size. The proposed Site Plan meets this criteria. However, if future signs are planned for either street frontage, the subject CUP Site Plan and sign sizes may need to be modified. At the P&Z Commission hearing, the Applicant should clarify the total number ofplanned signs for the Linder and Cherry street frontages. 14. Staff encourages the Applicant to adopt a uniform sign theme andlor design criteria for the project. Specifically, the wall signs for the fuel station, superstore and smaller retail buildmg should be consistent with the free-standing signage. 15. Applicant is proposing to construct a screen wall along the south property line adjacent to the Northgate Subdivision. Please provide details on the specific type of wall or fence construction and the proposed height prior to the P&Z Commission hearing. 16. Cherry Lane is designated as an entryway corridor in the Comprehensive Plan and requires a minimum 35-foot wide landscape buffer beyond the right-of--way line. The Site Plan shows a buffer width varying between 28 feet at the west end and 32 feet at the east end of the buffer. Please modify Site Plan to show a minimum 35-foot wide buffer width. In addition, the street trees in this buffer should be spaced a minimum of 35 feet on center. 17. Please provide a calculation of the total amount of landscaped area provided within the boundaries of the project site. A minimum of 10% of the gross land area must be either open space or landscaped area. 18. The C-N zone has a minimum rear building setback of 25 feet. During the pre-application meetings with Staff, Mr. Stubblefield stated his intent was to split off the 1.7+/- acre outparcel shown at the west end of the property. RECOMMENDATION Staff recommends approval of the Rezone and Conditional Use Applications with the above conditions. The property is located at the southeast corner of Linder Road and Cherry Lane, Meridian, Idaho. 2. Z'he owner of record of the subject property is Stubblefield Development Company of Meridian, Idaho. 3. Applicant is Hawkins Companies of Boise. 4. The subject property is currently zoned R-8. There is a request before the City Council to rezone the property to C-N. The zoning district of C-N is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2 H. RECOMMENDATION TO CITY COUNCIL - 1 CONDITIONAL USE PERMIT -CONSTRUCTION OF A 58,000 SQ.FT. The proposed application requests a conditional use permit for construction of a 58,000 sq.ft. retail commercial building and 4 fuel stations with a lcioslc, and a 10,500 s.f. retail building for Linder Crossing. The C-N zoning designation within the City of Meridian Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-8- 1). 6. The Meridian Planning and Zoning Commission recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 7. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Ordinance. RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they deny the conditional use permit as requested by the applicant based on finding that the proposed use is not compatible with the surrounding uses and they have also recommended denial of the zone change request. On October 23, 2000, the District Planning and Development staff inspected this site and evaluated the transportation system in the vicinity. On October 27, 2000, the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. The results of that analysis constitute the following Facts and Findings and recommended Site Specific Requirements. C. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Contact Construction Services at 387-6280 (with file numbers) for details. D. Request for Modification for driveway location on Linder Road: The applicant is proposing to construct one driveway on Linder Road, located at the south property line, approximately 200-feet south of the signalized intersection at Cherry Lane. District policy requires driveways to be located a minimum of 440-feet from a signalized intersection for full access, and 220-feet for a restricted right-in/right-out driveway. Driveways should also align or offset a minimum of 125-feet from any existing or proposed driveways on Linder Road. There are two existing driveways on the west side of Linder Road that serve as access to a gas station and retail shops. The existing southern driveway on the west side of Linder Road aligns with the proposed driveway, but the northern driveway is located within 100-feet of the proposed driveway. There is another existing driveway on the west side of Linder Road located approximately 20-feet south of the proposed driveway that serves a church. The applicant does not have sufficient frontage from the signal for a driveway. Staff recommends a modification to allow a restricted right-in/right-out driveway, located 200-feet south of the intersection at Cherry Lane. Due to the close proximity to the intersection, staff recommends that the applicant construct an on-site island to restrict the driveway to right- in/right-out. Coordinate the design of the island with Traffic Services staff for review and approval. The island may have to be constructed in the right-of--way of the driveway to be effective. E. Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. In accordance with past action by the District the applicant should be required to pave the driveway its full width of 30 to 35-feet and at least 30-feet into the site beyond the edge of pavement of Linder Road and install pavement tapers with 15-foot radii abutting the existing roadway edge. F. The applicant is proposing to construct three driveways on Cherry Lane. District policy allows three driveways along a frontage with more than 600-feet when the driveways are located in conformance with District policy. The applicant is proposing that these driveways be located: • 400-feet east of Cherry Lane (western driveway) • 320-feet east of the western driveway (middle driveway) • 240-feet east of the middle driveway at the east property line (eastern driveway) MCUP00-0048.cnm1 Page 3 ,~ District policy requires driveways to be located a minimum of 440-feet from a signalized intersection for frill access, and offset or align a minimum of 150-feet from any existing or proposed driveways or streets on Cherry Lane. G. Request for Modification for driveway location on Cherry Lane: The proposed driveway located 410-feet east of Linder Road does not meet the required offset from a signalized intersection. District policy requires driveways to be located a minimum of 440-feet from a signalized intersection. Staff recommends a modification of policy to allow a driveway in this location, as it will serve as a common driveway with the "NOT A PART" parcel to the west when it develops. H. Request for Modification for driveway location on Cherry Lane: The proposed middle driveway is located 160-feet west of 13"' Avenue on the north side of Cherry Lane, and within 150-feet of existing driveways on the north side of Cherry Lane. District policy requires driveways to align or offset a minimum of 150-feet from any existing or proposed driveways or roadways. The proposed driveway location does not meet District policy from existing driveways, but does meet policy for driveway offsets from 13`'' Street, and from the proposed driveways for this site. Due to the number and frequency of existing driveways, staff recommends a modification of policy to allow the proposed driveway location. Request for Modification for driveway location on Cherry Lane: The applicant is proposing to construct a driveway at the east property line. District policy required the driveway to offset a minimum of 150-feet from 13"' Avenue, and 150-feet from any existing or proposed driveways on Cherry Lane. The applicant also owns the "NOT A PART" parcel to the east of the site. After meeting with staff, the applicant has agreed to locate the driveway to meet policy. The driveway will be located off-site, but will also be utilized in the future when the parcel to the east develops. Due to the number and frequency of existing driveways on the north side of Cherry Lane, staff recommends a modification of policy to allow a driveway to be located a minimum of 150-feet east of 13`x' Avenue. Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. In accordance with past action by the District the applicant should be required to pave the driveways their full width of 30 to 35-feet and at least 30-feet into the site beyond the edge of pavement of Cherry Lane with 15-foot curb radii. K. Due to the number of vehicle trips per day, the applicant should be required to provide a minimum of 50-feet of on-site stacking at all driveways. L. District policy states that direct access to arterials and collectors is normally restricted and that the developer shall try to use combined access points. In accordance with District policy the applicant should be required to provide a recorded cross access easement for the parcels to the east and west to use this parcel for access to the public streets prior to issuance of a building permit (or other required permits). The District intends to require a similar agreement of the MCUP00-0048.cnun Page 4 owners of the parcels to the east and west if they are the subject of a future development application. M. The applicant should be required to replace unused curb cuts on Cherry Lane with standard curb, gutter and concrete sidewalk to match existing improvements. N. 15"' Street, a 36-foot wide local street dead-ends at the applicant's south property line. The applicant is not proposing to extend the roadway, or provide a vehicle connection from the site to this street. A vehicle connection to this site would cause commercial cut-through traffic on a residential street with front-on housing. Staff does recommend that the applicant provide a pedestrian access from the neighborhood to the site. District policy requires turnarounds on streets that are more than two lots in depth. There are eight residential lots that front on 15`'' Street. At the time that this subdivision was platted (North Gate No. 2, 1974) there was a note on the plat for a temporary turnaround easement to be in place until the tune that 15"' Street is extended. 15"' Street is not being extended with this application, and the temporary easement is still in place. O. 13"' Street, a 36-foot wide local street dead-ends at the applicant's south property line. The applicant is proposing to construct a narrow driveway off of the street to provide a vehicular access to the neighborhood, and to provide secondary emergency access to this segment of 13`'' Street. The City of Meridian staff is supportive of a neighborhood connection at this location. If neighborhood cut-through traffic becomes a problem in the future, the District will examine closing the connection. P. Replace any damaged curb, gutter and/or sidewalk on Cherry Lane with new curb, gutter and/or concrete sidewalk to match existing improvements. Segments to be replaced shall be determined by ACRD Construction Services staff. Contact Construction Services at 387-6280 (with file number) for details. Q. In order to reduce trips to and from this development it is recommended that Tenants occupying the proposed building be required to provide an Alternative Transportation Program for employees and provide an annual report to ACRD on employee participation. Commuteride staff will coordinate the Alternative Transportation Program with the applicant. For more information contact Pat Nelson at 387-6160. R. In order to reduce trips to and from this development, it is recommended that the tenants occupying the proposed building(s) be required to participate in any Transportation Management Association (TMA) or Transportation Management Organization (TMO) that is formed with a boundary that includes this site or is adjacent to this development. A Transportation Management Association (TMA) or Transportation Management Organization (TMO) is formed with a coordinator that works as a liaison between businesses and private and public transportation providers to increase the use of alternative transportation and other trip reduction measures (shuttle buses, bus pass programs, vanpools, carpools, bicycle and walking enhancements). An annual survey will be required of the TMA/TMO to monitor participation in alternative transportation programs and forwarded to the ACHD Commuteride Office. MCUP00-0048.cnun Page 5 ~ ~ S. Based on development patterns in this area and the resulting traffic generation, staff anticipates that the transportation system will be adequate to accommodate additional traffic generated by this proposed development with the requirements outlined within this report. Special Recommendation to City of Meridian: In order to reduce trips to and from this development it is recommended that tenants occupying the proposed building be required to provide an Alternative Transportation Program for employees and provide an annual report to ACHD on employee participation. Any pedestrian crosswalks or STOP signs in the parking lot, should be located a minimum of 100-feet south of the edge of pavement of Cherry Lane to allow for sufficient stacking. The following requirements are provided as conditions for approval: Site Specific Requirements: Dedicate 48-feet ofright-of--way from the centerline of binder Road abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. Allow up to 30 business days to process the right-of--way dedication after receipt of all requested material. The owner will be compensated for all right-of--way dedicated as an addition to existing right- of-way from available impact fee revenues in this benefit zone, if the owner submits a letter of application to the impact fee administrator prior to breaking ground, in accordance with Section 15 of ACHD Ordinance #193. 2. Other than the access points specifically approved with this application, direct lot or parcel access to Linder Road or Cherry Lane is prohibited. MCUP00-0048.c~nm Page 7 Standard Requirements: A request for modification, variance or waiver of any requirement or policy outlined herein shall be made in writing to the ACHD Planning and Development Supervisor. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship or inequity. The written request shall be submitted to the District no later than 9:00 a.m. on the day scheduled for ACHD Commission action. Those items shall be rescheduled for discussion with the Commission on the next available meeting agenda. Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action do not provide sufficient time for District staff to remove the item from the consent agenda and report to the Commission regarding the requested modification, variance or waiver. Those items will be acted on by the Commission unless removed from the agenda by the Commission. 2. After ACRD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within six days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall ~ecifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of its original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #193, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required pern~its), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. It is the responsibility of the applicant to verify all existing utilities within the right-of--way. Existing utilities damaged by the applicant shall be repaired by the applicant at no cost to ACHD. The applicant shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking ground within ACHD right-of--way. The applicant shall contact ACRD Traffic Operations 387-6190 in the event any ACHD conduits (spare or filled) are compromised during any phase of construction. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. 9. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless awaiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought.
