Project Narrative For The Site Plan Review and Conditional Use Permit Fred Meyer Gasoline Facility 1850 East Fairview Road Meridian, Idaho Fred Meyer Store No. 198 Our Job No. 7551 PROPOSED USE/PROJECT DESCRIPTION General: Fred Meyer, Inc., (Fred Meyer) proposes the construction of a retail gasoline facility at its retail store in Meridian, Idaho. The site is located in a GC (General Commercial) zone. The facility is proposed as an accessory use to the store and will provide customers the added benefit of being able to purchase gasoline conveniently and at a fair price. The facility will include a canopy over five multi-product dispensers (10 vehicle fueling positions) and a cashier's kiosk. The canopy will measure 43 feet by 84 feet (3,612 square feet), and will include Fred Meyer's signature colors and sign program. The dispensers will provide three grades of gasoline and diesel fuel with pay-at-the-pump convenience. The kiosk will be staffed by a gasoline facility attendant who will accept cash payments. The project also includes restriping parking stalls and rebuilding landscapes planted in the main parking field adjacent to the fueling facility. Hours/Staffing: The Fred Meyer gasoline facility will be open 24 hours and will be staffed by full-time attendants during the main store's business hours of 7 a.m. to 11 p.m. The facility will be an unattended cardlock facility during the evening, accepting pay-at-the-pump transactions only. Safe :Fred Meyer gasoline facility employees are professionally trained in all aspects of emergency response and facility maintenance. Specifically, employees are trained to take charge of emergency situations such as an overfill alarm, fuel spill, fire, or hose breakaway. Employees are also trained to perform detailed inspections of the facility and notify a certified service contractor for any repairs. State-of--the-art technology is utilized for the safest possible operation of this facility. Specifically the Fred Meyer gasoline facility is equipped with closed circuit television cameras, highly visible emergency pump shutoff switches, a spill cleanup kit, and fire extinguishers. Dispensers and fill ports are equipped with overfill protection and vapor recovery systems. The alarm system is tied directly to the main store. Absorbent materials are readily available for handling cleanup of minor spills. Underground Storage Tanks: Fuel will be stored in one 15,000-gallon dual tank (7,000-gallon super unleaded and 8,000-gallon diesel), and one 15,000-gallon regular unleaded. Both underground tanks are double-walled fiberglass. The tanks will be continually monitored by a sensitive leak detection system that will provide positive shutdown in the event a leak is detected. The tanks will be registered with the state, as required for all new underground storage tank installations. Traffic: According to the Institute of Transportation Engineers (ITE), Land Use Code No. 844 "Gasoline/Service Station," the gasoline facility is forecasted to generate1,686 daily trips and 146 new p.m. peak trips. However, excluding pass-by trips and internally captured trips already on the road network, the net number of new p.m. trips generated by the facility (actual impact on the road network) may be as low as 56 new p.m. peak hour trips, according to Group Mackenzie, Fred Meyer's traffic consultants. 7551.002 [JAH/rb/raw] ~ n Grading: The construction of this facility will require the excavation/removal of approximately 2,000 cubic yards of soil for the underground storage tanks. Erosion ControUDrainage Plans: A temporary erosion and sedimentation control plan will be designed in accordance with City standards and with the State of Idaho Department of Environmental Quality Management Practices for mitigation of erosion and sedimentation impacts in the downstream drainage system. The facility ties directly into the existing storm drainage facility for the Fred Meyer store. One exception is the area under the canopy which will be collected separately. This stormwa*.er will first be conveyed into a catch basin with an oil/water separator. The amount of runoff from this area under the canopy will be negligible due to the protection from the canopy, the site finished grades which prevent stormwater sheetflow from surrounding paved areas, and the dry cleanup methods that will be used for cleanup of minor spills and oils. Construction Schedule: The facility's construction schedule is approximately eight weeks. Construction is scheduled to be completed Spring 2001. Fire Code Standards (including UFC 1997 Edition, Articles 52 and 79): Fire apparatus access is adequately provided with the proposed site layout, since the existing driveways are being retained and the key drive aisles on site are being retained. The project is consistent with the 1997 UFC Article 52 (Motor Vehicle Fuel Dispensing Stations and Article 79 (Flammable and Combustible Liquids). A brief summary of some of the key features of the Fred Meyer Gasoline facility are as follows: • Dispensers are a minimum of 10 feet from property lines and extended hoses are minimum 5 feet from building openings (UFC 5201.4.1.2). • Emergency shutdown devices are provided at the kiosk, which is more than 25 and less than 75 feet from the dispensers (UFC 5201.5.3). • An attendant is present during Fred Meyer retail store hours to supervise, observe, and control the dispensing of motor fuels and to respond immediately to spill or other emergency conditions (UFC 5201.6.2) . • Fred Meyer will provide daily site visits, regular equipment inspection and maintenance, and visibly posted safe operation instructions, and emergency instructions/telephone numbers to satisfy the requirements relating to unsupervised dispensing that will occur during non-store hours (UFC 5201.6.3). • Signs prohibiting smoking, requiring engines to be turned off, and prohibiting unapproved containers will be posted (UFC 5201.7 and .8). • Fire Extinguishers will be provided (UFC 5201.9). • The dispensers will be programmed to limit uninterrupted fuel delivery to 25 gallons during unsupervised hours of operation (UFC 5202.4.4). • All underground tanks and piping will be dual-wall for secondary containment (UFC 7901.8.4 and UFC 7902.6.11). Leak detection devices will be incorporated that will trigger system alarm and shutdown (UFC 7902.6.13). • All tanks and piping will be pressure tested prior to being covered or placed in use (UFC 7901.11.10 and UFC 7902.6.16). • Tank fills are equipped with spill containment. Tanks also incorporate overfill prevention systems that will alarm or shutoff flows when liquid reaches a 90 or 95 percent capacity, respectively (UFC 7902.6.5). 7551.002 [JAH/rb/raw] Existing Use of Subject Property: Currently, a 172,163 square foot Fred Meyer retail store is present on the existing site. The Fred Meyer gasoline facility is proposed to be constructed in the existing Fred Meyer retail store parking lot along Fairview Avenue. The parking lot consists of striped parking stalls and associated landscaping planters. Characteristics of Subiect Property that Make a Conditional Use Permit Desirable: The proposed Fred Meyer gasoline site is located at the eastern portion of the parking lot of the Fred Meyer retail store, near Fairview Avenue. The project is compatible with the neighborhood land uses, which are governed by a mix of regulations including a commercial planned development process, General Retail and Service Commercial guidelines and the City of Meridian Zoning Code. The immediate neighborhood is largely designated for retail, commercial and office use. The gasoline facility is also compatible with the abutting streets, which are Fairview Avenue and Locust Grove Road. No changes are proposed to either street channelization or landscaping that would alter the streetscape. The Fred Meyer gasoline facility will offer an opportunity for Fred Meyer customers to buy gasoline conveniently and at a fair, competitive price in a one-stop shopping center. It will increase the selection of alternatives to the other gasoline facilities in the area. The project will be aesthetically pleasing, having graphics and colors on the canopy and a new sign that ties into the existing Fred Meyer graphics. It will result in positive changes to the landscape area of this site by replacing areas disturbed by construction with new groundcover and trees. The addition of retail gasoline sales to the Fred Meyer store follows the trend of the gasoline industry: adding new gasoline facilities to large retail stores. This is a very busy entrance to the shopping center and we are concerned over the increased traffic and conflicting turning movements that will be generated by this development. This portion of the parking lot is used by customers artd the resulting reduction of parking spaces would not be oC benefit to them. Gas is already convenient at the east and of the shopping center. I question the; need for another out parcel in this shopping center as the original plan did not show this area of parking lot as a developable pad. This use is simply too intensive. Canopy, Five ' Dispensers and Cashier's Kiosk in C-G Zone by Fred Meyer Inc. (File CUP-00- 041). We have reviewed this submittal and offer the following comments, as conditions of the applicant. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY Fred Meyer Inc. is proposing to add a fuel service facility at the southern end of their existing parking lot at the 1850 E. Fairview Avenue store. The fuel facility consists of a 3,612 sq. ft. canopy over five (5) multi-product fuel dispensers, a cashier's kiosk and the construction of new internal landscape islands. Fred Meyer is proposing the facility be a 24-hour operation (unattended from 11:OOpm to 7:OOam, with a cardlock system). The proposed structure is required to obtain a Conditional Use Permit per Comprehensive Plan Policy 5.16U (pg. 28), Land Use Chapter, which requires all uses within the Mixed/Planned Use Development area to be processed under the CUP procedure. Automobile service stations are a permitted use in the C-G zone. The fuel facility would result in a net loss of 24 parking spaces in Fred Meyer's parking lot. There would also be a change in the traffic circulation pattern for five (5) parking rows from angled to 90° parking. For this application, Fred Meyer is represented by Barghausen Consulting Engineers of Kent, Washington. LOCATION & SURROUNDING USES The subject property is located at 1850 E. Fairview Avenue. It is generally located at the NE corner of Locust Grove and Fairview Avenue. The lot is currently zoned General Commercial (C-G). The surrounding uses follow: North -Fred Meyer main store located north of fuel facility on same lot; Avest Mini-Storage is located immediately north of store. Both uses zoned C-G. South - D&B Supply and Econo Lube Subdivision (Shuck's Automotive and Econo Lube) located on south side of Fairview Avenue directly across from proposed facility, zoned C-G. East -Lot 5 of Avest Plaza Subdivision, containing amulti-tenant building with several retail stores. A Chevron gasoline station is immediately east, zoned C-G. West -Lot 3 and 4 of Avest Plaza Subdivision, containing McDonald's and Key Bank. Walgreen's is currently being constructed at the NWC of Locust Grove and Fairview. CUP-00-041 Fred Meyer Gas Facility.CUP Mayor, Council and P&Z August 1, 2000 Page 2 ~"\ APPLICATION BACKGROUND In 1995, the City of Meridian approved a C.U.P. for Fred Meyer (Avest Plaza). Avest Limited Partnership, the property owner which annexed and platted the Avest Subdivision, entered into a Development Agreement with the City the same year. As part of the subject application review, Staff reviewed the Development Agreement terms and the approved CUP conditions and found no special conditions restricting a gasoline facility or any future accessory uses within the boundaries of Avest commercial subdivision. GENERAL REQUIREMENTS Off-street parking shall be provided in accordance with Section 11-13 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific requirements. 2. Paving and striping shall be in accordance with the standards set forth in Sections 11-13-4.D. and 11-13-4.E. of the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 3. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. All site drainage shall be contained and disposed of on-site. 4. Outside lighting shall be designed and placed so as to not direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-13-4.C. Provide a minimum of one (1) three-inch (3") caliper tree per 1,500 sq. ft. of asphalt area on the site in accordance with City Ordinance Section 11-13-4.B.3.c. 6. All trash and/or garbage collection areas shall be enclosed on at least three (3) sides in accordance with City Ordinance Section 11-12-1.C. Coordinate trash enclosure locations and construction requirements with Sanitary Service Company (SSC) and provide a letter of approval from SSC to the Planning & Zoning Department prior to applying for building permits. 7. All signage shall be in accordance with the standards set forth in Section 11-14 of the City Zoning and Development Ordinance. 8. All construction shall conform to the requirements of the Americans with Disabilities Act. Per Item D. on Sheet C 1, they are proposing a new price sign be added to the existing Fred Meyer LD. sign on Fairview. Separate sign permits would be required for this modification. The existing sign height shall not be allowed to increase. B) Canopy: Item C. on Sheet A-3 calls out an "illuminated marquee board with changeable copy", but there is no corresponding "C" on this sheet. Applicant should clarify location and sign type of this item during the public hearing process. Staff assumes this item is the same as "A" on Sheet C 1 on the north canopy elevation, which calls it out as an "electronic reader board". Under Ordinance 11-14-3, which prohibits any flashing lights on signs, the City has not allowed electronic reader boards. Any electronic reader board would need to be specifically approved by City Council. Since the reader board faces the interior of the project and would not be visible from public right-of--way, Staff could support this sign. They are also proposing "Fred Meyer" LD. canopy signs on the North and South elevations. No canopy signs are proposed for the east or west elevations. C) General Terms: All Signage is subject to design review and shall require separate permits. No Signage is permitted in the ACRD right-of--way. No portable signs or temporary signage permitted (such as A-Frames, banners, etc.). 2. Parking: The applicant's cover letter states the proposed facility will require the removal of 48 parking stalls but will restripe five (5) parking rows in the lot, adding back a total of 24 of the 48 removed stalls, for a net loss of 24 stalls. The application states the new parking lot will provide a total of 860 parking spaces. City Ordinance requires 1 parking space per 200 sq. ft. of gross retail floor area. At 172,163 sq. ft., the store would require a minimum of 861 stalls, resulting in one (1) stall short of the minimum. Dimensions of all parking stalls and drive aisles on proposed Site Plan conform to minimum dimensions of the code. Prior to the 8-8-00 P&Z hearin>? the Applicant must confirm in writing to Staff that all 860 stalls are located on Lot 1, Block 1 of Avest Subdivision (Fred Meyer) This is unclear This count cannot incorporate stalls on other lots (i.e. McDonald's Key Bank retail pads All off-street parking serving Fred Meyer must be located on their legal lot. The Applicant is proposing a re-design of six (6) existing angled parking rows between the McDonald's drive entrance and the eastern parking lot entrance. While Staff recognizes that the re-design of this section of the parking lot from angled parking to straight, head-in parking may be inconsistent with adjacent, angled parking areas, we do not view it as a public safety hazard or circulation problem. The minimum 25-foot drive aisle widths and 19- foot parking stall lengths are met and the rows of parking are in a contiguous block, separated from the adjacent angled parking blocks. 4. Landscaping: The Preliminary Landscape Plan, Sheet PL1, proposes to remove all seven (7) CUP-00-041 Fred Meyer Gas Facility.CUP ~ ~~ Mayor, Council and P&Z August 1, 2000 Page 4 of the landscape islands in the middle of the existing parking rows within the project scope of work. The re-design of these rows (from 45° to 90° parking) provides for new end islands (which will accommodate two new trees each) and increases the number of mid-row planters. This change will result in the addition of 21 trees in this area of the parking lot (7 existing and 28 proposed). All new trees shall be a minimum of three-inch (3") caliper, per City Ordinance 11-13-4.B.3.c, not the 1.5" caliper shown on Sheet PL1. Staff recommends the new tree species and variety of maple be the same as existing to maintain consistency of internal plantings and aesthetics. 5. Irrigation: An underground, pressurized irrigation system must be installed to all landscaped areas. 6. Lighting: The canopy lighting must be shrouded so as to shield the traffic on Fairview Avenue. 7. Drainage: A proposed site drainage plan must be approved by the City Public Works Department prior to construction. 8. Trash: No new outdoor trash areas are proposed on Sheet C 1. If the Applicant intends to have any new trash enclosures other than standard cans, they must be screened from view and not be visible by the public or from adjacent properties. 9. Hours: The P&Z Commission and City Council should address the proposed 24-hour operation. The Zoning & Development Ordinance does not address this issue. 10. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy for the fuel kiosk and facility. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the required improvements (including paving, striping, landscaping, and irrigation). A bid must accompany any request for Temporary Occupancy. Any Temporary Occupancy will not exceed 60 days to complete the required improvements. 11. As part of a conditional use permit, the City of Meridian may impose additional restrictions/conditions. 12. Sanitary sewer and water service to this site will be provided via existing lines adjacent to the site. 13. Assessments for sewer and water service are determined during the building permit application process. Applicant will be required to enter into an Assessment Agreement with CUP-00-041 Fred Meyer Gas Faciliry.CUP n i"~ Mayor, Council and P&Z August 1, 2000 Page 5 the City of Meridian. An assessment agreement is a vehicle that protects the City of Meridian and the Developer in the event that estimated assessments are not in line with actual usages. The agreement provides for reimbursement to the developer for overpayment of assessments and payment to the City of Meridian of any shortfall in assessments. The overpayment/shortfall is determined after adequate historical usage. 14. In accordance with City Ordinance 11-13-4.B.2., underground year-round pressurized irrigation must be provided to all landscape areas on site. Please submit hook-up and design details based on the proposed landscaping. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the landscaped areas. RECOMMENDATION Staff recommends approval with the above conditions. Canopy, Five Dispensers and Cashier's Kiosk in C-G Zone by Fred Meyer Inc . (File CUP-00- 041). We have reviewed this submittal and offer the following comments, as conditions of the applicant. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY Fred Meyer Inc. is proposing to add a fuel service facility at the southern end of their existing parking lot at the 1850 E. Fairview Avenue store. The fuel facility consists of a 3,612 sq. ft. canopy over five (5) multi-product fuel dispensers, a cashier's kiosk and the construction of new internal landscape islands. Fred Meyer is proposing the facility be a 24-hour operation (unattended from 11:OOpm to 7:OOam, with a cardlock system). The proposed structure is required to obtain a Conditional Use Permit per Comprehensive Plan Policy 5.16U (pg. 28), Land Use Chapter, which requires all uses within the Mixed/Planned Use Development area to be processed under the CUP procedure. Automobile service stations are a permitted use in the C-G zone. The fuel facility would result in a net loss of 24 parking spaces in Fred Meyer's parking lot. There would also be a change in the traffic circulation pattern for five (5) parking rows from angled to 90° parking. For this application, Fred Meyer is represented by Barghausen Consulting Engineers of Kent, Washington. LOCATION & SURROUNDING USES The subject property is located at 1850 E. Fairview Avenue. It is generally located at the NE corner of Locust Grove and Fairview Avenue. The lot is currently zoned General Commercial (C-G). The surrounding uses follow: North -Fred Meyer main store located north of fuel facility on same lot; Avest Mini-Storage is located immediately north of store. Both uses zoned C-G. South - D&B Supply and Econo Lube Subdivision (Shuck's Automotive and Econo Lube) located on south side of Fairview Avenue directly across from proposed facility, zoned C-G. East -Lot 5 of Avest Plaza Subdivision, containing amulti-tenant building with several retail stores. A Chevron gasoline station is immediately east, zoned C-G. West -Lot 3 and 4 of Avest Plaza Subdivision, containing McDonald's and Key Bank. Walgreen's is currently being constructed at the NWC of Locust Grove and Fairview. CUP-00-041 Fred Meyer Gas Facility.CUP Mayor, Council and P&Z August 1, 2000 Page 2 /'\ APPLICATION BACKGROUND In 1995, the City of Meridian approved a C.U.P. for Fred Meyer (Avest Plaza). Avest Limited Partnership, the property owner which annexed and platted the Avest Subdivision, entered into a Development Agreement with the City the same year. As part of the subject application review, Staff reviewed the Development Agreement terms and the approved CUP conditions and found no special conditions restricting a gasoline facility or any future accessory uses within the boundaries of Avest commercial subdivision. GENERAL REQUIREMENTS 1. Off-street parking shall be provided in accordance with Section 11-13 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific requirements. 2. Paving and striping shall be in accordance with the standards set forth in Sections 11-13-4.D. and 11-13-4.E. of the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 3. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. All site drainage shall be contained and disposed of on-site. 4. Outside lighting shall be designed and placed so as to not direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-13-4.C. 5. Provide a minimum of one (1) three-inch (3") caliper tree per 1,500 sq. ft. of asphalt area on the site in accordance with City Ordinance Section 11-13-4.B.3.c. 6. All trash and/or garbage collection areas shall be enclosed on at least three (3) sides in accordance with City Ordinance Section 11-12-1.C. Coordinate trash enclosure locations and construction requirements with Sanitary Service Company (SSC) and provide a letter of approval from SSC to the Planning & Zoning Department prior to applying for building permits. 7. All signage shall be in accordance with the standards set forth in Section 11-14 of the City Zoning and Development Ordinance. All construction shall conform to the requirements of the Americans with Disabilities Act. CUP-00-041 Fred Meyer Gas Facility.CUP n Mayor, Council and P&Z August 1, 2000 Page 3 SITE SPECIFIC REQUIREMENTS Signage: A) Free-Standing: No new free-standing signs have been proposed under subject application and none are approved. Per Item D. on Sheet C1, they are proposing a new price sign be added to the existing Fred Meyer I.D. sign on Fairview. Separate sign permits would be required for this modification. The existing sign height shall not be allowed to increase. B) Canopy: Item C. on Sheet A-3 calls out an "illuminated marquee board with changeable copy", but there is no corresponding "C" on this sheet. Applicant should clarify location and sign type of this item during the public hearing process. Staff assumes this item is the same as "A" on Sheet C 1 on the north canopy elevation, which calls it out as an "electronic reader board". Under Ordinance 11-14-3, which prohibits any flashing lights on signs, the City has not allowed electronic reader boards. Any electronic reader board would need to be specifically approved by City Council. Since the reader board faces the interior of the project and would not be visible from public right-of--way, Staff could support this sign. They are also proposing "Fred Meyer" I.D. canopy signs on the North and South elevations. No canopy signs are proposed for the east or west elevations. C) General Terms: All Signage is subject to design review and shall require separate permits. No signage is permitted in the ACHD right-of--way. No portable signs or temporary signage permitted (such as A-Frames, banners, etc.). 2. Parking: The applicant's cover letter states the proposed facility will require the removal of 48 parking stalls but will restripe five (5) parking rows in the lot, adding back a total of 24 of the 48 removed stalls, for a net loss of 24 stalls. The application states the new parking lot will provide a total of 860 parking spaces. City Ordinance requires 1 parking space per 200 sq. ft. of gross retail floor area. At 172,163 sq. ft., the store would require a minimum of 861 stalls, resulting in one (1) stall short of the minimum. Dimensions of all parking stalls and drive aisles on proposed Site Plan conform to minimum dimensions of the code. Prior to the 8-8-00 P&Z hearin , tg he Applicant must confirm in writing to Staff that all 860 stalls are located on Lot 1, Block 1 of Avest Subdivision (Fred Meyer). This is unclear. This count cannot incoroorate stalls on other lots (i.e. McDonald's Key Bank retail padsZ All off-street parking serving Fred Meyer must be located on their legal lot. The Applicant isproposing a re-design of six (6) existing angled parking rows between the McDonald's drive entrance and the eastern parking lot entrance. While Staff recognizes that the re-design of this section of the parking lot from angled parking to straight, head-in parking may be inconsistent with adjacent, angled parking areas, we do not view it as a public safety hazard or circulation problem. The minimum 25-foot drive aisle widths and 19- foot parking stall lengths are met and the rows of parking are in a contiguous block, separated from the adjacent angled parking blocks. 4. Landscaping: The Preliminary Landscape Plan, Sheet PL1, proposes to remove all seven (7) CUP-00-041 Fred Meyer Gas Facility.CUP r \ A- R Mayor, Council and P&Z August 1, 2000 Page 4 of the landscape islands in the middle of the existing parking rows within the project scope of work. The re-design of these rows (from 45° to 90° parking) provides for new end islands (which will accommodate two new trees each) and increases the number ofmid-row planters. This change will result in the addition of 21 trees in this area of the parking lot (7 existing and 28 proposed). All new trees shall be a minimum of three-inch (3") caliper, per City Ordinance 11-13-4.B.3.c, not the 1.5" caliper shown on Sheet PL1. Staff recommends the new tree species and variety of maple be the same as existing to maintain consistency of internal plantings and aesthetics. 5. Irrigation: An underground, pressurized irrigation system must be installed to all landscaped areas. 6. Lighting: The canopy lighting must be shrouded so as to shield the traffic on Fairview Avenue. 7. Drainage: A proposed site drainage plan must be approved by the City Public Works Department prior to construction. 8. Trash: No new outdoor trash areas are proposed on Sheet C1. If the Applicant intends to have any new trash enclosures other than standard cans, they must be screened from view and not be visible by the public or from adjacent properties. 9. Hours: The P&Z Commission and City Council should address the proposed 24-hour operation. The Zoning & Development Ordinance does not address this issue. 10. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy for the fuel kiosk and facility. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the required improvements (including paving, striping, landscaping, and irrigation). A bid must accompany any request for Temporary Occupancy. Any Temporary Occupancy will not exceed 60 days to complete the required improvements. 11. As part of a conditional use permit, the City of Meridian may impose additional restrictions/conditions. 12. Sanitary sewer and water service to this site will be provided via existing lines adjacent to the site. 13. Assessments for sewer and water service are determined during the building permit application process. Applicant will be required to enter into an Assessment Agreement with CUP-00-041 Fred Meyer Gas Facility.CUP Mayor, Council and P&Z August 1, 2000 Page 5 the City of Meridian. An assessment agreement is a vehicle that protects the City of Meridian and the Developer in the event that estimated assessments are not in line with actual usages. The agreement provides for reimbursement to the developer for overpayment of assessments and payment to the City of Meridian of any shortfall in assessments. The property is located at 1850 E. Fairview Avenue, Meridian, Idaho. 2. The owner of record of the subject property is Fred Meyer, Inc. of Oregon. 3. Applicant is Barghausen Consulting Engineers of Meridian. 4. The subject property is currently zoned C-G. The zoning district of C-G is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2. 5. The proposed application requests a conditional use permit for Construction of a Fred Meyer gasoline facility consisting of a 3,612 sq.ft. canopy over five multi-product dispensers, a cashier's kiosk and parking lot improvements. The Meridian Planning and Zoning Commission recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 7. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Policy. 8. The Planning and Zoning Commission recognizes the concerns expressed in the letter of McDonald's Corporation dated August 24, 2000. RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the conditional use permit as requested by the applicant, subject to the following: Adopt the Recommendations of the Planning and Zoning and Engineering departments as follows: 1.1 Off-street parking shall be provided in accordance with Section 11-13 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific requirements. 1.2 Paving and striping shall be in accordance with the standards set forth in Sections 11-13-4.D. and 11-13-4.E. of the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 1.3 A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. All site drainage shall be contained and disposed of on-site. 1.4 Outside lighting shall be designed and placed so as to not direct illumination on any nearby residential areas and in accordance with City Ordinance Section 1 1-13-4.C. 1.5 Provide a minimum of one (1) three-inch (3") caliper tree per 1,500 sq. ft. of asphalt area on the site in accordance with City Ordinance Section 11-13-4.B.3.c. 1.6 All trash and/or garbage collection areas shall be enclosed on at least three (3) sides in accordance with City Ordinance Section 11-12-1.C. Coordinate trash enclosure locations and construction requirements with Sanitary Service Company (SSC) and provide a letter of approval from SSC to the Planning SL Zoning Department prior to applying for building permits. 1.7 All signage shall be in accordance with the standards set forth in Section 11-14 of the City Zoning and Development Ordinance. 1.8 All construction shall conform to the requirements of the Americans with Disabilities Act. 1.9 Signage: A) Free-Standing: No new free-standing signs have been proposed under subject application and none are approved. Per Item D. on Sheet Cl, they are proposing a new price sign be added to the existing Fred Meyer I.D. sign on Fairview. Separate sign permits would be required for this modification. The existing sign height shall not be allowed to increase. B) Canopy: Item C. on Sheet A-3 calls out an "illuminated marquee board with changeable copy", but there is no corresponding "C" on this sheet. Applicant should clarify location and sign type of this item during the public hearing process. Staff assumes this item is the same as "A" on Sheet Cl on the north canopy elevation, which calls it out as an "electronic reader board". Under Ordinance 11-14-3, which prohibits any flashing lights on signs, the City has not allowed electronic reader RECOMMENDATION TO CITY COUNCIL - 3 CONDITIONAL USE PERMIT -FRED MEYER GAS STATION IN C-G ZONE - BARGHAUSEN CONSULTING ENGINEERS boards. Any electronic reader board would need to be specifically approved by City Council. Since the reader board faces the interior of the project and would not be visible from public right-of-way, Staff could support this sign. They are also proposing "Fred Meyer" I.D. canopy signs on the North and South elevations. No canopy signs are proposed for the east or west elevations. C) General Terms: All signage is subject to design review and shall require separate permits. No signage is permitted in the ACRD right-of- way. No portable signs or temporary signage permitted (such as A- Frames, banners, etc.). 1.10 Parking: The applicant's cover letter states the proposed facility will require the removal of 48 parking stalls but will restripe five (5) parking rows in the lot, adding back a total of 24 of the 48 removed stalls, for a net loss of 24 stalls. The application states the new parking lot will provide a total of 860 parking spaces. City Ordinance requires 1 parking space per 200 sq. ft. of gross retail floor area. At 172,163 sq. ft., the store would require a minimum of 861 stalls, resulting in one (1) stall short of the minimum. Dimensions of all parking stalls and drive aisles on proposed Site Plan conform to minimum dimensions of the code. Prior to the 8-8-00 P&Z hearing, the Applicant must confirm in writing to Staff that all 860 stalls are located on Lot 1. Block 1 of Avest Subdivision (Fred Meyer). This is unclear. This count cannot incorporate stalls on other lots (i.e. McDonald's. Ivey Banlc. retail pads). All off-street parking serving Fred Meyer must be located on their legal lot. 1.11 The Applicant is proposing a re-design of six (6) existing angled parking rows between the McDonald's drive entrance and the eastern parking lot entrance. While Staff recognizes that the re-design of this section of the parking lot from angled parking to straight, head-in parking may be inconsistent with adjacent, angled parking areas, we do not view it as a public safety hazard or circulation problem. The minimum 25-foot drive aisle widths and 19-foot parking stall lengths are met and the rows of parking are in a contiguous block, separated from the adjacent angled parking blocks. RECOMMENDATION TO CITY COUNCIL - 4 CONDITIONAL USE PERMIT -FRED MEYER GAS STATION IN C-G ZONE - BARGHAUSEN CONSULTING ENGINEERS 1.12 Landscaping: The Preliminary Landscape Plan, Sheet PL1, proposes to remove all seven (7) of the landscape islands in the middle of the existing parking rows within the project scope of work. The re-design of these rows (from 450 to 900 parking) provides for new end islands (which will accommodate two new trees each) and increases the number of mid-row planters. This change will result in the addition of 21 trees in this area of the parking lot (7 existing and 28 proposed). All new trees shall be a minimum of three-inch (3") caliper, per City Ordinance 11-13-4.B.3.c, not the 1.5" caliper shown on Sheet PL1. Staff recommends the new tree species and variety of maple be the same as existing to maintain consistency of internal plantings and aesthetics. 1.13 Irrigation: An underground, pressurized irrigation system must be installed to all landscaped areas. 1.14 Lighting: The canopy lighting must be shrouded so as to shield the traffic on Fairview Avenue. 1.15 Drainage: A proposed site drainage plan must be approved by the City Public Works Department prior to construction. 1.16 Trash: No new outdoor trash areas are proposed on Sheet Cl. If the Applicant intends to have any new trash enclosures other than standard cans, they must be screened from view and not be visible by the public or from adjacent properties. 1.17 Hours: The P&Z Commission and City Council should address the proposed 24-hour operation. The Zoning &. Development Ordinance does not address this issue. 1.18 Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy for the fuel kiosk and facility. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the required improvements (including paving, striping, landscaping, and irrigation). A bid must accompany any request for Temporary Occupancy. Applicant will be required to enter into an Assessment Agreement with the City of Meridian. 1.21 In accordance with City Ordinance 11-13-4.B.2., underground year- round pressurized irrigation must be provided to all landscape areas on site. Please submit hook-up and design details based on the proposed landscaping. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the landscaped areas. Adopt the Recommendations of the Central District Health Department as follows: 1.22 Run-off is not to create a mosquito breeding problem. 1.23 stormwater shall be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality. 1.24 The Engineers and architects involved with the design of the subject project shall obtain current best management practices for stormwater disposal and design a stormwater management system that prevents groundwater and surface water degradation. It is not clear in the reports dated September 15, 2000 and received by BRIGGS ENGINEERING INC September 19, 2000, where it states that the Preliminary Plat is approved with reduced house sizes or reference to the lots sizes requested. However, on page 4 of the Findings of Fact and Conclusions of Law and order of conditional approval for the Preliminary Plat under the DECISION AND ORDER it appears that our concerns our addressed because it approves the Preliminary Plat as submitted. The DECISION AND ORDER states: 1. The Preliminary Plat of the applicant as evidenced by the "Preliminary Plat Drawing DWG DATE: 06/01/00 ris, and stamped SEP 01 2000, DWG NO. 990412-PRE, SHEET 1 of 1 PRE-1, \WLKV-PRE-2. RLS, BRIGGS ENGINEERING INC., Engineers, STEINER DEVELOMENT, LLC. Developers for WILKINS RANCH VILLAGE SUBDIVISION," is hereby conditionally approved; and It also appears that there may be old information that related to the previously requested R-4 zone. The applicant was directed by Planning and Zoning to modify the request to an R-8 zone. We did modify the request prior to the September 5, 2000, City Council meeting but it seems that the report references the previously requested. zone in several areas. We do agree with the requirements of the preliminary plat, the conditional~se and the rezone but there is concern that all that is requested may not have been addressed in the reports. This is a very busy entrance to the shopping center and we are concerned over the increased traffic and conflicting turning movements that will be generated by this development. This portion of the parking lot is used by customers and the resulting reduction of parking spaces would not be of benefit to them. Gas is already convenient at the east end of the shopping center. I question the need for another out parcel in this shopping center as the original. plan did not show this area of parking lot as a developable pad. This use is simply too intensive.
