A notice of a public hearing on the conditional use permit was published for two (2) consecutive weeks prior to the said public hearing scheduled for July 5, 2000, before the City Council, the first publication appearing and written notice having been mailed to property owners or purchasers of record within three hundred feet (300') of the external boundaries of the property under consideration more than fifteen (15) days prior to said hearing and with the notice of public hearing having been posted upon the property under consideration more than one week before said hearing and the copies of all notices were made available to newspaper, radio and television stations as public service announcements; and the matter having been duly considered by the City Council at the July 5, 2000, public hearing; and the applicant, affected property owners, and government subdivisions providing services within the planning jurisdiction of the City of Meridian, having been, given full opportunity to express comments and submit evidence. 2. ' There has been compliance with all notice and hearing requirements set forth in Idaho Code §67-6509, 6512, and Meridian City Code §§ 11-15-5 and 11-17-5 as evidenced by the Affidavit of Mailing, and the Affidavit of Publication and Proof of Posting filed with the staff report. 3. This proposed development request is in an Light Industrial Zone (I -L), by reason of the provisions of the Meridian City Code § 11-17-4, a public hearing was required before the City Council on this application. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY H & W, INC. / (CUP -00-031) _ 2 4. The property is located at the northwest corner of Franklin Road and W.10th Street, Meridian, Idaho. 5. The owner of record of the subject property is H& -W, Inc. of Boise. 6. Applicant is owner of record. 7. The subject property is currently zoned I -L. The zoning district of I -L is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7- 2N. 8. The proposed application requests a conditional use permit for 2 office/warehouse buildings on a single lot. The I -L zoning designation within the City of Meridian Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-8-1). 9. The Meridian Planning and Zoning Commission recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 10. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Ordinance. 11. The Meridian City Council takes judicial notice of its Zoning, Subdivision and Development Ordinances codified at Titles 11 and 12, Meridian City Code and all current zoning maps thereof and the Comprehensive Plan of the City of Meridian, and Maps and the Ordinance establishing the Impact Area Boundary. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY H & W, INC. / (CUP -00-031) _ 3 12. Giving due consideration to the comment received from the governmental subdivisions providing services in the City of Meridian planning jurisdiction public facilities and services required by the proposed development will not impose expense upon the public if the following conditions of development are imposed and the following is also found to be required to mitigate the effects of the proposed use and development upon services delivered by political subdivisions providing services to the subject real property within the planning jurisdiction of the City of Meridian: Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: 12.1 Off-street parking shall be provided in accordance with Section 11-13-4 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific comments. 12.2 Paving and striping shall be in accordance with the standards set forth in Sections 11-13-4 of the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 12.3 A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer ( Ord. 55 7, 10-1-91) for all off-street parking areas. All site drainage shall be contained and disposed of on-site. 12.4 Outside lighting shall be designed and placed so as to not direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-13-4-C. 12.5 All signage shall be in accordance with the standards set forth in Section 11- 14 of the City of Meridian Zoning and Development Ordinance. W, INC. / (CUP -00-031) 4 12.6 Determine the seasonal high groundwater elevation, and submit a profile of the subsurface soil conditions as prepared by a soil scientist with the design of site drainage plan. 12.7 Provide sidewalks in accordance with City Ordinance Section 12-5-2. 12.8 All construction shall conform to the requirements of the Americans with Disabilities Act. 12.9 Sanitary sewer and water service to this site is planned to be provided by extending service lines to the proposed building site. 12.10 Assessment fees for water and sewer service are determined during the building plan review process. Applicant shall be required to enter into a Re - Assessment Agreement with the City of Meridian for all commercial uses. 12.11 The proposed plan shows that the buildings include warehouse, shop, office, and showroom areas. However no details are provided about the actual use of the structures, anticipated tenants, etc. Applicant shall provide this information to determine if the proposed uses are permitted, or if they require conditional use approval with this application. Are there any commercial/retail uses that are proposed in any of the structures? 12.12 Franklin Road is designated as an entryway corridor in the Comprehensive Plan. A 35 -foot landscape setback is required beyond all road right-of-way. This requirement is met by the proposed plan. The ground of the landscape setback shall be planted with lawn, low shrubs, or other vegetative groundcover, rather than just bark as the plan suggests. 12.13 As a PD, a minimum of 10% of the gross land area must be open space. The gross land area of the site is 179,902 s.f. The total area of the site in landscaping and other non -paved or non -building uses is 50,745 s.f. (28%). However, a large portion of this is the Eight Mile Lateral and its associated easement and is outside of the site security fence. The Applicant shall calculate the total landscape area within the site fence boundaries as a percentage of the total site area to demonstrate compliance. This calculation is not shown on the plan. 12.14 The drive aisle on the east side of building 1 is only 13.5 feet wide. City Ordinance requires 25 -foot wide minimum drive aisles for two-way traffic. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY H S& W, INC. / (CUP -00-031) 5 rte, If clearly marked as one-way, drive aisles may go down to 13 feet for standard vehicles. However, it is unlikely that this would provide enough room for the large -truck traffic that will frequent the site. Any drive aisle less than 25 feet wide must be clearly posted as one-way. The Fire Marshall typically requires a minimum of 20 feet for fire access. The proposed drive aisle is subject to fire department approval. 12.15 Parking spaces must be 9' X 19' minimum, with a 25' driveway by City Ordinance. The proposed plan shows 9' X 18' stalls, with a 26' driveway. Modification of the parking layout shall be as follows: The 18 -foot stalls against the planters are OK, because they have room for cars to overhang. However, the stalls against the sidewalks shall be a full 19 feet, or the sidewalk shall be 7 -foot wide min. to allow 2 feet of overhang, plus a 5 -foot clear walking area. Removing the westernmost parking stall shown against the southeast side of building one shall provide a 25' clear drive aisle and maneuvering room parking aisles. 12.16 Based on the total amount of office/showroom space (23,000 s.f.) and warehouse/shop space (31,200 s.f.) in the two buildings, a total of 90 spaces, plus one for each company vehicle, shall be required. A total of 96 are shown, which meets the minimum requirement with up to 6 company vehicles. (If one space is removed, it will permit up to 5 company vehicles). Applicant shall verify that this is adequate for the anticipated number of company vehicles. 12.17 One (1) three-inch (3 ") caliper tree is required per 1,500 sq. ft. of asphalt on the site as per City Ordinance. The "Project Data" on the Site/Landscape Plan (Sheet Al) cites a total of 76,680 s.f. of asphalt area, which requires 51 trees. Sixty trees are proposed on the landscape plan. However, many are not K caliper. Standard policy is that if the applicant cannot provide the required number of 3" caliper trees and wishes to use smaller trees, 110% of the total caliper -inches required (51 trees X 3 inches X 110% = 168.3 total caliper -inches). Applicant shall provide the calculation for the total caliper - inches proposed on site. Modify the street tree pattern along Franklin Road to include at least two species, so that if one species is affected by pests or disease, it is less likely to spread and affect the other trees. 12.18 Coordinate a screened trash enclosure location for each building and construction requirements with Sanitary Service Company and provide a letter of approval from their office to Planning Sz Zoning when applying for FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY H S& W, INC. / (CUP -00-031) _ 6 r. a Certificate of Zoning Compliance. All trash areas are to be enclosed by a screening fence on at least three (3) sides. No trash enclosures are currently shown on the plan. Applicant shall be required to show the proposed trash enclosure locations. 12.19 Handicap parking, associated signage and building construction shall meet the requirements of the Americans with Disabilities Act. 12.20 No signage is proposed with the application. Limitation of signs to a single freestanding monument, not to exceed 72 s.f, plus standard on -building signage is required. All signage is subject to design review and requires separate permits. 13. The proposed uses within the subject application will be harmonious with and in accordance with the Meridian Comprehensive Plan and the City of Meridian Zoning and Development Ordinance because: 13.1 The subject property is designated on the "Generalized Land Use Map" as "Commercial". 14. The uses proposed within the subject application subject to the conditions herein ordered will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance or intended character of the general vicinity and that such uses will not change the intended essential character of the same area. 15. The uses proposed within the subject application will not be hazardous or disturbing to existing or future neighboring uses. 16. The uses proposed within the subject application will be served adequately by central public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, and sewer. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY H & W, INC. / (CUP -00-031) _ 7 17. The uses proposed within the subject application will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors. 18. The development will not result in the destruction, loss or damage of natural or scenic feature of major importance relating to the property. CONCLUSIONS OF LAW 1. The City of Meridian shall exercise the powers conferred upon it by the "Local Land Use Planning Act of 1975" hereinafter referred to for convenience as the "Act" codified at Chapter 65, Title 67, Idaho Code (I.C. §67-6503). 2. The Meridian City Council may exercise all the powers required and authorized under the "Act" except the power to adopt ordinances by the establishment of a Planning and Zoning Commission by ordinance pursuant to Idaho Code Section 67- 6504 which the City Council of the City of Meridian has established by the passage of the "City of Meridian Zoning and Development Ordinance" at Titles XI and XII, Chapter I, Meridian City Code. 3. As part of a zoning ordinance the City Council can, subject to hearing and notice provision required, provide for the process of special and/or conditional use permits which a proposed use is otherwise prohibited by the terms of the ordinance but allowed FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT BY H & W, INC. / (CUP -00-031) _ 8 with conditions under the specific provisions of the ordinance which the City of Meridian has done in the adoption of its zoning ordinances. 4. The City Council has the duty and responsibility to review the facts and circumstances of each application for special use permit to determine prior to granting the same that the evidential showing supports the finding that the following standards are met and that the proposed development: (Meridian City Code § 11-17-3 ) a. Will, in fact, constitute a conditional use as determined by City policy; b. Will be harmonious with and in accordance with the Comprehensive Plan and this Ordinance; C. Will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; d. Will not be hazardous or disturbing to existing or future neighboring uses; e. Will be served adequately by essential public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; f. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; g. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; h. Will not result in the destruction, loss or damage of a natural or scenic feature of major importance. Prior to granting a conditional use permit in a Light Industrial District (I -L), a public hearing shall be conducted with notice to be published and provided to property owners or purchasers of record within three hundred feet (300') of the external boundaries of the land under consideration for the conditional use permit all in accordance with the provisions of Meridian City Code § 11-17-5 City of Meridian Zoning and Development Ordinance, which provides as follows: "Prior to approving a Conditional Use Permit, the applicant and the Commission and Council shall follow notice and hearing procedures provided in Chapter 15 of this Title. Provided, however, that conditional use applications for land in Old Town and in industrial and commercial districts shall only be required to have one public hearing which shall be held before the Planning and Zoning Commission; and after the recommendation of the Commission is made, the application shall go before the City Council without a public hearing and the Council may approve, deny, or modify the recommendation of the Commission." 6. Following the public hearing and within 45 days after the conclusion of the public hearing the Commission shall, transmit its recommendations to the Meridian City Council with supportive reasons. The Commission shall recommend that the application be approved, approved with conditions or denied. The Commission shall ensure that any approval or approval with conditions of an application shall be in accordance with Meridian Comprehensive Plan, City of Meridian Zoning and Development Ordinance, and Idaho State law. (Meridian City Code § 11-17-6) 7. When the City Council approves a conditional use permit it may impose conditions of that approval that reasonably: A. The City of Meridian has, by ordinance, established the Impact Area and the Comprehensive Plan of the City of Meridian, which was adopted December 21, 1993, Ord. 629, January 4, 1994 and Maps. The Applicant shall calculate the total landscape area within the site fence boundaries as a percentage of the total site area to demonstrate compliance. This calculation is not shown on the plan. 1.14 The drive aisle on the east side of building 1 is only 13.5 feet wide. City Ordinance requires 25 -foot wide minimum drive aisles for two-way traffic. If clearly marked as one-way, drive aisles may go down to 13 feet for standard vehicles. However, it is unlikely that this would provide enough room for the large -truck traffic that will frequent the site. Any drive aisle less than 25 feet wide must be clearly posted as one-way. PUBLIC HEARING: REQUEST FOR A CONDITIONAL USE PERMIT FOR PROPOSED (2) OFFICEMAREHOUSE BUILDINGS ON 4.13 ACRES ZONED I -L BY H&W, INC. —CORNER OF FRANKLIN ROAD AND 10TH STREET: Borup: Mr. Siddoway. Siddoway: Mr. Chairman and members of the commission this is a proposal with H&W Inc. as the applicant. This is a copy of the proposed site plan. They would have an access off of 10th and off Franklin road into their parking lot areas. You have our comments dated June 6th. Several things we have asked the applicant to clarify at this hearing that I would like to point out. First of all we do note that the 35 foot landscape set back is required as a condition of the CUP. This plan is in conformance with that requirement. It is also considered a Planned Development due to the fact that there are two primary structures on a single lot and the only why that can happen is through a PUD under our current ordinance. That ordinance has a requirement for 10 percent common open space based on the calculations they provided on their site plan, they are showing upward of 28 percent but that does include extensively this area along the canal which is outside of their security fence. We would say there needs to be at least 10 inside of that. One other hot issue is this corner of the building only has a 13 foot wide paved drive isle which seems fairly inadequate for the types of large trucks that are going to be accessing this warehouse/office use. Another issue with this that we state right in the beginning is we need some clarification. Posed uses are not clearly spelled out other then the fact that they are office/warehouse/showroom type uses. We need to verify if there is any retail uses or anything that needs to be approved as part of the conditional use permit. No specific information as to the tenants of these buildings has been provided. The drive isle is an issue. We point out that our ordinance requires 9 x 19 foot stalls. The plan shows 9 x 18 with a 26 foot driveway. We only require a 25 foot driveway. There is one parking stall on the end and looks like it will have a difficult time pulling out. If we eliminate that one parking stall then we maintain that 25 clear drive access isle that the ordinance requires. We did a parking calculation and show that they have adequate parking with up to 5 company vehicles. We would like the applicant to verify that is enough. Also the tree requirement, although you just saw our new landscape ordinance requirement until that gets finalized, we are still under the one 3 inch caliper tree per 1500 square feet of asphalt ordinance. Given that and the square footage of asphalt shown on the plan they would require 51 trees. This site plan does include 60 trees but not all 3 inch caliper. Our policy has been, if they are dropping caliper inches the total on the site has to be 110% of the total required. We need the applicant to verify the total caliper inches proposed on the site based on the number of trees they are proposing and the sizes. Minor issues such as the including some additional species of trees. I would point out that no signage has been proposed for this application. It is required to be part of the application. Our staff recommendation based on other standard on other entry way corridors is to limit it to a single 72 square foot monument sign plus on building signage if the applicant has issues he should bring it up at this point because what ever is approved with this application for signage is what they will be held to. Let our comments stand and I stand for questions. Borup: Is the applicant here and like to come forward. Whitney: Good evening ladies and gentlemen, my name is Ron Whitney. 1412 W. Idaho Street, Ste 200, Boise representing the applicant. We have reviewed staff comments and concur with the conditions of approval. I have to apologize on the issue of the 10 percent landscaping. The architect has assured me that we're well in compliance with that but hasn't given me specific numbers as far as the breakdown once we exclude the area along the canal. The driveway that has been referred to on the northeast corner, we do intend on that being a one way drive and the intent is that drive is only serving the easterly building. We do not anticipate retail in there at this time. I would pose the question, do we have the option of asking for approval of potential retail tonight or is that a issue we can address later on. As far as the signage goes we are familiar with the ordinance and have not problem with complying with the maximum requirements in place at this time. Any other question I could help you with. Norton: When you said this will be office building and showroom, what does showroom mean. Whitney: It would primarily be—we are not looking at this being direct retail to the public so it would be something of manufacturing or warehousing that is going on there that would be a showroom to display the product that is available. We are anticipating more of a wholesale type use. Norton: Can you give me specifics what it is going to be. Whitney: Possibly like cabinets, if it were modular cabinets that were warehoused there and distributed out of that building and there would be a display room that would exhibit the product. Norton: You agree with number 13 staff comments regarding there is no signage proposed with this application that any signage you would have to come through for another design. Whitney: Yes. Nary: I was curious on condition 3 and I understand the staffs concern that it is not very clear to me that you have specific tenant in mind at this point. Whitney: We do not have specific tenants at this point. Nary: So the reason for the two buildings is just economically feasible way to make this project more soluble. It appears that the condition doesn't really give enough for the city to come back. If you have a permitted use on our laundry list of permitted uses, you may not have to come back to notify the staff as to what you are putting in there. Would you be adverse to something a little stronger as to whatever type (inaudible) notice to the city as to what type of business are in there. Whitney: Oh no, that would be fine. END OF SIDE FIVE Borup: I think the thing we have conditional use permit can be reviewed on 10 day notice so if there was a problem you just have the city would have to hang their hat on. Was staff concerned potential retail use. Siddoway: I mentioned it because if it is not approved they will have to come through with the modification of the conditional use permit to add that. Borup: If what is not approved? Siddoway: Retail use on the site. It is not approved as part of this conditional use permit tonight and they want to put some in the future then it would have to go through a new conditional use permit. Borup: Is something you would anticipate you would want to do. Whitney: Certainly if we could actually get the approval taken care of tonight so that it came up, we could avoid that process later on. We'd like to do that. Borup: Will different retail uses have different parking requirements. Siddoway: Retail is at one per 200 square feet. The parking calculations that I did were based on the office use at one per 400 and with the warehouse one per 1000 plus one per vehicle in use at the business. Based on those standards they are in compliance with up to 5 company vehicles. If there is a retail use the parking requirement would double in the square footage that is in that retail use. Right now it is calculated at the office and warehouse use standards. No excess parking at this point unless there is less than 5 company vehicles then there might be up to 5. Borup: So if it went to retail they would have to come up with more parking spaces. Would that need to come back before the commission to add parking. Siddoway: I would recommend it based on —it would have to do some serious modifications to their site with that use. I would say if they are going to add retail use in the future, it should come through as a modification of the conditional use permit. Whitney: We can live with that. Siddoway: On number 9 which is the one about the trees, I am concerned that the 110% rule is met and I would just state that if it is not, if it is fine. We need those calculations. But if it is not there will have to be some additional trees provided to get to that 168.3 caliper inches. Applicant shall be required to enter into a Re -Assessment Agreement with the City of Meridian for all commercial uses. 1.11 The proposed plan shows that the buildings include warehouse, shop, office, and showroom areas. However no details are provided about the actual use of the structures, anticipated tenants, etc. Applicant shall provide this information to determine if the proposed uses are permitted, or if they require conditional use approval with this application. Specifically, staff wonders if any commercial/retail uses are proposed in any of the structures. 1.12 Franklin Road is designated as an entryway corridor in the Comprehensive Plan. A 35 -foot landscape setback is required beyond all road right-of-way. This requirement is met by the proposed plan. The ground of the landscape setback shall be planted with lawn, low shrubs, or other vegetative groundcover, rather than just bark as the plan suggests. 1.13 As a PD, a minimum of 10% of the gross land area must be open space. The gross land area of the site is 179,902 s.f. The total area of the site in landscaping and other non -paved or non -building uses is 50,745 s.f. RECOMMENDATION TO CITY COUNCIL - 3 CONDITIONAL USE PERMIT — 2 OFFICE/WAREHOUSE BUILDINGS —H& -W, INC. (28%). However, a large portion of this is the Eight Mile Lateral and its associated easement and is outside of the site security fence. The Applicant shall calculate the total landscape area within the site fence boundaries as a percentage of the total site area to demonstrate compliance. This calculation is not shown on the plan. Grz-sf 1.14 The drive aisle on the west side of building 1 is only 13.5 feet wide. City Ordinance requires 25 -foot wide minimum drive aisles for two-way traffic. If clearly marked as one-way, drive aisles may go down to 13 feet for standard vehicles. However, it is unlilcely that this would provide enough room for the large -truck traffic that will frequent the site. Any drive aisle less than 25 feet wide must be clearly posted as one-way. The Fire Marshall typically requires a minimum of 20 feet for fire access. The proposed drive aisle is subject to fire department approval. 1.15 Parking spaces must be 9' X 19' minimum, with a 25' driveway by City Ordinance. The proposed plan shows 9' X 18' stalls, with a 26' driveway. Staff recommends modifying the parking layout as follows: The 18 -foot stalls against the planters are OK, because they have room for cars to overhang. However, the stalls against the sidewalks should be a full 19 feet, or the sidewalk should be 7 -foot wide min. to allow 2 feet of overhang, plus a 5 -foot clear walking area. Staff recommends removing the westernmost parking stall shown against the southeast side of building one to provide 25' clear drive aisle and maneuvering room parking aisles. 1.16 Based on the total amount of office/showroom space (23,000 s.f.) and warehouse/shop space (31,200 s.f.) in the two buildings, a total of 90 spaces, plus one for each company vehicle, would be required. A total of 96 are shown, which meets the minimum requirement with up to 6 company vehicles. (If one space is removed, it will permit up to 5 company vehicles). Applicant shall verify that this is adequate for the anticipated number of company vehicles. 1.17 One (1) three-inch (3") caliper tree is required per 1,500 sq. ft. of asphalt on the site as per City Ordinance. The "Project Data" on the Site/Landscape Plan (Sheet Al) cites a total of 76,680 s.f. of asphalt area, which requires 51 trees. Staff recommends modifying the street tree pattern along Franklin Road to include at least two species, so that if one species is affected by pests or disease, it is less likely to spread and affect the other trees. 1.18 Coordinate a screened trash enclosure location for each building and construction requirements with Sanitary Service Company and provide a letter of approval from their office to Planning &_ Zoning when applying for a Certificate of Zoning Compliance. The property is located in an area designated as Existing Urban in the Comprehensive Plan. The surrounding uses follow: North — Eight -Mile Lateral and existing Mini Storage. South — Franklin Road and Crestwood Estates Subdivision East — Contractor's Yard (Mortensen Construction) West — Vacant land, zoned RT in Ada County GENERAL COMMENTS: 1. Off-street parking shall be provided in accordance with Section 11-13-4 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific comments. 2. Paving and striping shall be in accordance with the standards set forth in Sections 11-13-4 of the City of Meridian Zoning and Development Ordinance and in accordance with H&W Inc Office-Warehouses-CUP.doc Mayor, Council and P&Z June 6, 2000 Page 2 Americans with Disabilities Act (ADA) requirements. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. All site drainage shall be contained and disposed of on-site. 4. Outside lighting shall be designed and placed so as to not direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-13-4-C. 5. All signage shall be in accordance with the standards set forth in Section 11-14 of the City of Meridian Zoning and Development Ordinance. 6. Determine the seasonal high groundwater elevation, and submit a profile of the subsurface soil conditions as prepared by a soil scientist with the design of site drainage plan. 7. Provide sidewalks in accordance with City Ordinance Section 12-5-2. 8. All construction shall conform to the requirements of the Americans with Disabilities Act. SITE SPECIFIC COMMENTS: 1. Sanitary sewer and water service to this site is planned to be provided by extending service lines to the proposed building site. 2. Assessment fees for water and sewer service are determined during the building plan review process. Applicant shall be required to enter into a Re -Assessment Agreement with the City of Meridian for all commercial uses. An assessment agreement is a vehicle that protects the City of Meridian and the Developer in the event that estimated assessments are not in line with actual usage. The agreement provides for reimbursement to the developer for over payment of assessments and payment to the City of Meridian of any shortfall in assessments. The overpayment/shortfall is determined after adequate historical usage. 3. The proposed plan shows that the buildings include warehouse, shop, office, and showroom areas. However no details are provided about the actual use of the structures, anticipated tenants, etc. Applicant shall provide this information to determine if the proposed uses are permitted, or if they require conditional use approval with this application. Specifically, staff wonders if any commercial/retail uses are proposed in any of the structures. 4. Franklin Road is designated as an entryway corridor in the Comprehensive Plan. A 35 -foot landscape setback is required beyond all road right-of-way. This requirement is met by the proposed plan. The ground of the landscape setback shall be planted with lawn, low shrubs, CUP -00-031 H&W Inc Office -Warehouses. CUP. doc Mayor, Council and P&Z June 6, 2000 Page 3 or other vegetative groundcover, rather than just bark as the plan suggests. 5. As a PD, a minimum of 10% of the gross land area must be open space. The gross land area of the site is 179,902 s.f. The total area of the site in landscaping and other non -paved or non -building uses is 50,745 s.f. (28%). However, a large portion of this is the Eight Mile Lateral and its associated easement and is outside of the site security fence. The Applicant shall calculate the total landscape area within the site fence boundaries as a percentage of the total site area to demonstrate compliance. This calculation is not shown on the plan. 6. The drive aisle on the west side of building 1 is only 13.5 feet wide. City Ordinance requires 25 -foot wide minimum drive aisles for two-way traffic. If clearly marked as one-way, drive aisles may go down to 13 feet for standard vehicles. However, it is unlikely that this would provide enough room for the large -truck traffic that will frequent the site. Any drive aisle less than 25 feet wide must be clearly posted as one-way. The Fire Marshall typically requires a minimum of 20 feet for fire access. The proposed drive aisle is subject to fire department approval. 7. Parking spaces must be 9' X 19' minimum, with a 25' driveway by City Ordinance. The proposed plan shows 9' X 18' stalls, with a 26' driveway. Staff recommends modifying the parking layout as follows: The 18 -foot stalls against the planters are OK, because they have room for cars to overhang. However, the stalls against the sidewalks should be a full 19 feet, or the sidewalk should be 7 -foot wide min. to allow 2 feet of overhang, plus a 5 -foot clear walking area. Staff recommends removing the westernmost parking stall shown against the southeast side of building one to provide 25' clear drive aisle and maneuvering room parking aisles. 8. Based on the total amount of office/showroom space (23,000 s.f.) and warehouse/shop space (31,200 s.f.) in the two buildings, a total of 90 spaces, plus one for each company vehicle, would be required. A total of 96 are shown, which meets the minimum requirement with up to 6 company vehicles. (If one space is removed per comment #6, it will permit up to 5 company vehicles). Applicant shall verify that this is adequate for the anticipated number of company vehicles. 9. One (1) three-inch (3") caliper tree is required per 1,500 sq. ft. of asphalt on the site as per City Ordinance. The "Project Data" on the Site/Landscape Plan (Sheet Al) cites a total of 76,680 s.£ of asphalt area, which requires 51 trees. Sixty trees are proposed on the landscape plan. However, many are not 3" caliper. Standard policy is that if the applicant cannot provide the required number of 3" caliper trees and wishes to use smaller trees, 110% of the total caliper -inches required (51 trees X 3 inches X 110% = 168.3 total caliper -inches). Staff recommends modifying the street tree pattern along Franklin Road to include at least two species, so that if one species is affected by pests or disease, it is less likely to spread and affect the other trees. 11. Coordinate a screened trash enclosure location for each building and construction requirements with Sanitary Service Company and provide a letter of approval from their office to Planning & Zoning when applying for a Certificate of Zoning Compliance. All trash areas are to be enclosed by a screening fence on at least three (3) sides. No trash enclosures are currently shown on the plan. Applicant shall respond by showing the proposed trash enclosure locations. 12. Handicap parking, associated signage and building construction shall meet the requirements of the Americans with Disabilities Act. 13. No signage is proposed with the application. Staff recommends limiting signs to a single freestanding monument, not to exceed 72 s.E, plus standard on -building signage. All signage is subject to design review and requires separate permits. 14. This conditional use permit shall be subject to review upon ten (10) days' notice to the applicant. RECOMMENDATION: Staff recommends approval of the project with the conditions noted above. COMPREHENSIVE PLAN ANAYSIS: The 1993 Comprehensive Plan contains a variety of goals and policies relevant to this application. The following sections most directly apply to the proposed project and are repeated here for the Council and Commission's consideration during the hearing process. Economic Development 1.3 The character, site improvements and type of new commercial or industrial developments should be harmonized with the natural environment and respect the unique needs and features of each area. Land Use 3.1 Industrial development within the urban service planning area should receive the highest priority. 3.5 Industrial development should be encouraged to locate adjacent to existing industrial uses.
