Dear Shari:
This Final Plat and application for Gemtone Center No. 4 comply with the requirements, conditions, and
provisions of the approved preliminary plat and the ordinances of the City of Meridian—as discussed and
approved by the Meridian City Council. This Final Plat also conforms with Title 50, Chapter 13 of the Idaho
Code and was prepared in conformance with acceptable surveying practices and local standards. The
approved construction plans were designed in accordance with acceptable engineering practices and local
standards.
With respect to the other required Statements of Compliance, we offer the following:
1. The streets, curbs, gutters and sidewalks will be constructed to meet the standards of the Ada
County Highway District and City of Meridian Ordinances. These facilities will be
constructed in accordance with the approved plans.
2. The proposed use conforms to the policies and goals of the Meridian Comprehensive Plan.
3. Connections to City services will be provided and any development on these sites will
utilized these connections.
4. The development complies with City ordinances.
5. Appropriate easements are addressed on the plat.

Strata, Inc. has performed the authorized ground water depth evaluation in Phases I and
II of the referenced subdivision. Our work was performed in accordance with our Confirming
Proposal for the referenced project dated May 7, 1996. Per our confirming proposal, we have
observed one test pit at each of the three proposed storm water seepage bed locations for Phases
I and II of the referenced subdivision. The approximate location of each the three test pits is
presented on the attached site plan. We have also reviewed our in-house files and other available
ground water information for the project vicinity.
We understand that each of the three test pits was loosely backfilled even with the
existing, adjacent ground surface. We recommend that all three test pits be re -excavated and be
refilled with structural fill compacted to a minimum of 95% of ASTM Test D-698 (Standard
Proctor), since the loose backfill will settle with time. The re -excavation and recompaction of
structural fill need only be accomplished in those portions of the test pits that will not be
incorporated into the proposed seepage pits, or which are also located beneath future building,
sidewalk, or pavement areas.
Based on our review of the plans for the referenced project and the Ada County Highway
District (ACHD) Development Policy Manual, a minimum 3 -foot vertical separation must be
maintained between the bottom of the stormwater disposal facility and the seasonal high ground
water elevation at that location. Per ACHD regulations, a 3 -foot -thick sand filtration layer must
also be constructed immediately beneath the bottom of the proposed stormwater disposal seepage
trenches. The bottom of the stormwater disposal facility and top of the sand filtration layer will
be at the same elevation.
During our subsurface evaluation, ground water was observed in all three test pits. The
depth to ground water observed at each test pit location is presented on the attached site plan.
The depth to ground water ranged between 6.5 and 8.5 feet below the existing ground surface
during our subsurface evaluation.

Based on our review of available information and in-house files for projects in the vicinity
of the proposed project, it is our opinion that the seasonal ground water table could rise to within
about 6 feet of the existing ground surface at the site of the proposed project. Therefore,
stormwater disposal seepage pits should be designed accordingly. Furthermore, we recommend
that all of the proposed stormwater disposal seepage pits be excavated into the native, clean sand
or gravel that was observed at each of the three test pit locations at a depth that ranged from 4.5
to 8.5 feet below the existing ground surface. For your convenience, we have also indicated the
depth to the top of the clean sand or gravel at each test pit location on the attached site plan.
This report has been prepared to evaluate the subsurface ground water conditions for the
proposed Gemtone Center No. 2 subdivision on North Eagle Road in Meridian, Idaho. Our
services consist of professional opinions and recommendations made in accordance with generally
accepted geotechnical engineering principles and practices. This acknowledgement is in lieu of

Stiles: Mr. Mayor and Council, this is for another phase of Gemtone Subdivision.
This would be where Blue Cross is located. The City has a well -type here. I
don't know if you're seeing that or not. This plat was previously submitted and
approved by the Council in May of 1999 which would mean they have to submit
their final plat — it has to be recorded by that date of 2000. The original Gemtone
Center No. 4 included the entire Pine Street right-of-way and this one has
excluded it. The only things I can see that have changed is they had the same
number of lots although they have included a little sliver of a lot along the west
boundary and along the southern boundary, and the note says that is for
landscape and drainage. I would like to have the applicant's representative
present to explain their reason for not including Pine Avenue and if they propose
this plat as revised, I would recommend it be denied due to the fact that they are
not dedicating that additional right-of-way for Pine. Took it off.
Bird: When we passed that in May, that was dedicated (inaudible)
Stiles: Yes, it was. There was no explanation of why that was taken off. I know
Dennis Baker is getting anxious to come in with a plan for all the property he's
purchased in that area, but it's almost appearing to be kind of a spite strip that's
been intentionally left off of the plat.
Bird: Mr. Mayor. This — if we allow something like this, we are going to have the
same problem you have when you go right across the street that we're having
with Pine Street right over there which we, as a City, got taken to the cleaners on
that baby. I guess the best thing to do would be to table this until next week and
get their representative in here and find out — I recall when we passed this in
May, that Pine Avenue was going through. There was no ifs ands and buts
about it. If it's proper, I'll make a motion that we table this until February 15,
2000.

We have reviewed this submittal and offer the following comments, as conditions of the final

SITE SPECIFIC COMMENTS
1. This final plat generally conforms to the approved preliminary plat.
2. Sanitary sewer service to this site will be via the existing main that traverses through the
development.
3. Water service to this site will be via an existing main that traverses through the
development.
4. All street signs, street lights, pressurized irrigation system, domestic water system
(activated fire hydrants), are to be installed prior to obtaining building permits.
5. The developer shall be required to develop an O&M manual for the pressurized irrigation
system within this development. A substantially complete copy shall be required prior to
development plan approval, and the final complete copy, including as -built drawings
shall be required prior to the City's final subdivision approval.
6. Please annotate and dimension the "10 foot wide easement to Mountain States Telephone
and Telegraph Co. (Instrument No. 9034208)"
7. Please identify the reference point shown northwest of the subdivision boundary.
8. The Land Surveyor preparing this plat shall affix his stamp, signature and date to the face
of the plat.
9. Please submit a copy of the plat second page for review by the Public Works Department,
as the submittal packet staff received did not contain one.
10. Please annotate and dimension the dashed "vision triangle" shown across the southerly
side of lots 5 & 6.
11. Complete the recording information in the reference to the temporary turn around at the
end of E. State Avenue.
12. Remove the "or as allowed by conditional use permit" text from plat note number 4.
13. Change the date of platting to the year 2000.

EASEMENT AGREEMENT
This Easement Agreement is made and entered into this _ day of , 19_, by the undersigned
CITY OF MERIDIAN, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, hereafter referred to as "Grantor"
for the benefit of CROSSROADS BUSINESS CENTER, LLC that maintains a mailing address of P. O. Box 2727, Boise,
Idaho 83701, and its successors and assigns (the "Developer') and for the benefit of the Grantee and present and future
owners of all or any portion of the Gemtone Subdivisions No. 2, No. 3 and No. 4 (hereafter described and
shown on Exhibits A & B) for the following reason:
A. The "Developer" of Gemtone #4 Subdivision is required by the City to construct a pump station for
the pressurized irrigation system serving Gemtone #2, #3, and #4 Subdivisions.
Now, therefore, in consideration of the foregoing premises and for One Dollar and othergood and
valuable consideration, the sufficiency of which is hereby acknowledged by the Grantor, the Grantor, for his heirs,
successors and assigns, hereby grants the easement hereinafter described and agrees as follows:
Grant of Easements:
The Grantor hereby grants to the Developer and its successors and assigns the permanent Irrigation
Easement, more particularly described below:
The permanent Irrigation Easement. The Irrigation Easement hereby granted consists of the permanent
and perpetual right to excavate, grade and backfill for the installation, repair, maintenance, alteration,
support, lowering or raising of, and to install, repair, maintain, alter, support, lower or raise, and utilize the
pump station and pipe in, into, upon, over, across, and under a parcel of land as shown on Exhibit B
attached hereto and incorporated by this reference; additionally, Grantor grants to the Developer the right
of permanent access, ingress and egress, to and from the pump station and pipes, to perform the acts
stated in this Easement Agreement. In furtherance of the foregoing, the Irrigation Easement includes, but
is not limited to, as well the following —
(i) the right to grade the land described above and to extend cuts and fills for such grading into, on and
along such land as the Developer shall deem necessary and the right to use the easement for construction
purposes, as set forth in this Easement Agreement during the construction and placement of the pump
station and pipe;
(i) upon completion of construction of the pump station and pipe across the Grantor's Parcel, the
Developer, and his assignees, have the right to access the Grantor's Parcel for the purposes of inspection,
repair, and maintenance of the pump station and pipe as required; any access other than through the
easement will be by permission only.
HOWEVER, Grantor shall not unreasonably withhold permission; if an emergency exists and it is
necessary to proceed through Grantor's property to gain access to the easement and grantors permission
has been attempted to be obtained, but permission has not been obtained, the Developer shall have the
right to access the easement through Grantor's parcel.
(ii) the right from time to time to trim and to cut down and clear away any and all trees and brush now or
hereafter on said land or that may be a hazard to the pump station or pipe or interfere with the exercise of
the Developer's rights hereunder;

2. Grantor's Title and Authority
The Grantor hereby covenants, represents and warrants to the Developer that such Grantor has fee He
to Grantor's Parcel, described in Exhibit "A" and full power and authority to grant the Irrigation Easement.
General Terms and Interpretation
a. Benefits and Burdens to Run with the Land. The benefits and burdens of this agreement shall run with the
land. The Developer is authorized to record this Agreement in the records of Ada County, Idaho.
b. Entire Agreement: Modifications. This Agreement represents the entire agreement between the Grantor
and the Developer covering the subject -matter hereof, replacing and superseding all prior and other
contemporaneous discussions, representations, understandings and agreements. This Agreement shall
not be modified except by a written instrument executed by the party or parties to be bound.
C. Other Uses within the Easements. The Grantor reserves the right to use the land within the easement for
any use that does not interfere with the full enjoyment of the easement hereby granted; provided, however,
the Grantor covenants, for himself, his successors and assigns, not to build, erect or construct any
structure, improvement or other obstruction within the bounds of the easement.
d. Gender and Number. Unless the context specifically requires otherwise, the singular includes the plural,
and vice versa, and each gender includes every other gender. In particular, but not by way of limitation,
the term "Grantor" includes jointly and severally each and every person or legal entity who executes this
Agreement in that capacity.
e. Grantee Promise. After construction of the pump house and pipe are complete, the Grantee will repair the
surface of the ground outside the pump house to an equal or better condition than existed prior to any
construction activity.
f. Binding. This agreement shall not be binding upon the parties until all of the parties have signed and the
Meridian City Council has authorized, or ratified, the signatures of the Mayor and City Clerk.
In witness whereof, the Grantor has caused this Easement Agreement to be duly executed and delivered on the
date first above written.

easement being more particularly described as follows:

Gemtone, Inc., an Idaho corporation, with its principal place of business at P. O.
Box 2727, Boise, Idaho 83701, as Grantor, hereby BARGAINS, SELLS AND CONVEYS to
The City of Meridian, a municipal corporation, for which its address is 33 East Idaho Avenue,
Meridian, Idaho 83642, as Grantee, for good and valuable consideration, the following described
tract of land and improvements thereon in the County of Ada, State of Idaho subject to
covenants, conditions and restrictions of record and the "Declaration of Covenants and
Restrictions and Grant of Easements" executed by Grantor and Grantee of even date herewith:
A parcel located in the NE '/ of Section 8, Township 3 North,
Range 1 East, Boise Meridian, City of Meridian, Ada County,
Idaho, more particularly described as follows:
Beginning at an aluminum cap monument marking the southeast
corner of Lot 2 of Block 3 of TREASURE VALLEY BUSINESS
CENTER -PHASE 1 as shown on the plat on file in the office of
the Recorder, Ada County, Idaho, in. Book 53 of Plats at
Pages 4790-4791, from which a 5/8 inch diameter iron pin
marking the centerline of North Hickory Avenue and the southerly
boundary of said TREASURE VALLEY BUSINESS CENTER -
PHASE 1 bears N 89 °35' 15" W a distance of 563.82 feet;
thence S 0°24'45" W a distance of 160.00 feet to a 5/8 inch
diameter iron pin;

EASEMENT AGREEMENT
This Easement Agreement is made and entered into this -__- day of 19_, by the undersigned
CITY OF MERIDIAN A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, hereafter referred to as "Grantor"
for the benefit of CROSSROADS BUSINESS CENTER, LLC that maintains a mailing address of P. O. Box 2727, Boise,
Idaho 63701, and its successors and assigns (the "Developef) and for the benefit of the Grantee and present and future
owners of all or any portion of the Gemtone Subdivisions No. 2 No. 3 and No. 4 (hereafter described and
shown on Exhibits A 8 B) for the following reason:
A. The 'Developer" of Gemtone #4 Subdivision is required by the City to construct a pump station for
the pressurized irrigation system serving Gemtone #2, #3, and #4 Subdivisions.
Now, therefore, in consideration of the foregoing premises and for One Dollar —and othergoodand
valuable consideration, the sufficiency of which is hereby acknowledged by the Grantor, the Grantor, for his heirs,
successors and assigns, hereby grants the easement hereinafter described and agrees as follows:
1. Grant of Easements:
The Grantor hereby grants to the Developer and its successors and assigns the permanent Irrigation
Easement, more particularly described below:
The permanent Irrigation Easement. The Irrigation Easement hereby granted consists of the permanent
and perpetual right to excavate, grade and backfill for the installation, repair, maintenance, alteration,
support, lowering or raising of, and to install, repair, maintain. atter, support, lower or raise, and utilize the
pump station and pipe In, into, upon, over, across, and under a parcel of land as shown on Exhibit B
attached hereto and incorporated by this reference; additionally, Grantor grants to the Developer the right
of permanent access, ingress and egress, to and from the pump station and pipes, to perform the acts
stated in this Easement Agreement. In furtherance of the foregoing, the Irrigation Easement includes, but
is not limited to, as well the following —
n the right to grade the land described above and to extend cuts and fills for such grading into, on and
along such land as the Developer shall deem necessary and the right to use the easement for construction
purposes, as set forth in this Easement Agreement during the construction and placement of the pump
station and pipe;
Ca) upon completion of construction of the pump station and pipe across the Grantor's Parcel, the
Developer, and his assignees, have the right to access the Grantor's Parcel for the purposes of inspection,
repair, and maintenance of the pump station and pipe as required; any access other than through the
easement will be by permission only.
HOWEVER, Grantor shall not unreasonably withhold permission; If an emergency exists and it is
necessary to proceed through Grantor's property to gain access to the easement and grantor's permission
has been attempted to be obtained, but permission has not been obtained, the Developer shall have the
right to access the easement through Grantor's parcel.
(ii) the right from time to time to trim and to cut down and clear away any and all trees and brush now or
hereafter on said land or that may be a hazard to the pump station or pipe or interfere with the exercise of
the Developer's rights hereunder;
