This approval was granted contingent upon the completion of several tasks as required by UDC l 1-6B-8C2 within one year of the date of tentative approval. Since that date, the required tasks have been completed within the time period allowed. I find that the property boundary adjustment is in conformance with UDC I 1-6B-8 and therefore grant final approval of the property boundary adjustment. The applicant. Director, or a parry of record may request City Council review of a decision of the Director. All requests for review shall he tiled in writing with the Planning Department on or before February 21, 2013, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC l 1-SA-6B. If City Council review of the decision is not requested. the action of the Director represents a final decision on the land use application. When the Home on Lot 9, Block 4 of Champion Park Subdivision No. 1 was built the excavator, concrete foundation installer and the city inspector all missed the correct front pin and the home was built according to the incorrect pin which was exposed and used to determine measurements. The correct pin was buried and located approximately 4 feet away. Prior to building the home next door on Lot 8, Block 4, we determined that the wrong pin was used on the house next door and had the record of survey done in order to correct the problem. The owner of the home on Lot 9 Block 4 did not give us an affidavit of Legal Interest so we could not proceed with fixing the problem.
