These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY This application requests approval for a satellite marketing education classroom for 25-30 high school students in an existing office/warehouse building that is owned and managed by Hon Contractors. Ordinance 11-8-1, Zoning Schedule of Uses, does not specifically list classrooms as an allowable use under any zoning district. Therefore, a Conditional Use Permit is required to determine the allowability. The subject lot was recently approved for a Planned Development to allow two (2) buildings on the same lot. The P&Z Department is aware of no outstanding zoning or permit violations on this property. It has received occupancy and is in compliance with all current codes. LOCATION & SURROUNDING USES The subject property is located at 357 E. Watertower Lane in the Honor Park Subdivision #2. It is approximately 700 feet east of E. 1St Street on the south side of Watertower. The lot is currently zoned C -G. This classroom is proposed for the building situated on the front half of the lot (see the cross -hatched tenant bay on the Site Plan in the application). The property is located in an area designated as Existing Urban in the Comprehensive Plan. The surrounding uses follow: North — Existing 11,200 s.f. office/warehouse building. Paving and striping shall be in accordance with the standards set forth in Sections 11-13-4.D. and 11-13-4.F. of the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 3. All signage shall be in accordance with the standards set forth in Section 11-2-415 of the City of Meridian Zoning and Development Ordinance. 4. All construction shall conform to the requirements of the Americans with Disabilities Act. SITE SPECIFIC COMMENTS: Assessment fees for water and sewer service are determined during the building plan review process. Applicant shall be required to enter into a Re -Assessment Agreement with the City of Meridian for all commercial uses. An assessment agreement is a vehicle that protects the City of Meridian and the Developer in the event that estimated assessments are not in line with actual usages. The agreement provides for reimbursement to the developer for over payment of assessments and payment to the City of Meridian of any shortfall in assessments. The overpayment/shortfall is determined after adequate historical usage. 2. The School District application states that students will be bused to the location and only two (2) parking spaces will be needed. The existing building and parking lot were designed to accommodate at least one (1) space per every 400 s.f. of gross floor area. The proposed classroom is approximately 1,400 s.f. in area, which would allow 3.5 parking spaces. A condition of approval should be placed that restricts the total number of parking spaces for this classroom to a maximum of four (4) stalls. No signage was submitted with the application. All future signage for this tenant space will require separate permits. 4. This conditional use permit shall be subject to review upon ten (10) days notice to the applicant. Transfer of the conditional use permit will need to be submitted and approved by the Zoning Administrator for any new owners/tenants. There has been compliance with all notice and hearing requirements set forth in Idaho Code §67-6509, 6512, and Meridian City Code §§ 11-15-5 and 11-17-5 as evidenced by the Affidavit of Mailing, and the Affidavit of Publication and Proof of Posting filed with the staff report. 3. This proposed development request is in the C -G zone, by reason of the provisions of the Meridian City Code § 11-17-4, a public hearing was required before the City Council on this application. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY JOINT SCHOOL DISTRICT NO. 2 / (CUP -00-027) - 2 4. The property is located at 911 Meridian Road, Meridian, Idaho. 5. The owner of record of the subject property is the Meridian Joint School District of Meridian. 6. Applicant is owner of record. 7. The subject property is currently zoned C -G. The zoning district of C -G is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2. 8. The proposed application requests a conditional use permit for a marketing education classroom to accommodate 2 non -concurrent classes of 25-30 students. The C- G zoning designation within the City of Meridian Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-8-1). 9. The Meridian Planning and Zoning Commission recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 10. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Ordinance. 11. The Meridian City Council takes judicial notice of its Zoning, Subdivision and Development Ordinances codified at Titles 11 and 12, Meridian City Code and all current zoning maps thereof and the Comprehensive Plan of the City of Meridian, and Maps and the Ordinance establishing the Impact Area Boundary. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY JOINT SCHOOL DISTRICT NO. 2 / (CUP -00-027) - 3 12. Giving due consideration to the comment received from the governmental subdivisions providing services in the City of Meridian planning jurisdiction public facilities and services required by the proposed development will not impose expense upon the public if the following conditions of development are imposed and the following is also found to be required to mitigate the effects of the proposed use and development upon services delivered by political subdivisions providing services to the subject real property within the planning jurisdiction of the City of Meridian: Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: 12.1 Off-street parking shall be provided in accordance with Section 11-13-4 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific requirements. 12.2 Paving and striping shall be in accordance with the standards set forth in Sections 11-13-4.D. and 11-13-41. of the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 12.3 All signage shall be in accordance with the standards set forth in Section 11- 2-415 of the City of Meridian Zoning and Development Ordinance. 12.4 All construction shall conform to the requirements of the Americans with Disabilities Act. 12.5 Assessment fees for water and sewer service are determined during the building plan review process. The existing building and parking lot were designed to accommodate at least one (1) space per every 400 s.f. of gross floor area. A condition of approval shall be placed that restricts the total number of parking spaces for this classroom to a maximum of four (4) stalls. 12.7 No signage was submitted with the application. All future signage for this tenant space will require separate permits. Adopt the Recommendations of the Meridian Fire Department as follows: 12.8 All exit signs and fire extinquishers shall be in working order. Adopt the Recommendations of the Sanitary Service as follows: 12.9 The concrete apron in front shall remain. Adopt the Recommendations of the Ada County Highway District as follows: 12.10 All future design plans and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived in writing by the District. 12.11 Pay any road impact fees prior to building construction in accordance with Ordinance # 193. 13. The proposed uses within the subject application will be harmonious with and in accordance with the Meridian Comprehensive Plan and the City of Meridian Zoning and Development Ordinance because: 13.1 The subject property is designated on the "Generalized Land Use Map" as "Commercial". 14. The City of Meridian shall exercise the powers conferred upon it by the "Local Land Use Planning Act of 1975" hereinafter referred to for convenience as the "Act" codified at Chapter 65, Title 67, Idaho Code (I.C. §67-6503). 2. The Meridian City Council may exercise all the powers required and authorized under the "Act" except the power to adopt ordinances by the establishment of a Planning and Zoning Commission by ordinance pursuant to Idaho Code Section 67- 6504 which the City Council of the City of Meridian has established by the passage of the FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY JOINT SCHOOL DISTRICT NO. 2 / (CUP -00-027) - 6 "City of Meridian Zoning and Development Ordinance" at Titles XI and XII, Chapter I, Meridian City Code. 3. As part of a zoning ordinance the City Council can, subject to hearing and notice provision required, provide for the process of special and/or conditional use permits which a proposed use is otherwise prohibited by the terms of the ordinance but allowed with conditions under the specific provisions of the ordinance which the City of Meridian has done in the adoption of its zoning ordinances. 4. The City Council has the duty and responsibility to review the facts and circumstances of each application for special use permit to determine prior to granting the same that the evidential showing supports the finding that the following standards are met and that the proposed development: (Meridian City Code § 11-17-3) a. Will, in fact, constitute a conditional use as determined by City policy; b. Will be harmonious with and in accordance with the Comprehensive Plan and this Ordinance; C. Will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; d. Will not be hazardous or disturbing to existing or future neighboring uses; e. Will be served adequately by essential public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY JOINT SCHOOL DISTRICT NO. 2 / (CUP -00-027) - 7 f. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; g. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; h. Will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 5. Prior to granting a conditional use permit in General Retail and Service Commercial District (C -G), a public hearing shall be conducted with notice to be published and provided to property owners or purchasers of record within three hundred feet (300') of the external boundaries of the land under consideration for the conditional use permit all in accordance with the provisions of Meridian City Code § 11-17-5 City of Meridian Zoning and Development Ordinance, which provides as follows: "Prior to approving a Conditional Use Permit, the applicant and the Commission and Council shall follow notice and hearing procedures provided in Chapter 15 of this Title. Provided, however, that conditional use applications for land in Old Town and in industrial and commercial districts shall only be required to have one public hearing which shall be held before the Planning and Zoning Commission; and after the recommendation of the Commission is made, the application shall go before the City Council without a public hearing and the Council may approve, deny, or modify the recommendation of the Commission." 6. Following the public hearing and within 45 days after the conclusion of the public hearing the Commission shall, transmit its recommendations to the Meridian City Council with supportive reasons. The Commission shall recommend that the application be approved, approved with conditions or denied. (Meridian City Code § 11-17-6) 7. When the City Council approves a conditional use permit it may impose conditions of that approval that reasonably: A. Minimize adverse impact on other development; B. Control the sequence and timing of development; C. Control the duration of development; D. Assure that the development is maintained property; E. Designate the exact location and nature of the development; F. Require the provision for on-site public facilities or services; and G. Require more restrictive standards than those generally required, in this Ordinance. 8. The City of Meridian has, by ordinance, established the Impact Area and the Comprehensive Plan of the City of Meridian, which was adopted December 21, 1993, Ord. 629, January 4, 1994 and Maps. A notice of a public hearing on the conditional use permit was published for two (2) consecutive weeks prior to the said public hearing scheduled for June 6, 2000, before the City Council, the first publication appearing and written notice having been mailed to property owners or purchasers of record within three hundred feet (300') of the external boundaries of the property under consideration more than fifteen (15) days prior to said hearing and with the notice of public hearing having been posted upon the property under consideration more than one week before said hearing and the copies of all notices were made available to newspaper, radio and television stations as public service announcements; and the matter having .been duly considered by the City Council at the June 6, 2000, public hearing; and the applicant, affected property owners, and government subdivisions providing services within the planning jurisdiction of the City of Meridian, having been given full opportunity to express comments and submit evidence. 2. The C- G zoning designation within the City of Meridian Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. The Meridian Planning and Zoning Commission recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 10. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Ordinance. 11. The Meridian City Council takes judicial notice of its Zoning, Subdivision and Development Ordinances codified at Titles 11 and 12, Meridian City Code and all current zoning maps thereof and the Comprehensive Plan of the City of Meridian, and Maps and the Ordinance establishing the Impact Area Boundary. The uses proposed within the subject application will be served adequately by central public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, and sewer. 17. The uses proposed within the subject application will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors. 18. The development will not result in the destruction, loss or damage of natural or scenic feature of major importance relating to the property. CONCLUSIONS OF LAW 1. The City of Meridian shall exercise the powers conferred upon it by the "Local Land Use Planning Act of 1975" hereinafter referred to for convenience as the "Act" codified at Chapter 65, Title 67, Idaho Code (I.C. §67-6503). 2. The Meridian City Council may exercise all the powers required and authorized under the "Act" except the power to adopt ordinances by the establishment of a Planning and Zoning Commission by ordinance pursuant to Idaho Code Section 67- 6504 which the City Council of the City of Meridian has established by the passage of the FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY JOINT SCHOOL DISTRICT NO. 2 / (CUP -00-027) - 6 "City of Meridian Zoning and Development Ordinance" at Titles XI and XII, Chapter 1, Meridian City Code. 3. As part of a zoning ordinance the City Council can, subject to hearing and notice provision required, provide for the process of special and/or conditional use permits which a proposed use is otherwise prohibited by the terms of the ordinance but allowed with conditions under the specific provisions of the ordinance which the City of Meridian has done in the adoption of its zoning ordinances. 4. The City Council has the duty and responsibility to review the facts and circumstances of each application for special use permit to determine prior to granting the same that the evidential showing supports the finding that the following standards are met and that the proposed development: (Meridian City Code § 11-17-3) .. Will, in fact, constitute a conditional use as determined by City policy; b. Will be harmonious with and in accordance with the Comprehensive Plan and this Ordinance; C. Will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; d. Will not be hazardous or disturbing to existing or future neighboring uses; e. Will be served adequately by essential public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY JOINT SCHOOL DISTRICT NO. 2 / (CUP -00-027) - 7 f. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; g. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; h. Will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 5. Prior to granting a conditional use permit in General Retail and Service Commercial District (C -G), a public hearing shall be conducted with notice to be published and provided to property owners or purchasers of record within three hundred feet (300') of the external boundaries of the land under consideration for the conditional use permit all in accordance with the provisions of Meridian City Code § 11-17-5 City of Meridian Zoning and Development Ordinance, which provides as follows: "Prior to approving a Conditional Use Permit, the applicant and the Commission and Council shall follow notice and hearing procedures provided in Chapter 15 of this Title. Provided, however, that conditional use applications for land in Old Town and in industrial and commercial districts shall only be required to have one public hearing which shall be held before the Planning and Zoning Commission; and after the recommendation of the Commission is made, the application shall go before the City Council without a public hearing and the Council may approve, deny, or modify the recommendation of the Commission." 6. Following the public hearing and within 45 days after the conclusion of the public hearing the Commission shall, transmit its recommendations to the Meridian City Council with supportive reasons. The Commission shall recommend that the application be approved, approved with conditions or denied. (Meridian City Code § 11-17-6) 7. When the City Council approves a conditional use permit it may impose conditions of that approval that reasonably: A. Minimize adverse impact on other development; B. Control the sequence and timing of development; C. Control the duration of development; D. Assure that the development is maintained property; E. Designate the exact location and nature of the development; F. . Require the provision for on-site public facilities or services; and G. Require more restrictive standards than those generally required, in this Ordinance. 8. That the Applicant of the property is granted a conditional use permit for a marketing education classroom to accommodate 2 non -concurrent classes of 25-30 students, the proposed application request of a conditional use permit for the construction, development, maintenance and use for a marketing education classroom to accommodate 2 non -concurrent classes of 25-30 students, as described in Exhibit "A" attached hereto, and incorporated herein as if set forth in full hereat, and for the development of the aforementioned development for a marketing education - classroom to accommodate 2 non -concurrent classes of 25-30 students, and which property is described as: Lot 3 in Block 1 of Honor Park Subdivision No. 2, according to the plat thereof filed in Book 68 of Plats acPages 6959 and 6960, records of Ada County, Idaho. That the above named applicant is granted a conditional use permit for a marketing education classroom to accommodate 2 non -concurrent classes of 25-30 students, located at Lot 3, Block 1, Honor Park Subdivision No. 2, Meridian, Idaho, subject to the following conditions of use and development: Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: 2.1 Off-street parking shall be provided in accordance with Section 11-13-4 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific requirements. 2.2 Paving and striping shall be in accordance with the standards set forth in Sections 11-13A.D. and 11-13-41. of the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 2.3 All signage shall be in accordance with the standards set forth in Section 11-2-415 of the City of Meridian Zoning and Development Ordinance. 2.4 All construction shall conform to the requirements of the Americans with Disabilities Act. 2.5 Assessment fees for water and sewer service are determined during the building plan review process. Applicant shall be required to enter into a Re -Assessment Agreement with the City of Meridian for all commercial uses. 2.6 The School District application states that students will be bused to the location and only two (2) parking spaces will be needed. The existing building and parking lot were designed to accommodate at least one (1) space per every 400 s.f. of gross floor area. The proposed classroom is approximately 1,400 s.f. in area, which would allow 3.5 parking spaces. A condition of approval shall be placed that restricts the total number of parking spaces for this classroom to a maximum of four (4) stalls. 2.7 No signage was submitted with the application. All future signage for this tenant space will require separate permits. Adopt the Recommendations of the Ada County Highway District as follows: 2.10 All future design plans and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACED Ordinances unless specifically waived in writing by the District. 2.11 Pay any road impact fees prior to building construction in accordance . with Ordinance # 193. 3. Honor Park Subdivision, and the School District is proposing classes there. Staff has no obiections. Thev did have a recommendation that no more than four parking spaces for the facility be allocated for the school since they don't have adequate parking for the kids to come and park there, but the School District has indicated that they are going to bus the students there. I'm really sorry that you waited all night for this. If I had known that you were here, I would have told you that we would take care of it. Corrie: Okay. I think this width is dimensioned here as 15 feet. We have a 9 foot wide parking stall ordinance. It is not enough width for 3 cars. Borup: Any problem with stacking on the staff parking. It looks like it is 30 feet, so they could add a couple more feet to that and have-- Siddoway: I think it is 25 from here to here and minimum length is 19. You need a minimum of 36. Or submit a variance to City Council, but it does not seem like the required parking can be supplied. That is the main issue I see. Norton: I move that we recommend to City Council deny this request for conditional use permit for child care center (12 plus children) in a R-8 zone by Tara L. Gorton at 420 E. Broadway. Brown: In the Comprehensive Plan for the downtown Meridian area under goal statements and policies it says to support these kinds of uses but it says to support them when they are compatible with the neighbors and the existing. The requested zone is R-15. There is 3.4 acres total. There is two canals on site. The Settlers Canal is the northern most. It is proposed to remain untiled. This is the Flem Canal which sets just south of this one. This is proposed to be tiled with a –this is the location of the pedestrian pathway that they are proposing on their site plan. South is Danbury Faire Subdivision. Some lots have fence and some do not. There is a junk yard to the east. This property does not go all the way to that. Directly north there is a vacant parcel that is zone C -G. The proposed apartments would sit between the existing Subdivision and these commercial properties. Parking half covered, half uncovered and they have 10 buildings with 4 units per building for a total of 40 apartments. This is the landscape plan. You have our staff comments that are dated May 18tH. We do have a written response from the applicant. One of the issues they brought up was that they were not submitting for planned development, but I would point out that this is in the mixed planned use zone in the Comprehensive Plan and as such is required to come through as a planned development and meet those standards. A notice of a public hearing on the conditional use permit vas published for two (2) consecutive weeks prior to the said public hearing scheduled for June 6, 2000, before the City Council, the first publication appearing and written notice having been mailed to property owners or purchasers of record within three hundred feet (300) of the external boundaries of the property under consideration more than fifteen (15) days prior to said hearing and with the notice of public hearing having been posted upon the property under consideration more than one week before said hearing and the copies of all notices were made available to newspaper, radio and television stations as public service announcements; and the matter having been duly considered by the City Council at the June 6, 2000, public hearing; and the applicant, affected property owners, and government subdivisions providing services within the planning jurisdiction of the City of Meridian, having been given full opportunity to express comments and submit evidence. 2. There has been compliance with all notice and hearing requirements set forth in Idaho Code §67-6509, 6512, and Meridian City Code §§ 11-15-5 and 11-17-5 as evidenced by the Affidavit of Mailing, and the Affidavit of Publication and Proof of Posting filed with the staff report. 3. This proposed development request is in the C -G zone, by reason of the provisions of the Meridian City Code § 11-17-4, a public hearing was required before the City Council on this application. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY JOINT SCHOOL DISTRICT NO. 2 / (CUP -00-027) - 2 4. The property is located at 911 Meridian Road, Meridian, Idaho. 5. The owner of record of the subject property is the Meridian Joint School District of Meridian. 6. Applicant is owner of record. 7. The subject property is currently zoned C -G. The zoning district of C -G is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2. 8. The proposed application requests a conditional use permit for a marketing education classroom to accommodate 2 non -concurrent classes of 25-30 students. The C- G zoning designation within the City of Meridian Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-8-1). 9. The Meridian Planning and Zoning Commission recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 10. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Ordinance. 11. The Meridian City Council takes judicial notice of its Zoning, Subdivision and Development Ordinances codified at Titles 11 and 12, Meridian City Code and all current zoning maps thereof and the Comprehensive Plan of the City of Meridian, and Maps and the Ordinance establishing the Impact Area Boundary. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY JOINT SCHOOL DISTRICT NO. 2 / (CUP -00-027) - 3 12. Giving due consideration to the comment received from the governmental subdivisions providing services in the City of Meridian planning jurisdiction public facilities and services required by the proposed development will not impose expense upon the public if the following conditions of development are imposed and the following is also found to be required to mitigate the effects of the proposed use and development upon services delivered by political subdivisions providing services to the subject real property within the planning jurisdiction of the City of Meridian: Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: 12.1 Off-street parking shall be provided in accordance with Section 11-13-4 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific requirements. 12.2 Paving and striping shall be in accordance with the standards set forth in Sections 11-13A.D. and 11-13-41. of the Citv of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 12.3 All signage shall be in accordance with the standards set forth in Section 11- 2-415 of the City of Meridian Zoning and Development Ordinance. 12.4 All construction shall conform to the requirements of the Americans with Disabilities Act. 12.5 Assessment fees for water and sewer service are determined during the building plan review process. Applicant shall be required to enter into a Re - Assessment Agreement with the City of Meridian for all commercial uses. 12.6 The School District application states that students will be bused to the location and only two (2) parking spaces will be needed. The existing building and parking lot were designed to accommodate at least one (1) space per every 400 s.f. of gross floor area. Adopt the Recommendations of the Meridian Fire Department as follows: 12.8 All exit signs and fire extinguishers shall be in working order. Adopt the Recommendations of the Sanitary Service as follows: 12.9 The concrete apron in front shall remain. Adopt the Recommendations of the Ada County Highway District as follows: 12.10 All future design plans and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived in writing by the District. 12.11 Pay any road impact fees prior to building construction in accordance with . Ordinance # 193. 13. The proposed uses within the subject application will be harmonious with and in accordance with the Meridian Comprehensive Plan and the City of Meridian Zoning and Development Ordinance because: 13.1 The subject property is designated on the "Generalized Land Use Map" as "Commercial". 14. The uses proposed within the subject application will not be hazardous or disturbing to existing or future neighboring uses. 16. The uses proposed within the subject application will be served adequately by central public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, and sewer. 17. The uses proposed within the subject application will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors. 18. The development will not result in the destruction, loss or damage of natural or scenic feature of major importance relating to the property. CONCLUSIONS OF LAW 1. The City of Meridian shall exercise the powers conferred upon it by the "Local Land Use Planning Act of 1975" hereinafter referred to for convenience as the "Act" codified at Chapter 65, Title 67, Idaho Code (I.C. §67-6503). 2. The Meridian City Council may exercise all the powers required and authorized under the "Act" except the power to adopt ordinances by the establishment of a Planning and Zoning Commission by ordinance pursuant to Idaho Code Section 67- 6504 which the City Council of the City of Meridian has established by the passage of the FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY JOINT SCHOOL DISTRICT NO. 2 / (CUP -00-027) - 6 "City of Meridian Zoning and Development Ordinance" at Titles XI and XII, Chapter I, Meridian City Code. 3. As part of a zoning ordinance the City Council can, subject to hearing and notice provision required, provide for the process of special and/or conditional use permits which a proposed use is otherwise prohibited by the terms of the ordinance but allowed with conditions under the specific provisions of the ordinance which the City of Meridian has done in the adoption of its zoning ordinances. 4. The City Council has the duty and responsibility to review the facts and circumstances of each application for special use permit to determine prior to granting the same that the evidential showing supports the finding that the following standards are met and that the proposed development: (Meridian City Code § 11-17-3) a. Will, in fact, constitute a conditional use as determined by City policy; b. Will be harmonious with and in accordance with the Comprehensive Plan and this Ordinance; C. Will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; d. Will not be hazardous or disturbing to existing or future neighboring uses; e. Will be served adequately by essential public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY JOINT SCHOOL DISTRICT NO. 2 1 (CUP -00-02 7) _ 7 r. f. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; g. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; h. Will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 5. Prior to granting a conditional use permit in General Retail and Service Commercial District (C -G), a public hearing shall be conducted with notice to be published and provided to property owners or purchasers of record within three hundred feet (300') of the external boundaries of the land under consideration for the conditional use permit all in accordance with the provisions of Meridian City Code § 11-17-5 City of Meridian Zoning and Development Ordinance, which provides as follows: "Prior to approving a Conditional Use Permit, the applicant and the Commission and Council shall follow notice and hearing procedures provided in Chapter 15 of this Title. Provided, however, that conditional use applications for land in Old Town and in industrial and commercial districts shall only be required to have one public hearing which shall be held before the Planning and Zoning Commission; and after the recommendation of the Commission is made, the application shall go before the City Council without a public hearing and the Council may approve, deny, or modify the recommendation of the Commission." 6. Following the public hearing and within 45 days after the conclusion of the public hearing the Commission shall, transmit its recommendations to the Meridian City Council with supportive reasons. The Commission shall recommend that the application be approved, approved with conditions or denied. The Commission shall ensure that any FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY JOINT SCHOOL DISTRICT NO. 2 / (CUP -00-027) 8 approval or approval with conditions of an application shall be in accordance with Meridian Comprehensive Plan, City of Meridian Zoning and Development Ordinance, and Idaho State law. (Meridian City Code § 11-17-6) 7. When the City Council approves a conditional use permit it may impose conditions of that approval that reasonably: A. Minimize adverse impact on other development; B. Control the sequence and timing of development; C. Control the duration of development; D. Assure that the development is maintained property; E. Designate the exact location and nature of the development; F. Require the provision for on-site public facilities or services; and G. Require more restrictive standards than those generally required, in this Ordinance. 8. The City of Meridian has, by ordinance, established the Impact Area and the Comprehensive Plan of the City of Meridian, which was adopted December 21, 1993, Ord. 629, January 4, 1994 and Maps. DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS NOW, THEREFORE, BASED UPON THE ABOVE AND FOREGOING FINDINGS OF FACT AND CONCLUSIONS OF LAW, the City Council does hereby ORDER and this does Order that: 1. It looks like it is 30 feet, so they could add a couple more feet to that and have-- Siddoway: I think it is 25 from here to here and minimum length is 19. You need a minimum of 36. Or submit a variance to City Council, but it does not seem like the required parking can be supplied. That is the main issue I see. Norton: I move that we recommend to City Council deny this request for conditional use permit for child care center (12 plus children) in a R-8 zone by Tara L. Gorton at 420 E. Broadway. Brown: In the Comprehensive Plan for the downtown Meridian area under goal statements and policies it says to support these kinds of uses but it says to support them when they are compatible with the neighbors and the existing. This is the Flem Canal which sets just south of this one. This is proposed to be tiled with a –this is the location of the pedestrian pathway that they are proposing on their site plan. South is Danbury Faire Subdivision. Some lots have fence and some do not. There is a junk yard to the east. This property does not go all the way to that. Directly north there is a vacant parcel that is zone C -G. The proposed apartments would sit between the existing Subdivision and these commercial properties. Parking half covered, half uncovered and they have 10 buildings with 4 units per building for a total of 40 apartments. This is the landscape plan. You have our staff comments that are dated May 18th. We do have a written response from the applicant.
