Sheri & Brad: I am submitting a package of materials for the required easement vacations and lot line adjustments for the proposed Walgreens at Fairview Ave. & Locust Grove Rd. As per our conversation, I would like to schedule these items for the February 08, 2000 Planning Commission Meeting and then the next possible City Council Meeting. The easement vacation request is for the easements along the side and rear lot lines (not adjacent to a street) of Lots 1, 2, 7, & 8, Block 1, Doris Subdivision. The overall width of these easements is 6 ft. with 3 ft. on each lot. The enclosed materials contain a parcel map, ALTA survey, and proposed site plan (30 copies of each) to illustrate the location of the easements. I have been coordinating with Idaho Power regarding the easements and have filed an application for a release of easement with them. In addition to the easement vacation request, I am requesting a lot line adjustment. This proposal includes shifting the lot line that runs basically north south between Lot 1 and Lot 2 to the west 49 ft. The lot line running basically north south between Lot 7 and Lot 8 would also shift 49 ft. to the west. Further, the lot line running basically east/west between Lot 1 and Lot 8 would be shifted to the south 69 ft. The lot line running basically east/west between Lot 2 and Lot 7 would shift 22 ft. to the south. The enclosed materials include a drawing showing the basic size and shape of the lots after the adjustments and a proposed site plan illustrating the lot line adjustments (30 copies). Written notice of public hearing on said petition shall be given, by certified mail with return receipt, at least ten (10) days prior to the date of public hearing to all property owners within three hundred feet (300') of the boundaries of the area described in the petition. Pursuant to Meridian City Code §§ 12-10-1 A and B and 12-10-2 A and Bit provides as follows: 12 -10-1 APPLICATION PROCEDURE: A. Application: Any property owner desiring to vacate an existing subdivision, public right of way or easement shall complete and file an application with the Administrator. These provisions shall not apply to the widening of any street which is shown on this Comprehensive Development Plan, or the dedication of streets, rights of ~vay or easements to be shown on a recorded subdivision. B. Administrator Action: Upon receipt of the completed application, the Administrator shall affix the date of application acceptance thereon. Commission Recommendation: The Commission shall review the request and all agency responses and make a recommendation to the Council for either approval, conditional approval, or denial. B. Street Improvements; Bond: When considering an application for dedication procedures, the Council may approve, deny or modify the application. When a dedication is approved, the required street improvements shall be constructed or a bond furnished assuring the construction, prior to acceptance of the dedication. To complete the acceptance of any dedication of land, the owner shall furnish to the Council a deed describing and conveying such lands to be recorded with the County Recorder. FINDINGS OF FACT 1. Hawkins-Smith Development Company, 8645 W. Franklin Road, Boise, Idaho 83709, is a legally recognized form of business in the State of Idaho. {see Chapter 6 of Title 53 Idaho Code} 2. Hawkins-Smith Development Company, filed a petition for the vacation of a 6-foot wide public utility and drainage easement running east/west between Lot 1 and Lot 8 and between Lot 2 and Lot 7 and a 6-foot easement running north/south between Lot 1 and Lot 2 and between Lot 7 and Lot 8 of Doris Subdivision, as dedicated in the Warranty Deeds of the record owners, and in the Affidavits of Legal Interest, all of which are attached hereto as Exhibit "A" consisting of seven (7) pages. 3. The legal descriptions of the utility easements which are the subject of this petition are: Public Utility Easements To Be Vacated In Doris Subdivision For Meridian Walgreens A strip of land 6.00 feet wide lying within lots 1,2,7 and 8, Block 1, of Doris Findings of Fact and Conclusions of Law and -Page 4 of 8 Order of Vacation of a 6-foot wide easement / Doris Subdivision By: Hawkins-Smith /VAC-00-002 Subdivision as recorded in Boolc 16 of Plats at Page 1080 of Ada County records, lying in the SE 1/4 of the SE 1/4 of Section 6, T.3N., R.lE., B.M., Ada County, Idaho, the center line of which is more particularly described as follows: the lot line common to said lot 7 and 8, and the lot line common to said lot 2 and 1, and the lot line common to said lot 7 and 2, and the lot line common to said lot 8 and 1. Said strip of land is shown on the plat of Doris Subdivision as a public utilities easement 3.00' on each side of side and back lot lines. 4. The particular circwnstances of the requested vacation is: The vacation is required to accommodate the proposed Walgreens development. The easement vacation is for the easements along the side and rear lot lines (not adjacent to a street) of Lots 1,2,7, and 8, Bloclc 1, Doris Subdivision. The overall width of these easements is 6 ft. with 3 ft. on each lot. In addition there is also required a lot line adjustment. This would include shifting the lot line that runs basically north/south between Lot 1 and Lot 2 to the west 49 ft. The lot line running basically north/south between Lot 7 and Lot 8 would also shift 49 ft. to the west. Further, the lot line running basically east/west between Lot 1 and Lot 8 would be shifted to the south 69 ft. The lot line running basically east/west between Lot 2 and Lot 7 would shift 22 ft. to the south. 5. The names of the affected by the petition to vacate, and which utilities will need to supply to the City of Meridian their Relinquishment letters upon completion of the project, include: 5.1 The owners of the property are Brent and Luana Barrus, Kevin and Lila Bates, John.and Cheryl Wardle, and Cheri Mansayon, Meridian, Idaho. 5.2 Intermountain Gas, US West Communications, Inc., City of Meridian, TCI Cablevision and Idaho Power, attached within Exhibit "A" are the Relinquishment of Easements releases. 6. The utility companies will not fully release the easement until such time that they have 6ecn able to reroute their services through. the newly proposed utility casement and ensure that their new service lines are operational_ At that time, they will be able to disconnect and remove the existing services and facilities. They will then be able, and willing, to grant the full release of easement. I have also attached a copy of the plat map legal description. Because the original was hand written, the copy is a little difficult to read. I have also attached a copy of the legal description and exhibit of the current utility easement being vacated. I hope that you find everything in order so as to proceed with the adoption of the Findings of Fact and Conclusions of Law at the scheduled City Council meeting tonight. The lindings of Fact and Conclusions of Law have conditioned the approval of the vacation of easement on obtaining the full release of easement letters. Tonight's adoption is not to approve the easement and direct the mayor to sign the vacation, but is merely to adopt the conditions required before the eascuzent will be vacated. Borup: Good evening ladies and gentlemen. We'd like to begin our February Planning and Zoning Commission meeting. First on the agenda is minutes of the previous held meeting of January 12, 2000. Before we do that, I don't know we need to take roll call other then mention that we have all the Commissioner's here tonight. I would like to welcome a new Commissioner, Sally Norton. Tonight is her first night. Commissioner's are appointed by the Mayor, confirmed by City Council. Again, it is Sally's first night. We are glad to have her here, so everyone be kind to her. First item, minutes from the previous meeting open for a motion unless there is any questions or additions to the minutes from the Commissioner's. Barbeiro: Mr. Chairman, I make a motion that we approve the minutes from the January 12~h meeting as submitted. Brown: Second. Borup: We have a motion and a second. All in favor? Last month we took care of annexation and zoning. Change would not effect that. Brad would you like to -if I didn't, this is the opening of the continued public hearing. Brad. Hawkins Clark: Commissioner's I would point out that the Item number 1, the applicant has requested a withdrawal of the conditional use permit application. I will go on and make comments, but since they are no longer requested a planned unit development, they are conforming to the straight R-8 zoning standards. They are not requesting a planned unit development, so therefore a conditional use permit is not necessary. I will go ahead and address Item number 2. Borup: Do we need to have a withdrawal? Hawkins Clark: That has been submitted in writing. Borup: So you have a written withdrawal? Okay. So that is what we should consider at this point. Item number 1 is withdrawn? Hawkins Clark: Yeah, it should be attached to the written response from JUB Engineers which you should have in your packets. It is the last page, I believe. Brown: I got the comments. The overall width of these easements is 6 ft. with 3 ft. on each lot.
