Locust Grove Road in Meridian, Idaho, on the east side of Locust Grove, north of Victory Road, Section 20, Township 3 North, Range 1 East of the Boise -Meridian. The property contains 5.96 acres. Included in this request is an application for annexation from Ada County to the City of Meridian, a requested zone change from RT (Rural Transition) to R4 (Low Density Residential), and a preliminary plat for a 24- lot (21 buildable) subdivision. Currently, the property is undeveloped pastureland. A density of 3.52 dwelling units per acre is proposed. The enclosed applications for a preliminary plat and zone change have been submitted in accordance with the requirements of the Meridian Zoning Ordinance. There are no requests for variances to the standards of the Ordinance. The proposed density is in compliance with the current Meridian City Comprehensive Plan. The 21 residential lots are a minimum of 8,000 square feet and have 80 feet of minimum street frontage each. All streets will be public and constructed to Ada County Highway District standards. Public services will be provided to this subdivision. Sewer and water service is readily available in Locust Grove Road adjacent to the site. The requested zoning designation for this property is R4 (Low Density Residential). This zoning designation provides for single-family dwellings with a maximum density of 4du/acre and connection to the Municipal water and sewer systems of the City. This property is surrounded by existing R4 development. A zone change on this property is desirable because it would provide for the continuation of the growth pattern that exists in this portion of the City. This continued growth would be compatible with these adjacent land uses. Specific Comprehensive Plan policies that support the requested zone change include Land Use Residential Policies 2.3U (Protect property values), 2AU (Sidewalks/pavement), and 2.5U (Compatible infill), in addition to Housing Policies 1.7 (Connection to services), 1.12 (Infill), and 1.13U (Compatible infill). In all, we feel that this development is a nice fit into the overall plan envisioned by the City of Meridian for this area. Our request meets the intent of the Meridian Comprehensive Plan for development in this area. Sewer and water are located adjacent to the site and will be provided to the development. The plat has been designed based on Ada County Highway District policy and the City of Meridian subdivision standards. We have included statements addressing traffic impact and seasonal ground water elevations as required in your application. There are no significant or scenic features of major importance that affect the consideration of this application. RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the requested annexation and zoning as requested by the Applicant for the property described in the application, subject to the following: Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: 1.1 A condition of the Annexation shall be that the Applicant provides a minimum of five percent (5%) common open space within the legal description boundaries. The open space shall be exclusive of all street rights-of-way and street buffers, except for right-of-way specifically dedicated for landscaping within a subdivision. Stormwater detention RECOMMENDATION TO CITY COUNCIL - 2 ANNEXATION AND ZONING - INGLENOOK SUBDIVISION - HUBBLE ENGINEERING facilities must be designed in accordance with Section 11.2 of the Landscape Ordinance in order to count toward the open space requirement. Open space may be active or passive in its intended use, and must be accessible by all residents of the subdivision. Common open space shall be suitably improved for its intended use. At a minimum, common open space lots shall include one (1) deciduous shade tree per eight thousand (8,000) square feet and lawn, either seed or sod. 1.2 All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous to the parcel shall be tiled per City Ordinance 12-4-13. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 1.3 Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes such as landscape irrigation. 1.4 Two -hundred -fifty- and 100 -watt, high-pressure sodium streetlights will be required at locations designated by the Public Works Department. All streetlights shall be installed at subdivider's expense. Irl order to provide pedestrian access and usability of the Lot 13 open space, the Applicant must provide a 10 -foot wide micropath from the inglenook Court cul-de-sac to Lot 13, Block 1 as a common lot in the subdivision. Otherwise, the Lot 13 open space could not be considered usable since it would be inaccessible to the residents of the subdivision. It is the Applicant's decision as to the micropath location, but Staff recommends it be located between Lot 12 and 14, Block 1. (The 10 -foot micropath could be added without losing a lot b� shifting the property lines of Lot 11 and 15, Block 1 five feet.) Applicant shall cause deed restrictions to be created for the two lots adjacent to the micro -path common lot, that will pFohibit the installation of fences adjacent to those installed along the common lines with the common micro -path lot. 5. The plat does not show an irrigation easement line for the Nine Mile Drain. Please modify the plat to reflect all irrigation easements. ACRD is requiring the Applicant to construct a stub street to the south property line. During the Tech Review meeting, the concept discussed was to stub at the extreme east end of the subdivision, essentially bending the cul-de-sac around to the south. Staff does not agree with this option and recommends that the stub street be in general alignment with the stub street already shown to the north property line. The stub street in Sherbrook Hollows Subdivision is also in this general alignment and would provide for a more logical "grid" street system ACHD's concern was that a straight street would encourage a `raceway" effect. However, once the property south of Inglenook develops and the stub is matched with the Sherbrook Hollows stub, the street will be no more than 800 feet in length, which is less than a typical block length. Staff recommends the south stub be located where Lot 7, Block 1 is shown. 8. In accordance with City Ordnance 12-13-8-1, underground year-round pressurized irrigation must be provided to all common landscape areas on site. Applicant sha11 be required to utilize any existing surface or well water for the prirnary source. I would like to provide the following information in support of our request for reconsideration. 1. Providence Development Group is a member of the Hubble Group of companies, which includes Hubble Homes, the homebuilder for this community. As such, it is our recommendation that we would provide a minimum home site size of 1700 square feet on the 21 home sites in Inglenook. A sample of our existing product includes the Sawtooth, Yellowstone and Teton as shown on the attached product flyer. In addition, we have recently designed two new floor plans, which will also be included at 2006, and 2278 square feet. Both of these new products will be two-story homes. In addition, each of these units will have a three -car option available and each of the floor plans will fit, with the three -car option, on each of the lots in Inglenook . 2. We are providing a pathway connection to a future pathway along the canal along the eastside of our property. When the properties on the north and south boundaries of proposed subdivision are ultimately developed, this will allow for a connection of a pathway system of Sherbrook Hollow on the south up to Los Alamitos on the north. Our portion of the pathway on the Inglenook property will be constructed concurrent with our development of the project. 701 S. One of the primary goals of Providence Development Group is to develop property that provides community amenities including pathways and parks for the residents. However, a small six -acre parcel severely restricts the ability to provide the additional open space of the development both from the size as well as the homeowner's costs to maintain the landscaping. I would like to provide the following information in support of our request for reconsideration. Providence Development Group is a member of the Hubble Group of companies, which includes Hubble Homes, the homebuilder for this community. As such, it is our recommendation that we would provide a minimum home site size of 1700 square feet on the 21 home sites in Inglenook. A sample of our existing product includes the Sawtooth, Yellowstone and Teton as shown on the attached product flyer. In addition, we have recently designed two new floor plans, which will also be included at 2006, and 2278 square feet. Both of these new products will be two-story homes. In addition, each of these units will have a three -car option available and each of the floor plans will fit, with the three -car option, on each of the lots in Inglenook. 2. We are providing a pathway connection to a future pathway along the canal along the eastside of our property. When the properties on the north and south boundaries of proposed subdivision are ultimately developed, this will allow for a connection of a pathway system of Sherbrook Hollow on the south up to Los Alamitos on the north. Our portion of the pathway on the Inglenook property will be constructed concurrent with our development of the project. 701 S. We had several negotiations with the Shipley family in our attempt to purchase their property or the rear five acres of their property in order to coordinate development. However, we were not able to reach satisfactory terms for our development of their property. 4. One of the primary goals of Providence Development Group is to develop property that provides community amenities including pathways and parks for the residents. However, a small six -acre parcel severely restricts the ability to provide the additional open space of the development both from the size as well as the homeowner's costs to maintain the landscaping. There has been compliance with all notice and hearing requirements set forth in Idaho Code §§ 67-6509 and 67-6511, and §§1 1-2-416E and 11-2-417A, Municipal Code of the City of Meridian. 3. The City Council takes judicial notice of its zoning, subdivisions and development ordinances codified at Title 11, Municipal Code of the City of Meridian, and all current zoning maps thereof, and the Comprehensive Plan of the City of Meridian adopted December 21, 1993, Ordinance No. 629, January 4,1994, and maps and the ordinance Establishing the Impact Area Boundary. 4. The property is approximately 5.97 acres in size and is located at the east side of Locust Grove, north of Victory Road. The owner of record of the subject property is Clifford D. Babbit of Boise, Idaho. 6. Applicant is Providence Development Group, LLC of Meridian, Idaho. 7. The property is presently zoned by Ada County as RUT, and consists of vacant pasture ground. 8. The Applicant requests the property be zoned as R-4 Low Density Residential. 9. The subject property is bordered to the north and south by Ada County property and to the east and west by R-4 zoned property, including Tarawood Subdivision and Salmon Rapids Subdivision. 10. The property which is the subject of this application is within the Area of Impact of the City of Meridian. 11. The entire parcel of property is included within the Meridian Urban Service Planning Area as the Urban Service Planning Area as defined in the Meridian Comprehensive Plan. 12. The Applicant proposes to develop the subject property in the following manner: a 24 lot residential subdivision. 13. The Applicant requests zoning of the subject real property as R-4 which is consistent with the Meridian Comprehensive Plan Generalized Land Use Map which designates the subject property as Single Family Residential. There are no significant or scenic features of major importance that affect the consideration of this application. 15. The intended open space is not well located; the creation of the additional residential lots would create unreasonable public safety issues, and the proposed annexation development would create difficulties for development of the property to the south, which is the Shipley property. 16. It is found to not be in the best interests of the City of Meridian to annex the subject property, at this time, given the subject development proposal. CONCLUSIONS OF LAW 1. The City of Meridian has authority to annex real property upon written request for annexation and the real property being contiguous or adjacent to city boundaries and that said property lies within the area of city impact as provided by Idaho Code Section 50-222. The Municipal Code of the City of Meridian Section 1I- 2-417 provides the City may annex real property that is within the Meridian Urban Service Planning Area as set forth in the City's Comprehensive Plan. 2. The City Council may take judicial notice of government ordinances, and policies, and of actual conditions existing within the City and State. 3. The requested zoning of Low Density Residential District, (R-4) is defined in the Zoning Ordinance at 11-7-2 C. as follows: (R-4) Low Density Residential District: Only single-family dwellings shall be permitted and no conditional uses shall be permitted except for planned residential development and public schools. The purpose of the R-4 District is to permit the establishment of low density single-family dwellings, and to delinate those areas where predominantly residential development has, or is likely to occur in accord with the Comprehensive Plan of the City, and to protect the integrity of residential areas by prohibiting the intrusion of incompatible nonresidential uses. The R-4 District allows for a maximum of four (4) dwelling units per acre and requires connection to the Municipal water and sewer systems of the City. 5. That in § 11-2-417 A it provides in part that: "If the Commission and Council approve an annexation request, the Commission and Council shall insure that said annexation is in accord with this Ordinance and the Comprehensive Plan." 6. After the plan has been amended, the zoning ordinance may then be considered for amendment pursuant to section 67-6511(b), Idaho Code." 7.
