Therefore the City Council makes the following findings: FINDINGS OF FACT 1. That the proposed development is in conformance with the Comprehensive Plan by reason of the fact that it lies within the existing Urban Area as defined in the Meridian Comprehensive Plan Generalized Land Use Map, Infrastructure Planning Analysis Comprehensive Plan and Map, adopted December 21, 1993, and the property is presently zoned Low Density Residential District (R- 4), and requires connection to the Municipal Water and Sewer System. [Meridian City Code § 11-7-2 C.] 2. The preliminary plat is in conformance with the Comprehensive Plan City of Meridian adopted December 21, 1993, Ordinance No. 629. 3. It is determined that Urban Services can be made available to accommodate the proposed development if the plat complies with the requirements and conditions hereinafter set forth as conditions of preliminary plat approval. 4. It is found that the Recommendation To City Council of the Planning and Zoning Commission is reasonable and appropriate for the conditions of approval of the preliminary plat as hereinafter set forth. 7. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Sewer manholes shall be provided to keep the sewer lines on the south and west sides of the centerline. 2.8 Water service to this site will be via extensions from extensions of an existing main in Ustick Road. Applicant shall be responsible to construct the water mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. 2.9 Two -hundred -fifty- and 100 -watt, high-pressure sodium streetlights shall be required at locations designated by the Public Works Department. All streetlights shall be installed at subdivider's expense. Typical locations are at street intersections and/or fire hydrants. 2.10 Applicant has not indicated whether the pressurized irrigation system within this development is to be owned and maintained by an association or the Nampa &_ Meridian Irrigation District. If the system is being proposed as a private system, plans and specifications for the irrigation system shall be reviewed by the Public Works Department as part of the development plan review process. A draft copy of the pressurized irrigation system O&M manual must be submitted prior to plan approval. The City of Meridian requires that pressurized irrigation systems be supplied by a year-round source of water. If a creek or well source is not available, a single -point connection to the culinary water system shall be required. If a single -point connection is utilized, the developer shall be responsible for the payment of assessments for the common areas prior to signature on the final plat by the Meridian City Engineer. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the entire common open area. 2.11 A 20 -foot wide minimum landscape buffer, beyond the required ACHD right-of-way along Ustick Road, shall be constructed by the developer as FINDINGS OF FACT AND CONCLUSIONS OF LAW AND ORDER OF CONDITIONAL APPROVAL OF PRELIMINARY PLAT BY: ROBERT GLENN FOR WANDA'S MEADOW SUBDIVISION/ (PP -00-011) _ 5 a condition of the plat. The landscape buffer shall be within a common lot, owned and maintained by a homeowners association, with a note indicating such on the plat. The buffer shall contain, at a minimum, one -tree -per 35 lineal feet along Ustick Road. Fencing shall not encroach upon this buffer. 2.12 Detailed landscape plans for all common lots shall be submitted for review and approval with submittal of the Final Plat application. A letter of credit or cash surety will be required for the improvements prior to City signature on the Final Plat. 2.13 Six -foot -high, permanent perimeter fencing shall be required along the north, east and west property lines. Submit detailed fencing plans for review and approval with submittal of the Final Plat. All required fencing is to be in place prior to issuance of building permits. 2.14 The application incorrectly states that there are 2 common lots. The plat actually shows 3 common lots — Lot 1 Block 1, and Lots 1 &. 7, Block 2. Fencing on either side of Lot 7, Block 2, shall be limited to solid fencing at a maximum height of three feet or non -sight -obstructing fencing of a maximum of four feet because the lot is within 20 feet of the right-of-way. The applicant shall submit proposed fence details for the lot with the fencing plan described in comment number 7. Developer is responsible for fencing Lot 7, Block 2, prior to applying for building permits. This lot is not a pedestrian walkway, Applicant shall leave the drainage easement as an easement within one of the lots rather than the common lot if the Ada County Highway District will allow. 2.15 Applicant shall provide a stub street to the west property line located approximately 125 -feet south of the north property line. The newly submitted plat for the Hollows Sub. shows a stub street connecting to Wanda's Meadow Sub. in this same location. This stub shall be required even if ACHD changes their recommendation not to require the stub street. 2.16 Any entry signage for the subdivision shall be placed outside of a 40'x 40' clear sight triangle, measured from the projected intersection of Ustick Road and North Lily Turf Ave.; or, if the sign is less than 3' in FINDINGS OF FACT AND CONCLUSIONS OF LAW AND ORDER OF CONDITIONAL APPROVAL OF PRELIMINARY PLAT BY: ROBERT GLENN FOR WANDA'S MEADOW SUBDIVISION/ (PP -00-011) - 6 height, it may be placed within the sight triangle. Applicant shall show the entry signage location on the required landscape plan to be submitted with the final plat application. 2.17 Add a note to the final plat for minimum house size. 2.18 Submit 10 copies of the revised plat that conforms to these requirements at least one week prior to the public hearing with City Council. Also submit one 8'/z x 11 legible copy of the revised plat. 2.19 As drawn, Lot 3, Block 2, would not meet the minimum street frontage requirement on the W. Summer St. frontage. The requirement shall be the front of house orientation to be set toward N. Lily Turf Ave. To avoid being locked into this orientation restriction, adjust the Summer St. frontage to be 80 -feet (1/2 arc length of curve + frontage). Adopt the Recommendations of the Ada County Highway District as follows: 2.20 Dedicate 48 -feet of right-of-way from the centerline of Ustick Road abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. Allow up to 30 business days to process the right-of-way dedication after receipt of all requested material. 2.21 Locate Lillyturf Avenue off Ustick Road 110 -feet east of the west property line. 2.22 The existing driveway on Ustick Road, located approximately 265 -feet east of the west property line, shall be closed. 2.23 Construct all public roads within the proposed subdivision as 36 -foot street sections with curb, gutter, and 5 -foot wide concrete sidewalks within 50 -feet of right-of-way. 2.24 Construct a 5 -foot wide concrete sidewalk on Ustick Road abutting the entire parcel, located 2 -feet within the new right-of-way. Coordinate the location, elevation and grade of the sidewalk with District staff. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND ORDER OF CONDITIONAL APPROVAL OF PRELIMINARY PLAT BY: ROBERT GLENN FOR WANDA'S MEADOW SUBDIVISION/ (PP -00-011) - 7 2.25 Provide an ACHD approved turnaround at the terminus of Lillyturf Avenue. The District will consider alternatives to the standard turnaround on a case-by-case basis. This shall be based on turning area, drainage, maintenance considerations and the written approval of the emergency fire service for the area where the development is locate. Submit a design of the turnarounds for review and approval by District staff. 2.26 Stub Pampass Avenue to the north property line located approximately 120 -feet west of the east property line. Install a sign at the terminus of the roadway stating that, "THIS ROAD WILL BE EXTENDED IN THE FUTURE". Coordinate the sign plan for the stub street, and the design of the turnaround with District staff. 2.27 Provide a stub street to the west property line located approximately I00 -feet south of the north property line. Install a sign at the terminus of the roadway stating that, "THIS ROAD WILL BE EXTENDED IN THE FUTURE'. Coordinate the sign plan for the stub street, and the design of the turnaround with District staff. 2.28 Other than the access point specifically approved with this application, direct lot or parcel access to Ustick Road is prohibited. Adopt the Meridian Fire Department's Recommendations as follows: 2.29 Applicants shall satisfy all fire code requirements including those pertaining to water flow and fire hydrants. 2.30 No parking of equipment, vehicles or trailers in cul-de-sac. Adopt the Central District Health Department's Recommendations as follows: 2.31 The Applicant's central sewage and central water plans must be submitted to and approved by the Idaho Department of Health & Welfare, Division of Environmental Quality. 2.32 Run-off is not to create a mosquito breeding problem. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND ORDER OF CONDITIONAL APPROVAL OF PRELIMINARY PLAT BY: ROBERT GLENN FOR WANDA'S MEADOW SUBDIVISION / (PP -00-011) - 8 2.33 Stormwater shall be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality. 2.34 The Engineers and architects involved with the design of the subject project shall obtain current best management practices for stormwater disposal and design a stormwater management system that prevents groundwater and surface water degradation. Additionally, the City Council at its July 18, 2000 meeting required the following conditions: 2.35 That the Preliminary Plat shall be required to note the house orientation for Lot 6 Block 1 and Lot 3 Block 3. 2.36 That all dimensional requirements from the Ada County Highway District shall be met. The District will consider alternatives to the standard turnaround on a case-by-case basis. This will be based on turning area, drainage, maintenance considerations and the written approval of the emergency fire service for the area where the development is locate. Submit a design of the turnarounds for review and approval by District staff. 1.28 Stub Pampass Avenue to the north property line located approximately 120 -feet west of the east property line. Install a sign at the terminus of the roadway stating that, "THIS ROAD WILL BE EXTENDED IN THE FUTURE". Coordinate the sign plan for the stub street, and the design of the turnaround with District staff. 1.29 Provide a stub street to the west property line located approximately 100 -feet south of the north property line. Mr. Siddoway. Siddoway: This was before you the previous month. There were issues on this the last time it was here. The biggest one was the stub street being provided to the property provided to the west. The plat that was originally submitted did not have it. This plat was submitted just today to the clerk. I have not had a chance to review it, but it is my general feeling that it meets compliance. With that, staff comments dated May 18tH Standard requirements based on public works issues. The 20 foot landscape buffer beyond ACHD right of way is required. The original plat did comply with this. I would say that we would recommend approval based on the comments in our staff report dated May 18 and allow the applicant to address any concerns he might have. Borup: Are you saying you want more time to study the plat. Siddoway: I am telling you I have not studied it. Borup: Comparing the two it looked to me like the only thing changed is around the area of the Stub street, we've added a flag lot there on lot 3 and appeared to my everything else complied. Is the applicant here. Pavelek: My name is Richard Pavelek, 915 W. Jefferson in Boise. What we have done is submitted the revised preliminary plat that is before you to address one of the staff conditions of approval and that was to provide a stub street to the property to the west. All other aspects are as original submission. What we wanted to do is share with you the solution that we feel meets all the requirements of the stub street. We have reviewed this with the highway district and they support this configuration and location for the stub street. As far as the other conditions of approval we have no difficulty in terms of meeting those prior to submission of the final plat. I believe the recommendation was from staff for approval and I believe the revision constitutes no defect in this plat. Norton: There seems to be a discrepancy between the application and the staff comments. Are there two or three common lots. Lot one block one, lot one and seven block 2. Are those all three of the common lots. Pavelek: Yes. Barbeiro: Steve, as I recall on this plan in the past, was the property to the east wasn't that zoned an R-3. We were talking about the road paralleling the property to the east. Siddoway: The property to the west of this project is R-3. The property to the west is a skinny sliver that is still RT. We have received a plat application for that property that also continues that stub street to the west. Barbeiro: I am referring to the property to the east. The sliver property. The discussion prior was that the road for this Subdivision should run center line to that property to the east. That was a discussion when this first came up for annexation and zoning because that essentially make the property to the east implausible. Borup: It is not big enough. If it was down the center line they would have to tear their buildings out. I don't think that owner requested that. Siddoway: I don't remember that. On the annexation and zoning there was a plat submittal conceptually shown as what they were intending to do. All of our comments were specific to annexation and zoning and made clear that the plat—none of the comments were in reference to the plat. Pavelek: Very briefly Mr. Chairman we did speak to the owner of the property to the east after the last public hearing and their feelings were that they did not want to develop at this time. If they do choose to in the future they would like to link their redevelopment of the property to their east, which has got a great potential for redevelopment. Siddoway: I was looking though the comments and there was one lot 3 block 2 not meeting minimum street frontage requirements. I am uncomfortable doing a on the fly review at the table. Borup: On the new plat it is lot 3 block 3. The numbers changed. Pavelek: Basically that was a recommendation that we choose one of the two for the fronting side and I think we can easily accommodate that. If it fronts on the north south street, it will meet the frontage requirements. If it fronts on the east west street it doesn't. Borup: That is where I have a disagreement with our ordinance. Steve did that answer that for you. Siddoway: Yes and it still is shy by just barely 79 feet and 80 feet is the minimum. 63.67 plus half of the 31.2 which is 79.31 for frontage along that. Borup: It is short .7 feet. You could take that out of lot 5 1 guess if you wanted flexibility. I might just mention a minor thing on item 5, it's a typo mentions what the applicant said they comply with that. They want you to do some landscaping along Victory Road. Can you handle that. The notice of public hearing on the application for annexation and zoning was published for two (2) consecutive weeks prior to said public hearing FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 1 AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY ROBERT GLENN (AZ -00-001) scheduled for February 15, 2000, before the City Council, the first publication appearing and written notice having been mailed to property owners or purchasers of record within three hundred feet (300') of the external boundaries of the property under consideration more than fifteen (15) days prior to said hearing and with the notice of public hearing having been posted upon the property under consideration more than one week before said hearing; and that copies of all notices were made available to newspaper, radio and television stations as public service announcements; and the matter having been duly considered by the City Council at the February 15, 2000, public hearing; and the applicant, affected property owners, and government subdivisions providing services within the planning jurisdiction of the City of Meridian, having been given full opportunity to express comments and submit evidence. 2. There has been compliance with all notice and hearing requirements set forth in Idaho Code H 67-6509 and 67-6511, and Meridian City Code H 11-15-5 and 11-16-1. 3. The City Council takes judicial notice of its zoning, subdivisions and development ordinances codified at Titles 11 and 12, Meridian City Code, and all current zoning maps thereof, and the Comprehensive Plan of the City of Meridian adopted December 21, 1993, Ordinance No. 629, January 4,1994, and maps and the ordinance Establishing the Impact Area Boundary. The property which is the subject to the application for annexation and zoning is described in the application, and by this reference is incorporated herein as if set forth in full. The property is approximately 7.99 acres in size. The property is located at Ustick Road west of Locust Grove Road, Meridian, Idaho. The property is designated as the Glenn Usticic Property, 5. The owner of record of the subject property is Ted G. and Wanda L. Hepper, of 1440 Usticic Road, Meridian, Idaho. 6. Applicant is Robert Glenn, of 604 N. Cole Road, Boise, Idaho. 7. The property is presently zoned by Ada County as Rural Transitional (R -T), and consists of open ground with one single family home. S. The Applicant requests the property be zoned as Low Density Residential (R-4). 9. The subject property is bordered to the north by Ada County and city limits of the City of Meridian are adjacent and abut to the south and west of the subject property. 10. The property which is the subject of this application is within the Area of Impact of the City of Meridian. 11. The entire parcel of the property is included within the Meridian Urban Service Planning Area as the Urban Service Planning Area is defined in the Meridian Comprehensive Plan. FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 3 AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY ROBERT GLENN (AZ -00-001) vl%� 12. The Applicant proposes to develop the subject property in the following manner: develop a residential subdivision. 13. The Applicant requests zoning of the subject real property as Low Density Residential (R-4) which is consistent with the Meridian Comprehensive Plan Generalized Land Use Map which designates the subject property as Single Family Residential. 14. There are no significant or scenic features of major importance that affect the consideration of this application. 15. Giving due consideration to the comment received from the governmental subdivisions providing services in the City of Meridian planning jurisdiction, public facilities and services required by the proposed development will not impose expense upon the public if the following conditions of development are imposed: Adopt the Recommendation of the Planning and Zoning staff as follows: 15.1 Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 15.2 Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-domestic purposes such as landscape irrigation. Adopt the Recommendation of the Meridian Fire Department as follows: FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 4 AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY ROBERT GLENN (AZ -00-001) .-N 15.3 Applicants shall satisfy all fire code requirements including those pertaining to water flow and fire hydrants. 15.4 An emergency turnaround will have to be provided. 16. It is found that if the developer pays for the requested improvements and complies with the conditions set forth in these Findings of Fact No. 15, and all sub -parts, the economic welfare of the City and its residents and tax and rate payers will be protected, which requirement shall be included in a development agreement, a condition of annexation and zoning designation. 17. It is also found that the development considerations as referenced in Finding No. 15 are reasonable to require and must be taken into account, in order to assure the proposed development is designed, constructed, operated and maintained in a manner which is harmonious and appropriate in appearance with the existing, or intended character of the general vicinity, in order to assure that the proposed use will not change the essential character of the affected vicinity and will insure that the proposed uses will not be hazardous or disturbing to the existing, or future neighboring uses, particularly considering the impact of proposed development on potential to produce excessive traffic, noise, smoke, fumes, glare and odors. 18. It is found that the zoning of the subject real property as (R-4) Low Density Residential District allows only single-family dwellings with a maximum of four (4) dwelling units per acre and requires connection to the Municipal Water and Sewer systems and will be compatible with the Applicant's development intentions, FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 5 AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY ROBERT GLENN (AZ -00-001) r. and will assure that the zoning is consistent with the Meridian Comprehensive Plan Generalized Land Use Map which designates the subject property as Low Density Single Family and Rural Residential Housing. 19. The subject annexation request and zoning designation and proposed development relates and is compatible to the goals and policies of the Comprehensive Plan of the City as follows: 19.1 The consideration of the provisions of the Comprehensive plan and the requirements of the Zoning ordinance assure that the processing of such application is the management of growth with the aim to achieve high- quality development. Enhancement of Meridian's quality of life for all residents is achieved by applying the criteria of the Comprehensive plan and the Zoning ordinances of the City to all applications such as the subject application. 19.2 This proposed new growth development will finance public service expansion by the requirement herein that the applicant comply with the requests submitted of the political subdivisions responses within the Meridian Urban Service Planning Area submitted in the record of this matter. 19.3 The application is consistent with Meridian's self identity. 19.4 The preservation and improvement of the character and quality of Meridian's man-made environment while maintaining its identity as a self-sufficient community is achieved by applying the criteria of the Comprehensive plan and the Zoning ordinances of the City to the subject application. 19.5 Compliance with the requests of the political subdivisions providing services, assures that community services are being provided for existing and projected needs and that the land use patterns of the City are balanced to insure that revenues pay for services and that the Urban Service Planning Area is visually attractive, efficiently managed and clearly identifiable. FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 6 AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY ROBERT GLENN (AZ -00-001) 19.6 Compatible and efficient use of land through innovative and functional site design is achieved by applying the criteria of the Comprehensive plan and the Zoning ordinances of the City to the subject application. 20. The property can be physically serviced with City water and sewer, if applicant extends the lines. CONCLUSIONS OF LAW 1. The City of Meridian has authority to annex real property upon written request for annexation and the real property being contiguous or adjacent to city boundaries and that said property lies within the area of city impact as provided by Idaho Code Section 50-222. The Meridian City Code § 11-16 provides the City may annex real property that is within the Meridian Urban Service Planning Area as set forth in the City's Comprehensive Plan. 2. The Council may take judicial notice of government ordinances, and policies, and of actual conditions existing within the City and State. 3. The City of Meridian has exercised its authority and responsibility as provided by "Local Land Use Planning Act of 1975', codified at Chapter 65, Title 67, Idaho Code by the adoption of `Comprehensive Plan City of Meridian adopted December 21, 1993, Ord. No. 629, January 4, 1994. 4. The following are found to be pertinent provisions of the City of Meridian Comprehensive Plan and are applicable to this Application: 4.A The Goals of the Comprehensive Plan are set forth at Page 5 and include: FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 7 AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY ROBERT GLENN (AZ -00-001) 4.1 To preserve Meridian's environmental quality and to make provisions for and improve the total natural environment by adopting City-wide and Urban Service Planning Area policies, which deal with area -specific policies and programs. 4.2 To ensure that growth and development occur in an orderly fashion in accordance with adopted policies and procedures governing the use of land, residential development the provision of services and the distribution of new housing units within the Urban Service Planning Area. 4.3 To encourage the kind of economic growth and development which supplies employment and economic self-sufficiency for existing and future residents, reduces the present reliance on Boise and strengthens the City's ability to finance and implement public improvements, services and its open space character. 4.4 To provide housing opportunities for all economic groups within the community. 4.5 To preserve and improve the character and quality of Meridian's man-made environment while maintaining its identity as a self-sufficient community. 4.6 To encourage cultural educational and recreational facilities which will fill the needs and preferences of the citizens of Meridian and to insure that these facilities are available to all residents of the City. 4.7 To provide community services to fit existing and projected needs. 4.8 To establish compatible and efficient use of land through the use of innovative and functional site design. 4.9 To encourage a balance of land use patterns to insure that revenues pay for services. FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 8 AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY ROBERT GLENN (AZ -00-001) n 4.10 To create an Urban Service Planning Area which is visually attractive, efficiently managed and clearly identifiable. 4.B Comprehensive Plan Policies: Goals Section Goal 4: To provide housing opportunities for all economic groups within the community. Goal 8: To establish compatible and efficient use of land through the use of innovative and functional site design. Goal 9: To encourage a balance of land use patterns to ensure that revenues pay for services. Goal 10: To create an Urban Service Planning Area which is visually attractive, efficiently managed and clearly identifiable. Economic Development Chapter 3. 1 — Approve quality housing projects that meet the needs of all economic levels. 3.2U — Encourage efforts to develop and maintain quality neighborhoods and housing... Land Use Chapter Goal: All land use development in the Meridian area will be considered an asset to the community and not detract from our quality of life. I AU — Encourage new development which reinforces the City's present development pattern of higher -density development within the Old Town area and lower -density development in outlying areas. 1.8U — Promote the development of high-quality and environmentally compatible residential areas that contain the necessary parks, schools and commercial facilities to maintain and form identifiable neighborhoods. 2.1 U — Support a variety of residential categories for the purpose of providing the FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 9 AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY ROBERT GLENN (AZ -00-001) City with a range of affordable housing opportunities. 2.3U — Protect and maintain residential neighborhood property values, improve each neighborhood's physical condition and enhance its quality of life for residents. 2AU — Encourage sidewalks and paved streets for all existing neighborhoods... 2.5U — Encourage compatible infill development which will improve existing neighborhoods. Transportation Chapter Local Streets: Serve primarily to provide direct access to abutting residential units and should be for local traffic movement. They are generally two lanes with parking with a right-of-way width of about 50 feet. Service to through -traffic is discouraged. The remaining transportation corridors of the Meridian Urban Service Planning Area are recommended for local street status. 1.2U - Achieve a local transportation system connected to all modes of the regional transportation system. 1 AU - Monitor and coordinate the compatibility of the land use and transportation system. 19U - Encourage proper design of residential neighborhoods to ensure their safety and tranquility. Housing Chapter 1.6 - Housing proposals shall be phased with transportation, open space and public service and facility plans, which will maximize benefits to the residents, minimize conflicts and provide a tie-in between new residential areas and service needs. 1.9 - The efficient use of land for public facilities, transportation systems, utilities, and the economic arrangement of buildings should be promoted. Community Design Chapter 6.1 U — All Meridian neighborhoods will be served with sidewalks, curb and gutters, and functional streets. FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 10 AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY ROBERT GLENN (AZ -00-001) n 6.2U — Pedestrian access connectors will be required in all new development to link subdivisions together to promote neighborhood identity. 6.11 U — Promote well-planned and well-designed affordable housing in all Meridian neighborhoods. 5. The requested zoning of Low Density Residential District, (R-4) is defined in the Zoning Ordinance at 11-7-2 C as follows: (R-4) Low Density Residential District: Only single-family dwellings shall be permitted and no conditional uses shall be permitted except for planned residential development and public schools. The purpose of the R-4 District is to permit the establishment of low density single-family dwellings, and to delineate those areas where predominantly residential development has, or is likely to occur in accord with the Comprehensive Plan of the City, and to protect the integrity of residential areas by prohibiting the intrusion of incompatible nonresidential uses. The R-4 District allows for a maximum of four (4) dwelling units per acre and requires connection to the Municipal water and sewer systems of the City. 6. By authority of the City of Meridian under the Comprehensive Plan, a conditional use permit is not required for Applicant to construct and develop single- family dwelling units on this parcel of land. 7. Since the annexation and zoning of land is a legislative function, the City has authority to place conditions upon the annexation of land. See Burt vs. The City of Idaho Falls, 105 Idaho 65, 665 P2d 1075 (1983). 8. The development of the annexed land, if annexed, shall meet and comply with the Ordinances of the City of Meridian including, but not limited to: Section 12-2-4 which pertains to development time schedules and requirements; Section 12-4-13, which pertains to the piping of ditches; and Section 12-5-2 N, FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 11 AND DECISION AND ORDER GRANTING APPLICATION FOR ANNEXATION AND ZONING/BY ROBERT GLENN (AZ -00-001) which pertains to pressurized irrigation systems. 9. The development of the property shall be subject to and controlled by the Zoning and Subdivision and Development Ordinance of the City of Meridian. 10. Section 11-16-4 A of the Zoning and Development Ordinance provides in part as follows: If property is annexed and zoned, the City may require or permit, as a condition of the zoning, that an owner or developer make a written commitment concerning the use or development of the subject property. If a commitment is required or permitted, it shall be recorded in the office of the Ada County Recorder and shall take effect upon the adoption of the ordinance annexing and zoning the property, or prior if agreed to by the owner of the parcel. Unless the commitment is modified or terminated by the City Council, the commitment shall be binding on the owner of the parcel, each subsequent owner, and each other person acquiring an interest in the property. A commitment is binding on the owner of the property even if it is unrecorded; however, an unrecorded commitment is binding on subsequent owners and each other person acquiring an interest in the property only if the subsequent owner and each other person acquiring an interest in the property has actual notice of the commitment. We have reviewed basically whether the services are available to this property or a development of the property. We stopped by the highway district and shown them a preliminary layout and it basically has ability to provide access onto the property. The services in terms of sewer and water are available in this particular area. I believe a request for a R-4 zone in this property for a single family subdivision is consistent with the Comprehensive Plan and a suitable plan can be developed for the subdivision of this property and also provide the frontage and access to the existing house in the middle of the property. That is all I have to say at this time. Borup: Just a reminder and others this is for zoning and annexation and they have submitted a concept layout at this point. Barbeiro: What are the existing buildings there now. There is a home. Is there a barn and a couple out buildings. Pavelek: I believe that is all that is on the property. Basically, the setback requirements of the existing buildings that are to be retained on the site will meet Meridian's setback requirements. Borup: Anything to remain other then the house. It is 80 feet at Ustick and it widens—it is about 90 feet wide. It is 600 feet deep, off of Ustick. I believe it is roughly 600 feet of ditch that runs in the back of the property by 10 feet wide. My question is at what point, I got zoning R-3 on the property next door there. The neighbors asked to see my preliminary plat and we talked about some contiguous stub roads. I am wondering if they have made those same sort of considerations now that they are platting their property. Borup: Again, this is a preliminary concept map but it does not show a stub road. That was something that you desire. Campbell: Yeah because I currently have a stub road that I designed onto his property Borup: It would be nice if they connected maybe. Campbell: Right. Mr. Parish's property only being 80 feet wide, I've seen one of those in Boise that ended up still having one house on it and a bunch donkeys and subdivisions coming in on either side and it just makes it impossible for you to do something. It appears to me that the road lines up and maybe your road should go along your easterly boundary but that is something we will look at in the future. When you come back, that is the question I will have about the plat. I am just making information so that there would no be a problem when you come back for your plat. I see you concept here and it concerns me that Mr. Parish's property is 80 feet and yet your not extending the road that was on the south side of Ustick going north. If it was extended similar to what was to the south, it would be able to provide frontage for his property to redevelop and then— Borup: What can he do with 80 feet. He can't put a road down there. Brown: You do a half plus 12 down his easterly boundary. At least it would be better than Mr. Parish ending up with 600 by 80 and those things do happen. Somehow there needs to be some thought taken. There is sidewalk on the south side of Ustick Road. B. On December 13, 1999, the District Planning and Development staff inspected this site and evaluated the transportation system in the vicinity. On December 20, 1999, the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. The results of that analysis constitute the following Facts and Findings and recommended Site Specific Requirements. C. The applicant is not proposing a stub street to the west property line. Staff recommends that the applicant be required to provide a stub street to the west property line, at a location approximately 125 -feet south of the north property line. The applicant should coordinate the location of the stub street with District staff. D. Utility street cuts in new pavement less than five years old are not allowed unless approved in writing by the District. Contact Construction Services at 387-6280 (with file numbers) for details. E. Any proposed public street intersection on Ustick Road should be located a minimum of 125 - from all public streets (as measured from centerline to centerline) and 220 -feet from all existing driveways. North Yellow Peak Way is on the south side of Ustick Road in alignment with this site's east property line. There are several single family dwelling driveways on the north side of Ustick Road that are within 50 -feet from the site's east and west property line. Any proposed public street intersection will require a variance from the existing single family dwelling driveways on the north side of the road. The site has insufficient frontage to offset from existing MAZ00-001.cmm Page 2 driveways and public streets on Ustick Road to meet District policy. Coordinate the location of any proposed public street intersection on Ustick Road with District staff. F. The site has an existing driveway on Ustick Road (that serves a single family dwelling), located approximately 265 -feet east of the west property line. If public streets are proposed, the applicant should be required to close the driveway on Ustick Road and take access off the proposed public street. G. Unless otherwise approved, the applicant should be required to constrict all public roads within the proposed subdivision as 36 -foot street sections with curb, gutter, and 5 -foot wide concrete sidewalks within 50 -feet of right-of-way. H. The applicant should be required to construct a 5 -foot wide concrete sidewalk on Ustick Road abutting the entire parcel, located 2 -feet within the new right-of-way. Coordinate the location, elevation and grade of the sidewalk with District staff. I. Any proposed turnaround should be constructed to provide a minimum turning radius of 45 -feet. The District will consider alternatives to the standard turnaround on a case-by-case basis. This will be based on turning area, drainage, maintenance considerations and the written approval of the emergency fire service for the area where the development is locate. Submit a design of the turnarounds for review and approval by District staff. In accordance with District policy, a stub street to the undeveloped parcel abutting this site's north property line should be required upon review of a future application for this site. K. Based on development patterns in this area and the resulting traffic generation, staff anticipates that the transportation system will be adequate to accommodate additional traffic generated by this proposed development with the requirements outlined within this report. If the rezone is approved and the District receives a development proposal, the District intends to provide the following requirements, in addition to any additional requirements that may apply upon District review of future development, to the City of Meridian: Site Specific Requirements: Dedicate 48 -feet of right-of-way from the centerline of Ustick Road abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. Allow up to 30 business days to process the right-of-way dedication after receipt of all requested material. The owner will be compensated for all right-of-way dedicated as an addition to existing right- of-way from available impact fee revenues in this benefit zone, if the owner submits a letter of application to the impact fee administrator prior to breaking ground, in accordance with Section 15 of ACHD Ordinance # 193. Any proposed public street intersection on Ustick Road shall be located a minimum of 125 -feet from all other public streets (as measured from centerline to centerline) on Ustick Road. As required by District policy, restrictions on the width, number and locations of driveways, shall be placed on future development of this parcel. 9. Other than the access point specifically approved with this application, direct lot or parcel access to Ustick Road is prohibited. Standard Requirements: A request for modification, variance or waiver of any requirement or policy outlined herein shall be made in writing to the ACHD Planning and Development Supervisor. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship or inequity. The written request shall be submitted to the District no later than 9:00 a.m. on the day scheduled for ACHD Commission action. Those items shall be rescheduled for discussion with the Commission on the next available meeting agenda. Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action do not provide sufficient time for District staff to remove the item from the consent agenda and report to the Commission regarding the requested modification, variance or waiver. Those items will be acted on by the Commission unless removed from the agenda by the Commission. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within six days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall specifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of its original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the MAZ00-OO l .cmm Page 4 Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #193, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Constriction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway. District prior to District approval for occupancy. 7. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. Existing utilities damaged by the applicant shall be repaired by the applicant at no cost to ACRD. The applicant shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in the event any ACHD conduits (spare or filled) are compromised during any phase of constriction. 8. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. 9. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council. The property included in this application is located in an area designated as Single-family Residential in the Meridian Comprehensive Plan. Property to the north and east is zoned R -T in Ada County. The property to the west is zoned R-3 and received preliminary plat approval (time has lapsed) for a development called The Hollows. Howell Tract Subdivision (Pheasant Pointe), an R-8 subdivision in Meridian, is located south of the property across Ustick Road. Although a conceptual subdivision layout was submitted with the annexation application, no detailed comments relating to subdivision platting are being included in this memorandum. The appropriateness of annexation and zoning with the requested zoning district is the only subject of consideration at this public hearing. A plat application has not been submitted. GENERAL REQUIREMENTS: 1. Any existing irrigation/drainage ditches crossing or adjacent to this property shall be tiled per City Ordinance 12-4-13. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 2. Any existing domestic wells and/or septic systems within this parcel will have to be removed from their domestic service per City Ordinance. Wells may be used for non-domestic purposes such as landscape irrigation. 3. A development agreement is not required for this project. Issues related to stub streets, perimeter fencing, planting strips, etc., will be included as conditions of approval for any future subdivision. However, the applicant needs to gather detailed design information prior to submittal of the preliminary plat. COMPREHENSIVE PLAN POLICIES The subject property is located in an area designated as Single-family Residential. The 1993 Comprehensive Plan contains a variety of goals and policies that are relevant to this application. Staff has selected the following sections that most directly apply to the proposed project. Goals Section Goal 4: To provide housing opportunities for all economic groups within the community. Goal 8: To establish compatible and efficient use of land through the use of innovative and functional site design. Goal 9: To encourage a balance of land use patterns to ensure that revenues pay for services. Goal 10: To create an Urban Service Planning Area which is visually attractive, efficiently managed and clearly identifiable. Economic Development Chapter 3. lU — Approve quality housing projects that meet the needs of all economic levels. 3.2U — Encourage efforts to develop and maintain quality neighborhoods and housing... Land Use Chapter Goal: All land use development in the Meridian area will be considered an asset to the community and not detract from our quality of life. I AU — Encourage new development which reinforces the City's present development pattern of higher -density development within the Old Town area and lower -density development in outlying areas. 1.8U — Promote the development of high-quality and environmentally compatible residential areas that contain the necessary parks, schools and commercial facilities to maintain and form identifiable neighborhoods. 2.1 U — Support a variety of residential categories for the purpose of providing the City with a range of affordable housing opportunities. 2.3U — Protect and maintain residential neighborhood property values, improve each neighborhood's physical condition and enhance its quality of life for residents. 2AU — Encourage sidewalks and paved streets for all existing neighborhoods... 2.5U — Encourage compatible infill development which will improve existing neighborhoods. I AU - Monitor and coordinate the compatibility of the land use and transportation system. 1.19U - Encourage proper design of residential neighborhoods to ensure their safety and tranquility. Housing Chapter 1.6 - Housing proposals shall be phased with transportation, open space and public service and facility plans, which will maximize benefits to the residents, minimize conflicts and provide a tie-in between new residential areas and service needs. 1.9 - The efficient use of land for public facilities, transportation systems, utilities, and the economic arrangement of buildings should be promoted.
