The Ada County Highway District (ACRD) staff has received and reviewed the application and site
plan for the item referenced above. ACRD does not have any site improvement requirements at
this time. The ACHD Commission will not hear this item unless the site plan is changed in such
a manner as to require Commission review.
ACRD policy requires that before any improvements of any kind are constructed or installed within
the public right-of-way, a permit or license agreement permitting the improvements must be
obtained.
All future design plans and construction shall be in accordance with the Ada County Highway
District Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived in writing by the District.
Contact Ms. Joyce Newton for payment of possible road impact fees prior to building construction
in accordance with Ordinance #193, also known as the Ada County Highway District Road Impact
Fee Ordinance.

I am writing this letter based on both your May 30, 2000 letter, previous conversations and an
on-site meeting with Mr. Eugene Quenzer. As I explained previously, the Nampa & Meridian
Irrigation District does not own a waste ditch known as the Rutledge Drain. The exception being
a short strip, which the District ended up with for operation and maintenance just west of the
Wilkins Property, but we do not claim anything upstream or downstream.
As I stated, in order for the Nampa & Meridian Irrigation District to own, operate and maintain a
facility we would need a recorded easement or be granted aright-of-way on a facility which is
not part of the District's system.
This requires landowner cooperation; the District would need to maintain this facility all the way
to the Fivemile Drain. Mr. Quenzer indicated to Bill Henson at approximately 2:00 PM on June
14, 2000 that he had no interest in authorizing a grand of easement to the Nampa & Meridian
Irrigation District at this time. Therefore, the District will have to decline your request for taking
over the operation and maintenance of the facility through the Wilkins Ranch Subdivision Phase 1
and 2.
In order for the developer or Ada County Highway District to discharge water back into the
Rutledge Drain, it would take written authorization from the downstream landowners agreeing to
allow this type of water to return into this facility. They need to understand all rights and
responsibilities that go with this and it will require a license agreement for the actual discharge
back into the District's Tenmile Drain.
If the developer still wants to pursue the Nampa & Meridian Irrigation District to operate and
maintain the Rutledge Drain, you need to secure written authorization and have a grant of
easement through all properties downstream back into the Fivemile Drain. You will also need an
approved license agreement accepting the discharge, approved drainage plans and the District's
Board of Directors approval.

Dear Shelby,
As per our conversation this moniii~, please review the following draft for the proposed merger of lots; 22
and 23, block lU, Lake at Cherry Lane No. 6.
PROJECT OVERVIEW;
1.) To remove the common property li<~e;(nortlt boundary of lot 23, south boundary of lot 22) and merge
into one single lat.
2.) To remove and vacate all utility easements "along" this common property line. All other existing
perimeter property line(s) and easement(s) to remain unchanged
3.) Remove or relocate utilities as necessary at applicant's expense. Utilities located on lot 22 will service
the new residence,
NOTES;
1.) Project has a purchaser (build job agreement), contuigent ou lot merger approval. Utility compaiues
have been contacted with no objection, and utility easement vacation applications have been filed.
2.) Merger will alleviate lot 23's restricted approach, allowing a proper entry for a three car garage as
designed in the proposed residence.
3.) Homes built on lots 16 and 4l, block lU, experienced compromised access and extensive utility and
ltght post Celocat1011(S), additionally lots 29,34 and 35 also have greatly restricted access.

NOTICE OF HEARING
NOTICE iS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the Meridian Planning and zoning Commission
of the City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho
Street, Meridian, Idaho, at the hour of 7:00 p.m. on August 8, 2000, for the purpose of
reviewing and considering the proposed Ordinance change to allow first-class mail to
replace the current requirement of certified mail for public hearing notices.
A more particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Street, and is available for inspection during
regular business.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing and the public is welcome and invited to
